designate Regional Ocean Partnerships of the National Oceanic and Atmospheric Administration, and for other purposes.</official-title></form><legis-body><section changed="not-changed" id="id9cc5a1b2-ddf7-40ef-808d-31c12e26b550" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Regional Ocean Partnership Act</short-title></quote>.</text></section><section changed="not-changed" id="id71d9e9c2-4270-4f55-80e9-05c530a7c1f1"><enum>2.</enum><header>Findings; sense of Congress; purposes</header><subsection id="idcd2e7dcb-2a48-41ac-9fad-8db5f3578cb5" changed="not-changed"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text><paragraph id="id13ab0974-5e77-4c92-a7b7-79ba98d55d43" changed="not-changed"><enum>(1)</enum><text>The ocean and coastal waters of the United States are foundational to the economy, security, global competitiveness, and well-being of the United States and continuously serve the people of the United States and other countries as an important source of food, energy, economic productivity, recreation, beauty, and enjoyment.</text></paragraph><paragraph id="ide375dee3-4251-4ceb-9ef4-0d9293e5fd48" changed="not-changed"><enum>(2)</enum><text>Over many years, the resource productivity and water quality of the ocean and coastal areas of the United States have been diminished by pollution, increasing population demands, economic development, and natural and man-made hazard events, both acute and chronic.</text></paragraph><paragraph id="idc6097b1a-50bd-4e4e-a034-0ec6dc3456ba" changed="not-changed"><enum>(3)</enum><text>Ocean and coastal areas of the United States are managed by State and Federal resource agencies and regulated on an interstate and regional scale by various overlapping Federal authorities, thereby creating a significant need for interstate coordination to enhance regional priorities, including the ecological and economic health of those areas.</text></paragraph><paragraph id="id6bd46cfe1e524d1a91c2045153aa0a37"><enum>(4)</enum><text>Tribal governments have unique expertise and knowledge important for the stewardship of the ocean and coastal waters of the United States. </text></paragraph></subsection><subsection id="id2368479a-31db-4ef0-9a3f-0095dab809f3" changed="not-changed"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph id="id5EB00321CA6F46FFBC1A99D069570C83" changed="not-changed"><enum>(1)</enum><text>the United States should seek to support interstate coordination of shared regional priorities relating to the management, conservation, resilience, and restoration of ocean and coastal areas to maximize efficiencies through collaborative regional efforts by Regional Ocean Partnerships, in consultation with Federal and State agencies, Tribal governments, and local authorities; </text></paragraph><paragraph id="idD58837C4CECB4A07BF1F2BAF66AEC7A6" changed="not-changed"><enum>(2)</enum><text>such efforts would enhance existing and effective State coastal management efforts based on shared regional priorities; and</text></paragraph><paragraph id="id17167932d16f42c3a18f094879f8bdf7"><enum>(3)</enum><text>Regional Ocean Partnerships should consult with Tribal governments and may include representation from Tribal governments.</text></paragraph></subsection><subsection id="id1e31fb8a2b5d49d8a1d0977e95bb26ed"><enum>(c)</enum><header>Purposes</header><text>The purposes of this Act are as follows:</text><paragraph id="idd160097d5e1048d095ebee886d98598c"><enum>(1)</enum><text>To complement and expand cooperative voluntary efforts intended to manage and restore ocean and coastal areas spanning across multiple State boundaries.</text></paragraph><paragraph id="id1e01548c016c445b9ee5f4acefce01cd"><enum>(2)</enum><text>To expand Federal support for monitoring, data management, and restoration activities in ocean and coastal areas.</text></paragraph><paragraph id="id4d869ef3ad844693a4cfd2e70477bcca"><enum>(3)</enum><text>To commit the United States to a comprehensive cooperative program to achieve improved water quality in, and improvements in the productivity of living resources of, all coastal ecosystems.