<section id="id2906fde6db9246f2a9174f53e581ba71"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> <paragraph id="id3549e0ea49a44ae4a1b32511943677f1"><enum>(1)</enum><text>to fulfill the trust responsibility of the United States to Indian Tribes and to promote Tribal sovereignty and economic self-sufficiency by settling water rights claims of Indian Tribes without lengthy and costly litigation;</text></paragraph>
<paragraph id="id47a9b8b10cfb4463bdd10489ab9e8b6e"><enum>(2)</enum><text>to ensure the sovereignty of the Fort Belknap Indian Community of the Fort Belknap Reservation of Montana and the economy of the Reservation will be able to depend on the development of the water and other resources of the Reservation;</text></paragraph> <paragraph id="id9d10f99bf15946c5ac3a96294366599a"><enum>(3)</enum><text>to transfer a portion of the land within the ancestral territory of the Fort Belknap Indian Community to restore, in part, the historical, cultural, and spiritual land of the Fort Belknap Indian Community;</text></paragraph>
<paragraph id="id8a4df673d65142fba0acf5d88ba76f70"><enum>(4)</enum><text>to plan, design, and construct the facilities needed to effectively use Reservation water rights, consistent with the Compact and this Act, and other resources that are necessary for—</text> <subparagraph id="id9a524ef7b1fb459c986320892a2ecbde"><enum>(A)</enum><text>the development of a viable Reservation economy; and</text></subparagraph>
<subparagraph id="idf20f31932c8a4bd4bfd320e4ba403d5e"><enum>(B)</enum><text>the implementation of the water rights compact between the Fort Belknap Indian Community and the State;</text></subparagraph></paragraph> <paragraph id="id7fcc2846f90548bf912706add53bdb31"><enum>(5)</enum><text>to achieve a fair, equitable, and final settlement of claims to water rights in the State for—</text>
<subparagraph id="ida2f2a915928c4928a375b54a1c0d1a3d"><enum>(A)</enum><text>the Fort Belknap Indian Community of the Fort Belknap Reservation of Montana; and </text></subparagraph> <subparagraph id="id2c722154eb9c401880b5cc6a91754915"><enum>(B)</enum><text>the United States for the benefit of the Fort Belknap Indian Community and allottees;</text></subparagraph></paragraph>
<paragraph id="id6e9238a432834e1180c915df52a4ba74"><enum>(6)</enum><text>to authorize, ratify, and confirm the water rights compact entered into by the Fort Belknap Indian Community, the State, and the United States, to the extent that the Compact is consistent with this Act;</text></paragraph> <paragraph id="idede1d3bdf3a649a9abe435f6ff571581"><enum>(7)</enum><text>to authorize and require the Secretary—</text>
<subparagraph id="idbb31cae96372454c8ee3d78cbd9f1d55"><enum>(A)</enum><text>to execute the Compact;</text></subparagraph> <subparagraph id="id22bc06dd500a47f1ad55225f39bf2ba6"><enum>(B)</enum><text>to make available priority funding from the Reclamation Water Settlement Fund established by section 10501 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407</external-xref>); and</text></subparagraph>
<subparagraph id="idea71c8a40e4a4b1ca63b66eecbeabf44"><enum>(C)</enum><text>to take any other actions necessary to carry out the Compact in accordance with this Act;</text></subparagraph></paragraph> <paragraph id="id78ee298840a74d0387da79e3b295f460"><enum>(8)</enum><text>to authorize and appropriate funds, including for certain economic development initiatives and projects on the Reservation, necessary for the implementation of the Compact and this Act in order to support a final water rights settlement for the Fort Belknap Indian Community that results in measurable benefits to the Tribes and members; and</text></paragraph>
<paragraph id="id634cf1e9b62d4d8cb0a5d5997353735b"><enum>(9)</enum><text>to authorize the exchange and transfer of certain Federal and State land.</text></paragraph></section> <section id="id9d43df1e77f0493f9c3d4ce5e353de0e"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="idc6b1e72bab5b4b8ebd0f856a53a66865"><enum>(1)</enum><header>Allottee</header><text>The term <term>allottee</term> means an individual or the Fort Belknap Indian Community who holds a beneficial real property interest in an allotment of Indian land that is—</text> <subparagraph id="id39a1ddcfcf3545d3a60af73555d44448"><enum>(A)</enum><text>located within the Reservation; and</text></subparagraph>
<subparagraph id="id00a3a0968d794c2488904da074d797ee"><enum>(B)</enum><text>held in trust by the United States.</text></subparagraph></paragraph> <paragraph id="id77c2c28449de4edbb2db0948695b7a3a"><enum>(2)</enum><header>Blackfeet tribe</header><text>The term <term>Blackfeet Tribe</term> means the Blackfeet Tribe of the Blackfeet Indian Reservation of Montana.</text></paragraph>
<paragraph id="iddf8e624ed13a435b9585a94cd0719e6b"><enum>(3)</enum><header>Commissioner</header><text>The term <term>Commissioner</term> means the Commissioner of Reclamation.</text></paragraph> <paragraph id="id1dd1f46d0132429f920648c1f01b8871"><enum>(4)</enum><header>Compact</header><text>The term <term>Compact</term> means—</text>
<subparagraph id="id36c87861a2fb4fdabae42462a4c1e133"><enum>(A)</enum><text>the Fort Belknap-Montana water rights compact dated April 16, 2001, as contained in section 85–20–1001 of the Montana Code Annotated (2019); and</text></subparagraph> <subparagraph id="id945e863a541a4b8ea694b65a1d83877c"><enum>(B)</enum><text>any exhibit (including exhibit amendments), part, or amendment to the Compact that is executed to make the Compact consistent with this Act.</text></subparagraph></paragraph>
<paragraph id="id2a69782c2e29401385ef7a5d1ae90db1"><enum>(5)</enum><header>CERCLA</header><text>The term <term>CERCLA</term> means the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref> et seq.).</text></paragraph> <paragraph id="idc12ede0e75b74a1283a7c8d9646fae99"><enum>(6)</enum><header>Enforceability date</header><text>The term <term>enforceability date</term> means the date described in section 10(f).</text></paragraph>
<paragraph id="idd6d6e1a426c7414db91f0d0bdec96297"><enum>(7)</enum><header>Fort belknap indian community</header><text>The term <term>Fort Belknap Indian Community</term> means the Gros Ventre and Assiniboine Tribes of the Fort Belknap Reservation of Montana, a federally recognized Indian Tribal entity included on the list published by the Secretary pursuant to section 104(a) of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131(a)</external-xref>).</text></paragraph> <paragraph id="idf8f92da68b274488960a10eafa991826"><enum>(8)</enum><header>Fort Belknap Indian community council</header><text>The term <term>Fort Belknap Indian Community Council</term> means the governing body of the Fort Belknap Indian Community.</text></paragraph>
<paragraph id="idf55507bfe0cd4fc79aff7f1df6d8b32c"><enum>(9)</enum><header>Fort Belknap Indian irrigation project</header>
<subparagraph id="idcb399f1abb444a7a931fe4e0034a30b2"><enum>(A)</enum><header>In general</header><text>The term <term>Fort Belknap Indian Irrigation Project</term> means the Federal Indian irrigation project units, systems, and works developed by the United States to irrigate land within the Reservation, including pursuant to—</text> <clause id="id40f04a66048f460486dd0ed033074346"><enum>(i)</enum><text>the Treaty of October 17, 1855 (11 Stat. 657);</text></clause>
<clause id="id1b7d9a4ce2ff4751af4fcf822faed5b9"><enum>(ii)</enum><text>the Act of May 1, 1888 (25 Stat. 113, chapter 213);</text></clause> <clause id="iddeba227b928b477d9e674c428d23a8d4"><enum>(iii)</enum><text>the Act of August 15, 1894 (28 Stat. 286, chapter 290);</text></clause>
<clause id="ida7d17328fc0c4ffe93ed8c7ea4abb230"><enum>(iv)</enum><text>the Act of July 1, 1898 (30 Stat. 571, chapter 545);</text></clause> <clause id="id5cdd0987732f4d7d85be503f15e3cd9b" commented="no"><enum>(v)</enum><text>the Act of April 30, 1908 (35 Stat. 70, chapter 153); and</text></clause>
<clause id="idadec884a6a8748d8a43876a2bf0d7a91"><enum>(vi)</enum><text>this Act.</text></clause></subparagraph> <subparagraph id="idc4aae472f38a43de919c908a309815f5"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Fort Belknap Indian Irrigation Project</term> shall include—</text>
<clause id="idfe0319d66b924343ace8a57c1dc222aa"><enum>(i)</enum><text>the Milk River unit, including—</text> <subclause id="id201668a4ac99483d9b56391bbe60c886"><enum>(I)</enum><text>the Three Mile Coulee unit;</text></subclause>
<subclause id="idf62b1e81ec364b199ead006fc867f99c"><enum>(II)</enum><text>the White Bear unit; and</text></subclause> <subclause id="idffde78723b8b48be867ebebad40c4f0a"><enum>(III)</enum><text>the Fort Belknap future irrigation project, including the Fort Belknap Reservoir and Dam;</text></subclause></clause>
<clause id="idc265366d7d064dd588403fa153852a8b"><enum>(ii)</enum><text>the Southern Tributary Irrigation Project, including—</text> <subclause id="id029b875a599d41edaf8a90360372fa63"><enum>(I)</enum><text>the Beaver Creek unit;</text></subclause>
<subclause id="id764d5c87746b49fb8baf350bb06f65d7"><enum>(II)</enum><text>the Duck Creek unit;</text></subclause> <subclause id="idceea4943d52a4aea9a26a711299440dc"><enum>(III)</enum><text>the Lodge Pole Creek unit;</text></subclause>
<subclause id="idf3749697503c4a00a5278fe0dff32123"><enum>(IV)</enum><text>the Big Warm Creek unit;</text></subclause> <subclause id="id95523ded4b614feeaa570efa72d63d3f"><enum>(V)</enum><text>the Jim Brown Creek unit;</text></subclause>
<subclause id="idcefe8b20f1a14a8dae357fad5d6e7cb4"><enum>(VI)</enum><text>the Little Peoples Creek unit;</text></subclause> <subclause id="id72c8a87e3dbf4c14b7884bd1d172f9e2"><enum>(VII)</enum><text>the South Fork Peoples Creek Unit; and</text></subclause>
<subclause id="ide5c59fe5ce0a412c8259793539fcbc6e"><enum>(VIII)</enum><text>the Little Warm Creek unit; and</text></subclause></clause> <clause id="ide4a3d9371da04c328c822ca504309dbf"><enum>(iii)</enum><text>the Peoples Creek Irrigation Project, including the Upper Peoples Creek Dam and Reservoir.</text></clause></subparagraph></paragraph>
<paragraph id="id891113083870465784cca65581406a61"><enum>(10)</enum><header>Fresno reservoir</header><text>The term <term>Fresno Reservoir</term> means the dam and reservoir of the Milk River Project, located on the Milk River 14 miles west of Havre, Montana, and authorized by the Act of June 16, 1933 (48 Stat. 195, chapter 90) (commonly known as the <quote>National Industrial Recovery Act</quote>).</text></paragraph> <paragraph id="idc63ef8e4d85f4016ae7e20d18a81ecd2"><enum>(11)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph>
<paragraph id="id8415e73f48fa4c4f98c736017e448e07"><enum>(12)</enum><header>Joint Board</header><text>The term <term>Joint Board</term> means the Joint Board of Control for the Milk River Project established in accordance with State law.</text></paragraph> <paragraph id="id68a3189837d645a2871661e06d71a3c0"><enum>(13)</enum><header>Lake Elwell</header><text>The term <term>Lake Elwell</term> means the water impounded on the Marias River in the State by Tiber Dam, a feature of the Lower Marias Unit of the Pick-Sloan Missouri River Basin Program.</text></paragraph>
<paragraph id="id7f32f31b1c474d2992ee692393d365fc"><enum>(14)</enum><header>Malta Irrigation District</header><text>The term <term>Malta Irrigation District</term> means the public corporation—</text> <subparagraph id="id80dd2293e3a14b56b164ed5e3e68de2e"><enum>(A)</enum><text>created on December 28, 1923, pursuant to the laws of the State relating to irrigation districts; and</text></subparagraph>
<subparagraph id="id694de6233c634fe69aa8b7ff9cc192a2"><enum>(B)</enum><text>headquartered in Malta, Montana.</text></subparagraph></paragraph> <paragraph id="id5b06b853661b4015a92f6cd128b3cec1"><enum>(15)</enum><header>Milk River</header><text>The term <term>Milk River</term> means the mainstem of the Milk River and each tributary of the Milk River between the headwater of the Milk River and the confluence of the Milk River with the Missouri River, consisting of—</text>
<subparagraph id="id22f949978db14bc08e481390b87b2c46"><enum>(A)</enum><text>Montana Water Court Basins 40F, 40G, 40H, 40I, 40J, 40K, 40L, 40M, 40N, and 40O; and</text></subparagraph> <subparagraph id="id9cc8856aa6c8466ba45d947af6e6c68e"><enum>(B)</enum><text>the portion of the Milk River and each tributary of the Milk River that flows through the Canadian Provinces of Alberta and Saskatchewan.</text></subparagraph></paragraph>
<paragraph id="id76cb065a140f47f0b75f409125bee514"><enum>(16)</enum><header>Milk river coordinating committee</header><text>The term <term>Milk River Coordinating Committee</term> means the committee established by article IV.C. of the Compact.</text></paragraph> <paragraph id="id299f75163c2444f89b9d916042bc9ce6"><enum>(17)</enum><header>Milk river project</header> <subparagraph id="id4f938ed5e0a14fd4a44c15ae405ca754"><enum>(A)</enum><header>In general</header><text>The term <term>Milk River Project</term> means the Bureau of Reclamation project conditionally approved by the Secretary on March 14, 1903, pursuant to the Act of June 17, 1902 (32 Stat. 388, chapter 1093), commencing at Lake Sherburne Reservoir and providing water to a point approximately 6 miles east of Nashua, Montana.</text></subparagraph>
<subparagraph id="idc4fb2fc1efa5429fa60bd02ce0929d26"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Milk River Project</term> includes the St. Mary Unit.</text></subparagraph></paragraph> <paragraph id="id84e1109c76d84efead45457e26a37f4f"><enum>(18)</enum><header>Missouri river basin</header><text>The term <term>Missouri River Basin</term> means the hydrologic basin of the Missouri River, including tributaries.</text></paragraph>
<paragraph id="ide433cd92cfe645c4a2945ec0eef8a257" commented="no"><enum>(19)</enum><header>Operations, maintenance, and repair</header><text>The term <term>operations, maintenance, and repair</term> means—</text> <subparagraph id="id711741e9ed5c4d8a8038757a65b90a0c" commented="no"><enum>(A)</enum><text>any recurring or ongoing activity associated with the day-to-day operation of a project;</text></subparagraph>
<subparagraph id="idc2f37f56294f437f9c3adac48b35a7d3" commented="no"><enum>(B)</enum><text>any activity relating to scheduled or unscheduled maintenance of a project; and</text></subparagraph> <subparagraph id="idf5f1dff64f384539bf43a83650529d3b" commented="no"><enum>(C)</enum><text>any activity relating to repairing or replacing a feature of a project.</text></subparagraph></paragraph>
<paragraph id="id59e30beab0cc47ef9553fc29bf9d30ae"><enum>(20)</enum><header>Pick-sloan missouri river basin program</header><text>The term <term>Pick-Sloan Missouri River Basin Program</term> means the Pick-Sloan Missouri River Basin Program (authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665)).</text></paragraph> <paragraph id="ida5bdfc66513840b2a289085338cb94ee"><enum>(21)</enum><header>PMM</header><text>The term <term>PMM</term> means the Principal Meridian, Montana.</text></paragraph>
<paragraph id="id0593cbf9d4b24df4b0a8c1a73f92f361"><enum>(22)</enum><header>Reservation</header>
<subparagraph id="ide9e11aa039194915ad6cebc397d07aa8"><enum>(A)</enum><header>In general</header><text>The term <term>Reservation</term> means the area of the Fort Belknap Reservation in the State, as modified by this Act.</text></subparagraph> <subparagraph id="id6f1e056e93be4361ab200bdbd9141c26"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Reservation</term> includes—</text>
<clause id="id79F5F8E49BF34711B8BCF290FDCE8554"><enum>(i)</enum><text>all land and interests in land established by—</text> <subclause id="id8d3a238e9e334a74bc1f83989b8e79c3"><enum>(I)</enum><text>the Agreement with the Gros Ventre and Assiniboine Tribes of the Fort Belknap Reservation, ratified by the Act of May 1, 1888 (25 Stat. 113, chapter 212), as modified by the Agreement with the Indians of the Fort Belknap Reservation of October 9, 1895 (ratified by the Act of June 10, 1896) (29 Stat. 350, chapter 398);</text></subclause>
<subclause id="id332d28621a514f879d70c7f72563aec8"><enum>(II)</enum><text>the Act of March 3, 1921 (41 Stat. 1355, chapter 135); and</text></subclause> <subclause id="id82a0c16ea4274398b22ed633c7c9be4b"><enum>(III)</enum><text>Public Law 94–114 (<external-xref legal-doc="usc" parsable-cite="usc/25/5501">25 U.S.C. 5501</external-xref> et seq.);</text></subclause></clause>
<clause id="idede0ccf5bf2c4f578ae128689791e857"><enum>(ii)</enum><text>the land known as the <quote>Hancock lands</quote> purchased by the Fort Belknap Indian Community pursuant to the Fort Belknap Indian Community Council Resolution No. 234–89 (October 2, 1989); and</text></clause> <clause id="id3192EA475D11487A889B3928C54EE905"><enum>(iii)</enum><text>all land transferred under section 6.</text></clause></subparagraph></paragraph>
<paragraph id="ida22e60ec0c3b49819b1aa4e07d261708"><enum>(23)</enum><header>St. Mary Unit</header>
<subparagraph id="iddf27d62a95a644adb9df34ff0206f6c4"><enum>(A)</enum><header>In general</header><text>The term <term>St. Mary Unit</term> means the St. Mary Storage Unit of the Milk River Project authorized by Congress on March 25, 1905.</text></subparagraph> <subparagraph id="id8d5854fdcb6042b2960549f114b649a6"><enum>(B)</enum><header>Inclusions</header><text>The term <term>St. Mary Unit</term> includes—</text>
<clause id="id11eaa006aa8a4b45a99580975e1b616a"><enum>(i)</enum><text>Sherburne Dam and Reservoir;</text></clause> <clause id="id88d504d16079468792fc3a3ac348b273"><enum>(ii)</enum><text>Swift Current Creek Dike;</text></clause>
<clause id="id9570552c88b74ac292242eb666776ff8"><enum>(iii)</enum><text>Lower St. Mary Lake;</text></clause> <clause id="idcfa83eb15a8a40b582d4fea01b38b080"><enum>(iv)</enum><text>St. Mary Canal Diversion Dam; and</text></clause>
<clause id="id0556d69ce2c34b1a8fdcbf1097dfc81d"><enum>(v)</enum><text>St. Mary Canal and appurtenances.</text></clause></subparagraph></paragraph> <paragraph id="id75b4dbe5c63646e98cf61e306abb1af0"><enum>(24)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph>
<paragraph id="idb52032c5a1ac4993bd3736972f383603"><enum>(25)</enum><header>Service contract</header><text>The term <term>service contract</term> means a business or commercial agreement between a contractor and a customer covering maintenance and servicing of facilities over a specified period.</text></paragraph> <paragraph id="id543c6655433e4459b47d6f1c2bc67366"><enum>(26)</enum><header>State</header><text>The term <term>State</term> means the State of Montana.</text></paragraph>
<paragraph id="id0c76812cfe104312bfdebd41c694900d"><enum>(27)</enum><header>Tribal water rights</header><text>The term <term>Tribal water rights</term> means the water rights of the Fort Belknap Indian Community, as described in article III of the Compact and this Act, including—</text> <subparagraph id="idf0a27bffcc504d55839432dca472e59b"><enum>(A)</enum><text>the allocation of water to the Fort Belknap Indian Community from Lake Elwell under section 7; and</text></subparagraph>
<subparagraph id="id06393edad22a46ceb6c81c3e3743542f"><enum>(B)</enum><text>the water rights of allottees.</text></subparagraph></paragraph> <paragraph id="idcafe3adab7cf4db9967d07e634237cf0"><enum>(28)</enum><header>Trust fund</header><text>The term <term>Trust Fund</term> means the Aaniiih Nakoda Settlement Trust Fund established under section 11(b)(1).</text></paragraph></section>
<section id="id272e1a149efc4d83a4087e9563f1dc87"><enum>4.</enum><header>Ratification of Compact and judicial decree</header>
<subsection id="id0655e4c0b5634d6887300e83d71a50eb"><enum>(a)</enum><header>Ratification of compact</header>
