definitions</header><subsection id="idCA3257AC29834F12B87AAF9837DD22F2"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Coronavirus Containment Corps Act</short-title></quote>.</text></subsection><subsection id="id19ccb8ce64eb400fa073d418c4358e37"><enum>(b)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="id00c0ac60f4de4a31ba8feb882921d356"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" id="idd83e98980c194bcb9c5fc986ed448cdc"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives;</text></subparagraph><subparagraph commented="no" id="idDBD2A760E2A845DDA88A7C06D678AA5E"><enum>(B)</enum><text>the Committee on Education and Labor of the House of Representatives; and</text></subparagraph><subparagraph commented="no" id="id9d381b35676d486db4bd4dbf0dbcb7f9"><enum>(C)</enum><text>the Committee on Health, Education, Labor, and Pensions of the Senate.</text></subparagraph></paragraph><paragraph id="idb19ec21e32a4462dae6a91edf84bf087"><enum>(2)</enum><header>COVID–19 public health emergency</header><text>The term <term>COVID–19 public health emergency</term> means—</text><subparagraph id="ida11b866f99da4b3aa0cb6419b4234dc1"><enum>(A)</enum><text>the public health emergency declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, as a result of confirmed cases of 2019 Novel Coronavirus (2019–nCoV) and any successor to such declaration; or</text></subparagraph><subparagraph id="idebba9f06b73446d5b16c8ae28a229c84"><enum>(B)</enum><text>the national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) on March 13, 2020, as a result of confirmed cases of 2019 Novel Coronavirus (2019–nCoV).</text></subparagraph></paragraph><paragraph id="idad25b8cd200f4a81a8178b683fdca8a1"><enum>(3)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> shall have the meaning given such term in the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450</external-xref> et seq.).</text></paragraph><paragraph id="id02CD2311D7FC48CB92DFC0521D8D2A0E"><enum>(4)</enum><header>Secretary</header><text>Except as otherwise provided in this Act, the term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph><paragraph id="id9c912991fde64834afb7d4302f749911"><enum>(5)</enum><header>State</header><text>The term <term>State</term> includes any of the 50 States, the District of Columbia, Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands. </text></paragraph><paragraph id="idf4f5ac92d7294e599e3b86a71c44aefb"><enum>(6)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> shall have the meaning given such term in the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450">25 U.S.C. 450</external-xref> et seq.).</text></paragraph></subsection></section><section id="id97953105fcb34cd3af949e59dba156d7"><enum>2.</enum><header>Nationwide contact tracing strategy</header><subsection id="idd66b24f443ae4d7f9483d2e6749e19f2"><enum>(a)</enum><header>In general</header><text>Not later than 21 days after the date of enactment of this Act, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall—</text><paragraph id="id2968038d85be4bebaa0553d4474916d3"><enum>(1)</enum><text>provide to the appropriate congressional committees a strategy to expand COVID–19 contact tracing; and</text></paragraph><paragraph id="idbfff6aa063ba4258861fe43c863f2e40"><enum>(2)</enum><text>include in such strategy recommendations to augment the capacity of State, Tribal, and local public health departments to train and place individuals into a Coronavirus Containment Corps to—</text><subparagraph id="idccc9e4be3d394ebaa5866e620013ccc9"><enum>(A)</enum><text>investigate cases of COVID–19;</text></subparagraph><subparagraph id="idef7486537689439c86958583ca304a18"><enum>(B)</enum><text>identify the contacts of individuals confirmed or presumed to have been infected by coronavirus;</text></subparagraph><subparagraph id="idf59847f9994a4f3ab66db937718a6e60"><enum>(C)</enum><text>trace such contacts; and</text></subparagraph><subparagraph id="id5a4e193cdae242ed8a3669424fd21007"><enum>(D)</enum><text>provide supports to ensure that such contacts can take the precautions necessary to safely quarantine to stop the spread of COVID–19.