</text></paragraph><paragraph id="id356c84f2d81f4f75b1a2286b6e54dc9e"><enum>(4)</enum><text>To authorize Regional Ocean Partnerships as intergovernmental coordinators for shared interstate and regional priorities relating to the collaborative management of the large marine ecosystems, thereby reducing duplication of efforts and maximizing opportunities to leverage support in the ocean and coastal regions.</text></paragraph><paragraph id="iddac4b942b88d46cd9c35447b5ec55680"><enum>(5)</enum><text>To empower States to take a lead role in managing oceans and coasts.</text></paragraph><paragraph id="idfdf412cf407a41d789ec4ec61abf5680"><enum>(6)</enum><text>To incorporate Tribal interests in the management of oceans and coasts and provide funding to support Tribal ocean and coastal resiliency activities in coordination with Regional Ocean Partnerships.</text></paragraph><paragraph id="ide7a0d692f58d4210adb2f9b6e7de34f1"><enum>(7)</enum><text>To enable Regional Ocean Partnerships, or designated fiscal management entities of such partnerships, to receive Federal funding to conduct the scientific research, conservation and restoration activities, and priority coordination on shared regional priorities necessary to achieve the purposes described in paragraphs (1) through (6).</text></paragraph></subsection></section><section changed="not-changed" id="ide478362a-e429-407f-81f2-c933f52837f9"><enum>3.</enum><header>Regional Ocean Partnerships</header><subsection id="id8d9574b6-e911-41d0-bdae-845cbed9f078" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id1bad383d-7eeb-4f61-be00-e15c472eb06b" changed="not-changed"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="id2c0c8845-795a-4132-9e85-b7891c66c93a" changed="not-changed"><enum>(2)</enum><header>Coastal state</header><text>The term <term>coastal state</term> has the meaning given that term in section 304 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58cd41d8-2cc0-40f1-a919-80b0151fe6b7" changed="not-changed"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph display-inline="no-display-inline" changed="not-changed" commented="no" id="id973552E0EE234B379CD1B633F8E08BC7"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given that term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>). </text></paragraph></subsection><subsection id="id03ffa87c-531c-4fd4-8042-d5b1f41c16b5" changed="not-changed"><enum>(b)</enum><header>Regional Ocean Partnerships</header><paragraph id="ide75569bb-7aca-4f77-acc4-6ecdb6fdc264" changed="not-changed"><enum>(1)</enum><header>In general</header><text>A coastal state may participate in a Regional Ocean Partnership with one or more other coastal states that share a common ocean or coastal area with the coastal state, without regard to whether the coastal states are contiguous.</text></paragraph><paragraph id="ida21936ce-433e-46dc-9e4b-42af65f8dae4" changed="not-changed"><enum>(2)</enum><header>Application</header><text>The Governor of a coastal state or the Governors of a group of coastal states may apply to the Secretary of Commerce, on behalf of a partnership, for the partnership to receive designation as a Regional Ocean Partnership if the partnership—</text><subparagraph id="id09ad5e29-a617-454c-aa1f-43e2a5beb68a" changed="not-changed"><enum>(A)</enum><text>meets the requirements under paragraph (3); and</text></subparagraph><subparagraph id="id2dfc42f7-8f40-457a-975d-ca22f0c2f268" changed="not-changed"><enum>(B)</enum><text>submits an application for such designation in such manner, in such form, and containing such information as the Secretary may require.