<paragraph id="idcb113820bdb344ac9209933dbd719c63"><enum>(1)</enum><header>In general</header><text>As modified by this Act, the Compact is authorized, ratified, and confirmed.</text></paragraph> <paragraph id="id53de24873ccb46de8eaa631dff51d2ea"><enum>(2)</enum><header>Amendments</header><text>Any amendment to the Compact is authorized, ratified, and confirmed to the extent that the amendment is executed to make the Compact consistent with this Act.</text></paragraph></subsection>
<subsection id="idc713b327fabc4e899b7319e3df643713"><enum>(b)</enum><header>Execution</header>
<paragraph id="iddd7bb4a8b6934ebfaec9e999e2b297d9"><enum>(1)</enum><header>In general</header><text>To the extent that the Compact does not conflict with this Act, the Secretary shall execute the Compact, including all exhibits to, or parts of, the Compact requiring the signature of the Secretary.</text></paragraph> <paragraph id="id21c121a77bbf48fbbf468f9d973c41ad"><enum>(2)</enum><header>Modifications</header><text>Nothing in this Act precludes the Secretary from approving any modification to an appendix or exhibit to the Compact that is consistent with this Act, to the extent that the modification does not otherwise require congressional approval under section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>) or any other applicable provision of Federal law.</text></paragraph></subsection>
<subsection id="id12c042e01a4044468cfdfdf7584a5454"><enum>(c)</enum><header>Environmental compliance</header>
<paragraph id="id51be45987125490b97d8d92e9effd55d"><enum>(1)</enum><header>In general</header><text>In implementing the Compact and this Act, the Secretary shall comply with all applicable provisions of—</text> <subparagraph id="idc34246161ce9492abb0994767226c7fe"><enum>(A)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.);</text></subparagraph>
<subparagraph id="idba704476e9644a4e9954419d6637a708"><enum>(B)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); and</text></subparagraph> <subparagraph id="idc4840d62a8b8442ca69b60442c2fcda7"><enum>(C)</enum><text>other applicable environmental laws and regulations.</text></subparagraph></paragraph>
<paragraph id="id8565fa1bb0ff475185893dc3d957d9c5"><enum>(2)</enum><header>Effect of execution</header>
<subparagraph id="id6c95eccd532f4f54a6794875c66ed2a1"><enum>(A)</enum><header>In general</header><text>The execution of the Compact by the Secretary under this section shall not constitute a major Federal action for purposes of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text></subparagraph> <subparagraph id="id8d1aedd43b8d48f5b6000f56505e6498"><enum>(B)</enum><header>Compliance</header> <clause id="idD0DB48111D704AA89284A3864C1C15B6"><enum>(i)</enum><header>In general</header><text>The Secretary shall carry out all Federal compliance activities, including appropriate environmental, cultural, and historical compliance activities, necessary to implement the Compact and this Act.</text></clause>
<clause id="ide353a92fc0374702b911bef2e44c8280"><enum>(ii)</enum><header>Costs</header><text>The cost of carrying out Federal compliance activities under clause (i), including any costs associated with carrying out Federal approvals or other reviews or any other inherently Federal functions, shall remain the responsibility of the Secretary.</text></clause></subparagraph></paragraph></subsection></section> <section id="id626d748e384a4456b22a4950f904ebd3"><enum>5.</enum><header>Tribal water rights</header> <subsection id="idebd9419ae52b41d1bd1cbfaf1f175317"><enum>(a)</enum><header>Confirmation of tribal water rights</header> <paragraph id="id3c04df257a184460b67ee092cf672326"><enum>(1)</enum><header>In general</header><text>The Tribal water rights are ratified, confirmed, and declared to be valid.</text></paragraph>
<paragraph id="id99ece1a127b94c9791fa7250e17b36ec"><enum>(2)</enum><header>Use</header><text>Any use of the Tribal water rights shall be subject to the terms and conditions of the Compact and this Act.</text></paragraph> <paragraph id="id7be889005d6d4dc386f61291d68d5602"><enum>(3)</enum><header>Conflict</header><text>In the event of a conflict between the Compact and this Act, this Act shall control.</text></paragraph></subsection>
<subsection id="id6ad8aa110c8b41e7b75da350b2216a9c"><enum>(b)</enum><header>Intent of congress</header><text>It is the intent of Congress to provide to each allottee benefits that are equivalent to, or exceed, the benefits the allottees possess on the day before the date of enactment of this Act, taking into consideration—</text> <paragraph id="id37b8a9b727ed4beeadcd165d711ae56d"><enum>(1)</enum><text>the potential risks, cost, and time delay associated with litigation that would be resolved by the Compact and this Act;</text></paragraph>
<paragraph id="ided8fb715e92142a3b0079b2e401aef4a"><enum>(2)</enum><text>the availability of funding under this Act and from other sources;</text></paragraph> <paragraph id="id288b92a7505f4e4193ded2baf8574301"><enum>(3)</enum><text>the availability of water from the Tribal water rights; and</text></paragraph>
<paragraph id="id6835a7fbbbab416a9028ae06fa5066f4"><enum>(4)</enum><text>the applicability of section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>) and this Act to protect the interests of allottees.</text></paragraph></subsection> <subsection id="ida17f13fd00e8473398ba2e56ce70514a"><enum>(c)</enum><header>Trust status of tribal water rights</header><text>The Tribal water rights—</text>
<paragraph id="iddcc818bc11d14be2abcc33f2202eedb1"><enum>(1)</enum><text>shall be held in trust by the United States for the use and benefit of the Fort Belknap Indian Community in accordance with this Act; and</text></paragraph> <paragraph id="idacd61a0cd05a43539e30931a6f723560"><enum>(2)</enum><text>shall not be subject to forfeiture or abandonment.</text></paragraph></subsection>
<subsection id="idfd90f6323b5f400d952f292d0dcf22bb"><enum>(d)</enum><header>Allottees</header>
<paragraph id="ida29a7b04b94f4bb9b67d5945de21316d"><enum>(1)</enum><header>Applicability of the act of February 8, 1887</header><text>The provisions of section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), relating to the use of water for irrigation purposes, shall apply to the Tribal water rights.</text></paragraph> <paragraph id="id1097ddf71bf947a7b83f091f1acbb953"><enum>(2)</enum><header>Entitlement to water</header><text>Any entitlement to the use of water of an allottee under Federal law shall be satisfied from the Tribal water rights.</text></paragraph>
<paragraph id="id0d5c5ce157a144019bdae8ea9568f085"><enum>(3)</enum><header>Allocations</header><text>An allottee shall be entitled to a just and equitable allocation of water for irrigation purposes.</text></paragraph> <paragraph id="idf61c75206e19497ebacc174ae1ca5d59"><enum>(4)</enum><header>Claims</header> <subparagraph id="idad6d1fa08fe04d649bb9d99fd5dbf006"><enum>(A)</enum><header>Exhaustion of remedies</header><text>Before asserting any claim against the United States under section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), or any other applicable law, an allottee shall exhaust remedies available under the Tribal water code or other applicable Tribal law.</text></subparagraph>
<subparagraph id="id27c678adcf6542f2a5de9587057d7881"><enum>(B)</enum><header>Action for relief</header><text>After the exhaustion of all remedies available under the Tribal water code or other applicable Tribal law, an allottee may seek relief under section 7 of the Act of February 8, 1887 (24 Stat. 390, chapter 119; <external-xref legal-doc="usc" parsable-cite="usc/25/381">25 U.S.C. 381</external-xref>), or other applicable law.</text></subparagraph></paragraph> <paragraph id="idbecd79419586409e8f66d09a30e313d4"><enum>(5)</enum><header>Authority of the secretary</header><text>The Secretary shall have the authority to protect the rights of allottees in accordance with this section.</text></paragraph></subsection>
<subsection id="id61a57586e65c4f19a98c141e9be4fbbf"><enum>(e)</enum><header>Authority of the Fort Belknap Indian Community</header>
<paragraph id="id867d04994dd342bc8f357210246d50c3"><enum>(1)</enum><header>Authority</header>
<subparagraph id="id007a50318e0849fa96e157e1c157c705"><enum>(A)</enum><header>In general</header><text>The Fort Belknap Indian Community shall—</text> <clause id="id73316a90874049a28ce51abda41a4f6a"><enum>(i)</enum><text>govern the use of the Tribal water rights pursuant to Tribal law, the Compact, this Act, and applicable Federal law; and</text></clause>
<clause id="idcfea563cc7d24ffdbc73a655d8e14802"><enum>(ii)</enum><text>have—</text> <subclause id="id5ff6a903be3a46bfad84cf566975b252"><enum>(I)</enum><text>administrative, regulatory, and adjudicatory authority over all Tribal water rights, including the authority to allocate, distribute, use, and temporarily transfer by service contract, lease, exchange, or other agreement the Tribal water rights for any use within the Reservation; and</text></subclause>
<subclause id="id0d5492d073b045158bd365af8ecb3215"><enum>(II)</enum><text>the authority to voluntarily allocate, distribute, use, and temporarily transfer by service contract, lease, exchange, or other agreement the Tribal water rights off the Reservation within the Missouri River Basin.</text></subclause></clause></subparagraph> <subparagraph id="id94b2bb499500498f9530e842b30de006"><enum>(B)</enum><header>Transfer of Tribal water rights</header><text>If applicable State and Federal laws are amended or expanded after the date of enactment of this Act to authorize water users to transfer water rights interbasin, interstate, or internationally, the Fort Belknap Indian Community shall have the right and authority to temporarily transfer Tribal water rights of the Fort Belknap Indian Community to the same extent permissible for State-based and other water rights users.</text></subparagraph></paragraph>
<paragraph id="id373ab0b48f194b779236e04de6a9abc9"><enum>(2)</enum><header>Requirements</header><text>A service contract, lease, exchange, or other agreement referred to in subclauses (I) and (II) of paragraph (1)(A)(ii)—</text> <subparagraph id="id9dba98380d104168956a80d4c786088d"><enum>(A)</enum><text>shall be for a term of not more than 100 years;</text></subparagraph>
<subparagraph id="id44f78f159740480ca09b96e92b3a3e45"><enum>(B)</enum><text>may include provisions for renewal of the agreement for an additional term of not more than 100 years; and</text></subparagraph> <subparagraph id="id7d2639bbace7426f87f35f9bb915964d"><enum>(C)</enum><text>shall not permanently alienate any portion of the Tribal water rights.</text></subparagraph></paragraph>
<paragraph id="id399622a0f3604de7b87223b54eab45e6"><enum>(3)</enum><header>Land leases by allottees</header><text>Notwithstanding paragraph (1), an allottee may lease any interest in land held by the allottee, together with any water right determined to be appurtenant to the interest in land, in accordance with the Tribal water code.</text></paragraph> <paragraph id="ida8b4d02291194e1f8ca07b988f6e6ebe"><enum>(4)</enum><header>Deferral or forbearance of tribal water use</header> <subparagraph id="idad27ac9abf164d2cb6215b5c4480c923"><enum>(A)</enum><header>In general</header><text>In accordance with the right of the Fort Belknap Indian Community to choose to limit the development and use of the Tribal water rights by the Fort Belknap Indian Community and to allow the water of the Tribal water rights to pass through the priority system to be diverted by a third party for compensation, as negotiated by the Fort Belknap Indian Community, the deferral or forbearance of the use of Tribal water rights shall be permissible.</text></subparagraph>
<subparagraph id="id3b9c9b1fd3e645af931729f4ce0c53b7"><enum>(B)</enum><header>Limitations</header><text>The deferral or forbearance of the use of the Tribal water rights under subparagraph (A) shall not be considered to be—</text> <clause id="id19721c4518114afaae0ee09ed72e51b1"><enum>(i)</enum><text>a transfer of the Tribal water rights off the Reservation under paragraph (1)(A)(ii)(II); or</text></clause>
<clause id="id36bfc50faf8f41b788655f0ff2c0c874"><enum>(ii)</enum><text>a transfer of title of the Tribal water rights.</text></clause></subparagraph></paragraph></subsection> <subsection id="idf1f9abdb600841a0a0611bcf3545d48b"><enum>(f)</enum><header>Tribal water code</header> <paragraph id="idb1308e203eac48c099dd0bb5339dcd4d"><enum>(1)</enum><header>In general</header><text>Notwithstanding article IV.A.2. of the Compact, not later than 4 years after the date on which the Fort Belknap Indian Community approves the Compact in accordance with section 10(f)(1), the Fort Belknap Indian Community shall enact a Tribal water code that—</text>
<subparagraph id="id27fe8401271d45f0a58e734fff8555f9"><enum>(A)</enum><text>is consistent with the Compact and this Act; and</text></subparagraph> <subparagraph id="id8d5a695029e04770a4b740497d320465"><enum>(B)</enum><text>provides for—</text>
<clause id="id1e13c1ca4cbc4baa88499505bf05dedc"><enum>(i)</enum><text>the administration, management, regulation, enforcement, and governance, including adjudicatory jurisdiction, of the Tribal water rights and all uses of the Tribal water rights; and</text></clause> <clause id="id0b64179fcc4246f6b606de1b94c302e9"><enum>(ii)</enum><text>the establishment by the Fort Belknap Indian Community of the conditions, permit requirements, and other requirements for the allocation, distribution, and use of the Tribal water rights, including irrigation, livestock, domestic, commercial, municipal, industrial, cultural, and recreational uses.</text></clause></subparagraph></paragraph>
<paragraph id="id280b27b2f8014ed28b71d2bf7d9369d8"><enum>(2)</enum><header>Inclusions</header><text>Subject to paragraph (3)(B)(i), the Tribal water code shall—</text> <subparagraph id="id0b4d4e04295b44d9b0fac669506384c7"><enum>(A)</enum><text>provide that use of water by allottees shall be satisfied with water from the Tribal water rights;</text></subparagraph>
<subparagraph id="id46dd940efca64587bc8f201fbe49ad5b"><enum>(B)</enum><text>provide for a process by which an allottee may request that the Fort Belknap Indian Community provide water for irrigation use in accordance with this Act, including the provision of water under any allottee lease under section 4 of the Act of June 25, 1910 (36 Stat. 856, chapter 431; <external-xref legal-doc="usc" parsable-cite="usc/25/403">25 U.S.C. 403</external-xref>);</text></subparagraph> <subparagraph id="idf75cdf5d9d4a429a89eb5a44a285d919"><enum>(C)</enum><text>provide for a due process system that includes a process by which the Fort Belknap Indian Community can resolve disputes, including a process for the resolution of—</text>
<clause id="idf9318f91d8ea4a899575222defdd826d"><enum>(i)</enum><text>any contested administrative decision, including any denial of a request for an allocation of water from the Tribal water rights by—</text> <subclause id="idc30c9362b43c48f6b3941d1d7b7866c4"><enum>(I)</enum><text>an allottee for irrigation purposes on allotted land;</text></subclause>
<subclause id="id363f7ab63a0a4e2e9d2ce3c39f6307fd"><enum>(II)</enum><text>a successor-in-interest to an allottee;</text></subclause> <subclause id="idf0f0d5254c83474d8e36dc0a973332da"><enum>(III)</enum><text>any other member of the Fort Belknap Indian Community; or</text></subclause>
<subclause id="id77a005529647452794e0779403efece1"><enum>(IV)</enum><text>an owner of fee land within the boundaries of the Reservation; and</text></subclause></clause> <clause id="id20c6db76c9654c64ad9c1fcd515a8b65"><enum>(ii)</enum><text>the appeal and adjudication of administrative decisions under clause (i) and any denied or disputed distribution of water; and</text></clause></subparagraph>
<subparagraph id="idc10067eb23d746a0be0d19ede5ae521a"><enum>(D)</enum><text>include a requirement that—</text> <clause id="id544f5f949ab743cd9ea42f8904642fbc"><enum>(i)</enum><text>any allottee asserting a claim relating to the enforcement of rights of the allottee under the Tribal water code, including to the quantity of water allocated to land of the allottee, shall exhaust all remedies available to the allottee under Tribal law before initiating an action against the United States or petitioning the Secretary pursuant to subsection (d)(4); and</text></clause>
<clause id="id9c642a25c935447489b2e0912bab7826"><enum>(ii)</enum><text>any other Tribal water user asserting a claim relating to the enforcement of rights under the Tribal water code shall exhaust all remedies available under Tribal law.</text></clause></subparagraph></paragraph> <paragraph id="id90e719dfa9144d70ac30ce3ece6e04d8"><enum>(3)</enum><header>Action by secretary</header> <subparagraph id="idece496d0c6e9435898c1d87aebb1acd0"><enum>(A)</enum><header>In general</header><text>During the period beginning on the date of enactment of this Act and ending on the date on which a Tribal water code described in paragraphs (1) and (2) is enacted, the Secretary shall administer the Tribal water rights, including with respect to the rights of allottees, in accordance with this Act.</text></subparagraph>
<subparagraph id="idecf94aa1cccb4a499ed988860656afa8"><enum>(B)</enum><header>Approval</header><text>The Tribal water code described in paragraphs (1) and (2) shall not be valid unless—</text> <clause id="idaf2ed20aaeae4ec1ab353f7be96dea74"><enum>(i)</enum><text>the provisions of the Tribal water code required by paragraph (2) are approved by the Secretary; and</text></clause>
<clause id="id49c4eef4c7374f08bdcb999b68d1582c"><enum>(ii)</enum><text>each amendment to the Tribal water code that affects a right of an allottee is approved by the Secretary.</text></clause></subparagraph> <subparagraph id="id18801afeeeb34fa4bc9cbf3c06a67dfb"><enum>(C)</enum><header>Approval period</header> <clause id="ida242616864ea43179f15adc9568338c6"><enum>(i)</enum><header>In general</header><text>The Secretary shall—</text>
<subclause id="id011ede32ff05453f9dceeb5fedebdd23"><enum>(I)</enum><text>approve or disapprove the Tribal water code or an amendment to the Tribal water code by not later than 180 days after the date on which the Tribal water code or amendment to the Tribal water code is submitted to the Secretary; and</text></subclause> <subclause id="id629df683e37a46dd97469cb708042c36"><enum>(II)</enum><text>notify the Fort Belknap Indian Community of the decision of the Secretary by not later than 15 days after the date on which the Secretary makes the decision.</text></subclause></clause>
<clause id="idd9d56035f82a4d9dac91835c3fb19bba"><enum>(ii)</enum><header>No action</header><text>If the Secretary does not approve or disapprove the Tribal water code or amendment to the Tribal water code and notify the Fort Belknap Indian Community by the applicable deadlines described in clause (i), the Tribal water code or amendment to the Tribal water code shall be deemed to be approved.</text></clause> <clause id="id06db3ca4787a4b01a955453fb4b43c14"><enum>(iii)</enum><header>Disapproval</header><text>If the Secretary disapproves the Tribal water code or amendment to the Tribal water code, the Secretary, in consultation with the Fort Belknap Indian Community, shall have 90 days to resolve the basis for the disapproval, and if the basis for the disapproval has not been resolved by that date, the Tribal water code shall be deemed approved.</text></clause>