</text></subparagraph></paragraph></subsection><subsection id="id9830a0538c9e4131a4278138b70b6e63"><enum>(b)</enum><header>Consultation</header><text>In developing the strategy under subsection (a), the Secretary shall consult with—</text><paragraph id="idc95f0a31a83345b3bfbb5f84f8a5f2c3"><enum>(1)</enum><text>State public health officials;</text></paragraph><paragraph id="idc5bf6284dca8433c90f46de35854c7f1"><enum>(2)</enum><text>Tribal public health officials, Indian Tribes, and Tribal organizations;</text></paragraph><paragraph id="id12c5218374ec4d17ba1c43853e484934"><enum>(3)</enum><text>local public health officials;</text></paragraph><paragraph id="id4a0313a5b396443aac15abeb5938e865"><enum>(4)</enum><text>the Director of the Indian Health Service; and</text></paragraph><paragraph id="id8240a57552664e45b9203f435f23dd0b"><enum>(5)</enum><text>experts with knowledge of or field experience concerning racial and ethnic disparities in public health and historically marginalized communities.</text></paragraph></subsection><subsection id="id41617a1a592e4cfc8fe2245c87f9d64a"><enum>(c)</enum><header>Requirements</header><text>The strategy under subsection (a) shall identify—</text><paragraph id="id6256586f20154cfd8a8bc5335d6125d2"><enum>(1)</enum><text>the minimum number of persons needed to investigate cases of COVID–19 and identify the contacts of individuals confirmed or presumed to have been infected by SARS–CoV–19 for each State and Indian Tribe;</text></paragraph><paragraph id="id4b32aae5d465409bab50e24bda797500"><enum>(2)</enum><text>the minimum number of contact tracers needed for each State and Indian Tribe;</text></paragraph><paragraph id="id5054347096824e5da7108614ac9670f0"><enum>(3)</enum><text>the minimum number of specialists needed to connect contacts described in paragraph (1) to social supports to ensure those contacts can take the precautions necessary to safely quarantine to stop the spread of COVID–19 for each State and Indian Tribe;</text></paragraph><paragraph id="idec666bd0c3544f1488b1fe5dee953e78"><enum>(4)</enum><text>the recommended qualifications necessary for case investigators, contact tracers, and social support specialists to perform such duties successfully;</text></paragraph><paragraph id="id6330700cea2f486fb68feb1f0f14e91a"><enum>(5)</enum><text>strategies to enable State, Tribal, and local public health departments to hire, train, and deploy case investigators, contact tracers, and social support specialists;</text></paragraph><paragraph id="idee44428cde9d44709858a4c773b04e07"><enum>(6)</enum><text>strategies to rapidly develop guidance and training materials (including training on social determinants of health, cultural competency, communications skills, and implicit and explicit bias training) necessary to support public health departments in preparing individuals to serve as case investigators, contact tracers, and social support specialists;</text></paragraph><paragraph id="ida54c4343366d4ac68eecadaf366dcfd3"><enum>(7)</enum><text>plans to use mobile or app-based contact tracing technology, including—</text><subparagraph id="ida1dac8fd263e43638cf3d48d78b78a19"><enum>(A)</enum><text>plans to prevent the misuse of data and to ensure the automatic deletion of data after the conclusion of the COVID–19 public health emergency; and</text></subparagraph><subparagraph id="id1480870a16ba4b8eb023129e52d717ae"><enum>(B)</enum><text>plans to prohibit data sharing with and within the Federal Government, with the exceptions of the Centers for Disease Control and Prevention and the Indian Health Service;</text></subparagraph></paragraph><paragraph id="id1bb409b70fab449fa56898fa5c8127ff"><enum>(8)</enum><text>strategies to record and publicly report deidentified data, while protecting—</text><subparagraph id="idcc8717bd03c74dada541eeac60e3404a"><enum>(A)</enum><text>the privacy of individuals and information regarding their personal health; and</text></subparagraph><subparagraph id="id99e72652603847fea274c8136247ae31"><enum>(B)</enum><text>Tribal data sovereignty;</text></subparagraph></paragraph><paragraph id="id571dd2953dd9433e9a3a9a91f673a0c8"><enum>(9)</enum><text>protocols to limit the risks posed to individual privacy and data security, including through data minimization, anonymizing and redacting, and limitations on sharing and storing personally identifiable information;</text></paragraph><paragraph id="id1b37b3b92ddf41009293e1dcaa4a5fd2"><enum>(10)</enum><text>strategies to monitor and evaluate best practices in contact tracing, with input from State, Tribal, and local public health departments; and</text></paragraph><paragraph id="idbb1690068f934f49aabf60decb17f8b0"><enum>(11)</enum><text>strategies to coordinate with State and Tribal workforce agencies to recruit newly unemployed individuals—</text><subparagraph id="id4c46e75d522c4ecc900a137cf7dd1f91"><enum>(A)</enum><text>prioritizing individuals from within the communities in which they will work; and</text></subparagraph><subparagraph id="id12e92a9826804051a990e1e65e6afbb9"><enum>(B)</enum><text>reflecting the diversity of that community.