which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Health and Human Services to award additional funding through the Sanitation Facilities Construction Program of the Indian Health Service, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H54E0BB513C3B4ADF83C9F969CBA251F1"><section section-type="section-one" id="H0A5B4FF9352A472EB9A784DF1CB4FFAB"><enum>1.</enum><header>Indian Health Service Sanitation Facilities Construction Program funding</header><subsection id="H81D0BC1FB0F0409B9D24D487363661FF"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="H193B81D37C104DF6AC151968787FCB1D"><enum>(1)</enum><text display-inline="yes-display-inline">the COVID–19 crisis has highlighted the lack of infrastructure and sanitation available in Native communities; and</text></paragraph><paragraph id="H0582B901967A412F8EB87A0480EA7F9E"><enum>(2)</enum><text display-inline="yes-display-inline">addressing the Sanitation Facilities Deficiency List of the Division of Sanitation Facilities and Construction of the Indian Health Service included in the Sanitation Deficiency System will—</text><subparagraph id="HCB3F3456513A4974AE2E86D56FDA5C78"><enum>(A)</enum><text display-inline="yes-display-inline">result in investments in necessary water infrastructure; and</text></subparagraph><subparagraph id="H721C10568F5F4FEE94F9880CDD7D4063"><enum>(B)</enum><text display-inline="yes-display-inline">improve health outcomes.</text></subparagraph></paragraph></subsection><subsection id="HE0E026DEAA47471FA2FF6EDCDA359A7B"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idBE0D77B578BE432B82F94717D5017CA0"><enum>(1)</enum><header>Sanitation Deficiency System</header><text>The term <term>Sanitation Deficiency System</term> means the system established by the Secretary under section 302(g) of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1632">25 U.S.C. 1632(g)</external-xref>) to identify, report, and prioritize the sanitation deficiencies of Indian Tribes and communities.</text></paragraph><paragraph id="id92F40DE8098C4319889A90E12292097E"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, acting through the Director of the Indian Health Service.</text></paragraph></subsection><subsection id="H59B57BC54DDC4F7B916E5D441253AADA"><enum>(c)</enum><header>Additional funding for sanitation facilities</header><paragraph id="H8390B4A065124302B1FC38D26EC4DDFA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall award additional funding under the Sanitation Facilities Construction Program for the planning, design, construction, modernization, improvement, and renovation of water, sewer, and solid waste sanitation facilities that are funded, in whole or part, by the Indian Health Service—</text><subparagraph id="id1BA4D1F81F6E47799BFE29881F73FF94"><enum>(A)</enum><text display-inline="yes-display-inline">through, or provided for in, a contract or compact with the Indian Health Service under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>);</text></subparagraph><subparagraph id="id1B5B90FA64E84CC7BCD487F742B8C28D"><enum>(B)</enum><text>pursuant to section 7 of the Act of August 5, 1954 (68 Stat. 674, chapter 658; 73 Stat. 267; <external-xref legal-doc="usc" parsable-cite="usc/42/2004a">42 U.S.C. 2004a</external-xref>); and </text></subparagraph><subparagraph id="id681958F170DD41E5B36322FF030D47AF"><enum>(C)</enum><text>pursuant to section 302 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1632">25 U.S.C. 1632</external-xref>).</text></subparagraph></paragraph><paragraph id="H0FEE7235195D45ABB9266CA53BB801EE"><enum>(2)</enum><header>Priority for funding</header><text>In awarding funding to sanitation facilities under paragraph (1), the Secretary shall prioritize sanitation facilities in accordance with the Sanitation Deficiency System.</text></paragraph></subsection><subsection id="HFF2B7134E9CB44548427487188F15B52"><enum>(d)</enum><header>Authorization of appropriations</header><paragraph id="H111F0AE6531A4356935398DF5D26834E"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to carry out this section $3,000,000,000 for fiscal year 2022, to remain available until expended.</text></paragraph><paragraph id="id2C8D69FD87E547FD8A94F1C0C49C4E58" commented="no"><enum>(2)</enum><header>Additional support</header><text> Of the funds appropriated under paragraph (1), $350,000,000 shall be for additional staffing support to carry out this section.</text></paragraph><paragraph id="HCB671A830A534B7392B7BC9B4400B601"><enum>(3)</enum><header>Requirement</header><text display-inline="yes-display-inline">Amounts made available under paragraph (1) shall be in addition to any amounts made available to carry out the purposes described in subsection (c)(1) under any other provision of law.</text></paragraph></subsection></section></legis-body></bill>
