introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Environmental Protection Agency to develop effluent limitations guidelines and standards and water quality criteria for PFAS under the Federal Water Pollution Control Act, to provide Federal grants to publicly owned treatment works to implement such guidelines and standards, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0DC81BD6E1084DB2AA527083D6BD5575"><section section-type="section-one" id="H354058EC943B40D98683BB46D4DF1BD4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Water Standards for PFAS Act of 2021</short-title></quote>.</text></section><section id="H26FF51D61B024167B6A1EA3C34185BC5"><enum>2.</enum><header>Clean Water Act effluent limitations guidelines and standards and water quality criteria for PFAS</header><subsection id="H80899B831D71485F8AB5AD21BD2C8027"><enum>(a)</enum><header>Deadlines</header><paragraph id="H16427B1E9471443EAAB281FCB0E87499"><enum>(1)</enum><header>Water quality criteria</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, the Administrator shall publish in the Federal Register human health water quality criteria for each measurable perfluoroalkyl substance, polyfluoroalkyl substance, and class of such substances.</text></paragraph><paragraph commented="no" id="H33A262D03D5F4F32B56A58AEE21B5DC5"><enum>(2)</enum><header>Effluent limitations guidelines and standards for priority industry categories</header><text display-inline="yes-display-inline">As soon as practicable, but not later than 4 years after the date of enactment of this section, the Administrator shall publish in the Federal Register a final rule establishing, for each priority industry category, effluent limitations guidelines and standards, in accordance with the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>), for the discharge (including a discharge into a publicly owned treatment works) of each measurable perfluoroalkyl substance, polyfluoroalkyl substance, and class of such substances.</text></paragraph></subsection><subsection commented="no" id="H585F8917CD2B49E5A377FD2D88D18F13"><enum>(b)</enum><header>Notification</header><text>The Administrator shall notify the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate of each publication made under this section.</text></subsection><subsection commented="no" id="H5D259345B09548A78E27501BDDF175B9"><enum>(c)</enum><header>Implementation assistance for publicly owned treatment works</header><paragraph commented="no" id="HD117D49783EF4E8C96A0C684E6621B07"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall award grants to owners and operators of publicly owned treatment works, to be used to implement effluent limitations guidelines and standards developed by the Administrator for a perfluoroalkyl substance, polyfluoroalkyl substance, or class of such substances.</text></paragraph><paragraph commented="no" id="H6DE6759F7FDB411DBCB395DC2DBB6E7D"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator to carry out this subsection $200,000,000 for each of fiscal years 2022 through 2026, to remain available until expended.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF2EC2C5EFEFC4640A583E3143B7FCB24"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="H18F17572F6CB4CAE94F9C2EA014169B0"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph commented="no" id="H648DADB03D624D838F78DC9EAFF0AF5A"><enum>(2)</enum><header>Effluent limitation</header><text display-inline="yes-display-inline">The term <term>effluent limitation</term> has the meaning given that term in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>).</text></paragraph><paragraph commented="no" id="H37F97EF8EC034DC4A859B82881E2B612"><enum>(3)</enum><header>Measurable</header><text display-inline="yes-display-inline">The term <term>measurable</term>, with respect to a chemical substance or class of chemical substances, means capable of being measured using—</text><subparagraph commented="no" id="idB54534692E5F480E9F15BBC39056B02F"><enum>(A)</enum><text>a test procedure promulgated or approved in accordance with part 136 of title 40, Code of Federal Regulations (or successor regulations); or</text></subparagraph><subparagraph commented="no" id="id512E9C1D00454560A5027B180AE3AEB7"><enum>(B)</enum><text>another analytical method for measuring a perfluoroalkyl substance, polyfluoroalkyl substance, or class of those substances, if the analytical method is validated by the Administrator.</text></subparagraph></paragraph><paragraph commented="no" id="H414615F4DEDF493ABB60ADDD4B06B3A6"><enum>(4)</enum><header>Perfluoroalkyl substance</header><text display-inline="yes-display-inline">The term <term>perfluoroalkyl substance</term> means a chemical of which all of the carbon atoms are fully fluorinated carbon atoms.</text></paragraph><paragraph commented="no" id="H93817256747948B8972A3AEA08E2F193"><enum>(5)</enum><header>Polyfluoroalkyl substance</header><text display-inline="yes-display-inline">The term <term>polyfluoroalkyl substance</term> means a chemical containing at least one fully fluorinated carbon atom and at least one carbon atom that is not a fully fluorinated carbon atom.</text></paragraph><paragraph id="HFC18AA0742FE46F192BBB66929CCC9D3"><enum>(6)</enum><header>Priority industry category</header><text>The term <term>priority industry category</term> means the following point source categories:</text><subparagraph id="H44CC90F80AB14A2096C8DA926A50C8DC"><enum>(A)</enum><text>Organic chemicals, plastics, and synthetic fibers, as identified in part 414 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph id="H77C0417A7CD843A390A737D9F64F62CB"><enum>(B)</enum><text display-inline="yes-display-inline">Pulp, paper, and paperboard, as identified in part 430 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph id="HDF2ADF9469774A2488A8E532921EDA02"><enum>(C)</enum><text display-inline="yes-display-inline">Textile mills, as identified in part 410 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph commented="no" id="H652D9D8364CB4CAC99CBF56B3E6D264A"><enum>(D)</enum><text>Electroplating, as identified in part 413 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph commented="no" id="H3746BE914D524F2F99A215503DF8F203"><enum>(E)</enum><text>Metal finishing, as identified in part 433 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph commented="no" id="HCEB60FD9935E4F0E8ED9DE861140DDBE"><enum>(F)</enum><text>Leather tanning and finishing, as identified in part 425 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph commented="no" id="HC43C545240314CB38277F0CB884ED1C7"><enum>(G)</enum><text>Paint formulating, as identified in part 446 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph commented="no" id="H90764B4CF8BE4BA2A2B98EA47138E058"><enum>(H)</enum><text>Electrical and electronic components, as identified in part 469 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph commented="no" id="HB3FE5AAAC5ED43AB823C4B15D5865F93"><enum>(I)</enum><text>Plastics molding and forming, as identified in part 463 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph></paragraph><paragraph id="H0A29E8DE2A354C35A0CCB4F7EBC5FB94"><enum>(7)</enum><header>Treatment works</header><text display-inline="yes-display-inline">The term <term>treatment works</term> has the meaning given that term in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>).</text></paragraph><paragraph id="id38740C6E7C1B437EB3ECFE4B22EC7712"><enum>(8)</enum><header>Water quality criteria</header><text>The term <term>water quality criteria</term> means the recommended criteria for water quality developed by the Administrator under section 304(a)(1) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1314">33 U.S.C. 1314(a)(1)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