<clause id="iddd99e3f9218c493b8cc07aff953b8dd8"><enum>(iv)</enum><header>Extensions</header><text>The deadlines described in clauses (i)(I) and (iii) may be extended by the Secretary with the agreement of the Fort Belknap Indian Community.</text></clause></subparagraph></paragraph></subsection> <subsection id="id26e322f51aac47ab83ac41937508f532"><enum>(g)</enum><header>Administration</header> <paragraph id="id6490c9bd280741b0a0a5138ae7310418"><enum>(1)</enum><header>No alienation</header><text>The Fort Belknap Indian Community shall not permanently alienate any portion of the Tribal water rights.</text></paragraph>
<paragraph id="id291dbac8450d474daa8faa13bbfff86c"><enum>(2)</enum><header>Purchases or grants of land from indians</header><text>An authorization provided by this Act for the allocation, distribution, leasing, or other arrangement entered into pursuant to this Act shall be considered to satisfy any requirement for authorization of the action by treaty or convention imposed by section 2116 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>).</text></paragraph> <paragraph id="id6b842c2f75c14c25b3ae74cfeb922089"><enum>(3)</enum><header>Prohibition on forfeiture</header><text>The non-use of all or any portion of the Tribal water rights by any water user shall not result in the forfeiture, abandonment, relinquishment, or other loss by the Fort Belknap Indian Community of all or any portion of the Tribal water rights.</text></paragraph></subsection>
<subsection id="id0d50d584d60748b4bce6735fbf19f4d2"><enum>(h)</enum><header>Effect</header><text>Except as otherwise expressly provided in this section, nothing in this Act—</text> <paragraph id="id4e3e2fd5325a46c7bbac12c9517665ba"><enum>(1)</enum><text>authorizes any action by an allottee against any individual or entity, or against the Fort Belknap Indian Community, under Federal, State, Tribal, or local law; or</text></paragraph>
<paragraph id="idc06dc029bcc84a9bbe1e7f3ddf5140a3"><enum>(2)</enum><text>alters or affects the status of any action brought pursuant to section 1491(a) of title 28, United States Code.</text></paragraph></subsection> <subsection id="id01a39872b4a74995be7d534f8cbb0dd4"><enum>(i)</enum><header>Pick-Sloan Missouri river basin program power rates</header><text>The Secretary, in cooperation with the Secretary of Energy, shall make available, at project-use pumping power, preference customer rates established as of the date of enactment of this Act, Pick-Sloan Missouri River Basin Program pumping power to—</text>

<section id="idc833c761fee643f1aced4509b42f9f45"><enum>6.</enum><header>Exchange and transfer of public land into trust</header>
<subsection id="id3cd0a567744440c99fd125c105f46f1c"><enum>(a)</enum><header>Exchange of Federal and State land</header>
<paragraph id="idbc3aed1e07c24ab6b5c56575ff1eecc7"><enum>(1)</enum><header>In general</header><text>In partial satisfaction of claims relating to Indian water rights covered by this Act, the Fort Belknap Indian Community agrees to the exchange and transfer of land in accordance with this subsection.</text></paragraph> <paragraph id="id27d7583378684d37bff5f3fbde204360"><enum>(2)</enum><header>State land</header><text>The Secretary shall offer to enter into negotiations with the State for the purpose of exchanging Federal land described in paragraph (3) for the following parcels of land owned by the State, located on and off of the Reservation:</text>

<paragraph id="idc340b2b6bd284245bfc8de79b3e021a0"><enum>(4)</enum><header>Completion</header><text>The Secretary shall complete a land exchange under this subsection, and shall take the land received by the Federal Government into trust for the benefit of the Fort Belknap Indian Community, by not later than 10 years after the enforceability date.</text></paragraph> <paragraph id="idc9735c1fbde04e72bc6603eb602d2b45"><enum>(5)</enum><header>Requirements</header> <subparagraph id="id20794d0b8acc41b79fdc2654968077f0"><enum>(A)</enum><header>Value</header><text>The Secretary shall negotiate with the State using the roughly equivalent theory of valuation of any Federal land exchanged for State land.</text></subparagraph>
<subparagraph id="id1d8dd0ba0f294dd98904e083a9d5655b"><enum>(B)</enum><header>Basis</header><text>Unless the Secretary and the State specifically agree otherwise, each land exchange under this subsection shall be on a whole-estate for whole-estate basis.</text></subparagraph> <subparagraph id="id2d48129764ec4baf949662a54a785eca"><enum>(C)</enum><header>Survey</header><text>If a survey is requested by the State or required by the Secretary, the Secretary shall provide such financial or other assistance as may be necessary—</text>
<clause id="id1F2A2CB83A7F47DF84D7A73DB9F1C270"><enum>(i)</enum><text>to conduct additional surveys and obtain appraisals of the transferred land, including any mining claims; and </text></clause> <clause id="id410D9CF1BF134B23A8853622F5633808"><enum>(ii)</enum><text>to satisfy administrative requirements necessary to accomplish the land transfers under this subsection.</text></clause></subparagraph></paragraph>
<paragraph id="id3017ec79d0af4ddfac82f5740b896ff1"><enum>(6)</enum><header>Existing rights and uses</header>
<subparagraph id="id07e1c3e7c43147749b7212ebba26a1a4"><enum>(A)</enum><header>Uses</header>
<clause id="idcfb8669e9f5a453a984cba09dec4bfcf"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), any use (including grazing) authorized under a valid lease, permit, or right-of-way on land exchanged under this subsection, as in effect on the date of the transfer, shall remain in effect until the date on which the lease, permit, or right-of-way expires.</text></clause> <clause id="id6ff0a1e6e6f14fcabba2846ac913fd7b"><enum>(ii)</enum><header>Exception</header><text>Clause (i) shall not apply if the holder of the lease, permit, or right-of-way requests an earlier termination of the lease, permit, or right-of-way in accordance with applicable law.</text></clause></subparagraph>
<subparagraph id="id8f75ffa9f68d4215bd9a53544a162aa9"><enum>(B)</enum><header>Improvements</header><text>Any improvements constituting personal property (as defined by State law) on land exchanged under this subsection by the holder of the lease, permit, or right-of-way shall remain the property of the holder and shall be removed not later than 90 days after the date on which the lease, permit, or right-of-way expires, unless the Fort Belknap Indian Community and the holder agree otherwise.</text></subparagraph> <subparagraph id="idb94136099cdb450a9c265a36e19c9093"><enum>(C)</enum><header>Eligibility</header><text>Notwithstanding paragraph (2), if, at any time after the date of enactment of this Act, the Fort Belknap Indian Community Council enters into a lease for any other State parcel or secures the written consent of each lessee of any other State parcel to the exchange of that parcel, the other State parcel shall be eligible for exchange and transfer under this subsection.</text></subparagraph></paragraph>
<paragraph id="id1a4cfd5f3f66459fae8a5fd4403bb46a"><enum>(7)</enum><header>Quantity of state land to be exchanged or transferred</header>
<subparagraph id="ida370a191fc104819b00398e5df7ca378"><enum>(A)</enum><header>On reservation</header><text>The total quantity of State land located within the boundaries of the Reservation that shall be exchanged and transferred under this subsection is 20,296.1 acres.</text></subparagraph> <subparagraph id="id7d620e3656cf493fb4c11068482e930e"><enum>(B)</enum><header>Off reservation</header><text>The total quantity of State land located outside of the boundaries of the Reservation that shall be exchanged and transferred under this subsection is 7,413 acres.</text></subparagraph>
<subparagraph id="id2cd74ec4a0ef4403b0b0f11f1b94c9c7"><enum>(C)</enum><header>Technical corrections</header><text>Notwithstanding the descriptions of the parcels of land owned by the State under paragraph (2), the State may, with the consent of the Fort Belknap Indian Community, make technical corrections to the land parcels to more specifically identify the acreage of the land parcels.</text></subparagraph></paragraph></subsection> <subsection id="id113a3a8517db4f73bfff4e301e3f9281"><enum>(b)</enum><header>Federal land transfers</header> <paragraph id="id4b2c2bd72a4f4f8383681634ffcfa442"><enum>(1)</enum><header>In general</header><text>In partial satisfaction of claims relating to Indian water rights covered by this Act, the Fort Belknap Indian Community agrees to the transfer of land in accordance with this subsection.</text></paragraph>
<paragraph id="idd92bd24c084745198aa0b20b6cd85eed"><enum>(2)</enum><header>Transfers</header>
<subparagraph id="idac862826961c4352b36da71fac4c21e1"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), on selection and request by the Fort Belknap Indian Community, the Secretary shall convey all Federal land within the parcels described in paragraph (3) to the Fort Belknap Indian Community by transfer to the United States, to be held in trust for the benefit of the Fort Belknap Indian Community as part of the Reservation.</text></subparagraph> <subparagraph id="idd0b91b0eba93439bae171b42efe4b654"><enum>(B)</enum><header>Valid existing rights</header><text>Any land subject to valid existing rights of a private fee landowner or the surface rights of any person under sections 2318 through 2352 of the Revised Statutes (commonly known as the <quote>Mining Law of 1872</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/30/21">30 U.S.C. 21</external-xref> et seq.), shall not be transferred under subparagraph (A).</text></subparagraph>
<subparagraph id="id0b430ab8b76c4d6c9d316b25ec8d17e5"><enum>(C)</enum><header>Withdrawal of Federal land from development and leasing</header><text>Subject to valid existing rights described in subparagraph (B), effective on the date of enactment of this Act, all Federal land within the parcels described in paragraph (3) shall be withdrawn from all forms of all forms of entry, appropriation, or disposal under the public land laws, location, entry, and patent under the mining laws, and disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text></subparagraph> <subparagraph id="id065b348ab1fb4c679b4aef46ba725c83"><enum>(D)</enum><header>Easements</header><text>Any road within a parcel described in paragraph (3) that is necessary for customary access to a fee parcel by the private fee landowner or owner of mineral rights shall be continued with guaranteed access to the private fee parcel or mineral rights through an easement at the expense of the fee owner or owner of the mineral rights.</text></subparagraph></paragraph>

<subparagraph id="idd05ce4a26ec04ec4b4afafb7dde9d776"><enum>(D)</enum><header>Dodson Land</header>
<clause id="id7b593adc7d704377b180a0b94fe6736f"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Dodson Land described in clause (iii) shall be transferred in accordance with paragraph (2)(A).</text></clause> <clause id="id3f5c3c7c725c4220a7ad85d087f076dc"><enum>(ii)</enum><header>Restrictions</header><text>A transfer under this subparagraph shall not occur unless and until a cooperative agreement has been negotiated among the Bureau of Reclamation, the Bureau of Indian Affairs, and the Fort Belknap Indian Community—</text>
<subclause id="id50130f01d59049feb3eec333e092aba8"><enum>(I)</enum><text>to ensure that the Bureau of Reclamation and any successor in interest, including the Malta Irrigation District, shall have adequate rights-of-way across the Dodson Land described in clause (iii) to carry out operations, maintenance, and rehabilitation, consistent with all applicable laws and any delivery contracts in effect on the date of enactment of this Act for the Milk River Project, on the conditions that—</text> <item id="ideb21e75579be4f5c90929398dbf2f860"><enum>(aa)</enum><text>the Bureau of Reclamation shall—</text>
<subitem id="idCCAB72E48CE644AE80F5E049FE4B9EFC"><enum>(AA)</enum><text>identify and provide legal descriptions of the location of the Dodson Project facilities; and</text></subitem> <subitem id="id62176c63e96d4f9cb978c534dc4425e7"><enum>(BB)</enum><text>delineate the rights-of-way across the Dodson Land and limit the rights-of-way to only such Dodson Land as is determined necessary and required for the operations, maintenance, and rehabilitation;</text></subitem></item>
<item id="id4c0544d2df284d489594eb4eacc95d49"><enum>(bb)</enum><text>the Fort Belknap Indian Community shall have legislative, regulatory, and adjudicatory jurisdiction over all the transferred land; and </text></item> <item id="id221e0028024a4d028862b94d3206a027"><enum>(cc)</enum><text>the Fort Belknap Indian Community shall have the right to use the Dodson Land for any purpose, on the condition that the use does not interfere with the Bureau of Reclamation facilities;</text></item></subclause>
<subclause id="id335f740a5e5f49dfad5d3e453e3c1b5b"><enum>(II)</enum><text>to manage and implement planning, design, and construction relating to rehabilitation, replacement, and repairs of existing Dodson Project facilities, as described in this section;</text></subclause> <subclause id="idbe734728e8904861a5040e8135c3d32e"><enum>(III)</enum><text>to ensure that the right of ingress and egress by personnel of the Bureau of Reclamation, the Malta Irrigation District (or a successor in interest to the Malta Irrigation District), and other authorized personnel for Milk River Project purposes is provided; and</text></subclause>
<subclause id="id639da83742724883a43310936fa68247"><enum>(IV)</enum><text>to provide that the Bureau of Reclamation shall retain ownership of any existing Milk River Project infrastructure.</text></subclause></clause> <clause id="ide4802eec208c4714a0427736bc51ba8c" commented="no"><enum>(iii)</enum><header>Description of Dodson Land</header> <subclause id="idb8f69e39c0fb4b80a748b5f386583f94"><enum>(I)</enum><header>In general</header><text>The Dodson Land referred to in clauses (i) and (ii) is the approximately 2,500 acres of land owned by the United States that is, as of the date of enactment of this Act, under the jurisdiction of the Bureau of Reclamation and located at the northeastern corner of the Reservation (which extends to the point in the middle of the main channel of the Milk River), where the Dodson Project facilities of the Milk River Project, including the Dodson Diversion Dam and Dodson South Canal, are located, and more particularly described as follows:</text>

<subclause id="idb7cd4d564c2743a7a6f2e64de56360cc" commented="no"><enum>(II)</enum><header>Clarification</header><text>The supplemental plats described in items (aa) through (dd) of subclause (I) are official plats, as documented by retracement boundary surveys of the General Land Office, and on record at, and accepted by, the Bureau of Land Management on March 11, 1938.</text></subclause></clause></subparagraph></paragraph> <paragraph id="ida42f66447a774b458f4a6c24a9d48a1b"><enum>(4)</enum><header>Existing rights and uses</header> <subparagraph id="id810c52153f7d4e78a424cd27cf5a6d85"><enum>(A)</enum><header>Uses</header> <clause id="idd12492d609fa4dba95380340b8042096"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), any use (including grazing) authorized under a valid lease, permit, or right-of-way on land transferred under this subsection, as in effect on the date of the transfer, shall remain in effect until the date on which the lease, permit, or right-of-way expires.</text></clause>
<clause id="idd203ed3e426841618472dcd1cf950395"><enum>(ii)</enum><header>Exception</header><text>Clause (i) shall not apply if the holder of the lease, permit, or right-of-way requests an earlier termination of the lease, permit, or right-of-way, in accordance with existing law.</text></clause></subparagraph> <subparagraph id="idf85f8c64170940b9988cbcd62d07183a"><enum>(B)</enum><header>Improvements</header><text>Any improvements constituting personal property (as defined by State law) on land transferred under this subsection by the holder of the lease, permit, or right-of-way—</text>
<clause id="id47d18a39cfdb4822994690322c0905d7"><enum>(i)</enum><text>shall remain the property of the holder; and</text></clause> <clause id="idcfffb99f78e1471ea87b9a13032f77ea"><enum>(ii)</enum><text>shall be removed not later than 90 days after the date on which the lease, permit, or right-of-way expires, unless the Fort Belknap Indian Community and the holder agree otherwise.</text></clause></subparagraph>
<subparagraph id="id361cd8de819c4360bd8f216ab98f83fd"><enum>(C)</enum><header>Payments</header><text>The Secretary shall disburse to the Fort Belknap Indian Community any amounts that accrue to the United States under a lease, permit, or right-of-way on land described in paragraph (3) from any sale, bonus, royalty, or rental relating to that land in the same manner as amounts received from other land held by the Secretary in trust for the Fort Belknap Indian Community.</text></subparagraph></paragraph> <paragraph id="id917f733d5f674a559c27a25d92fce88b"><enum>(5)</enum><header>Survey</header><text>With respect to the transfer of land under this subsection—</text>
<subparagraph id="id7cf2e2260d5647528915ebfac531bead"><enum>(A)</enum><text>notwithstanding the descriptions of the parcels of Federal land under paragraph (3), the United States may, with the consent of the Fort Belknap Indian Community, make technical corrections to the land parcels to more specifically identify the acreage of the land parcels;</text></subparagraph> <subparagraph id="id31225e55e8ce41509c8643d0a293dff7"><enum>(B)</enum><text>unless the United States or the Fort Belknap Indian Community request an additional survey for the transferred land or a technical correction is made under subparagraph (A), the description of land under this section shall be controlling; </text></subparagraph>
<subparagraph id="iddfd9ad4cd83b4e77a5b41feaea4835a6"><enum>(C)</enum><text>the Secretary shall provide such financial or other assistance as may be necessary—</text> <clause id="idE42F72A28A164A0895416633D1B84752"><enum>(i)</enum><text>to conduct additional surveys and obtain appraisals of the transferred land, including any mining claims; and </text></clause>
<clause id="idADD4FBB10C6249F8BFDE4710BE742A59"><enum>(ii)</enum><text>to satisfy administrative requirements necessary to accomplish the land transfers under this subsection; and </text></clause></subparagraph> <subparagraph id="idef51a96bdfe543c392a896a5331410a0"><enum>(D)</enum><text>the descriptions under this section or any survey under subparagraph (C) shall control the total acreage to be transferred.</text></subparagraph></paragraph>
<paragraph id="id17596032d77242c880b3d8b0fb8709d7"><enum>(6)</enum><header>Date of transfer</header>
<subparagraph id="ida06797c36d9e486eb8219c8e2a601b7b"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the transfer of land to the United States to be held in trust for the Fort Belknap Indian Community under this subsection shall take effect on the issuance of a trust deed, which shall be issued as expeditiously as practicable after notice of the enforceability date is published in the Federal Register.</text></subparagraph> <subparagraph id="idfe52ea96c9a947d5adaf78c9ac945928"><enum>(B)</enum><header>Completion</header><text>All land transfers under this subsection shall be completed by the Federal Government by not later than 10 years after the enforceability date.</text></subparagraph></paragraph>
<paragraph id="idbce25bb1f6514b17bc2c36aef2da265b"><enum>(7)</enum><header>Total amount of federal land to be transferred</header><text>The total amount of Federal land to be transferred by the Federal Government under this subsection is approximately 30,844 acres.</text></paragraph></subsection> <subsection id="id3d54e50658694309bd2739e1d7bee7dc"><enum>(c)</enum><header>Foreclosed Department of Agriculture land</header><text>Any Department of Agriculture trust land within the Reservation that has been or is foreclosed on by the United States shall be transferred to the United States to be held in trust for the Fort Belknap Indian Community by—</text>
