which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support the reuse and recycling of batteries and critical minerals, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Battery and Critical Mineral Recycling Act of 2021</short-title></quote>.</text></section><section commented="no" id="idE67032326D8C477E8E9BA6064FD8C6A6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idaf3c575ad780426ebd1969cd6bfefe3d"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency. </text></paragraph><paragraph id="id22c38f650ca54d0d85f6828742c6cc2f"><enum>(2)</enum><header>Battery</header><text>The term <term>battery</term> means a device that—</text><subparagraph id="id5EC0747DAA3147189A56B60EC11D6696"><enum>(A)</enum><text>consists of 1 or more electrochemical cells that are electrically connected; and</text></subparagraph><subparagraph id="id651241957DDF4E6C97DD1A90C8ED1059"><enum>(B)</enum><text>is designed to store and deliver electric energy.</text></subparagraph></paragraph><paragraph id="id8f34a204b9df425980ee700f22cb2629"><enum>(3)</enum><header>Battery producer</header><text>The term <term>battery producer</term> means, with respect to a covered battery or covered battery-containing product that is sold, offered for sale, or distributed for sale in the United States, including through retail, wholesale, business-to-business, and online sale, the following applicable entity:</text><subparagraph id="id9c1555428e664d3cb4e6b789a48b7c79"><enum>(A)</enum><text>A person who—</text><clause id="idBEADB5C771D34072A717FB4CE836DE29"><enum>(i)</enum><text>manufactures the covered battery or covered battery-containing product; and </text></clause><clause id="id818DBDF036A44A62ACF1823388E5CF94"><enum>(ii)</enum><text>sells or offers for sale the covered battery or covered battery-containing product under the brand of that person.</text></clause></subparagraph><subparagraph id="id3c320561a1254fa7985c9dc7cf92f6bd"><enum>(B)</enum><text>If there is no person described in subparagraph (A) with respect to the covered battery or covered battery-containing product, the owner or licensee of the brand under which the covered battery or covered battery-containing product is sold, offered for sale, or distributed, regardless of whether the trademark of the brand is registered.</text></subparagraph><subparagraph id="idd6c33ef9487f429f8391df7efbab8c51" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>If there is no person described in subparagraph (A) or (B) with respect to the covered battery or covered battery-containing product, a person that imports the covered battery or covered battery-containing product into the United States for sale or distribution. </text></subparagraph></paragraph><paragraph id="idc82c6a0a610b4e0280351b0994fe11b6"><enum>(4)</enum><header>Covered battery</header><text>The term <term>covered battery</term> means a new or unused primary battery or rechargeable battery.</text></paragraph><paragraph id="id57b7e97c97f44bc095fda3ee07fc2318"><enum>(5)</enum><header>Covered battery-containing product</header><text>The term <term>covered battery-containing product</term> means a new or unused product that contains or is packaged with a primary battery or rechargeable battery. </text></paragraph><paragraph id="id9d4cbfad81ea45759e18bd45034753bd"><enum>(6)</enum><header>Primary battery</header><text>The term <term>primary battery</term> means a nonrechargeable battery that weighs not more than 4.4 pounds, including an alkaline, carbon-zinc, and lithium metal battery.</text></paragraph><paragraph id="id7ecb5765c4284434972b048782df61b0"><enum>(7)</enum><header>Rechargeable battery</header><subparagraph id="id25AF70C41460400EB7C0369DA79FB7F2"><enum>(A)</enum><header>In general</header><text>The term <term>rechargeable battery</term> means a battery that—</text><clause id="idBC9577A6E8FF4A97BA6B5322D0DB27C3"><enum>(i)</enum><text>contains 1 or more voltaic or galvanic cells that are electrically connected to produce electric energy;</text></clause><clause id="idCDF0A7DCCA124D4E8BB614B56DD80579"><enum>(ii)</enum><text>is designed to be recharged;</text></clause><clause id="idAC2438822AED406B9BBF61E5AF3758B2"><enum>(iii)</enum><text>weighs not more than 11 pounds; and </text></clause><clause id="id1A07FD3087B142F1840D88CFD747BE89"><enum>(iv)</enum><text>has a watt-hour rating of not more than 300 watt-hours. </text></clause></subparagraph><subparagraph id="idD19414B193BD4E5BBF2EE96E1D0658C2"><enum>(B)</enum><header>Exclusions</header><text>The term <term>rechargeable battery</term> does not include a battery that—</text><clause id="id40a7be3ec1944bc784314093ae16c66f"><enum>(i)</enum><text>contains electrolyte as a free liquid; or</text></clause><clause id="id521f8fdebb5f43f2a1d9a526b1e517d1"><enum>(ii)</enum><text>employs lead-acid technology, unless that battery is sealed and does not contain electrolyte as a free liquid.