</text></subparagraph></paragraph></subsection><subsection id="ida3c200d018964ef39e465727921047aa"><enum>(d)</enum><header>Strategies To enable hiring, training, and deployment</header><text>Not later than 7 days after the strategy under subsection (a) is provided to the appropriate congressional committees, the Secretary shall provide the strategies described in subsection (c)(5) to States and Tribes.</text></subsection><subsection id="idc6063e5f40e34208917ecfe6c403a534"><enum>(e)</enum><header>Coordination</header><text>The Director of the Centers for Disease Control and Prevention shall coordinate with the Director of the Indian Health Service to ensure the strategy developed under this section meets the needs of Indian Tribes. </text></subsection></section><section id="id557af9f8fcb1465eb32bd02c0f647031"><enum>3.</enum><header>Grants to public health departments</header><subsection id="id07684fac55d34f28823bafdb73eb9892"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall award a grant to each State and local public health department that seeks a grant in accordance with this section to implement the strategy under section 2(a).</text></subsection><subsection id="id3305b1d134f44e5c9fdb0eae0a177d6c"><enum>(b)</enum><header>Formula</header><text>The Secretary shall allocate amounts made available pursuant to subsection (a) in accordance with a formula to be established by the Secretary that—</text><paragraph id="idd7af6f8aa942495db78a80b2ce98d01e"><enum>(1)</enum><text>provides a minimum level of funding to each grantee; and</text></paragraph><paragraph id="id3f593402d8184f94bc333ee83299a578"><enum>(2)</enum><text>allocates—</text><subparagraph id="id6be59f1f279d43238873ffbc453b4910"><enum>(A)</enum><text>additional funding among grantees based on—</text><clause id="id4de6191900714dd6845d55d48628b0e2"><enum>(i)</enum><text>population, including the presence of medically underserved populations (as defined in section 330(b)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(b)</external-xref>));;</text></clause><clause id="idc9d042401e9d461fad5d04be50a12be1"><enum>(ii)</enum><text>projected need for COVID–19 in vitro diagnostic tests (as defined in section 809.3 of title 21, Code of Federal Regulations (or successor regulations)) during the period of the grant;</text></clause><clause id="id24ff7f070fca40919ccdf0249085c756"><enum>(iii)</enum><text>the percentage of COVID–19 cases per 10,000 persons as of the date of submission of the application for the grant;</text></clause><clause id="idc6c3113e747a4c059ac8e17cad8e3693"><enum>(iv)</enum><text>COVID–19 case growth rate; and</text></clause><clause id="id667e98c9cac54d36bcde67dce1360da2"><enum>(v)</enum><text>projected number of COVID–19 cases during the period of the grant; and</text></clause></subparagraph><subparagraph id="ida788b98657884895b2e6c5ff53ba3462"><enum>(B)</enum><text>an additional increment for States that have a plan to increase the percentage of the population that will be tested.</text></subparagraph></paragraph></subsection><subsection id="id62305bfed2954f29badd3a367427b499"><enum>(c)</enum><header>Required uses of funds</header><text>Amounts made available to a grantee pursuant to subsection (a) shall be used for the following activities:</text><paragraph id="id1176e3af7610415ca003f36a62e90aa9"><enum>(1)</enum><text>Costs, including wages and benefits, including health care benefits, as appropriate, related to the recruiting and hiring of individuals—</text><subparagraph id="idd3f14cccadcd4d3abb2becb220db2316"><enum>(A)</enum><text>to serve as case investigators, contact tracers, and social support specialists described in paragraphs (1), (2), and (3), respectively, of section 2(c); and</text></subparagraph><subparagraph id="idf2d44ac94322447cbff1ac6f925ed1e3"><enum>(B)</enum><text>employed by—</text><clause id="id340c96c276aa4304bfb220263628d1d4"><enum>(i)</enum><text>the State or local government involved; or</text></clause><clause id="id5b8e6b06848d4c3e83e5711b7fac3bba"><enum>(ii)</enum><text>a nonprofit organization with demonstrated expertise in implementing public health programs.