<paragraph id="id2826ce309acd4b698e46f623a9a3435f"><enum>(1)</enum><text>not later than 10 years after the enforceability date, if the foreclosure occurs before the enforceability date; or</text></paragraph> <paragraph id="idf2bae1d016044df0ac7cb198809ec5bc"><enum>(2)</enum><text>not later than 10 years after the date of the foreclosure, if the foreclosure occurs after the enforceability date.</text></paragraph></subsection>
<subsection id="id2a11cd66616143ae92287fa3c35747ed"><enum>(d)</enum><header>Impacts on local governments</header><text>The Secretary may, at the discretion of the Secretary, try to ensure that land to be exchanged under this section is selected in a manner that minimizes the financial impact of the exchange on local governments.</text></subsection> <subsection id="idc7cd764fef5540a48f50ba6d33033f52"><enum>(e)</enum><header>Tribally owned fee land</header><text>Not later than 10 years after the enforceability date, the Secretary shall take into trust for the benefit of the Fort Belknap Indian Community all fee land owned by the Fort Belknap Indian Community to become part of the Reservation. </text></subsection>
<subsection id="id677fa09e2eb84fb49c7c41570948d081" commented="no"><enum>(f)</enum><header>Water rights</header><text>Beginning on the date of the applicable transfer of land to the United States to be held in trust for the Fort Belknap Indian Community under this section, if any Federal, State, or fee land transferred under this section is subject to a water right in existence on the date of the transfer, the United States, as trustee for the benefit of the Fort Belknap Indian Community, shall be the successor in interest with respect to the water right, in accordance with the terms and conditions that applied to the predecessor in interest.</text></subsection> <subsection id="idf7b4f5295eb84edf9673e892e2a1d833"><enum>(g)</enum><header>Transfer of title</header><text>Title to all land acquired by and owned by the United States and title to all tribally owned fee land included under this section shall be transferred, without charge, to the United States, to be held in trust for the benefit of the Fort Belknap Indian Community as part of the Reservation, pursuant to such method of conveyance as the Secretary determines to be necessary. </text></subsection>
<subsection id="id5883d10065474cc0b7c41f2ae78c35c3"><enum>(h)</enum><header>Jurisdiction of Grinnell lands</header>
<paragraph id="id46b6d747018740b4a2e78a7403c18b3f"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of Federal law, beginning on the date on which the conditions described in paragraph (2) are met, the Fort Belknap Indian Community Council shall have administrative, regulatory, and judicial jurisdiction over the Grinnell Lands described in subsection (b)(3)(C), including jurisdiction over public recreational access, hunting, and fishing, and natural resource management.</text></paragraph> <paragraph id="id4193b57144b8468c9d81c9bb053a8a6d"><enum>(2)</enum><header>Conditions</header><text>The conditions referred to in paragraph (1) are the conditions that the Fort Belknap Indian Community Council shall adopt—</text>
<subparagraph id="id910d48f1df794af1b1d82fe85ed9a18b"><enum>(A)</enum><text>hunting and fishing laws that grant nontribal members equivalent rights and privileges to those that nontribal members enjoy under the hunting and fishing laws (including regulations) of the State, as in effect on the date of enactment of this Act, including rights relating to permit fees and bag limits; and</text></subparagraph> <subparagraph id="id7fc7cc116d774cc3973c6a66b39d7202"><enum>(B)</enum><text>public recreational access laws that grant nontribal members equivalent rights of access for recreational purposes that nontribal members enjoy under Federal law (including regulations), as in effect on the date of enactment of this Act.</text></subparagraph></paragraph>
<paragraph id="ide8d9fc52b1d94411bc5315498b5fcb7a"><enum>(3)</enum><header>Tribal laws</header>
<subparagraph id="id4d25015a46864f78b8fd4c52c82d456e"><enum>(A)</enum><header>In general</header><text>Any Tribal laws promulgated by the Fort Belknap Indian Community pursuant to the jurisdiction of the Fort Belknap Indian Community under paragraph (1) shall be subject to—</text> <clause id="id614b0baf445f460486afe62dcc4057b7"><enum>(i)</enum><text>a 30-day notice and comment period provided by the Secretary to the State; and</text></clause>
<clause id="idca62d95c8dd74b6ca38558b7c5818be5"><enum>(ii)</enum><text>after that period, the approval of the Secretary, subject to subparagraph (B).</text></clause></subparagraph> <subparagraph id="id2b0ebd164ce344d3bf29bf76bbdba83e"><enum>(B)</enum><header>Secretarial approval</header><text>Not later than 180 days after the date on which the notice and comment period under subparagraph (A)(i) ends, the Secretary shall approve or disapprove the Tribal law.</text></subparagraph></paragraph>
<paragraph id="id32e26cb459be413f86a8391582544ca0"><enum>(4)</enum><header>Notification after federal or state amendment</header>
<subparagraph id="id66a2b2da1dbe411c93b756c87e2e4585"><enum>(A)</enum><header>In general</header><text>If an applicable Federal or State hunting and fishing or recreational access law or regulation is amended after the date on which jurisdiction over that law or regulation on the Grinnell Lands described in subsection (b)(3)(C) is transferred to the Fort Belknap Indian Community Council under this subsection, the head of the appropriate Federal or State agency, as applicable, shall promptly notify the Fort Belknap Indian Community Council of the amendment.</text></subparagraph> <subparagraph id="id88001d86f64d4b2bb214a642fc8d2658"><enum>(B)</enum><header>Response</header> <clause id="id859bd3a6affb4dcf8eb24efd50fe03d4"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), not later than 120 days after the date on which notification is provided to the Fort Belknap Indian Community Council under subparagraph (A), the Fort Belknap Indian Community Council shall—</text>
<subclause id="id6c08e6107ee54867bb3d29285e80bdd3"><enum>(I)</enum><text>amend the Tribal law of the Fort Belknap Indian Community Council to comply with the amended law or regulation; and</text></subclause> <subclause id="id277483d1e99a40e8b97c859462238f19"><enum>(II)</enum><text>notify the Secretary of the amendment.</text></subclause></clause>
<clause id="id42fac829c9fe42a893ab6e84bb71e4f0"><enum>(ii)</enum><header>Secretarial action</header><text>The Secretary shall—</text> <subclause id="id41fc6d3b2e3c43238025f9a26488dd0d"><enum>(I)</enum><text>approve or disapprove an amendment under clause (i)(I) by not later than 90 days after the date on which the Secretary receives notice of the amendment under clause (i)(II); and</text></subclause>
<subclause id="idb02711e8315b478ca5e536485f5466b9"><enum>(II)</enum><text>notify the Fort Belknap Indian Community of the decision of the Secretary by not later than 15 days after the date on which the Secretary makes the decision and, if disapproved, provide the reasons for disapproval.</text></subclause></clause> <clause id="idba1b3b0e01db40c9bd147f8b751b9180"><enum>(iii)</enum><header>No action</header><text>If the Secretary does not disapprove the amendment under clause (ii)(I) and notify the Fort Belknap Indian Community of the disapproval by the deadline described in clause (ii)(II), the amendment shall be deemed to be approved.</text></clause>
<clause id="id7e180c54735d4e8cab61d51736d961e6"><enum>(iv)</enum><header>Failure to respond</header><text>If the Fort Belknap Indian Community Council fails to comply with clause (i), regulatory jurisdiction shall revert to the United States under paragraph (1) until the earlier of—</text> <subclause id="id09bd125146954347835188b9ca920706"><enum>(I)</enum><text>such time as the Tribal laws of the Fort Belknap Indian Community comply with the amended Federal or State law or regulation; and</text></subclause>
<subclause id="id9a242de165ae4c8fa1615bb9cfaf3226"><enum>(II)</enum><text>the date described in paragraph (5).</text></subclause></clause> <clause id="id271133e6adb64382b2b4a07636bff5b1"><enum>(v)</enum><header>Extensions</header><text>Notwithstanding any other provision of law, a deadline described in clause (i) or clause (ii) may be extended or otherwise altered by the Secretary if, before the applicable deadline, the Secretary obtains the voluntary and express written consent of the Fort Belknap Indian Community to extend or otherwise alter the deadline.</text></clause></subparagraph></paragraph>
<paragraph id="idbb9fec5e36c74d8b975d3d633acb71f7"><enum>(5)</enum><header>Regulation by Fort Belknap Indian Community council</header><text>Notwithstanding any other provision of law, beginning on the date that is 25 years after the date of enactment of this Act—</text> <subparagraph id="id94a41ea065314c53ad9ee9759e3084b9"><enum>(A)</enum><text>the Fort Belknap Indian Community Council may regulate the Grinnell Lands described in subsection (b)(3)(C) under, and according to, Tribal law, subject to such approval by the Secretary as may be required for any other Tribal law; and</text></subparagraph>
<subparagraph id="idf7b59b20cb63477d9864d0aa9169c795"><enum>(B)</enum><text>the other provisions of this subsection shall not apply.</text></subparagraph></paragraph></subsection> <subsection id="id795c7bbda85344f39752fd4a9ebd7896"><enum>(i)</enum><header>Environmental analysis</header><text>Notwithstanding section 4(c), in preparing an environmental assessment or environmental impact statement pursuant to section 102(2) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)</external-xref>) for the acquisition of State land parcels and the conveyance of Federal land under this section, the Secretary shall only be required to study, develop, and describe—</text>
<paragraph id="id09e3ae8e64704ccfa250ebdf56a36783"><enum>(1)</enum><text>the proposed agency action; and</text></paragraph> <paragraph id="idd7f2a02799c84a9d97e5741862a5b160"><enum>(2)</enum><text>the alternative of no action.</text></paragraph></subsection>
<subsection id="idad2e1f658ee346b4b206eee99bc53e20"><enum>(j)</enum><header>Land status</header><text>All land held in trust by the United States for the benefit of the Fort Belknap Indian Community under this section shall be—</text> <paragraph id="idb7cc367696d846fcb938439197bb3548"><enum>(1)</enum><text>beneficially owned by the Fort Belknap Indian Community; and</text></paragraph>
<paragraph id="id42bff451ef61437b8eba3c97f0d81533"><enum>(2)</enum><text>added to and made a part of the Reservation for the use by, and benefit of, the Fort Belknap Indian Community. </text></paragraph></subsection> <subsection id="id9733d5f46e8740a38ea716b2b6745210"><enum>(k)</enum><header>Authorization of appropriations</header> <paragraph id="id9D37F9B32AFC4924860F9DC86265394B"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary for the administrative costs of carrying out this section $5,000,000 for each of fiscal years 2022 through 2024, without further charge to the Fort Belknap Indian Community. </text></paragraph>
<paragraph id="id9076723376684B60BBEE1775D0759474"><enum>(2)</enum><header>Limitation</header><text>The amounts made available under paragraph (1) shall be in addition to any other amounts made available under this Act to carry out the exchanges and transfers of land under this section. </text></paragraph></subsection></section> <section id="id37d4edddcc994ccdbdb9edc2ed4aa9b8"><enum>7.</enum><header>Storage allocation from Lake Elwell</header> <subsection id="id2a6ba7728da740ebbe0bb81e5639fb44"><enum>(a)</enum><header>Storage allocation of water to fort belknap indian community</header> <paragraph id="ide559c92240c643b1a99310fd6f8df81d"><enum>(1)</enum><header>In general</header><text>The Secretary shall permanently allocate to the Fort Belknap Indian Community 20,000 acre-feet per year of water stored in Lake Elwell for use by the Fort Belknap Indian Community for any beneficial purpose on or off the Reservation, under a water right held by the United States and managed by the Bureau of Reclamation for the benefit of the Fort Belknap Indian Community, as measured—</text>
<subparagraph id="id7188febc7cf34a9bb148db0ffbd80e65"><enum>(A)</enum><text>by direct diversion from the Reservoir or at the outlet works of the Tiber Dam;</text></subparagraph> <subparagraph id="idfb5b320d6e8c41f18d0df08c8371d7f4"><enum>(B)</enum><text>by direct diversion from any place in the Marias River downstream of Lake Elwell; or</text></subparagraph>
<subparagraph id="id14a801f105df425282e614da4b3d68c2"><enum>(C)</enum><text>by direct diversion from any place in the Missouri River downstream of the confluence of the Missouri River and the Marias River.</text></subparagraph></paragraph> <paragraph id="id63e0381072774c7483dbf1326694cdd1"><enum>(2)</enum><header>Source of allocation</header> <subparagraph id="id84387f19f4914269abd44116ddddeb82"><enum>(A)</enum><header>In general</header><text>For each applicable year, the Fort Belknap Indian Community shall take the allocation under paragraph (1) from the active conservation pool or the joint-use pool of the reservoir in such quantities as are sufficient to satisfy the total annual allocation.</text></subparagraph>
<subparagraph id="id6ebab2dd59a14737855e89ea8fcaa48d"><enum>(B)</enum><header>Priority</header><text>The allocation under paragraph (1) to the Fort Belknap Indian Community shall take priority over any and all instream flow and recreational uses of the applicable water.</text></subparagraph></paragraph></subsection> <subsection id="id715fe2c7df5c4b60adc7091e1d66a0d2"><enum>(b)</enum><header>Treatment</header> <paragraph id="id43e9185a9c8c4eb9b75fb11957ee653b"><enum>(1)</enum><header>In general</header><text>The allocation under subsection (a) to the Fort Belknap Indian Community shall be considered to be a part of the Tribal water rights.</text></paragraph>
<paragraph id="id00c0572d27134cf3adf93a07726b26a7"><enum>(2)</enum><header>Priority date</header><text>The priority date of the allocation under subsection (a) to the Fort Belknap Indian Community shall be the priority date of the Lake Elwell water right held by the Bureau of Reclamation.</text></paragraph> <paragraph id="id2f5464db9b3b433aa7cd4e93cd87e10a"><enum>(3)</enum><header>Administration</header> <subparagraph id="id8a162d0326234bdfa0d177a53b667a23"><enum>(A)</enum><header>In general</header><text>The Fort Belknap Indian Community shall administer the water allocated under subsection (a) in accordance with—</text>
<clause id="id862eea19b96b4cdc8b5107201abb6a4b"><enum>(i)</enum><text>the Compact;</text></clause> <clause id="idfed367d3ddeb4574be7e308f709fb89d"><enum>(ii)</enum><text>this Act; and</text></clause>
<clause id="id768b53bb05b045dd9edd48116422fb90"><enum>(iii)</enum><text>Tribal law.</text></clause></subparagraph> <subparagraph id="idb35ba268b55f43d5af54c39ef637b4e5"><enum>(B)</enum><header>Temporary transfer</header><text>In accordance with subsection (d), the Fort Belknap Indian Community may temporarily transfer off the Reservation, by service contract, lease, exchange, or other agreement, the water allocated under subsection (a), subject to—</text>
<clause id="id28729dc94de14ec98dcd53c3c5a9d274"><enum>(i)</enum><text>the approval of the Secretary; and</text></clause> <clause id="id482a047db0b94a86a0aba343a9ad4f7c"><enum>(ii)</enum><text>the requirements of the Compact.</text></clause></subparagraph>
<subparagraph id="id117af418c5ff4e6da3bd2162943a4dc7"><enum>(C)</enum><header>Exception</header><text>Notwithstanding subparagraph (A), paragraphs (1) through (3) of article IV.A.5.b. of the Compact shall not apply to any annual allocation under this subsection, except to the extent that article limits the use of the allocation to a location within the Missouri River Basin.</text></subparagraph></paragraph></subsection> <subsection id="idc0dc792e63dd4149ac4977417d830edc"><enum>(c)</enum><header>Allocation agreement</header> <paragraph id="id5bac68bd77fb45d09d445203dbc0d427"><enum>(1)</enum><header>In general</header><text>As a condition of receiving an allocation under this section, the Fort Belknap Indian Community shall enter into an agreement with the Secretary to establish the terms and conditions of the allocation, in accordance with the Compact and this Act.</text></paragraph>
<paragraph id="iddbed560c22cd42fe8a4b14a06ab41f7c"><enum>(2)</enum><header>Inclusions</header><text>The agreement under paragraph (1) shall include provisions establishing that—</text> <subparagraph id="idaf52ed608a304cdf806f44ca713a456c"><enum>(A)</enum><text>the agreement shall be without limit as to term;</text></subparagraph>
<subparagraph id="idaa31e86f48c14010b1ffbafe3dec86ae"><enum>(B)</enum><text>the Fort Belknap Indian Community, and not the United States, shall be entitled to all consideration due to the Fort Belknap Indian Community under any lease, contract, or agreement entered into by the Fort Belknap Indian Community pursuant to subsection (d);</text></subparagraph> <subparagraph id="ida5ed10d2457442fea887914340a35b25"><enum>(C)</enum><text>the United States shall have no obligation to monitor, administer, or account for—</text>
<clause id="idace90634b2d74344baa29fcb3d780daf"><enum>(i)</enum><text>any funds received by the Fort Belknap Indian Community as consideration under any lease, contract, or agreement entered into by the Fort Belknap Indian Community pursuant to subsection (d); or</text></clause> <clause id="id92a49731813945f9ab329caf52931d3c"><enum>(ii)</enum><text>the expenditure of those funds;</text></clause></subparagraph>
<subparagraph id="id16090fdefa774d20aca93303aaacea52"><enum>(D)</enum><text>if the capacity or function of Lake Elwell facilities are significantly reduced, or are anticipated to be significantly reduced, for an extended period of time, the Fort Belknap Indian Community shall have the same storage rights as other storage contractors with respect to the allocation under this section;</text></subparagraph> <subparagraph id="idd71b749ade8a47ed83c3be8b18ce6349"><enum>(E)</enum><text>the costs associated with the construction of the storage facilities at Tiber Dam allocable to the Fort Belknap Indian Community shall be nonreimbursable;</text></subparagraph>
<subparagraph id="ided4cd302e3674fdf8dc58c4cc2c8661f"><enum>(F)</enum><text>no water service capital charge shall be due or payable for any water allocated to the Fort Belknap Indian Community under this section or the allocation agreement, regardless of whether that water is delivered for use by the Fort Belknap Indian Community or under a service contract, lease, exchange, or other agreement entered into by the Fort Belknap Indian Community pursuant to subsection (b)(3)(B);</text></subparagraph> <subparagraph id="ide301fe2048364bb18066b9b67d43aabd"><enum>(G)</enum><text>the Fort Belknap Indian Community shall not be required to make payments to the United States for any water allocated to the Fort Belknap Indian Community under this section or the allocation agreement, except for each acre-foot of stored water leased or transferred for industrial purposes as described in subparagraph (H); and</text></subparagraph>