</text></subparagraph></paragraph><paragraph id="id43a54c80-cfdb-4e9f-9e4c-65582c0ee5dd" changed="not-changed"><enum>(3)</enum><header>Requirements</header><text>A partnership is eligible for designation as a Regional Ocean Partnership by the Secretary under paragraph (2) if the partnership—</text><subparagraph id="id0aab57c2-6fbc-4775-9dbc-1088d741e18a" changed="not-changed"><enum>(A)</enum><text>is established to coordinate the interstate management of ocean and coastal resources;</text></subparagraph><subparagraph id="id39dab943-4569-4c61-9ecf-0b4802c57d7a" changed="not-changed"><enum>(B)</enum><text>focuses on the environmental issues affecting the ocean and coastal areas of the members participating in the partnership;</text></subparagraph><subparagraph id="id6981D8388BA2479F907DA295D89F3055" changed="not-changed"><enum>(C)</enum><text>complements existing State coastal and ocean management efforts on an interstate scale, focusing on shared regional priorities;</text></subparagraph><subparagraph id="idd91613c7-cd3b-426d-8d65-769c063d9960" changed="not-changed"><enum>(D)</enum><text>does not have a regulatory function; and</text></subparagraph><subparagraph id="id0860bc5b-a194-4a99-bd5f-ae97d5156377" changed="not-changed"><enum>(E)</enum><text>is not duplicative of an existing Regional Ocean Partnership designated under paragraph (4), as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id7f8c46ad-48c8-4d24-be33-337995def114" changed="not-changed"><enum>(4)</enum><header>Designation of certain entities as Regional Ocean Partnerships</header><text>Notwithstanding paragraph (2) or (3), the following entities are designated as Regional Ocean Partnerships:</text><subparagraph commented="no" id="idb305b74d-25b3-466e-8e56-98a94b0f35a9" changed="not-changed"><enum>(A)</enum><text>The Gulf of Mexico Alliance, comprised of the States of Alabama, Florida, Louisiana, Mississippi, and Texas.</text></subparagraph><subparagraph commented="no" id="idff6c5a77-6779-455f-a4e7-17f9b5b7ddde" changed="not-changed"><enum>(B)</enum><text>The Northeast Regional Ocean Council, comprised of the States of Maine, Vermont, New Hampshire, Massachusetts, Connecticut, and Rhode Island.</text></subparagraph><subparagraph commented="no" id="id4d106cd8-5d5a-4cd2-a9b7-ab4a4d7773e5" changed="not-changed"><enum>(C)</enum><text>The Mid-Atlantic Regional Council on the Ocean, comprised of the States of New York, New Jersey, Delaware, Maryland, and Virginia.</text></subparagraph><subparagraph commented="no" id="id835f4485-8b5c-4166-ab55-fc0d15eda6d3" changed="not-changed"><enum>(D)</enum><text>The West Coast Ocean Alliance, comprised of the States of California, Oregon, and Washington and the coastal Indian Tribes therein.</text></subparagraph></paragraph></subsection><subsection id="id54b75b3a-0512-4629-8545-c96770613590" changed="not-changed"><enum>(c)</enum><header>Governing bodies of Regional Ocean Partnerships</header><paragraph id="id08f306ff-5859-4f13-a7d5-0b87ae4c83ca" changed="not-changed"><enum>(1)</enum><header>In general</header><text>A Regional Ocean Partnership designated under subsection (b) shall be governed by a governing body.</text></paragraph><paragraph id="id2ea099fa-a3fc-437f-a480-719be75fb218" changed="not-changed"><enum>(2)</enum><header>Membership</header><text>A governing body described in paragraph (1)—</text><subparagraph id="id08b92bca-c70a-4386-9139-94068de235dd" changed="not-changed"><enum>(A)</enum><text>shall be comprised, at a minimum, of voting members from each coastal state participating in the Regional Ocean Partnership, designated by the Governor of the coastal state; and</text></subparagraph><subparagraph id="ideaa63c17-3137-410f-b467-9f7d6dabf054" changed="not-changed"><enum>(B)</enum><text>may include such other members as the partnership considers appropriate.