</text></clause></subparagraph></paragraph><paragraph id="idafc418ed7f0f4a59a5c9086fffeae85f"><enum>(2)</enum><text>Supplies necessary for grantees to implement the strategy under section 2, including any supplies, equipment, including personal protective equipment, or technology for individuals serving as case investigators, contact tracers, or social support specialists.</text></paragraph><paragraph id="id187e43f5a23f40e986dd40a73cf037b8"><enum>(3)</enum><text>Administrative costs and activities necessary for grantees to implement the strategy under section 2.</text></paragraph><paragraph id="ide512ef8ffeaa457ab86844503bf3932d"><enum>(4)</enum><text>Development of partnerships with State, Tribal, and local workforce development systems (as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)) to provide training and supportive service for individuals serving as case investigators, contact tracers, or social support specialists.</text></paragraph><paragraph id="id263cbcedd5344ed1a52214dd8c41d136"><enum>(5)</enum><text>Reporting to the Centers for Disease Control and Prevention on—</text><subparagraph id="idd4f7ecc36b434f90bcc05d219cf192c3"><enum>(A)</enum><text>implementation of the strategy under section 2; and</text></subparagraph><subparagraph id="id00d4d4b4dc5f4b7b8a728365e89fce09"><enum>(B)</enum><text>indicators of performance listed in section 5(c)(1).</text></subparagraph></paragraph></subsection><subsection id="ide7471aa4c8d74148b4ac307f06616684"><enum>(d)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $10,000,000,000, to remain available until expended.</text></subsection></section><section id="ide1c9751cc85e4a6eae1834dc48985917"><enum>4.</enum><header>Awards to Tribes and Tribal organizations</header><subsection id="idfe9b5f0db5cb4e41a255815f97b6768c"><enum>(a)</enum><header>In general</header><text>Subject to the availability of appropriations, the Secretary, acting through the Director of the Indian Health Service, in coordination with the Director of the Centers for Disease Control and Prevention and in consultation with Indian Tribes and Tribal organizations, shall award funds to Indian Tribes and Tribal organizations to implement the strategy under section 2.</text></subsection><subsection id="idf3798a8f38bf47ca936739f0f4f9d03c"><enum>(b)</enum><header>Formula</header><text>The Secretary shall allocate amounts made available pursuant to subsection (a) in accordance with a formula to be established by the Secretary in consultation with Indian Tribes and Tribal organizations that—</text><paragraph id="id2982ab6f451a4468a5e05a7cc2c97667"><enum>(1)</enum><text>provides a minimum level of funding to each federally recognized Indian Tribe; and</text></paragraph><paragraph id="id9e7eb0867e984147adfc8637c3f3aaa7"><enum>(2)</enum><text>allocates additional funding on the basis of population.</text></paragraph></subsection><subsection id="id46db05c7e76f4de49a5ffe884d917f0f"><enum>(c)</enum><header>Eligible activities</header><text>Amounts made available to an awardee pursuant to subsection (a) shall be used for the following activities:</text><paragraph id="id15da7a1e261441e89af3e0d8b2024e16"><enum>(1)</enum><text>Costs, including wages and benefits, including health care benefits, as appropriate, related to the recruiting and hiring of individuals—</text><subparagraph id="id9d212edbbd704a599d891f641aadc79d"><enum>(A)</enum><text>to serve as case investigators, contact tracers, and social support specialists, which may include community health representatives, described in paragraphs (1), (2), and (3), respectively, of section 2(c); and</text></subparagraph><subparagraph id="id7ed11ffc86c1457a8de22691ab4720e1"><enum>(B)</enum><text>employed by—</text><clause id="idf60f0e0718eb47419718ba771815eee8"><enum>(i)</enum><text>the Tribal government involved; or</text></clause><clause id="idc94d70ce1e404612b68d19caa475afbf"><enum>(ii)</enum><text>a nonprofit organization with demonstrated expertise in implementing public health programs.</text></clause></subparagraph></paragraph><paragraph id="ide3496302c5fd47999f668403f57a45c4"><enum>(2)</enum><text>Supplies necessary for awardees to implement the strategy under section 2, including any supplies, equipment, including personal protective equipment, or technology for individuals serving as case investigators, contact tracers, or social support specialists.