<subparagraph id="id1a133101214f4c11acf3584d70749944"><enum>(H)</enum><text>for each acre-foot of stored water leased or transferred by the Fort Belknap Indian Community for industrial purposes—</text> <clause id="idec347ec2c3cc4bb5b4d886d25e7d4044"><enum>(i)</enum><text>the Fort Belknap Indian Community shall pay annually to the United States an amount necessary to cover the proportional share of the annual operations and maintenance costs, but not replacement and construction costs, allocable to the quantity of water leased or transferred by the Fort Belknap Indian Community for industrial purposes; and</text></clause>
<clause id="idcc6a533a2d9a43dc9d48b0987b8b0dd6"><enum>(ii)</enum><text>the annual payments of the Fort Belknap Indian Community shall be reviewed and adjusted, as appropriate, to reflect the actual operations, maintenance, and rehabilitation costs for Tiber Dam. </text></clause></subparagraph></paragraph></subsection> <subsection id="ida93180d2d11641c0b5a6e103aa0d32ad"><enum>(d)</enum><header>Agreement by Fort Belknap Indian Community</header><text>The Fort Belknap Indian Community may use, lease, contract, exchange, or enter into any other agreement for the use of the water allocated to the Fort Belknap Indian Community under subsection (a) if—</text>
<paragraph id="id1262d78545b44abcab0f8dce8021405f"><enum>(1)</enum><text>the use of water that is the subject of such an agreement occurs within the Missouri River Basin; and</text></paragraph> <paragraph id="id95d484ad7ddc4892984df20bdac39470"><enum>(2)</enum><text>the agreement does not permanently alienate any water allocated to the Fort Belknap Indian Community under subsection (a).</text></paragraph></subsection>
<subsection id="id0fbaf337c7d149088c7a4e420b68818e"><enum>(e)</enum><header>Effective date</header><text>The allocation under subsection (a) takes effect on the enforceability date.</text></subsection> <subsection id="idd40d55cbcc6d4c358a90253e1e054b8c"><enum>(f)</enum><header>No carryover storage</header><text>The allocation under subsection (a) shall not be increased by any unused Fort Belknap Indian Community Tribal water rights from year-to-year carryover storage.</text></subsection>
<subsection id="idad663eadc2494079ba500f67fcc2dea1"><enum>(g)</enum><header>Water development and delivery</header>
<paragraph id="id25222d740ddf4fb3ab3b6d56bc167697"><enum>(1)</enum><header>Obligation to provide facility for transport to reservation</header><text>Except as otherwise provided in this Act, the United States shall have no obligation under this Act to provide any facility for the transport to the Reservation or any other location of the water allocated under this section to the Fort Belknap Indian Community relating to the release of Tribal water rights from Lake Elwell Dam and Reservoir in accordance with a request from the Fort Belknap Indian Community.</text></paragraph> <paragraph id="id6316002b83b54735900a14e3e3ff5649"><enum>(2)</enum><header>Development and delivery costs</header><text>Except for the use of Federal amounts made available under section 8, the United States is not required to pay the cost of developing or delivering to the Reservation any water allocated under subsection (a).</text></paragraph>
<paragraph id="id438e8adefd994e4394a4b853213616b8"><enum>(3)</enum><header>Water delivery</header><text>If Lake Elwell does not have enough stored water available to satisfy the annual obligation under subsection (a), the Fort Belknap Indian Community shall have the right to divert a quantity of water equal to the quantity of water unable to be allocated from Lake Elwell for that year from—</text> <subparagraph id="id7A2D04F8DE014DC48D656662F5A2D67D"><enum>(A)</enum><text>any place and at any time in the Marias River downstream of the Lake Elwell Dam; and </text></subparagraph>
<subparagraph id="id8C2880653D5E423E87B35D47243ED51B"><enum>(B)</enum><text>any place and at any time in the Missouri River downstream of the confluence of the Missouri River and the Marias River.</text></subparagraph></paragraph></subsection></section> <section id="id0ece0883e3004bc4a9839434af4235e4"><enum>8.</enum><header>Milk River Project</header> <subsection id="id0d42785e979d47e991b9fcf1812bb37b"><enum>(a)</enum><header>Milk river project modifications</header> <paragraph id="id5e7a491f4ce4489593b7fecfb48a91c5"><enum>(1)</enum><header>Procedures</header> <subparagraph id="id4335b5325d2745dd84fc3d9ba754a051"><enum>(A)</enum><header>In general</header><text>The Commissioner, in consultation with the Assistant Secretary for Indian Affairs, the Fort Belknap Indian Community, the Joint Board, and other affected stakeholders, shall modify the operating procedures of the Milk River Project as the Commissioner determines to be necessary to ensure that the Fresno Reservoir is operated in accordance with article III.A.2. and article IV.E. of the Compact.</text></subparagraph>
<subparagraph id="id2ac7f8e200b84b8fabc898a48bb85b9c"><enum>(B)</enum><header>1946 Fresno Reservoir agreement</header>
<clause id="id59ebe88e11ca41fb8d9200ecc1e36545"><enum>(i)</enum><header>In general</header><text>The Commissioner shall carry out such actions as the Commissioner determines to be necessary to provide an accounting of the <fraction>1/7</fraction> share of the Fort Belknap Indian Community to the Fresno Reservoir total quantity of stored water available for use during each irrigation season from the waters of the Milk River Project that are impounded and stored in the Fresno Reservoir under the agreement between the Commissioner and the Assistant Secretary of Indian Affairs relating to the Milk River Project, numbered I–1–Ind. 18725, and dated July 8, 1946.</text></clause> <clause id="id10BFC4EB43B54F42A89A660A797184B0"><enum>(ii)</enum><header>Requirement</header><text>The accounting under clause (i) shall include monthly calculations of the <fraction>1/7</fraction> share of stored water of the Fort Belknap Indian Community.</text></clause>
<clause id="idcbdb35572d65469b95f4105d38cee543"><enum>(iii)</enum><header>Additional considerations</header><text>In addition to the <fraction>1/7</fraction> share described in clause (i), the Commissioner shall take into consideration and fully account for the right of the Fort Belknap Indian Community to the Milk River consistent with article III.A.1. of the Compact.</text></clause> <clause id="id293de9c9499c4888a7b1655a6625c530"><enum>(iv)</enum><header>Downstream release</header><text>Any water stored on behalf of the Fort Belknap Indian Community in the Fresno Reservoir that is available at the end of each irrigation season shall be released downstream, in a manner to be determined by the Fort Belknap Indian Community, for storage in the proposed Fort Belknap Reservoir.</text></clause>
<clause id="iddfd7ab619735483bbebe119312341b04"><enum>(v)</enum><header>Amendments</header><text>The Commissioner and the Assistant Secretary for Indian Affairs may jointly amend the agreement referred to in clause (i) as the Commissioner and the Assistant Secretary determine to be necessary to provide for an equitable accounting of the share of the Fort Belknap Indian Community described in clause (i).</text></clause></subparagraph></paragraph> <paragraph id="id701bbb4939c34a7c8d46ce731b73d048"><enum>(2)</enum><header>Facilities</header><text>The Secretary may make such modifications to the federally owned facilities of the Milk River Project as the Secretary determines to be necessary to satisfy the applicable mitigation requirements of the Compact.</text></paragraph>
<paragraph id="idb328f65301a845c0892c5d8bd9d2fa66"><enum>(3)</enum><header>Costs</header><text>The Secretary shall retain the fiscal responsibilities described in the agreement described in paragraph (1)(B)(i), including the responsibility for construction costs and annual operation and maintenance charges, that support the continued right of the Fort Belknap Indian Community to the <fraction>1/7</fraction> share of water stored in the Fresno Reservoir.</text></paragraph></subsection> <subsection id="ide9ce2c079c504d6fad5fff17a96748d9"><enum>(b)</enum><header>Milk river coordinating committee</header> <paragraph id="id1b907ba44a00484da0c6c54b30db0701"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Commissioner, the Director of the Bureau of Indian Affairs, the Director of the United States Geological Survey, the Director of the United States Fish and Wildlife Service, and the Director of the Bureau of Land Management, may participate in the Milk River Coordinating Committee pursuant to article IV.C. of the Compact.</text></paragraph>
<paragraph id="ide2c2cbac15b544e0b2c7a310b2854bd7"><enum>(2)</enum><header>Inapplicability of federal advisory committee act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Milk River Coordinating Committee.</text></paragraph> <paragraph id="id3fa719b5404e4df69df7b9ecc814877a"><enum>(3)</enum><header>Technical support</header><text>The Secretary may—</text>
<subparagraph id="idf47ef1b33b30465cb80ea9d46438d5ed"><enum>(A)</enum><text>maintain a publicly accessible database of diversions from the Milk River made—</text> <clause id="id566dea437d9141e3ae0956a7f6b11e16"><enum>(i)</enum><text>pursuant to the Milk River Project;</text></clause>
<clause id="idcfffa280fdcd4da6bf358ced2549aade"><enum>(ii)</enum><text>under applicable contracts; and</text></clause> <clause id="id2f91d8e6105b405a9b7eea51d3f803bc"><enum>(iii)</enum><text>by the Fort Belknap Indian Community; and</text></clause></subparagraph>
<subparagraph id="id4603f903b92547fdae993688c87c27fa"><enum>(B)</enum><text>provide such other technical support as the Milk River Coordinating Committee may request, including the maintenance of gages necessary to account for daily diversions from the Milk River.</text></subparagraph></paragraph> <paragraph id="ida120c033fba549b28e885337141c03a4"><enum>(4)</enum><header>Coordination of storage and release</header><text>Notwithstanding article IV.C.11. of the Compact, the Secretary (acting through the Commissioner), and in consultation with the Milk River Coordinating Committee, shall develop an accounting for the coordination of storage and release of water from Federal storage facilities within the federally owned portion of the Milk River Project.</text></paragraph></subsection>
<subsection id="idd7b7834880ca445ca660b89e5dd829b9"><enum>(c)</enum><header>Milk river project mitigation</header>
<paragraph id="iddcc0d1c829b348aca1906f486c3fd9a8"><enum>(1)</enum><header>Costs</header>
<subparagraph id="id4DC129CAEB7540C9939C2E6745DBE218"><enum>(A)</enum><header>In general</header><text>Consistent with the agreement of the Federal Government, the State, and the Fort Belknap Indian Community to provide mitigation measures to address impacts on the water users of the Milk River Project, in accordance with article VI.B. of the Compact and this Act—</text> <clause id="id5c4269bb35b44595806d970909d052f4"><enum>(i)</enum> <subclause commented="no" display-inline="yes-display-inline" id="id015FFACF51744B75B74EDEA351A8A7EE"><enum>(I)</enum><text>except as provided in subclause (II), the total cost of such mitigation measures shall not exceed $69,500,000, adjusted to reflect changes in construction cost indices from January 1, 2021, that are applicable to the types of construction involved in the activities described for mitigation activities; and</text></subclause>
<subclause id="idDBEAF330308E4D1CB6619F5EDF726B88" indent="up1"><enum>(II)</enum><text>if the studies by the State and Federal Government require a cost to support such mitigation measures that is greater than $69,500,000, the total cost of such mitigation shall be such amount as is identified in the studies, and such amount is hereby approved; and </text></subclause></clause> <clause id="id246f2acbf58f410abe5728aac7472db0"><enum>(ii)</enum><text>the State and the Federal Government shall enter into a cost-share agreement by not later than 1 year after the date of enactment of this Act to contribute to the cost of such mitigation measures.</text></clause></subparagraph>
<subparagraph id="id4BC205CC37844125BEB3E757028A762D"><enum>(B)</enum><header>Treatment of amounts paid</header><text>Any amount paid by the State or the Federal Government under the cost-share agreement entered into pursuant to clause (ii) of subparagraph (A) shall be counted toward the fulfillment of the obligation of the State or the Federal Government, respectively, under the agreement described in the matter preceding clause (i) of that subparagraph. </text></subparagraph></paragraph> <paragraph id="idac7ad0368b594d3e8f20aa44a751e254"><enum>(2)</enum><header>Compliance with NEPA</header><text>The Secretary shall ensure that each project that receives Federal funds under this subsection is carried out in accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text></paragraph>
<paragraph id="idfdd11e7b2831430b9169366a948f4c43"><enum>(3)</enum><header>Expenditure of funds</header><text>Subject to applicable State law, funds provided by the State under this subsection may be expended at any time after the date on which funds are provided.</text></paragraph> <paragraph id="id43be7c4e89b64717bf204348d7fa693a"><enum>(4)</enum><header>Report</header><text>Not less frequently than once each year, the Secretary shall request that the State submit to the Fort Belknap Indian Community an accounting of any funds expended by the State under this subsection during the preceding calendar year.</text></paragraph></subsection>
<subsection id="id1ccac488ff964cd9b5dc751c43b3a4e2"><enum>(d)</enum><header>Tribal agreement between the Fort Belknap Indian Community and the Blackfeet Tribe related to the Milk River</header><text>Section 3705(e)(1) of the Blackfeet Water Rights Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; 130 Stat. 1818) is amended by striking <quote>shall establish,</quote> and inserting <quote>shall establish, by not later than 4 years after the date on which that 3-year period ends,</quote>.</text></subsection></section> <section id="id66f4bcd9d3754fc7bfba4c3b45854425"><enum>9.</enum><header>Satisfaction of claims</header> <subsection id="idc057550df6184506a9b68ac20aee2169"><enum>(a)</enum><header>In general</header><text>The benefits provided under this Act shall be in complete replacement of, complete substitution for, and full satisfaction of any claim of the Fort Belknap Indian Community against the United States that is waived and released by the Fort Belknap Indian Community under section 10(a).</text></subsection>
<subsection id="id90833535f9b74d05bcfe4ffef61045ac"><enum>(b)</enum><header>Allottees</header><text>The benefits realized by the allottees under this Act shall be in complete replacement of, complete substitution for, and full satisfaction of—</text> <paragraph id="id3f95bdb4baa84afda741d0a8cd924af0"><enum>(1)</enum><text>all claims waived and released by the United States (acting as trustee for the allottees) under section 10(a)(2); and</text></paragraph>
<paragraph id="id08cdf2dd0d784646a85bd690b91f050e"><enum>(2)</enum><text>any claims of the allottees against the United States similar to the claims described in section 10(a)(2) that the allottee asserted or could have asserted.</text></paragraph></subsection></section> <section id="id1de190281c5e4eaaba146fe5af310063"><enum>10.</enum><header>Waivers and releases of claims</header> <subsection id="idfc953a6fefa2434cb5f7328c422ba466"><enum>(a)</enum><header>In general</header> <paragraph id="id085d77f697fe481d96d0a947104dfa49"><enum>(1)</enum><header>Waiver and release of claims by the fort belknap indian community and united states as trustee for the fort belknap indian community</header><text>Subject to the reservation of rights and retention of claims under subsection (d), as consideration for recognition of the Tribal water rights and other benefits described in the Compact and this Act, the Fort Belknap Indian Community, acting on behalf of the Fort Belknap Indian Community and members of the Fort Belknap Indian Community (but not any member of the Fort Belknap Indian Community as an allottee), and the United States, acting as trustee for the Fort Belknap Indian Community and the members of the Fort Belknap Indian Community (but not any member of the Fort Belknap Indian Community as an allottee), shall execute a waiver and release of all claims for water rights within the State that the Fort Belknap Indian Community, or the United States acting as trustee for the Fort Belknap Indian Community, asserted or could have asserted in any proceeding, including a State stream adjudication, on or before the enforceability date, except to the extent that such rights are recognized in the Compact and this Act.</text></paragraph>
<paragraph id="id23cd0920e30d446a896b651c5a169fa2"><enum>(2)</enum><header>Waiver and release of claims by the united states as trustee for allottees</header><text>Subject to the reservation of rights and the retention of claims under subsection (d), as consideration for recognition of the Tribal water rights and other benefits described in the Compact and this Act, the United States, acting as trustee for the allottees, shall execute a waiver and release of all claims for water rights within the Reservation that the United States, acting as trustee for the allottees, asserted or could have asserted in any proceeding, including a State stream adjudication, on or before the enforceability date, except to the extent that such rights are recognized in the Compact and this Act.</text></paragraph> <paragraph id="id44230d5b6cd246cfb7a4d489b3745506"><enum>(3)</enum><header>Waiver and release of claims by the fort belknap indian community against the united states</header><text>Subject to the reservation of rights and retention of claims under subsection (d), the Fort Belknap Indian Community, acting on behalf of the Fort Belknap Indian Community and members of the Fort Belknap Indian Community (but not any member of the Fort Belknap Indian Community as an allottee), shall execute a waiver and release of all claims against the United States (including any agency or employee of the United States) relating to—</text>
<subparagraph id="id63c8fdd230a34d08a1b07cef2e6ec57f"><enum>(A)</enum><text>water rights within the State that the United States, acting as trustee for the Fort Belknap Indian Community, asserted or could have asserted in any proceeding, including a general stream adjudication in the State, except to the extent that such rights are recognized as Tribal water rights under this Act;</text></subparagraph> <subparagraph id="id829ec8da083f4496aafedbdc3c9dd992"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="id0ea6d5a2f6ac457c907245752e5b42dd"><enum>(i)</enum><text>damage, loss, or injury to water, water rights, land, or natural resources due to loss of water or water rights, including damages, losses, or injuries to hunting, fishing, gathering, or cultural rights, if the claim first accrued on or before the enforceability date;</text></clause>
<clause id="id737820e61f644dc5b259e4e8c5b8a2e7"><enum>(ii)</enum><text>interference with, diversion of, or taking of water, if the claim first accrued on or before the enforceability date; or</text></clause> <clause id="idc4c848952e384140a1daecc8190ff64c"><enum>(iii)</enum><text>failure to protect, acquire, replace, or develop water, water rights, or water infrastructure within the State, if the claim first accrued on or before the enforceability date;</text></clause></subparagraph>
<subparagraph id="id6886e67a24ff4b25a280acf28bd8f57f"><enum>(C)</enum><text>a failure to establish or provide a municipal rural or industrial water delivery system on the Reservation;</text></subparagraph> <subparagraph id="idba351aa52c334887993e6a943810b819"><enum>(D)</enum><text>a failure to provide for operation and maintenance, or deferred maintenance, for the Fort Belknap Indian Irrigation Project or any other irrigation system or irrigation project on the Reservation;</text></subparagraph>