</text></subparagraph></paragraph></subsection><subsection id="id7c85b275-edcd-4464-a1ee-5c1c3df45330" changed="not-changed"><enum>(d)</enum><header>Functions</header><text>A Regional Ocean Partnership designated under subsection (b) may perform the following functions:</text><paragraph id="idd84e994e-f55b-4e05-80f3-d1ad6264909e" changed="not-changed"><enum>(1)</enum><text>Promote coordination of the actions of the agencies of coastal states participating in the partnership with the actions of the appropriate officials of Federal agencies and State and Tribal governments in developing strategies—</text><subparagraph id="idc9c80dce-ed56-4121-9f4e-66e81bb78cdb" changed="not-changed"><enum>(A)</enum><text>to conserve living resources, increase valuable habitats, enhance coastal resilience and ocean management, promote ecological and economic health, and address such other issues related to the shared ocean or coastal area as are determined to be a shared, regional priority by those states; and</text></subparagraph><subparagraph id="id31480769-f282-48f4-85ca-deda16e3d34e" changed="not-changed"><enum>(B)</enum><text>to manage regional data portals and develop associated data products for purposes that support the priorities of the partnership.</text></subparagraph></paragraph><paragraph id="id57310557-3f18-44a3-b868-20425a22706d" changed="not-changed"><enum>(2)</enum><text>In cooperation with appropriate Federal and State agencies, Tribal governments, and local authorities, develop and implement specific action plans to carry out coordination goals.</text></paragraph><paragraph id="id022de138-8555-4e25-8d2a-78f5d3932e36" changed="not-changed"><enum>(3)</enum><text>Coordinate and implement priority plans and projects, and facilitate science, research, modeling, monitoring, data collection, and other activities that support the goals of the partnership through the provision of grants and contracts under subsection (f).</text></paragraph><paragraph id="idc3a63021-c9e9-4df4-9261-8710f9d20564" changed="not-changed"><enum>(4)</enum><text>Engage, coordinate, and collaborate with relevant governmental entities and stakeholders to address ocean and coastal related matters that require interagency or intergovernmental solutions.</text></paragraph><paragraph id="id5a717763-7a67-4bce-8f2c-67ebcf18f32b" changed="not-changed"><enum>(5)</enum><text>Implement outreach programs for public information, education, and participation to foster stewardship of the resources of the ocean and coastal areas, as relevant.</text></paragraph><paragraph id="id72cfdbcd-de6b-4e77-b4b0-90a0df23ca26" changed="not-changed"><enum>(6)</enum><text>Develop and make available, through publications, technical assistance, and other appropriate means, information pertaining to cross-jurisdictional issues being addressed through the coordinated activities of the partnership.</text></paragraph><paragraph id="idc757c1ed-664d-4b67-b082-32e37d458285" changed="not-changed"><enum>(7)</enum><text>Serve as a liaison with, and provide information to, international counterparts, as appropriate on priority issues for the partnership.</text></paragraph></subsection><subsection id="idd40862393cda4cda9adc681287b7a3b1"><enum>(e)</enum><header>Consultation and engagement</header><text>A Regional Ocean Partnership designated under subsection (b) shall maintain mechanisms for consultation and engagement with the following: </text><paragraph id="id14CFF6283AAF468E903B20A85AEC05DF"><enum>(1)</enum><text>The Federal Government. </text></paragraph><paragraph id="id42DAE6A41DD349BDB85535D09491BE6D"><enum>(2)</enum><text>Tribal governments. </text></paragraph><paragraph id="idCE976CE8553A400BA1F6A212FEB316D4"><enum>(3)</enum><text>Nongovernmental entities, including academic organizations, nonprofit organizations, and businesses.</text></paragraph></subsection><subsection id="id77c1f8d02a38493ea86ac037185625ab"><enum>(f)</enum><header>Grants and contracts</header><paragraph id="idfba828f279c1453a83b6d22efb26ce1f"><enum>(1)</enum><header>In general</header><text>A Regional Ocean Partnership designated under subsection (b) may, in coordination with existing Federal and State management programs, from amounts made available to the partnership by the Administrator or the head of another Federal agency provide grants and enter into contracts for the purposes described in paragraph (2).