</text></clause></subparagraph></paragraph><paragraph id="id759f63c1caff47c5aa83e8164cdcd832"><enum>(8)</enum><header>Recycling</header><text>The term <term>recycling</term> means the series of activities, including separation, collection, and processing, through which materials are recovered or otherwise diverted from the solid waste stream—</text><subparagraph id="idF8B72AC3D5934B2BBFFD70F5819C344E"><enum>(A)</enum><text>unrelated to the manufacturing of batteries; and</text></subparagraph><subparagraph id="id224D544E38E0463CB57AA88C52E8F61F"><enum>(B)</enum><text>for use—</text><clause id="id2FAB5A544BA74F8190C76F563D3D6041"><enum>(i)</enum><text>as raw materials; or </text></clause><clause id="idBB8412EA59064C6BBB54B4C3ABB3EA63"><enum>(ii)</enum><text>in the manufacture of products other than fuel.</text></clause></subparagraph></paragraph><paragraph id="id98f410843d5544ec92e79322c1f5cf8d"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></section><section id="id3CBBC09BFA3449A490A22AAA5ECA7382"><enum>3.</enum><header>Grants</header><subsection id="id5ACC7F19C6E54250BD3815BB2AFD66E9"><enum>(a)</enum><header>Battery recycling research, development, and demonstration grants</header><paragraph id="idb3837a99c9634f789238404f5e5b4526"><enum>(1)</enum><header>In general</header><text>The Secretary shall award multiyear grants to eligible entities for research, development, and demonstration projects to create innovative and practical approaches to increase the reuse and recycling of batteries, including by addressing—</text><subparagraph id="idc897bb54f5154800b1a01c858fb727cc"><enum>(A)</enum><text>recycling activities;</text></subparagraph><subparagraph id="id5ead5b81a54a415faa703164d84627c6"><enum>(B)</enum><text>the development of methods to promote the design and production of batteries that take into full account and facilitate the dismantling, reuse, recovery, and recycling of battery components and materials;</text></subparagraph><subparagraph id="id176e0b4bc296440fb2e0e6f616ee5978"><enum>(C)</enum><text>strategies to increase consumer acceptance of, and participation in, the recycling of batteries;</text></subparagraph><subparagraph id="id050561f9e2db4197a3c9acdc992c77e2"><enum>(D)</enum><text>the integration of increased quantities of recycled critical minerals in batteries and other products to develop markets for recycled battery materials and critical minerals;</text></subparagraph><subparagraph id="idbb8246d49bb14e3d8ae347b02602d4da"><enum>(E)</enum><text>safe disposal of waste materials and components recovered during the recycling process;</text></subparagraph><subparagraph id="id88dadb1f975f4092a42fe85ecb61c42c"><enum>(F)</enum><text>the protection of the health and safety of all persons involved in, or in proximity to, recycling and reprocessing activities;</text></subparagraph><subparagraph id="id4f93d346d8824897a91744cac0d8f80c"><enum>(G)</enum><text>mitigation of environmental impacts that arise from recycling batteries, including disposal of toxic reagents and byproducts related to recycling processes;</text></subparagraph><subparagraph id="idedd59e4cf24e4c66a3e641160aadf426"><enum>(H)</enum><text>protection of data privacy associated with collected covered battery-containing products; </text></subparagraph><subparagraph id="id64895242E2A64002A1E9A084C0C62A64"><enum>(I)</enum><text>the optimization of the value of material derived from recycling batteries; and</text></subparagraph><subparagraph id="ida7fb30ec3f4d41a0a299da077fb381a3"><enum>(J)</enum><text>the cost-effectiveness of the reuse and recycling of batteries.