<subparagraph id="id7e4f1fbb8e7748b9911792ebe5662aff"><enum>(E)</enum><text>the litigation of claims relating to the water rights of the Fort Belknap Indian Community in the State;</text></subparagraph> <subparagraph id="id9ba5356d7f1b49128d4049c12f997a76"><enum>(F)</enum><text>the negotiation, execution, or adoption of the Compact (including exhibits); and</text></subparagraph>
<subparagraph id="id3276a754298d4ce99e0288473e34c259"><enum>(G)</enum><text>the allocation of water of the Milk River and the St. Mary River (including tributaries) between the United States and Canada pursuant to the International Boundary Waters Treaty of 1909 (36 Stat. 2448).</text></subparagraph></paragraph></subsection> <subsection id="idabde428c19974529a8185c28d6611c3f"><enum>(b)</enum><header>Effectiveness</header> <paragraph id="idCAA2DF1CAA24410EBAB953F97DAB9372"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraphs (2) and (3), the waivers and releases under subsection (a) shall take effect on the enforceability date.</text></paragraph>
<paragraph id="id4e41d21a93d94adda83d86963b6d39fb"><enum>(2)</enum><header>Exchange of Federal and State land</header><text>The waivers and releases under subsection (a) relating to the land exchange and transfer described in section 6(a) shall take effect on the date on which the land exchange and transfer into trust is completed in accordance with paragraph (4) of that section.</text></paragraph> <paragraph id="id6C558FC5801E4E018E1C45FC90CC2AC5"><enum>(3)</enum><header>Federal land transfers</header><text>The waivers and releases under subsection (a) relating to the land transfers described in section 6(b) shall take effect on the date on which all of the land transfers are completed in accordance with paragraph (6)(B) of that section.</text></paragraph></subsection>
<subsection id="ide29d4e1082aa490192458cf7e93fe771"><enum>(c)</enum><header>Objections in montana water court</header><text>Nothing in this Act or the Compact prohibits the Fort Belknap Indian Community, a member of the Fort Belknap Indian Community, an allottee, or the United States in any capacity from objecting to any claim to a water right filed in any general stream adjudication in the Montana Water Court.</text></subsection> <subsection id="ida12197cbc1da46538dd31913559e2cf2"><enum>(d)</enum><header>Reservation of rights and retention of claims</header><text>Notwithstanding the waivers and releases under subsection (a), the Fort Belknap Indian Community, acting on behalf of the Fort Belknap Indian Community and members of the Fort Belknap Indian Community, and the United States, acting as trustee for the Fort Belknap Indian Community and the allottees shall retain—</text>
<paragraph id="idb280ed31955d48bb8e7daf8a92aa6581"><enum>(1)</enum><text>all claims (including claims accruing after the enforceability date) relating to—</text> <subparagraph id="id814597b60b244c419433d7bb086eb49a"><enum>(A)</enum><text>enforcement of water rights recognized under the Compact, the settlement agreement, any final court decree, or this Act; and</text></subparagraph>
<subparagraph id="idee963294d6464f9597b6592bacf9369a"><enum>(B)</enum><text>the land transfers required under section 6;</text></subparagraph></paragraph> <paragraph id="id41c308c2677a48fc82b3c80b0e3fe4a6"><enum>(2)</enum><text>all claims relating to—</text>
<subparagraph id="idadb9c3ea83df4a29aa90028933996a78"><enum>(A)</enum><text>activities affecting the quality of water, including enforcement of any court decrees, any claims the Fort Belknap Indian Community might have pending in any court of competent jurisdiction as of the date of enactment of this Act, and any claims under—</text> <clause id="id6bc6079c0f82464c85a77dbb62b3282e"><enum>(i)</enum><text>the CERCLA, including damages to natural resources;</text></clause>
<clause id="id1666aabfc1d34dd8a3322b08dc15c9b7"><enum>(ii)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref> et seq.);</text></clause> <clause id="id7a2d85bdb3ae40a88b0932fdb0fedfae"><enum>(iii)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> et seq.); and</text></clause>
<clause id="id3803fe4b89cb4993bd8ed030597b31f6"><enum>(iv)</enum><text>any regulations implementing the Acts described in clauses (i) through (iii);</text></clause></subparagraph> <subparagraph id="id8fd18322383d4686b47eb62829034b22"><enum>(B)</enum><text>damage, loss, or injury to land or natural resources that are not due to loss of water or water rights (including hunting, fishing, gathering, or cultural rights); and</text></subparagraph>
<subparagraph id="id73258a2c11c24c21b2c469be42a5daf8"><enum>(C)</enum><text>an action to prevent any person or party (as defined in sections 29 and 30 of article II of the Compact) from interfering with the enjoyment of the Tribal water rights;</text></subparagraph></paragraph> <paragraph id="ida48d5abbedf749b2a9d19d12fe7e47e2"><enum>(3)</enum><text>all claims arising under section 13(i) relating to the enforcement of any Federal, State, or Tribal law (including common law);</text></paragraph>
<paragraph id="id2b357374de2f453085139b9e5fc651ea"><enum>(4)</enum><text>all claims relating to off-Reservation hunting rights, fishing rights, gathering rights, or other rights;</text></paragraph> <paragraph id="id42edef9253844dbbbbec473fccc6c9ab"><enum>(5)</enum><text>all claims relating to the right to use and protect water rights acquired after the date of enactment of this Act;</text></paragraph>
<paragraph id="id2f0ef25b34e24e2d90045b9a17ab9432"><enum>(6)</enum><text>all claims relating to the allocation of waters of the Milk River and the Milk River Project between the Fort Belknap Indian Community and the Blackfeet Tribe, pursuant to section 3705(e)(3) of the Blackfeet Water Rights Settlement Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; 130 Stat. 1818); and</text></paragraph> <paragraph id="id155b9d597a6e419e82ce7ad4ed7ecb6f"><enum>(7)</enum><text>all rights, remedies, privileges, immunities, and powers not specifically waived and released pursuant to this Act or the Compact.</text></paragraph></subsection>
<subsection id="id4ee1f34e21e140e1aa24aeca33cd08fb"><enum>(e)</enum><header>Effect of compact and act</header><text>Nothing in the Compact or this Act—</text> <paragraph id="id46c5062dcb7b4ce595e84630283f5c95"><enum>(1)</enum><text>affects the authority of the Fort Belknap Indian Community to enforce the laws of the Fort Belknap Indian Community, including with respect to environmental protections;</text></paragraph>
<paragraph id="id5c3c4a37a66b4d99bf33d4bde40ff402"><enum>(2)</enum><text>affects the ability of the United States, acting as a sovereign, to take any action authorized by law (including regulations), including any law relating to health, safety, or the environment, including—</text> <subparagraph id="id562f9ad4b09741c8860c49c7b06434ba"><enum>(A)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> et seq.);</text></subparagraph>
<subparagraph id="id237b0832e35544f4aef97bc08f75a65c"><enum>(B)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref> et seq.); and</text></subparagraph> <subparagraph id="ide3eadaaece984570b6d0e8690ead0d9b"><enum>(C)</enum><text>the CERCLA; </text></subparagraph></paragraph>
<paragraph id="ide02e102c6c3b42f3a817466daba870af"><enum>(3)</enum><text>affects the ability of the United States to act as trustee for any other Indian Tribe or an allottee of any other Indian Tribe;</text></paragraph> <paragraph id="idd4a47d281ed24204a04a2fcd5a55853b"><enum>(4)</enum><text>confers jurisdiction on any State court—</text>
<subparagraph id="idab0f398ada064f01a5d60b5050426486"><enum>(A)</enum><text>to interpret Federal law relating to health, safety, or the environment;</text></subparagraph> <subparagraph id="id5efc682bc23d474d926de478921e6ef7"><enum>(B)</enum><text>to determine the duties of the United States or any other party pursuant to a Federal law relating to health, safety, or the environment;</text></subparagraph>
<subparagraph id="id8580d6ab8ae2469cae7071f8a4cb55c5"><enum>(C)</enum><text>to conduct judicial review of a Federal agency action; or</text></subparagraph> <subparagraph id="id17a49210be9f42cab3547ca1eebc2671"><enum>(D)</enum><text>to interpret Tribal law; or</text></subparagraph></paragraph>
<paragraph id="id23024e59e6394b628d03c24e655093c5"><enum>(5)</enum><text>waives any claim of a member of the Fort Belknap Indian Community in an individual capacity that does not derive from a right of the Fort Belknap Indian Community.</text></paragraph></subsection> <subsection id="idafa6f6526c4d44c4a434f88d46928cc7"><enum>(f)</enum><header>Enforceability date</header><text>The enforceability date shall be the date on which the Secretary publishes in the Federal Register a statement of findings that—</text>
<paragraph id="id360c179e42f64d2ea7fc661f0c97c5ab"><enum>(1)</enum><text>the eligible members of the Fort Belknap Indian Community have voted to approve this Act and the Compact by a majority of votes cast on the day of the vote;</text></paragraph> <paragraph id="idd3f471dbb7284e27ab198566c0fb3345"><enum>(2)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="idab98f10a825d4426bbd7f40a08921886"><enum>(A)</enum><text>the Montana Water Court has issued a final judgment and decree approving the Compact and that decision has become final and nonappealable; or</text></subparagraph>
<subparagraph id="idc134c2432e1944f6b056cee201920a6b" indent="up1"><enum>(B)</enum><text>if the Montana Water Court is found to lack jurisdiction, the appropriate United States district court has approved the Compact, and that decision has become final and nonappealable;</text></subparagraph></paragraph> <paragraph id="id87a221433bbf4f26a61f357e0b21382f"><enum>(3)</enum><text>all of the amounts authorized under section 12 have been appropriated and deposited in the designated accounts;</text></paragraph>
<paragraph id="id9dd208e651e04f13baac66dbcd56ad38"><enum>(4)</enum><text>the Secretary has executed the agreements with the Fort Belknap Indian Community as required under the Compact and this Act, which agreements are—</text> <subparagraph id="id4b7642a0f9f046c3a441b985f2ce3893"><enum>(A)</enum><text>the agreement described in section 6(b)(3)(D)(ii); and</text></subparagraph>
<subparagraph id="id7a80d32b032a4b6e8ac1a9010f309839"><enum>(B)</enum><text>the agreement described in section 7(c)(1);</text></subparagraph></paragraph> <paragraph id="idcc23508ca8514a6db7ca2a13cef28e0c"><enum>(5)</enum><text>the State has paid the amounts under section (8)(c)(1)(A) and section 11(n)(1) into mitigation funding accounts that shall be established as part of the cost-share agreements required pursuant to those sections; and </text></paragraph>
<paragraph id="id695aaa0b74494f3a9e358a32e1063a0a"><enum>(6)</enum><text>the waivers and releases under subsection (a) (other than the waivers and releases for which a different effective date has been provided under paragraphs (2) and (3) of subsection (b)) have been executed by the Fort Belknap Indian Community and the Secretary.</text></paragraph></subsection> <subsection id="id408f2fa3b28e4c4e955e305574238b01"><enum>(g)</enum><header>Tolling of claims</header> <paragraph id="id12956d7ab4854e2788db57749381dd43"><enum>(1)</enum><header>In general</header><text>Each applicable period of limitation and time-based equitable defense relating to a claim described in this section shall be tolled for the period beginning on the date of enactment of this Act and ending on the enforceability date.</text></paragraph>
<paragraph id="id4eba05a8f83e4dd6b4ca08c94bd9a6f9"><enum>(2)</enum><header>Effect of subsection</header><text>Nothing in this subsection revives any claim or tolls any period of limitations or time-based equitable defense that expired before the date of enactment of this Act.</text></paragraph></subsection> <subsection id="idd7e61edc6f944954ba21eeaee920a264"><enum>(h)</enum><header>Voiding of waivers</header><text>If the authority provided by this Act terminates under section 14—</text>
<paragraph id="idc2b3f8c2ae9746b5836b620d71976692"><enum>(1)</enum><text>the approval by the United States of the Compact under section 4 shall no longer be effective;</text></paragraph> <paragraph id="id49e13e501d244ca8b2dafbc4433f9dd8"><enum>(2)</enum><text>any waivers and releases executed by the Fort Belknap Indian Community under this section shall be void;</text></paragraph>
<paragraph id="idbd9b299e91774676a13d2727e3358e91"><enum>(3)</enum><text>any unexpended and unobligated Federal funds in the Settlement Trust Fund not made available to the Fort Belknap Indian Community as authorized by this Act, together with any interest earned on those funds, shall be returned to the Federal Government, unless otherwise agreed to by the Fort Belknap Indian Community and the United States; and</text></paragraph> <paragraph id="id86e4198aaebf4bb58cf48481eeb52a07"><enum>(4)</enum><text>all statutes of limitations applicable to any claim subject to the waiver shall be tolled until, as applicable—</text>
<subparagraph id="id2BA0EFCBEE874AE8BEBF0DA817ECD59B"><enum>(A)</enum><text>June 30, 2035; or </text></subparagraph> <subparagraph id="id016D0D6DBEB547449FE36DEEE886E8A6"><enum>(B)</enum><text>a later date in accordance with section 14(a)(1)(B).</text></subparagraph></paragraph></subsection></section>
<section id="id7364fef1730249e094cc9d63c4c541de"><enum>11.</enum><header>Aaniiih Nakoda Settlement Trust Fund</header>
<subsection id="id5defa4f81f424498b8b19d84905eef57"><enum>(a)</enum><header>Definition of plan</header>
<paragraph id="id63b983f2062544caa1d0f398d45e7520"><enum>(1)</enum><header>In general</header><text>In this section, the term <term>Plan</term> means the document entitled <quote>Fort Belknap Indian Community Comprehensive Water Development Plan</quote>, prepared by Natural Resources Consulting Engineers, Inc., and dated February 2019.</text></paragraph> <paragraph id="ida65f5e9827ee4fc6b706acc3b983aed9"><enum>(2)</enum><header>Inclusion</header><text>In this section, the term <term>Plan</term> includes any modification to the document referred to in paragraph (1) that the Fort Belknap Indian Community determines to be necessary to account for conditions in existence at the time at which an activity is carried out pursuant to this section.</text></paragraph></subsection>
<subsection id="id9fd43aea9f22489d81c01cd3a9907ef4"><enum>(b)</enum><header>Establishment</header>
<paragraph id="id33ebe2b4104e4a5c98281434e5f84e74"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish in the Treasury of the United States a trust fund for the Fort Belknap Indian Community, to be known as the <quote>Aaniiih Nakoda Settlement Trust Fund</quote>, consisting of—</text> <subparagraph id="idfea6cc90f7ed444ea081539b9b94ad48"><enum>(A)</enum><text>the amounts deposited in the Trust Fund under subsection (d); and</text></subparagraph>
<subparagraph id="id4def994bb5d248429a871e53d71f2920"><enum>(B)</enum><text>any interest earned on those amounts.</text></subparagraph></paragraph> <paragraph id="ide0a4c70628054a178f841910c0301a96"><enum>(2)</enum><header>Management; availability</header><text>For the purpose of carrying out this Act, amounts in the Trust Fund shall—</text>
<subparagraph id="id0952ae39d28148d1b8b14c7b9ac83ca6"><enum>(A)</enum><text>be allocated, maintained, managed, invested, and distributed by the Secretary; and</text></subparagraph> <subparagraph id="id3ddff2162970407db9c614d3ad5b448b"><enum>(B)</enum><text>remain available until expended.</text></subparagraph></paragraph></subsection>
<subsection id="idf533fd9983374feaba79c2480cefb5bb"><enum>(c)</enum><header>Accounts</header><text>The Secretary shall establish in the Trust Fund the following accounts:</text> <paragraph id="id961beda69c5346dfafa3d6f32a9fbf56"><enum>(1)</enum><text>The Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account for activities described in the Plan relating to—</text>
<subparagraph id="id542f6758c2a74b17bba0273e8d7cbc02"><enum>(A)</enum><text>rehabilitation and modernization, including improvements to increase conservation efforts, of the Milk River unit of the Fort Belknap Indian Irrigation Project;</text></subparagraph> <subparagraph id="idb3e9dac1899241e1994ba52d6f9e81a5"><enum>(B)</enum><text>expansion of the Milk River unit of the Fort Belknap Indian Irrigation Project;</text></subparagraph>
<subparagraph id="id57bd4e83f182413da1c2fba5f6187c03"><enum>(C)</enum><text>rehabilitation and modernization of the Southern Tributary Irrigation Project units of the Fort Belknap Indian Irrigation Project;</text></subparagraph> <subparagraph id="ide952450946934d34a39af4e31a68dd69"><enum>(D)</enum><text>the Peoples Creek Irrigation Project of the Fort Belknap Indian Irrigation Project; and</text></subparagraph>
<subparagraph id="idca6c901272fe4f67ab641a676b3be5fb"><enum>(E)</enum><text>other land- and water-related projects.</text></subparagraph></paragraph> <paragraph id="id0eb6a30c211c440eb69a92460656c219"><enum>(2)</enum><text>The Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, Maintenance, and Repair Account, of which only the earned interest may be used to pay for activities described in the Plan relating to—</text>
<subparagraph id="id1b0da437ce8c40bd8e014e77719ea7fd"><enum>(A)</enum><text>the costs of administering and regulating the Tribal water rights, including through—</text> <clause id="id28416ac06caf48cea5b354ce1ff78912"><enum>(i)</enum><text>the development or enactment of a Tribal water code in accordance with section 5(f); and</text></clause>
<clause id="idd0b43c207f0044328ebd4eb141e12fcb"><enum>(ii)</enum><text>the establishment and operation of a Tribal water resources department; and</text></clause></subparagraph> <subparagraph id="id76fd8a861be34c1bbdb992c1c50e4b09"><enum>(B)</enum><text>the annual operations, maintenance, and repair assessment costs for the Tribe and Tribal member water users, including allottees. </text></subparagraph></paragraph>
<paragraph id="idbb0a868654104b5191cda609d6915060"><enum>(3)</enum><text>The Fort Belknap Indian Community Tribal Economic Development Account, the principal and interest of which may be used by the Fort Belknap Indian Community to pay the costs of such activities described in the Plan as the Fort Belknap Indian Community determines to be necessary to advance the economic development of the Fort Belknap Indian Community.</text></paragraph> <paragraph id="id32f68896407e46d1b1a1b4f2c8130eea"><enum>(4)</enum><text>The Fort Belknap Indian Community Clean and Safe Domestic Water Supply and Wastewater Systems Account, the principal and interest of which may be used by the Fort Belknap Indian Community to pay the costs of activities described in the Plan relating to—</text>
<subparagraph id="id327a49f42ecb40f2a4cd57647e3ec241"><enum>(A)</enum><text>preparation of a feasibility study and design of a water supply and sewer treatment system for the Fort Belknap Indian Community;</text></subparagraph> <subparagraph id="idc893437b3ec54057a26ea3ff70dc7b81"><enum>(B)</enum><text>the planning, design, and construction of a domestic water supply system and related facilities for Tribal communities;</text></subparagraph>
<subparagraph id="id94486caf846945d19311499970fe5e42"><enum>(C)</enum><text>the planning, design, and construction of a wastewater treatment and collections system for Tribal communities; and</text></subparagraph> <subparagraph id="ida1f6c826b6a2460db9b7378335d6d3dc"><enum>(D)</enum><text>environmental compliance in the development and construction of projects under this Act.</text></subparagraph></paragraph></subsection>