</text></paragraph><paragraph id="idd65e3799-890e-4c61-8b08-6777d9cd1a31" changed="not-changed"><enum>(2)</enum><header>Purposes</header><text>The purposes described in this paragraph include any of the following:</text><subparagraph id="id97a68c67-ef94-40ed-8550-132fbca14e21" changed="not-changed"><enum>(A)</enum><text>Monitoring the water quality and living resources of multi-State ocean and coastal ecosystems and coastal communities.</text></subparagraph><subparagraph id="id05e54397-ebd9-4131-99fc-a0502b9fb5a4" changed="not-changed"><enum>(B)</enum><text>Researching and addressing the effects of natural and human-induced environmental changes on—</text><clause id="idF976786C0DAF483784A87A400FDF18F8" changed="not-changed"><enum>(i)</enum><text>ocean and coastal ecosystems; and</text></clause><clause id="idE0B9A8A2B3CA41B1AF810F4997EB585D" changed="not-changed"><enum>(ii)</enum><text>coastal communities.</text></clause></subparagraph><subparagraph id="id6e9b758d-adaf-40cd-8f49-0ede0e88139f" changed="not-changed"><enum>(C)</enum><text>Developing and executing cooperative strategies that—</text><clause id="id0cfa662e-29c0-41a1-a89b-9f94b8c3b8a5" changed="not-changed"><enum>(i)</enum><text>address regional data issues identified by the partnership; and</text></clause><clause id="ideaf9c400-6b6d-4f99-a777-32fe1a97a2e0" changed="not-changed"><enum>(ii)</enum><text>will result in more effective management of common ocean and coastal areas.</text></clause></subparagraph></paragraph></subsection><subsection id="id2258b1a2-f03c-485e-ac4c-afb11833e712" changed="not-changed"><enum>(g)</enum><header>Report required</header><paragraph id="iddcb641e9-fbe7-4beb-a991-ef75d0a68061" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Not later than 5 years after the date of the enactment of this Act, the Administrator, in coordination with the Regional Ocean Partnerships designated under subsection (b), shall submit to Congress a report on the partnerships. </text></paragraph><paragraph id="idc841f706-7d92-4d28-8b5b-8a051bdc959f" changed="not-changed"><enum>(2)</enum><header>Report requirements</header><text>The report required by paragraph (1) shall include the following:</text><subparagraph id="id499ee41e-1afa-410d-a8dd-ac8b1e5f2e3a" changed="not-changed"><enum>(A)</enum><text>An assessment of the overall status of the work of the Regional Ocean Partnerships designated under subsection (b).</text></subparagraph><subparagraph changed="not-changed" id="id86859F49DF774151949ED5D56DACC55E"><enum>(B)</enum><text>An assessment of the effectiveness of the partnerships in supporting regional priorities relating to the management of common ocean and coastal areas. </text></subparagraph><subparagraph changed="not-changed" id="id62262DA6416E429D84F95EC5914F03A6"><enum>(C)</enum><text>An identification of any duplication of efforts between the partnerships and other entities. </text></subparagraph><subparagraph changed="not-changed" id="id1B62295F1925475CB97795D47B134234"><enum>(D)</enum><text>An assessment of the benefits and costs of the partnerships. </text></subparagraph><subparagraph id="id8679956d-b90a-4278-8724-22493f4edd85" changed="not-changed"><enum>(E)</enum><text>An assessment of the effectiveness of the strategies that the partnerships are supporting or implementing and the extent to which the priority needs of the regions covered by the partnerships are being met through such strategies.</text></subparagraph><subparagraph id="id90D673335C5B4E309D3018840DDCC09C" changed="not-changed"><enum>(F)</enum><text>An assessment of how the efforts of the partnerships support or enhance Federal and State efforts consistent with the purposes of this Act. </text></subparagraph><subparagraph id="id06cf8f11-f45a-4064-b590-900160acf2ec" changed="not-changed"><enum>(G)</enum><text>Such recommendations as the Administrator may have for improving— </text><clause changed="not-changed" id="id51EF6B21ACC54ED3B6FCD4C5D47A255A"><enum>(i)</enum><text>efforts of the partnerships to support the purposes of this Act; and </text></clause><clause id="idD47B1794EEF94F0880096668B7D03C33" changed="not-changed"><enum>(ii)</enum><text>collective strategies that support the purposes of this Act in coordination and consultation with all relevant Federal, State, and Tribal entities.