</text></paragraph><paragraph id="id6ccbd9a1be9b4f468ddf0cf4c8ab7079"><enum>(3)</enum><text>Administrative costs and activities necessary for awardees to implement the strategy under section 2.</text></paragraph><paragraph id="id210393196b4e4fac8e2960896a23bb23"><enum>(4)</enum><text>Development of partnerships with State and local workforce development systems (as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)) to provide training and supportive service for individuals serving as case investigators, contact tracers, or social support specialists.</text></paragraph><paragraph id="id42fd13506d044686b3149b61c4949f3e"><enum>(5)</enum><text>Reporting to the Indian Health Service, which shall then report the information to the Centers for Disease Control and Prevention, on—</text><subparagraph id="idf142515e53724ded8d0f59337c0f8540"><enum>(A)</enum><text>implementation of the strategy under section 2; and</text></subparagraph><subparagraph id="id92788c8384a64da58e1a33c8abdfaacd"><enum>(B)</enum><text>indicators of performance listed in section 5(c)(1).</text></subparagraph></paragraph></subsection><subsection id="id409d5b5818bb40b8818029cf7c452680"><enum>(d)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $1,000,000,000, to remain available until expended.</text></subsection></section><section id="id685937ff8d7f4d3788afcbe24260a2a7"><enum>5.</enum><header>Reporting by the Centers for Disease Control and Prevention</header><subsection id="ide313b854b99846af9ce40549cc5d1ad4"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, and every 30 days thereafter, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall report to the appropriate congressional committees on the implementation of the strategy under section 2.</text></subsection><subsection id="ide1d03cd2901c4b3293f19b039f0906ff"><enum>(b)</enum><header>Reporting infrastructure</header><text>In carrying out subsection (a), the Secretary shall—</text><paragraph id="idfaba79c7337b4a979695423fb3508deb"><enum>(1)</enum><text>support a reporting infrastructure that—</text><subparagraph id="id2ed9732d83044a31a4c266c669988475"><enum>(A)</enum><text>minimizes administrative burdens on States, Indian Tribes, Tribal organizations, and localities; and</text></subparagraph><subparagraph id="id413cc90b0583455b8a9f7b7c0279afc9"><enum>(B)</enum><text>protects the privacy of individuals’ information; and</text></subparagraph></paragraph><paragraph id="id47bceb080fd64318ac417794bb35f083"><enum>(2)</enum><text>consult with Indian Tribes and Tribal organizations and coordinate with the Indian Health Service to create a reporting infrastructure for Indian Tribes and Tribal organizations that—</text><subparagraph id="idadc9be31f03a412da6747ba6aa5ac3ab"><enum>(A)</enum><text>honors and preserves Tribal data sovereignty; and</text></subparagraph><subparagraph id="id0bd11d5104c044bd95c52336db38c890"><enum>(B)</enum><text>ensures that Indian Tribes and Tribal organizations consent before any Tribal data is reported.</text></subparagraph></paragraph></subsection><subsection id="ideab1ad4f3fe2483a9fb3b65f14c6507f"><enum>(c)</enum><header>Requirements</header><text>The report under subsection (a) shall—</text><paragraph id="id7098db1cf5db42359405776f7681c84d"><enum>(1)</enum><text>for each State and Indian Tribe include—</text><subparagraph id="id302553409ef8497887eb17efb7c9a62b"><enum>(A)</enum><text>the number of case investigators hired, trained, and deployed;</text></subparagraph><subparagraph id="id4ccfd8d817504e779d0adda9968d4feb"><enum>(B)</enum><text>the number of contact tracers hired, trained, and deployed;</text></subparagraph><subparagraph id="id07f924708af8486dabdbc57e9d76ad4e"><enum>(C)</enum><text>the number of social support specialists hired, trained, and deployed;</text></subparagraph><subparagraph id="ide21cd38e0a18413391e5b2a0793506cc"><enum>(D)</enum><text>the number of case investigations launched;</text></subparagraph><subparagraph id="id1f7f596bb9e249ad8f60de1d9b2aa817"><enum>(E)</enum><text>the percentage of contacts reached compared to the percentage of contacts identified;</text></subparagraph><subparagraph id="id9ad7cc6bc9b34ce792b990865c187062"><enum>(F)</enum><text>the percentage of contacts quarantined or isolated compared to the percentage of contacts reached;</text></subparagraph><subparagraph