</text></subparagraph></paragraph><paragraph id="idB5B8306E3653438EB58AC9D2476263B3"><enum>(2)</enum><header>Eligible entities</header><text>The Secretary may award a grant under paragraph (1) to—</text><subparagraph id="idb470453e003a414c8127d6b6588061f2"><enum>(A)</enum><text>an institution of higher education; </text></subparagraph><subparagraph id="id6CF5CBDC4C2444A4A3C8A9029C91751E"><enum>(B)</enum><text>a National Laboratory; </text></subparagraph><subparagraph id="id759F631F916A476FABFF9BAE341F9EA2"><enum>(C)</enum><text>a Federal research agency; </text></subparagraph><subparagraph id="id146239E98A0640D596606E016C8D2B36"><enum>(D)</enum><text>a State research agency; </text></subparagraph><subparagraph id="id1F88FA4B88EE44E085287AF7CA2D65FF"><enum>(E)</enum><text>a nonprofit organization; </text></subparagraph><subparagraph id="id9DE017CC68324AC59CBC4ED681D77BF8"><enum>(F)</enum><text>an industrial entity;</text></subparagraph><subparagraph id="id08B13650F95E40BEAB1647CD04048970"><enum>(G)</enum><text>a manufacturing entity;</text></subparagraph><subparagraph id="id3652E652D4C5447A82F0988D97B7253A"><enum>(H)</enum><text>a private battery-collection entity; </text></subparagraph><subparagraph id="id214d989f06dc47f0afdd6d94ef35cbea"><enum>(I)</enum><text>an entity operating 1 or more battery recycling activities;</text></subparagraph><subparagraph id="idbd2ecdf019564a768857c4589f8fc523"><enum>(J)</enum><text>a State or municipal government entity;</text></subparagraph><subparagraph id="id16ac865148854245b79a3d8ae5fbef3e"><enum>(K)</enum><text>a battery producer;</text></subparagraph><subparagraph id="id8cf659ef00c645d991f815e9dfff3127"><enum>(L)</enum><text>a battery retailer; or</text></subparagraph><subparagraph id="id395ccaff3f5f42eeba7147ac7d533c4b"><enum>(M)</enum><text>a consortium of 2 or more entities described in subparagraphs (A) through (L). </text></subparagraph></paragraph><paragraph id="id2a788ff2d1604f1dafe7f7b9a71ab8b1"><enum>(3)</enum><header>Applications</header><subparagraph commented="no" id="idE03F908F4C9D4F1196809DA124FFBC70"><enum>(A)</enum><header>In general</header><text>To be eligible to receive a grant under paragraph (1), an eligible entity described in paragraph (2) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph><subparagraph id="id48B37CA721DB45A3A46E483A09FF0826"><enum>(B)</enum><header>Contents</header><text>An application submitted under subparagraph (A) shall describe how the project will promote collaboration among—</text><clause id="idd83faf09e8094214a701af3f2367ad96"><enum>(i)</enum><text>battery producers and manufacturers;</text></clause><clause id="id341800bb48b04a7d83f613e64241fbc9"><enum>(ii)</enum><text>battery material and equipment manufacturers;</text></clause><clause id="id35a229c537f64710a7eedf09d9d7299b"><enum>(iii)</enum><text>battery recyclers, collectors, and refiners; and</text></clause><clause id="id01b83177d1094008b0cd4b2d98256554"><enum>(iv)</enum><text>retailers. </text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="id12c482eb7fd24901aab3d04df0a6025d"><enum>(b)</enum><header>State and local programs</header><paragraph commented="no" id="idD224BF010BFC4D858763B82CBF7047EA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program under which the Secretary shall award grants, on a competitive basis, to States and units of local government to assist in the establishment or enhancement of State battery collection, recycling, and reprocessing programs.</text></paragraph><paragraph commented="no" id="id800E5BBB9D17494B9E47E109007273F8"><enum>(2)</enum><header>Non-Federal cost share</header><text>The non-Federal share of the cost of a project carried out using a grant under this subsection shall be 50 percent of the cost of the project. </text></paragraph><paragraph commented="no" id="id0914193114A64E7CBD06400D44B2F4CD"><enum>(3)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report that describes the number of battery collection points established or enhanced, an estimate of jobs created, and the quantity of material collected as a result of the grants awarded under paragraph (1).</text></paragraph></subsection><subsection commented="no" id="id5a09203b09f24a30aa0b7603a1ff61ef"><enum>(c)</enum><header>Retailers as collection points</header><paragraph id="id403b28f3b1c14c55af5434965e4bf65e"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants, on a competitive basis, to retailers that sell covered batteries or covered battery-containing products to establish and implement a system for the acceptance and collection of covered batteries and covered battery-containing products, as applicable, for reuse, recycling, or proper disposal.