<subsection id="id5489310bbd8e4fb5b786c40278399e9b"><enum>(d)</enum><header>Deposits</header><text>The Secretary shall deposit—</text> <paragraph id="id2d07c87a7ba14f6997f7a54eb387e1a2"><enum>(1)</enum><text>in the Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account established under subsection (c)(1), the amounts made available pursuant to section 12(b);</text></paragraph>
<paragraph id="id05577212662c4f95a3a0d47327a5e230"><enum>(2)</enum><text>in the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, Maintenance, and Repair Account established under subsection (c)(2), the amounts made available pursuant to section 12(c);</text></paragraph> <paragraph id="id0068af8e94d64a47a02de4dc5eb7e8ba"><enum>(3)</enum><text>in the Fort Belknap Indian Community Tribal Economic Development Account established under subsection (c)(3), the amounts made available pursuant to section 12(d); and</text></paragraph>
<paragraph id="id706af0d8a8eb48bbb2ed8836b122f1a7"><enum>(4)</enum><text>in the Fort Belknap Indian Community Clean and Safe Domestic Water Supply and Wastewater Systems Account established under subsection (c)(4), the amounts made available pursuant to section 12(e).</text></paragraph></subsection> <subsection id="id0a49bb49adfb47d7b06c173d8b63b09b"><enum>(e)</enum><header>Management and interest</header> <paragraph id="id9c4af5f84aec4fce83dd820a12193db4"><enum>(1)</enum><header>Management</header><text>On receipt and deposit of the funds into the accounts in the Trust Fund pursuant to subsection (d), the Secretary shall manage, invest, and distribute all amounts in the Trust Fund in accordance with the investment authority of the Secretary under—</text>
<subparagraph id="id96485e56cb35476b807e32a563550fc0"><enum>(A)</enum><text>the first section of the Act of June 24, 1938 (<external-xref legal-doc="usc" parsable-cite="usc/25/162a">25 U.S.C. 162a</external-xref>);</text></subparagraph> <subparagraph id="ide31454890c5540658f568483e2b4269e"><enum>(B)</enum><text>the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001</external-xref> et seq.); and</text></subparagraph>
<subparagraph id="idce4b12b712954a668b484213aa5a6f7c"><enum>(C)</enum><text>this section.</text></subparagraph></paragraph> <paragraph id="id7b101f3fe5494b7e90cb8be48ad42959"><enum>(2)</enum><header>Investment earnings</header><text>In addition to the deposits under subsection (d), any investment earnings, including interest, credited to amounts held in the Trust Fund are authorized to be appropriated for use in accordance with subsection (c).</text></paragraph></subsection>
<subsection id="idff623b6bd16242cca7e6f991400ea3f8"><enum>(f)</enum><header>Availability of amounts</header>
<paragraph id="ided929166aa9c441ab5a8738883252145"><enum>(1)</enum><header>Funding</header><text>Except as provided in paragraph (3), the amounts made available under this section (including any investment earnings on those amounts) shall be available for expenditure or withdrawal by the Fort Belknap Indian Community without fiscal year limitation beginning on the enforceability date.</text></paragraph> <paragraph id="id1e20e383311b431dac6564e4bad484d6"><enum>(2)</enum><header>Other funding</header><text>In addition to funding specifically made available under this Act, if the Secretary determines that, for a given fiscal year, a sufficient amount of funding has not been made available through annual appropriations or other sources, the Secretary shall expend from the Reclamation Water Settlements Fund established by section 10501(a) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407(a)</external-xref>) such amounts as are necessary to pay the Federal share of the costs associated with the Trust Fund.</text></paragraph>
<paragraph id="idf9b452ff5dda48378f230aeb9e8f54c1"><enum>(3)</enum><header>Use</header><text>Any amounts—</text> <subparagraph id="idb0a8fb974a3d4610969311b5991066b2"><enum>(A)</enum><text>deposited in the Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account established under subsection (c)(1) shall be available to the Fort Belknap Indian Community or the Secretary, as applicable, on the date on which the amounts are deposited, for the uses described in that subsection; and</text></subparagraph>
<subparagraph id="id96df067d5f934e87bfbb73000aee8b2f"><enum>(B)</enum><text>deposited in the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, Maintenance, and Repair Account established under subsection (c)(2) shall be made available to the Fort Belknap Indian Community on the date on which the amounts are deposited and the Fort Belknap Indian Community has satisfied the requirements of section 10(f)(1) for the uses described in subsection (c)(2). </text></subparagraph></paragraph></subsection> <subsection id="idc25c359fe08c4778af957f1b024c0def"><enum>(g)</enum><header>Withdrawals</header> <paragraph id="id963e51c00e50484ba767c5a62719f7a7"><enum>(1)</enum><header>American Indian Trust Fund Management Reform Act of 1994</header> <subparagraph id="id803513b519834e29a687c5f78f42a673"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (C), the Fort Belknap Indian Community may withdraw any portion of the amounts in the Trust Fund on approval by the Secretary of a Tribal management plan submitted by the Fort Belknap Indian Community in accordance with the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001</external-xref> et seq.).</text></subparagraph>
<subparagraph id="idab8f885c0149433fa1044a1271b8699b"><enum>(B)</enum><header>Additional requirements</header><text>In addition to the requirements under the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001</external-xref> et seq.), the Tribal management plan under this paragraph shall require that the Fort Belknap Indian Community shall spend all amounts withdrawn from the Trust Fund, and any investment earnings accrued through the investments under the Tribal management plan, in accordance with this Act.</text></subparagraph> <subparagraph id="ida33c4c82e4074338a4fba0cbde8e9f00"><enum>(C)</enum><header>Exception</header> <clause id="id105058B474AC4F0D828B915F077E1BDC"><enum>(i)</enum><header>In general</header><text>A withdrawal from the Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account established under subsection (c)(1)—</text>
<subclause id="ideb1f7a48264b479582005733f074da51"><enum>(I)</enum><text>shall be made only in accordance with subsection (f)(3); and</text></subclause> <subclause id="id26c0e08e63fc4709b0bb3d05ded57541"><enum>(II)</enum><text>notwithstanding any other provision of law, shall not be subject to the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001</external-xref> et seq.), consistent with subsection (m). </text></subclause></clause>
<clause id="id7b55aa8635044a248316e005732f54ad"><enum>(ii)</enum><header>Secretarial responsibility</header><text>The Secretary shall be responsible for carrying out activities described in subsection (c)(1).</text></clause></subparagraph> <subparagraph id="idc3bffc103f4c4acca32c0e6f310673d5"><enum>(D)</enum><header>Enforcement</header><text>The Secretary may carry out such judicial and administrative actions as the Secretary determines to be necessary—</text>
<clause id="id47eaae0e77c64a55aa74f0480f89681d"><enum>(i)</enum><text>to enforce the Tribal management plan; and</text></clause> <clause id="id86d783e101e04ea1b0bf109ac95ce1f2"><enum>(ii)</enum><text>to ensure that amounts withdrawn from the Trust Fund by the Fort Belknap Indian Community under this paragraph are used in accordance with this Act.</text></clause></subparagraph></paragraph>
<paragraph id="id515244e0bca54af48ffc0e17c279fdd7" commented="no"><enum>(2)</enum><header>Effect</header><text>Nothing in this subsection entitles the Fort Belknap Indian Community to judicial review of a determination of the Secretary regarding whether to approve a Tribal management plan under paragraph (1)(A), other than as provided under subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>).</text></paragraph></subsection> <subsection id="id98d931e175824e6687cdbc33eb751b74"><enum>(h)</enum><header>Liability</header><text>The Secretary shall not be liable for any expenditure or investment of amounts withdrawn from the Trust Fund by the Fort Belknap Indian Community pursuant to subsection (g).</text></subsection>
<subsection id="id9c92e2741bbb41e7a49a726daee70522"><enum>(i)</enum><header>Annual report</header><text>For each account in the Trust Fund (other than the Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account established under subsection (c)(1)), the Fort Belknap Indian Community shall submit to the Secretary a report in accordance with, as applicable—</text> <paragraph id="id8D8677CA06FD4F77B8DB5B922F10DC39"><enum>(1)</enum><text> the American Indian Trust Fund Management Reform Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/4001">25 U.S.C. 4001</external-xref> et seq.); or </text></paragraph>
<paragraph id="idFBB124ECA3C64635A83D701ED944CCD2"><enum>(2)</enum><text>the Tribal management plan. </text></paragraph></subsection> <subsection id="idba5336055fa74e9b974d38ed9d6228da"><enum>(j)</enum><header>No per capita payments</header><text>No principal or interest amount in any account established by this section shall be distributed to any member of the Fort Belknap Indian Community on a per capita basis.</text></subsection>
<subsection id="id045b358f12e14a0eb5cb7eacb6fdc0bf"><enum>(k)</enum><header>Ownership of the Fort Belknap Indian Irrigation Project</header>
<paragraph id="id4900bfd11809448c9439fdada5586ab7"><enum>(1)</enum><header>In general</header><text>The Fort Belknap Indian Irrigation Project shall be held in trust by the United States for the benefit of the Fort Belknap Indian Community.</text></paragraph> <paragraph id="id19AE7B4E92014F49AD36EC85321274FC" commented="no"><enum>(2)</enum><header>Management and control; financial responsibility</header> <subparagraph id="id3a6be0a922144821b9b4e070e136f6b1"><enum>(A)</enum><header>In general</header><text>The Secretary, acting through the Director of the Bureau of Indian Affairs (referred to in this paragraph as the <quote>Secretary</quote>), shall—</text>
<clause id="id0A789CCA28914D4EA3A11B69FF747FF3"><enum>(i)</enum><text>retain the Federal responsibilities, including fiduciary obligations and liability, as trustee of the Fort Belknap Indian Irrigation Project for the Fort Belknap Indian Community; and </text></clause> <clause id="idB8C25EDB90354642BA88BFF94081A0DF"><enum>(ii)</enum><text>except as provided in subparagraph (B), have full responsibility for the regulation, administration, management, and control of the Fort Belknap Indian Irrigation Project.</text></clause></subparagraph>
<subparagraph id="id93a53bf12d654cc9b6f6e7353c90096f" commented="no"><enum>(B)</enum><header>Indian self-determination</header><text>At the option of the Fort Belknap Indian Community, the Secretary shall enter into an agreement with the Fort Belknap Indian Community in accordance with the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> et seq.) under which—</text> <clause commented="no" id="id663FE5114ECE4AA88F54E4E42A064717"><enum>(i)</enum><text>the Fort Belknap Indian Community shall assume responsibility for the regulation, administration, management, and control of a portion or all of the Fort Belknap Indian Irrigation Project; and </text></clause>
<clause id="idc0f91ee9761f4f86b517429bdad783da" commented="no"><enum>(ii)</enum><text>the Secretary shall retain fiduciary obligations and liability, as trustee of the Fort Belknap Indian Irrigation Project for the Fort Belknap Indian Community.</text></clause></subparagraph></paragraph> <paragraph id="id8894bc6e1a904a51a3aa76c6d8e4a676"><enum>(3)</enum><header>Operations, maintenance, and repair costs</header><text>Except as otherwise provided in this Act, nothing in this Act affects any obligation, including financial obligations, of the United States for the operations, maintenance, and repair costs of the Fort Belknap Indian Irrigation Project. </text></paragraph></subsection>
<subsection id="idbbd887a25b784a5ca568d782622897d8"><enum>(l)</enum><header>Water transport obligation</header>
<paragraph id="id26c4d988c9f34671b9d93caf67709676"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide assistance with planning, design, and construction activities necessary to carry out the activities described in paragraphs (3) and (4) of subsection (c).</text></paragraph> <paragraph id="id2cbd62f486a94e0a87b2c442cd16f1c9"><enum>(2)</enum><header>Authorization of studies</header><text>The Secretary, with the informed consent of the Fort Belknap Indian Community, shall carry out 1 or more studies—</text>
<subparagraph id="idc458d611fb3740dd84ce63c2a6cf17a2"><enum>(A)</enum><text>to determine the feasibility of a water supply and wastewater system for the Fort Belknap Indian Community; and</text></subparagraph> <subparagraph id="id668c5ca23ef74548b4c1d46215793ca9"><enum>(B)</enum><text>if a project to be developed and constructed under this Act is associated with, affected by, or located within the same river basin as a Federal reclamation project in existence on the date of enactment of this Act—</text>
<clause id="id3abaae35805c4cc7a21b7f49d11d09bf"><enum>(i)</enum><text>to determine the environmental impact of the project; and</text></clause> <clause id="id80dc2240496b498384ffc5c4608fdbfa"><enum>(ii)</enum><text>to ensure environmental compliance in the development and construction of the project.</text></clause></subparagraph></paragraph></subsection>
<subsection id="iddf0689a20a5e4a17a44f74ae63f11653"><enum>(m)</enum><header>Indian self-Determination</header>
<paragraph id="ida4b1e0dd9c454041b7e5ef38dd70d842"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, if the Fort Belknap Indian Community, not later than 180 days after the date on which funds are appropriated for deposit in the Trust Fund and available for withdrawal, or not later than such alternative date as is agreed to by the Fort Belknap Indian Community and the Secretary, elects to perform a program, function, service, or activity, or a portion thereof, authorized under subsection (c)(1), the Secretary and the Fort Belknap Indian Community shall enter into, with respect to the program, function, service, or activity—</text> <subparagraph id="idC195E66769E34CB0BA7EC681FDEF9DEF"><enum>(A)</enum><text>a self-determination contract under title I of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5321">25 U.S.C. 5321</external-xref> et seq.); or</text></subparagraph>
<subparagraph id="id20802CEBEDDF4606ACB109F8CF6C4AAB"><enum>(B)</enum><text>a self-governance compact under title IV of that Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5361">25 U.S.C. 5361</external-xref> et seq.).</text></subparagraph></paragraph> <paragraph id="id611065105fdf40738c844c504f302a90"><enum>(2)</enum><header>Funding agreements</header> <subparagraph id="id52F5D33612FA4D9A8D1778AF3A3ED82E"><enum>(A)</enum><header>In general</header><text>After entering into a self-determination contract or self-governance compact under paragraph (1), the Secretary and the Fort Belknap Indian Community may enter into a funding agreement pursuant to section 403 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5363">25 U.S.C. 5363</external-xref>).</text></subparagraph>
<subparagraph id="id14D5EE50510844AD8C7556F65259AE8A"><enum>(B)</enum><header>Requirements</header>
<clause id="id13CE6CF80283479599264470765A7EB8"><enum>(i)</enum><header>In general</header><text>In providing to the Fort Belknap Indian Community funding, including funding for any related contract supports costs, to carry out a funding agreement entered into under subparagraph (A), the Secretary shall only use amounts from the Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account established under subsection (c)(1).</text></clause> <clause id="idf0d04e6f8bab4fcaae8e958d74434685"><enum>(ii)</enum><header>Application of self-determination contract or self-governance compact</header><text>Any funds transferred for use in a funding agreement under this paragraph shall be subject to the self-determination contract or self-governance compact entered into under paragraph (1).</text></clause></subparagraph></paragraph>
<paragraph id="id7f3f5508b40d471caa7228dffe9d4ed2"><enum>(3)</enum><header>Applicability of certain ISDEAA provisions</header><text>For purposes of this subsection—</text> <subparagraph id="id0cb85109c3fd4133a2ee6111e0057b4a"><enum>(A)</enum><text>the <quote>annual trust evaluation</quote> required under section 403(d) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5363">25 U.S.C. 5363(d)</external-xref>) shall monitor the performance, and progress toward completion, of the program, function, service, or activity carried out pursuant to the self-determination contract or self-governance compact entered into under paragraph (1);</text></subparagraph>
<subparagraph id="idb4b026dad13f40669a9ed45c1d1da08f"><enum>(B)</enum><text>the program, function, service, or activity carried out pursuant to the self-determination contract or self-governance compact entered into under paragraph (1) shall be considered to be <quote>construction programs or projects</quote> under section 403(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5363">25 U.S.C. 5363(e)</external-xref>); and</text></subparagraph> <subparagraph id="idacd199957ed44468a279549ce1bdcd27"><enum>(C)</enum><text>reporting requirements regarding planning, design, and the use and expenditure of funds shall be negotiated and included within the funding agreement entered into under paragraph (2).</text></subparagraph></paragraph>
<paragraph id="ide7403bbe7ab44437929a5a5314ef02d0"><enum>(4)</enum><header>Secretarial performance of activities</header><text>If the Fort Belknap Indian Community does not elect to carry out the program, function, service, or activity under paragraph (1) by the deadline described in that paragraph, the Secretary shall carry out the program, function, service, or activity using amounts made available from the Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account established under subsection (c)(1). </text></paragraph> <paragraph id="id746c5310419940e689ac7d9861e8e873"><enum>(5)</enum><header>Nonreimbursability of costs</header><text>All costs incurred in carrying out this subsection, including the cost of any oversight activity carried out by the Secretary under any agreement entered into under this subsection, shall be nonreimbursable.</text></paragraph>
<paragraph id="idc6d1dfefbc024b139f8603a58e7a009c"><enum>(6)</enum><header>Treatment</header><text>Any activities carried out pursuant to a self-determination contract or self-governance compact entered into under paragraph (1) that result in improvements, additions, or modifications to the Fort Belknap Indian Irrigation Project, including the acquisition of any real property interest (other than land), shall—</text> <subparagraph id="id66cbd932b013497e85d1f4676481c7e5"><enum>(A)</enum><text>become a part of the inventory of the Secretary relating to the Fort Belknap Indian Irrigation Project; and</text></subparagraph>
<subparagraph id="id354e6c902ceb40dda3d6ff53c091e20b"><enum>(B)</enum><text>be recorded in the inventory of the Secretary relating to the Fort Belknap Indian Irrigation Project.</text></subparagraph></paragraph></subsection> <subsection id="id0c3c9e80016f47bea49fccf881e9542a"><enum>(n)</enum><header>Peoples creek dam and reservoir</header> <paragraph id="id20b486eb3a7543a3ae0feed25d45ec54"><enum>(1)</enum><header>In general</header><text>Consistent with the agreement of the Federal Government, the State, and the Fort Belknap Indian Community to contribute to the cost of design and construction of the Peoples Creek Dam and Reservoir to support mitigation activities pursuant to article VI.C. of the Compact and this Act—</text>
