which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the penalties for violations of the Telephone Consumer Protection Act of 1993.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deter Obnoxious, Nefarious, and Outrageous Telephone Calls Act of 2021</short-title></quote> or the <quote><short-title>DO NOT Call Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id67475C2511BC425BA8CF41ECF9A283E5"><enum>2.</enum><header>Penalties for violations of the Telephone Consumer Protection Act of 1993</header><subsection id="id7F77EE67EE214C3C8CB389E1FE69F99F"><enum>(a)</enum><header>Criminal penalties</header><paragraph id="id8CAD3DFCE63845748B50FB864FF473B8"><enum>(1)</enum><header>In general</header><text>Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id182126449F09481C9233D203FAED362C"><subsection id="id97A0A84F1A964353877D272270B0BDD2"><enum>(k)</enum><header>Criminal penalties</header><paragraph id="id4D5D030B7D9E4304A3BA52905F65B2E6"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), any person who willfully and knowingly violates this section shall be imprisoned for not more than 1 year, fined under title 18, United States Code, or both.</text></paragraph><paragraph id="id01AA442FD1554FABBDD8DAB4540305D1"><enum>(2)</enum><header>Aggravated offense</header><text>Any person who willfully and knowingly violates this section shall be imprisoned for not more than 3 years, fined under title 18, United States Code, or both if—</text><subparagraph id="idF7AA839E4D8B47BEB37269DD2FFE2E19"><enum>(A)</enum><text>the person has previously been convicted under this subsection;</text></subparagraph><subparagraph id="idC3BFF49C51FB4E86A54E78D5EF250708"><enum>(B)</enum><text>the offense involved initiating more than—</text><clause id="id57B4C0C7A5924FB9A9877D7FAF245BA0"><enum>(i)</enum><text>100,000 calls in a 24-hour period;</text></clause><clause id="id890315F5A0B94E2FA4F820EDDCFC1952"><enum>(ii)</enum><text>1,000,000 calls in a 30-day period; or</text></clause><clause id="idAC52CD4083D642FF80C1A303A5B4C12A"><enum>(iii)</enum><text>10,000,000 calls in a 1-year period;</text></clause></subparagraph><subparagraph id="id0DF5BA8CC2F449B398CAFABA5378C1C2"><enum>(C)</enum><text>the person committed the offense with the intent to use the calls in furtherance of a felony or conspiracy to commit a felony; or</text></subparagraph><subparagraph id="idC0DB42ADF7454DA5BE1BB6048A5C6257"><enum>(D)</enum><text>the offense caused loss to 1 or more persons aggregating $5,000 or more in value during any 1-year period.</text></subparagraph></paragraph><paragraph id="idB4792E9028F7481E88797DAB392B389D"><enum>(3)</enum><header>Definitions</header><text>For purposes of this subsection—</text><subparagraph id="id8EE45636FEF94344B45DFFE16D7707A1"><enum>(A)</enum><text>the term <term>call</term> includes a message or other communication; and</text></subparagraph><subparagraph id="id38A00D2919DE4A6CAB01CB136F47ECF5"><enum>(B)</enum><text>the term <term>initiate</term>, with respect to a call, includes the act of sending, making, or transmitting a call, message, or other communication, as applicable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idFFBEE46296104DC095E66BE06261DBF3"><enum>(2)</enum><header>Technical and conforming amendment</header><text>Section 227(e)(5)(B) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(5)(B)</external-xref>) is amended, in the second sentence, by striking <quote>section 501</quote> and inserting <quote>subsection (k)</quote>.</text></paragraph></subsection><subsection id="id71A024F8670C4482A29A33C4EAD0F8B8"><enum>(b)</enum><header>Increased penalties for provision of inaccurate caller identification information</header><text>Section 227(e)(5) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)(5)</external-xref>) is amended—</text><paragraph id="idAE0C3919DCB24A7FBE7CF2A7C1F6C77B"><enum>(1)</enum><text>in subparagraph (A)(i), by striking <quote>$10,000</quote> and inserting <quote>$20,000</quote>; and</text></paragraph><paragraph id="id88246D74EF3A40249AC0BDFBBFE308AD"><enum>(2)</enum><text>in subparagraph (B), in the first sentence, by striking <quote>$10,000</quote> and inserting <quote>$20,000</quote>.</text></paragraph></subsection></section></legis-body></bill>