</text></paragraph><paragraph id="id4b0f845d201d433fa94b168d4d4b7b71"><enum>(2)</enum><header>Collection system</header><text>A system described in paragraph (1) shall include take-back of covered batteries—</text><subparagraph id="id8CC14682D6EB4C62A0FA8B01608A401C"><enum>(A)</enum><text>at no cost to the consumer; and</text></subparagraph><subparagraph id="idEFAB053B5BE247A79CC10DD9152FB87B"><enum>(B)</enum><text>on a regular, convenient, and accessible basis.</text></subparagraph></paragraph></subsection></section><section id="idDECB9BEBDB51490B91785952E6E866C8"><enum>4.</enum><header>Lithium-ion battery recycling prize competition</header><subsection id="idE5E0A6EE5311482F8FA2A0C84141AA57"><enum>(a)</enum><header>In general</header><text>The Secretary shall continue to carry out the existing Lithium-Ion Battery Recycling Prize competition of the Department of Energy established under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>).</text></subsection><subsection id="id486F74D9CBB54B5E97E0766CDBE6CD7F"><enum>(b)</enum><header>Additional funding for pilot projects</header><text>In addition to any other funds made available to the Secretary to carry out the competition described in subsection (a), there is authorized to be appropriated to the Secretary to carry out Phase III of that competition $10,000,000 for fiscal year 2021, to remain available until expended, which the Secretary may use—</text><paragraph commented="no" id="id5F2C380FA8E64AC684AA2EA4158F6D78"><enum>(1)</enum><text>to increase the number of winners of Phase III of that competition;</text></paragraph><paragraph commented="no" id="id720225AB8A4F45F98F7941E12EF5C719"><enum>(2)</enum><text>to increase the amount awarded to the winners of Phase III of that competition; or</text></paragraph><paragraph commented="no" id="id09F79AB57AE3415DA537C71C628A508A"><enum>(3)</enum><text>to carry out any other activity that is consistent with the goals of Phase III of that competition, as determined by the Secretary. </text></paragraph></subsection></section><section id="id3b419b18eb7747adb81f42035e3f0bf9"><enum>5.</enum><header>Best practices for collection of batteries to be recycled</header><subsection id="id6517fee072a74f4da5d31f425add1cd2"><enum>(a)</enum><header>In general</header><text>The Administrator shall develop voluntary best practices that may be implemented by State and local governments with respect to the collection of batteries to be recycled in a manner that—</text><paragraph id="id67EEC984BEFB47A58AEB7345A738012C"><enum>(1)</enum><text>to the maximum extent practicable, is technically and economically feasible for State and local governments;</text></paragraph><paragraph id="id75538672862141459C402F0087B4FE65"><enum>(2)</enum><text>is environmentally sound and safe for waste management workers; and </text></paragraph><paragraph id="idA7C74243D39345DBAE18602F73E6D4C5"><enum>(3)</enum><text>optimizes the value and use of material derived from recycling of batteries.</text></paragraph></subsection><subsection id="idca0521cf2917465e85bdad3b5867617f"><enum>(b)</enum><header>Consultation</header><text>The Administrator shall develop the voluntary best practices described in subsection (a) in coordination with State and local leaders and entities in relevant private sectors.</text></subsection><subsection id="id346b1fb2391a44e7b92eb3b6f9080f80" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator shall submit to Congress a report describing the voluntary best practices developed under subsection (a). </text></subsection></section><section id="id415bbbf3f6b044c390c911b3882e119e"><enum>6.