<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1901</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210527">May 27, 2021</action-date><action-desc><sponsor name-id="S314">Mr. Tester</sponsor> (for himself, <cosponsor name-id="S347">Mr. Moran</cosponsor>, <cosponsor name-id="S366">Ms. Warren</cosponsor>, <cosponsor name-id="S394">Ms. Smith</cosponsor>, <cosponsor name-id="S409">Mr. Luján</cosponsor>, <cosponsor name-id="S369">Mr. Markey</cosponsor>, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, <cosponsor name-id="S361">Ms. Hirono</cosponsor>, <cosponsor name-id="S406">Mr. Kelly</cosponsor>, <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>, and <cosponsor name-id="S359">Mr. Heinrich</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Act of June 18, 1934, to reaffirm the authority of the Secretary of the Interior to take land into trust for Indian Tribes, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBDB2516BC43A4105AE9E0FB1BD9125E3"><section section-type="section-one" id="HCD0B27BB8C604DFEAC3911E8B595F380"><enum>1.</enum><header>Authority reaffirmed</header><subsection id="H0B23B5F721464D10BC4B0E8C9D59BC1F"><enum>(a)</enum><header>Reaffirmation</header><text>Section 19 of the Act of June 18, 1934 (48 Stat. 988, chapter 576; <external-xref legal-doc="usc" parsable-cite="usc/25/5129">25 U.S.C. 5129</external-xref>) (commonly known as the <quote>Indian Reorganization Act</quote>), is amended—</text><paragraph id="HD5814CB04B7541F196D5D1749F574277"><enum>(1)</enum><text>in the first sentence—</text><subparagraph id="HE40669A46B904E0ABE025FEECEE08213"><enum>(A)</enum><text>by striking <quote>The term</quote> and inserting <quote>Effective beginning on June 18, 1934, the term</quote>; and</text></subparagraph><subparagraph id="HB3D4FB14FF634A7BB38162B5A1B9D3F9"><enum>(B)</enum><text>by striking <quote>any recognized Indian tribe now under Federal jurisdiction</quote> and inserting <quote>any federally recognized Indian tribe</quote>; and</text></subparagraph></paragraph><paragraph id="H2D56E620354B44C09BC493A65D065CAF"><enum>(2)</enum><text>by striking the third sentence and inserting the following: <quote>In this Act, the terms <quote>Indian tribe</quote> and <quote>tribe</quote> mean any Indian or Alaska Native tribe, band, nation, pueblo, village, or community that the Secretary of the Interior acknowledges to exist as an Indian tribe.</quote>.</text></paragraph></subsection><subsection id="H24A759D4B3024186AC9862F824FCD9F5"><enum>(b)</enum><header>Effective Date</header><text>The amendments made by subsection (a) shall take effect as if included in the Act of June 18, 1934 (48 Stat. 984, chapter 576; <external-xref legal-doc="usc" parsable-cite="usc/25/5101">25 U.S.C. 5101</external-xref> et seq.) (commonly known as the <quote>Indian Reorganization Act</quote>), on the date of the enactment of that Act.</text></subsection></section></legis-body></bill>