<subparagraph id="ida75f686ddc2e44a4bf011d29d45a6d9b"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="id54D58CA67D0B450E82E0B55A330253C1"><enum>(i)</enum><text>except as provided in clause (ii), the total cost of such mitigation measures shall not exceed $15,500,000, adjusted to reflect changes in the construction cost indices from May 1, 2021, that are applicable to the types of construction involved in the activities described for the mitigation activities; and</text></clause> <clause id="id5B40E625C39D43BAAAB458BC8673CCC4" indent="up1"><enum>(ii)</enum><text>if the studies by the State and Federal Government require a cost to support such mitigation measures that is greater than $15,500,000, the total cost of such mitigation shall be such amount as is identified in the studies, and such amount is hereby approved; and</text></clause></subparagraph>
<subparagraph id="idc0db025af17b4f7a8f8fbeaca093873b"><enum>(B)</enum><text>the State and the Federal Government shall enter into a cost-share agreement by not later than 1 year after the date of enactment of this Act to contribute to the cost of such mitigation measures.</text></subparagraph></paragraph> <paragraph id="id9552026e831d4b7bae74afe46f34da5b"><enum>(2)</enum><header>Treatment of amounts paid</header><text>Any amount paid by the State or the Federal Government under the cost-share agreement entered into pursuant to paragraph (1) shall be counted toward the fulfillment of the obligation of the State or the Federal Government, respectively, under the agreement described in the matter preceding subparagraph (A) of that paragraph. </text></paragraph></subsection>
<subsection id="id3daf197319604053a30fce84e27a2f04"><enum>(o)</enum><header>Nonreimbursability of costs</header><text>The costs to the Secretary of carrying out this section shall be nonreimbursable.</text></subsection></section> <section id="id4d42b9241a3448eca2c3ca96a08b00c8"><enum>12.</enum><header>Funding</header> <subsection id="idd3d35b07f09547268287c8ccf38c6285"><enum>(a)</enum><header>Reclamation water settlements fund</header> <paragraph id="id5f256106fb4746efb8c35d4a5deb84b0"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, on October 1, 2022, and each October 1 thereafter through October 1, 2034, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary for deposit in the Reclamation Water Settlements Fund established by section 10501(a) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407(a)</external-xref>) $30,000,000, to remain available until expended, for the use described in paragraph (2).</text></paragraph>
<paragraph id="id7d8b5bd8d466448e8ff48ea9cea5bcea"><enum>(2)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall use to carry out section 10501(c)(3)(B)(iii) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407(c)(3)(B)(iii)</external-xref>) the funds transferred under paragraph (1) specifically to pay towards the Federal share of the remaining costs of implementing the Indian water rights settlement agreement for the Fort Belknap Indian Community under this Act, without further appropriation.</text></paragraph></subsection> <subsection id="idab94bca9413644da9e0c6a991fc6539c"><enum>(b)</enum><header>Fort belknap indian community tribal land and water, rehabilitation, modernization, and expansion account</header> <paragraph id="id0155a3c305184f50a5e19ed93e8a2e07"><enum>(1)</enum><header>Mandatory appropriations</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall deposit in the Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account established under paragraph (1) of section 11(c) $134,478,400, as adjusted to reflect changes in construction cost indices since May 1, 2011, that are applicable to the types of construction involved in the activities described in that paragraph.</text></paragraph>
<paragraph id="id42d32a0035cd46d6835dd4d13e4f8e31"><enum>(2)</enum><header>Authorization of appropriations</header><text>In addition to the amounts made available under paragraph (1), there is authorized to be appropriated for deposit in the Fort Belknap Indian Community Tribal Land and Water Rehabilitation, Modernization, and Expansion Account established under paragraph (1) of section 11(c) $105,661,600, as adjusted to reflect changes in construction cost indices since May 1, 2011, that are applicable to the types of construction involved in the activities described in that paragraph.</text></paragraph></subsection> <subsection id="id8b48f303b81e4a9daa12e5cacdd09066"><enum>(c)</enum><header>Fort belknap indian community water resources and water rights administration, operation, maintenance, and repair account</header> <paragraph id="idb9b99cd5c54e4601b6fbd5bb17ccd6e8"><enum>(1)</enum><header>Mandatory appropriations</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall deposit in the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, Maintenance, and Repair Account established under paragraph (2) of section 11(c) $31,263,000, as adjusted to reflect changes in construction cost indices since May 1, 2011, that are applicable to the types of construction involved in the activities described in that paragraph.</text></paragraph>
<paragraph id="id5c50e1da5ff34927b8622495e7043b4f"><enum>(2)</enum><header>Authorization of appropriations</header><text>In addition to the amounts made available under paragraph (1), there is authorized to be appropriated for deposit in the Fort Belknap Indian Community Water Resources and Water Rights Administration, Operation, Maintenance, and Repair Account established under paragraph (2) of section 11(c) $30,037,000, as adjusted to reflect changes in construction cost indices since May 1, 2011, that are applicable to the types of construction involved in the activities described in that paragraph.</text></paragraph></subsection> <subsection id="id0eb2d615bd874961be179e9e39bf08f3"><enum>(d)</enum><header>Fort belknap indian community tribal economic development account</header> <paragraph id="idd0a18e6139c44377b5a571be1b3ca976"><enum>(1)</enum><header>Mandatory appropriations</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall deposit in the Fort Belknap Indian Community Tribal Economic Development Account established under paragraph (3) of section 11(c) $92,614,500, as adjusted to reflect changes in construction cost indices since May 1, 2011, that are applicable to the types of construction involved in the activities described in that paragraph.</text></paragraph>
<paragraph id="id3a6e260bcba64050a8f338248ab62514"><enum>(2)</enum><header>Authorization of appropriations</header><text>In addition to the amounts made available under paragraph (1), there is authorized to be appropriated for deposit in the Fort Belknap Indian Community Tribal Economic Development Account established under paragraph (3) of section 11(c) $75,775,500, as adjusted to reflect changes in construction cost indices since May 1, 2011, that are applicable to the types of construction involved in the activities described in that paragraph.</text></paragraph></subsection> <subsection id="id20e52d66b21d4e219be0981ae26c73ec"><enum>(e)</enum><header>Fort Belknap Indian Community Clean and Safe Domestic Water Supply and Wastewater Systems Account</header> <paragraph id="id9175277015c845aeba8ffba3fc15bb30"><enum>(1)</enum><header>Mandatory appropriations</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall deposit in the Fort Belknap Indian Community Clean and Safe Domestic Water Supply and Wastewater Systems Account established under paragraph (4) of section 11(c) $69,036,800, as adjusted to reflect changes in construction cost indices since May 1, 2011, that are applicable to the types of construction involved in the activities described in that paragraph.</text></paragraph>
<paragraph id="idf230dcb4e54e46b7b3a4be62aace35b8"><enum>(2)</enum><header>Authorization of appropriations</header><text>In addition to the amounts made available under paragraph (1), there is authorized to be appropriated for deposit in the Fort Belknap Indian Community Clean and Safe Domestic Water Supply and Wastewater Systems Account established under paragraph (4) of section 11(c) $54,243,200, as adjusted to reflect changes in construction cost indices since May 1, 2011, that are applicable to the types of construction involved in the activities described in that paragraph.</text></paragraph></subsection> <subsection id="id8c8cf1bad5f8494bbba1561de3c46a76"><enum>(f)</enum><header>Federal contribution to the milk river project mitigation</header> <paragraph id="idc50559eb25894426be80cf222a2915a7"><enum>(1)</enum><header>In general</header><text>Pursuant to article VI.B. of the Compact, the Federal contribution to the mitigation of impacts on the Milk River Project shall be the amount paid by the Federal Government pursuant to section 8(c)(1)(A)(ii), to be used to support the cost of construction and watershed improvements involved in the mitigation activities.</text></paragraph>
<paragraph id="idd89b184027f7466a90ebaf6728ac5365"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection, an amount equal to the amount described in paragraph (1) for fiscal year 2022, as adjusted to reflect changes in construction cost indices since May 1, 2021, that are applicable to the types of construction and other activities involved in the mitigation activities that will be implemented for the Milk River Project.</text></paragraph></subsection> <subsection id="id22c6c8cbe2f1490a9ed56d033b1d8ae6"><enum>(g)</enum><header>Federal contribution to the upper peoples creek project mitigation</header> <paragraph id="id8abae79ccee645e0a4d506ab8dba2b6a"><enum>(1)</enum><header>In general</header><text>Pursuant to article VI.C. of the Compact, the Federal contribution to the protection provided to the Upper Peoples Creek water users in the Peoples Creek Basin shall be the amount paid by the Federal Government pursuant to section 11(n)(1), to be used to support the cost of design and construction of the Upper Peoples Creek Dam and Reservoir.</text></paragraph>
<paragraph id="id42c583d88cb84f5fbd8a8731d2559139"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection an amount equal to the amount described in paragraph (1) for fiscal year 2022, as adjusted to reflect changes in construction cost indices since May 1, 2021, that are applicable to the types of design and construction involved in the mitigation activities that will be implemented for the Upper Peoples Creek Dam and Reservoir.</text></paragraph></subsection> <subsection id="id387d78f18e4c4e1fba39f617250ae49f"><enum>(h)</enum><header>Nonreimbursability of costs</header><text>All amounts incurred by the Secretary under this section shall be nonreimbursable.</text></subsection></section>
<section id="id11c18501504f41f89d59e3f81f4245d9"><enum>13.</enum><header>Miscellaneous provisions</header>
<subsection id="idac19eaa940be455ba30174c364bd69c6"><enum>(a)</enum><header>Waiver of sovereign immunity by the United States</header><text>Except as provided in subsections (a) through (c) of section 208 of the Department of Justice Appropriation Act, 1953 (<external-xref legal-doc="usc" parsable-cite="usc/43/666">43 U.S.C. 666</external-xref>), nothing in this Act waives the sovereign immunity of the United States.</text></subsection> <subsection id="id7336698aac124befb5a52f6d5609dcd3"><enum>(b)</enum><header>Other Tribes not adversely affected</header><text>Nothing in this Act quantifies or diminishes any land or water right, or any claim or entitlement to land or water, of an Indian Tribe, band, or community other than the Fort Belknap Indian Community.</text></subsection>
<subsection id="idd86e5539d71c47828c476443d1d28fc2"><enum>(c)</enum><header>Elimination of Department of Agriculture debts or liens against allotments of the fort belknap indian community members within the fort belknap indian irrigation project</header><text>The Secretary shall cancel and eliminate all debts or liens against the allotments of land held by the Fort Belknap Indian Community and the members of the Fort Belknap Indian Community due to construction assessments, annual operation and maintenance charges, and any other charge that may have been levied relating to an irrigation project of the Secretary for the Fort Belknap Indian Community.</text></subsection> <subsection id="ideab7d75962344f06b8bfc3fc042cfab9"><enum>(d)</enum><header>Effect on current law</header><text>Nothing in this Act affects any provision of law (including regulations) in effect on the day before the date of enactment of this Act with respect to pre-enforcement review of any Federal environmental enforcement action.</text></subsection>
<subsection id="id01fd77ed2db94a4282a00e6a4559ddf1"><enum>(e)</enum><header>Effect on reclamation laws</header><text>The activities carried out by the Commissioner under this Act shall not establish a precedent or impact the authority provided under any other provision of the reclamation laws, including—</text> <paragraph id="id16e7b7ab6f3f47f383eab686fcf2080d"><enum>(1)</enum><text>the Reclamation Rural Water Supply Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/2401">43 U.S.C. 2401</external-xref> et seq.); and</text></paragraph>
<paragraph id="id31185237b0fc49b38b0945cc4161882d"><enum>(2)</enum><text>the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 991).</text></paragraph></subsection> <subsection id="id13c79d240b5846b5ac4a69b3aed1f94b"><enum>(f)</enum><header>Additional funding</header><text>Nothing in this Act prohibits the Fort Belknap Indian Community from seeking—</text>
<paragraph id="id26e1d11e05e54d31bec395d461fd080b"><enum>(1)</enum><text>additional funds for Tribal programs or purposes; or</text></paragraph> <paragraph id="id1efedcf4f78c4783a423e04a1b2cfe37"><enum>(2)</enum><text>funding from the United States or the State based on the status of the Fort Belknap Indian Community as an Indian Tribe.</text></paragraph></subsection>
<subsection id="id34bc19ce9a124fca9c0aa550758b8518"><enum>(g)</enum><header>Rights under State law</header><text>Except as provided in section 1 of article III of the Compact (relating to the closing of certain water basins in the State to new appropriations in accordance with the laws of the State), nothing in this Act or the Compact precludes the acquisition or exercise of a right arising under State law (as defined in section 6 of article II of the Compact) to the use of water by the Fort Belknap Indian Community, or a member or allottee of the Fort Belknap Indian Community, outside the Reservation by—</text> <paragraph id="id0f486be080e348ba84b9b7aaa66750f3"><enum>(1)</enum><text>purchase of the right; or</text></paragraph>
<paragraph id="id43e9809694c7411082b6bad28ad96fba"><enum>(2)</enum><text>submitting to the State an application in accordance with State law.</text></paragraph></subsection> <subsection id="id7fc24f56209f459d82b5e42fd4cec750"><enum>(h)</enum><header>Water storage and importation</header><text>Nothing in this Act or the Compact prevents the Fort Belknap Indian Community from participating in any project to import water to, or to add storage in, the Milk River Basin.</text></subsection>
<subsection id="idb75512bceb78447ab24e61c1164a2b1c"><enum>(i)</enum><header>Environmental protection</header>
<paragraph id="id621422ed72b04858b0ec8c743e1486e9"><enum>(1)</enum><header>Definition of little rockies mountains</header><text>In this subsection, the term <term>Little Rockies Mountains</term> means the mountains that—</text> <subparagraph id="id1116d67566624d2eb67bdb5a143cadbd"><enum>(A)</enum><text>form the southern boundary of the Reservation; and</text></subparagraph>
<subparagraph id="id702147804ddd4a4a892b98c5455cf5a8"><enum>(B)</enum><text>are sacred and culturally significant to the Fort Belknap Indian Community.</text></subparagraph></paragraph> <paragraph id="id104e2caf413041969817cd87014d04cd"><enum>(2)</enum><header>Protection</header><text>Nothing in the Compact or this Act limits—</text>
<subparagraph id="id0a5d536eea5d4e21848f34c187318072"><enum>(A)</enum><text>the authority of the United States, the State, or the Fort Belknap Indian Community to enforce any Federal, State, or Tribal law (including common law) relating to the protection of the environment; or</text></subparagraph> <subparagraph id="id089aac85768a4aabbd746909b16a6945"><enum>(B)</enum><text>any claim of the Fort Belknap Indian Community, a member of the Fort Belknap Indian Community, or an allottee, or of the United States, acting on behalf of the Fort Belknap Indian Community, a member of the Fort Belknap Indian Community, or an allottee, for—</text>
<clause id="ida05a8e53827040e089ad99a6d23073f7"><enum>(i)</enum><text>damage to water quality caused by mining activities in the Little Rockies Mountains; or</text></clause> <clause id="id7d24e697ca8f4cf1902b7306f77ef2d5"><enum>(ii)</enum><text>depletion in surface flows or groundwater on the southern end of the Reservation.</text></clause></subparagraph></paragraph></subsection></section>
<section id="idcfdfe557cf794afab6e4cd7d27199677"><enum>14.</enum><header>Termination on failure to meet enforceability date</header>
<subsection id="ided8a9154ac834d7c92a431b724345dee"><enum>(a)</enum><header>In general</header><text>If the Secretary has not published a statement of findings under section 10(f) by the applicable date described in subsection (b)—</text> <paragraph id="ide4c58426518c41c88e7888be9e7eb09a"><enum>(1)</enum><text>the authority provided by this Act shall terminate effective on—</text>
<subparagraph id="idaff17b2645ce49c8a1b45d98082e1aae"><enum>(A)</enum><text>January 1, 2035; or</text></subparagraph> <subparagraph id="id2cb5acaf8f1947a4bfbef7dda28364d4"><enum>(B)</enum><text>a later date agreed to by the Fort Belknap Indian Community and the Secretary;</text></subparagraph></paragraph>
<paragraph id="id5d7b63ec488c4f428c3e25b8302ea4b6"><enum>(2)</enum><text>any action taken by the Secretary and any contract or agreement entered into pursuant to this Act that can be reversed shall be void; and</text></paragraph> <paragraph id="id329f1761b4e14cb7a51bf719a3610742"><enum>(3)</enum><text>any waivers and releases executed under section 10(a) shall be void.</text></paragraph></subsection>
<subsection id="id6d97b09169a84bd09e1485c42a0cd5ac"><enum>(b)</enum><header>Date described</header><text>The date referred to in subsection (a) is, as applicable—</text> <paragraph id="id6eb786e3d707460b801b97c637a847be"><enum>(1)</enum><text>December 31, 2034; or</text></paragraph>
<paragraph id="idd41b36917b0d446b8db9f62c5f5fa4f9"><enum>(2)</enum><text>an alternative later date agreed to by the Fort Belknap Indian Community and the Secretary after reasonable notice to the State.</text></paragraph></subsection></section> <section id="id63a5717e323d4aceb9dd3cd0b0b5a703"><enum>15.</enum><header>Antideficiency</header><text display-inline="no-display-inline">The United States shall not be liable for any failure to carry out any obligation or activity authorized by this Act, including any obligation or activity under the Compact, if—</text>
<paragraph id="idf451b7ea865340e28fb95362dda837df"><enum>(1)</enum><text>adequate appropriations are not provided by Congress expressly to carry out the purposes of this Act; or</text></paragraph> <paragraph id="idae0a0d0059e74f25bce2273342dedd52"><enum>(2)</enum><text>there are not enough funds available in the Reclamation Water Settlements Fund established by section 10501(a) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/407">43 U.S.C. 407(a)</external-xref>) to carry out the purposes of this Act. </text></paragraph></section>