</enum><header>Voluntary labeling guidelines</header><subsection id="idc29000b746524a9ab1b8fcc35e5b8e1b"><enum>(a)</enum><header>In general</header><text>There is established within the Department of Energy and the Environmental Protection Agency a voluntary program (referred to in this section as the <quote>program</quote>) to promote battery recycling through the development of—</text><paragraph id="id0fcdbb5270814323aa1b403c7d16758c"><enum>(1)</enum><text>voluntary labeling guidelines for batteries; and</text></paragraph><paragraph id="id24b2ec8185114b1b90aa1bddd4bb9f20" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>other forms of voluntary communication about the reuse and recycling of critical materials from batteries. </text></paragraph></subsection><subsection id="id15525F18AFB846E1BF5D2F3CBB381E61"><enum>(b)</enum><header>Purposes</header><text>The purposes of the program are to improve battery collection and reduce battery waste, including by—</text><paragraph id="idA4DFC892D9EE43A0B2A101B7D3B21A63"><enum>(1)</enum><text>identifying battery collection locations and increasing accessibility to those locations;</text></paragraph><paragraph id="id99B9B8229D3F4E8AA18DF0B241DE36A7"><enum>(2)</enum><text>promoting consumer education about battery collection and recycling; and</text></paragraph><paragraph id="id11451012F2AB41CB998C75D3B3A52067"><enum>(3)</enum><text>reducing safety concerns relating to the improper disposal of batteries.</text></paragraph></subsection><subsection id="id50caabbb06954fd1a43d86b23d19b6e7"><enum>(c)</enum><header>Division of responsibilities</header><text>Implementation responsibilities under the program shall be divided between the Secretary and the Administrator in accordance with the terms of 1 or more applicable agreements between the Secretary and the Administrator.</text></subsection><subsection id="idda5aac1133b6436fb064cec54fbebcf5"><enum>(d)</enum><header>Other standards and law</header><text>The Secretary and the Administrator shall make every reasonable effort to ensure that voluntary labeling guidelines and other forms of communication developed under the program are consistent with—</text><paragraph id="id38D7716182084B75B01CC7B95996898B"><enum>(1)</enum><text>international battery labeling standards; and </text></paragraph><paragraph id="id29327743A19B4EC5B7E2B784034F0EE5"><enum>(2)</enum><text>the Mercury-Containing and Rechargeable Battery Management Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14301">42 U.S.C. 14301 et seq.</external-xref>).</text></paragraph></subsection></section><section id="idb13ef9bff2524baa81bade7b05db0335"><enum>7.</enum><header>Task force on producer requirements</header><subsection id="idc8436a5ba10c4209ab52c62ec3bf7242"><enum>(a)</enum><header>In general</header><text>The Secretary shall convene a task force to develop an extended battery producer responsibility framework that—</text><paragraph id="id66a4318e47b64a238157479c5a3ff21d"><enum>(1)</enum><text>addresses battery recycling goals, cost structures for mandatory recycling, reporting requirements, product design, collection models, and transportation of collected materials;</text></paragraph><paragraph id="idae9f342e9c7e4b20b755a01f372f971f"><enum>(2)</enum><text>provides sufficient flexibility to allow battery producers to determine cost-effective strategies for compliance with the framework; and</text></paragraph><paragraph id="id78892bd718dd4374a80f15219476af34"><enum>(3)</enum><text>outlines regulatory pathways for effective recycling.</text></paragraph></subsection><subsection id="idaad04bf8258440ff98e26f145cc4b306"><enum>(b)</enum><header>Task force members</header><text>Members of the task force convened under subsection (a) shall include—</text><paragraph id="iddbdc808986a541d19a9cbe4698e619c6"><enum>(1)</enum><text>battery producers, manufacturers, retailers, recyclers, collectors, and refiners;</text></paragraph><paragraph id="id900eeaf6bed34e38b7ba04878d49a478"><enum>(2)</enum><text>States and municipalities; and</text></paragraph><paragraph id="idd09adc88bea247f6aea70372fdf87138"><enum>(3)</enum><text>other relevant stakeholders, such as environmental, clean energy, or consumer advocates, as determined by the Secretary.</text></paragraph></subsection><subsection id="idefb0a7b23b8f411880d6576d233b6449"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date on which the Secretary convenes the task force under subsection (a), the Secretary shall submit to Congress a report that—</text><paragraph id="iddac55484c4ff4baaa4023830edb27dc4"><enum>(1)</enum><text>describes the extended producer responsibility framework developed by the task force;</text></paragraph><paragraph id="id7f10daa745aa4689a138aa16da1faa8a"><enum>(2)</enum><text>includes the recommendations of the task force on how best to implement a mandatory pay-in or other enforcement mechanism to ensure that battery producers and sellers are contributing to the recycling of batteries;
