<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 191</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210203">February 3, 2021</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the removal of Federal employees who engage in certain actions.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Actors Lying Should be Eliminated Act</short-title></quote> or the <quote><short-title>FALSE Act</short-title></quote>.</text></section><section id="id168E9EBB94E34078B2E882FB561A74ED"><enum>2.</enum><header>Removal of certain Federal employees</header><subsection id="id2A23A7838A8E4766A4FCB7390EEF829C"><enum>(a)</enum><header>Definitions</header><text>In this section: </text><paragraph id="idF49650A990BD424ABD23295D85669284"><enum>(1)</enum><header>Becomes final</header><text>The term <term>becomes final</term> means, with respect to a sustained complaint—</text><subparagraph id="idC7F3CBBBC56D49AF94858476B4E0A479"><enum>(A)</enum><text>that—</text><clause id="idB318C489A6DA405E845010909BE4B666"><enum>(i)</enum><text>there is a final agency action; and</text></clause><clause id="id8EE87826F2CA4B04B7F7ABDB6740CA50"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id7503FC21950B4242862799288B2D3E63"><enum>(I)</enum><text>the time for seeking judicial review of the final agency action has lapsed and judicial review has not been sought; or</text></subclause><subclause id="id63D62F8648504DB49E7F375362AB1CDD" indent="up1"><enum>(II)</enum><text>judicial review of the final agency action was sought and final judgment has been entered upholding the agency action; or</text></subclause></clause></subparagraph><subparagraph id="idF0DCE99F5B164D1BAF88D3E7D82B0F6D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>that final judgment has been entered in a civil or criminal action. </text></subparagraph></paragraph><paragraph id="id7F1BC5D9B99A40BEA9E625D3537C76BD"><enum>(2)</enum><header>Civil service</header><text>The term <term>civil service</term> has the meaning given the term in section 2101 of title 5, United States Code.</text></paragraph><paragraph id="id59E1EE240B8E4A72A345D132B496F70C"><enum>(3)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means an employee with respect to whom there is a sustained complaint that becomes final.</text></paragraph><paragraph id="id113E703AE9CD428D822E8D2C907C6692"><enum>(4)</enum><header>Employee</header><text>The term <term>employee</term> means an individual occupying a position in the civil service.</text></paragraph><paragraph id="id037BC89BB6DA450687178FE55E1DC8A6"><enum>(5)</enum><header>Sustained complaint</header><text>The term <term>sustained complaint</term> means an administrative or judicial determination that an employee engaged in any of the following actions:</text><subparagraph id="idF7660DC4C2904DD4959A3D252BE917CC"><enum>(A)</enum><text>The employee violated section 1001 of title 18, United States Code.</text></subparagraph><subparagraph id="idE4F8449FC2B141A6BA47548E80946CC2"><enum>(B)</enum><text>The employee knowingly and willfully— </text><clause id="idEF5EBDD59A514925A14D2C5EEFBCDED9"><enum>(i)</enum><text>violated section 1301(a) of title 31, United States Code; or </text></clause><clause id="id304E326087D0435ABEE37ABC4A37122C"><enum>(ii)</enum><text>caused such section 1301(a) to be violated.</text></clause></subparagraph><subparagraph id="id844CFE3E3F264D3699E7D53C2A4F17E6" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>The employee knowingly and willfully entered inaccurate data into the website established under section 2(b) of the Federal Funding Accountability and Transparency Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/31/6101">31 U.S.C. 6101</external-xref> note). </text></subparagraph></paragraph></subsection><subsection id="id8A12FCC5238B4FA6A996D0CCB0A1B17E"><enum>(b)</enum><header>Removal required</header><text>Notwithstanding any other provision of law, the head of an agency, office, or other entity employing a covered employee shall, after notice and an opportunity for a hearing, remove the covered employee.</text></subsection></section></legis-body></bill>