</text></clause></subparagraph><subparagraph changed="not-changed" id="idA10871F304C640509E25D6EB8FF782AA"><enum>(H)</enum><text>The distribution of funds from each partnership for each fiscal year covered by the report. </text></subparagraph></paragraph></subsection><subsection id="id2155b069-bd24-4cae-b7a7-3588c3e339c2" changed="not-changed"><enum>(h)</enum><header>Availability of Federal funds</header><text>In addition to amounts made available to the Regional Ocean Partnerships designated under subsection (b) by the Administrator under this section, the head of any other Federal agency may provide grants to, enter into contracts with, or otherwise provide funding to such partnerships.</text></subsection><subsection id="idcadb6196-0470-4e34-bc78-96410754fd53" changed="not-changed"><enum>(i)</enum><header>Authorities</header><text>Nothing in this section establishes any new legal or regulatory authority of the National Oceanic and Atmospheric Administration or of the Regional Ocean Partnerships designated under subsection (b), other than—</text><paragraph id="ideec64744-9103-47dc-91e6-107a8f728170" changed="not-changed"><enum>(1)</enum><text>the authority of the Administrator to provide amounts to the partnerships; and</text></paragraph><paragraph id="ida9b9b520-c3d5-4265-bd0f-ad7d00c3b2c0" changed="not-changed"><enum>(2)</enum><text>the authority of the partnerships to provide grants and enter into contracts under subsection (f).</text></paragraph></subsection><subsection id="id98231188-bf71-46eb-afda-19f2cc747a37" changed="not-changed"><enum>(j)</enum><header>Funding</header><paragraph id="id23da7db65a0344029d5ba93b6a945a82"><enum>(1)</enum><header>Regional Ocean Partnerships</header><text>There are authorized to be appropriated to the National Oceanic and Atmospheric Administration the following amounts to be made available to the Regional Ocean Partnerships designated under subsection (b) or designated fiscal management entities of such partnerships to carry out activities of the partnerships under this Act:</text><subparagraph id="ide5fc36d669824951939e4f1d7a246877"><enum>(A)</enum><text>$10,100,000 for fiscal year 2022.</text></subparagraph><subparagraph id="idf3d112b4137a4ca19df20d898e40894f"><enum>(B)</enum><text>$10,202,000 for fiscal year 2023.</text></subparagraph><subparagraph id="id85bf3a971dc9406fb135bfc2891a8332"><enum>(C)</enum><text>$10,306,040 for fiscal year 2024.</text></subparagraph><subparagraph id="id5bebc6c9872f4d94aea23a91b18a08c8"><enum>(D)</enum><text>$10,412,160 for fiscal year 2025.</text></subparagraph><subparagraph changed="not-changed"><enum>(2)</enum><header>Distribution of amounts</header><text>Amounts made available under paragraph (1) shall be divided evenly among the Regional Ocean Partnerships designated under subsection (b).</text></paragraph><paragraph id="id8f64d7809af4464b88ab2737b3915251"><enum>(3)</enum><header>Tribal consultation</header><text>There is authorized to be appropriated to the National Oceanic and Atmospheric Administration $1,000,000 for each of fiscal years 2022 through 2026 for Indian Tribes to be distributed for purposes of participation in or engagement with the Regional Ocean Partnerships.</text></paragraph><paragraph id="id18320bd9cd994e2abccffd5f3d020df1"><enum>(4)</enum><header>Derivation</header><text>Funds to carry out the activities under this Act shall be derived from amounts authorized to be appropriated pursuant to paragraphs (1) and (3) that are appropriated after the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