id="id59da1519893d4e02a564d481a0e612e4"><enum>(G)</enum><text>the percentage of contacts connected to social supports compared to the percentage of contacts needing such supports to quarantine; and</text></subparagraph><subparagraph id="id510c5b809f4447a2848ecb194cdcaa55"><enum>(H)</enum><text>a description of any barriers that limit the ability of contacts to quarantine or isolate or access needed social supports; </text></subparagraph></paragraph><paragraph id="idfe8205d3526644e48bb6831489dfa471"><enum>(2)</enum><text>contextualize data reported so as to mitigate discrimination against historically marginalized communities; and</text></paragraph><paragraph id="id4c798c902f4d4f99a1f9b4bd1bd74b4f"><enum>(3)</enum><text>be made public on the internet website of the Centers for Disease Control and Prevention.</text></paragraph></subsection></section><section id="id6a134250397e446bac3e886cd5b38504"><enum>6.</enum><header>Grants to State and Tribal workforce agencies</header><subsection id="idf01c28eae1594b90976623a1950b78bd"><enum>(a)</enum><header>Definitions</header><paragraph id="idb8a05ab58801432fb0a6ac1f4c9a80c2"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this section, the terms used in this section shall have the meanings given such terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><paragraph id="id3B6DDC216E9D4C2C96E08851D48FE5E4"><enum>(2)</enum><header>Other definitions</header><text>In this section:</text><subparagraph id="id647b0abdeb6a4553a1cc5b8f25d63749"><enum>(A)</enum><header>Apprenticeship; apprenticeship program</header><text>The term <term>apprenticeship</term> or <term>apprenticeship program</term> means an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>) (50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.), including any requirement, standard, or rule promulgated under such Act, as such requirement, standard, or rule was in effect on December 30, 2019.</text></subparagraph><subparagraph id="id43061c8b116643f2982fc474f8fbb786"><enum>(B)</enum><header>Contact tracing and related positions</header><text>The term <term>contact tracing and related positions</term> means employment related to contact tracing, surveillance, containment, and mitigation activities.</text></subparagraph><subparagraph id="id4f7d6d67500e4adcaed283ca3d73ad16"><enum>(C)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><clause id="id8371e42356844296a075b4da24f53e66"><enum>(i)</enum><text>a State or territory, including the District of Columbia and Puerto Rico;</text></clause><clause id="id024c2077971f4778b83ff7ff4a22318d"><enum>(ii)</enum><text>an Indian Tribe, Tribal organization, Alaska Native entity, Indian-controlled organization serving Indians, urban Indian organization (as defined in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>)), or a Native Hawaiian organization;</text></clause><clause id="id1a7723c8d3f74e07924853c19e5dba20"><enum>(iii)</enum><text>an outlying area; or</text></clause><clause id="idc70040e84828408a903cc42792863103"><enum>(iv)</enum><text>a local board, if an eligible entity under clauses (i) through (iii) has not applied with respect to the area over which the local board has jurisdiction as of the date on which the local board submits an application under subsection (c).</text></clause></subparagraph><subparagraph id="idf906e0140a7746aea652d66e5bc12a85"><enum>(D)</enum><header>Eligible individual</header><text>Notwithstanding section 170(b)(2) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3225">29 U.S.C. 3225(b)(2)</external-xref>), the term <term>eligible individual</term> means an individual seeking or securing employment in contact tracing or related positions and is served by an eligible entity or community-based organization receiving funding under this section.</text></subparagraph><subparagraph id="ida36880fd9bcd4497bb287430072ff0cd"><enum>(E)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></subparagraph></paragraph></subsection><subsection id="id026b3b1566a34cb4bbf592a33b4a3604"><enum>(b)</enum><header>Grants</header><paragraph id="idbf8f41190ccd4bf68c159664f8a7b096"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations under subsection (g), the Secretary shall award national dislocated worker grants under section 170(b)(1)(B) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3225">29 U.S.C. 3225(b)(1)(B)</external-xref>) to each eligible entity that seeks a grant to assist local boards and community-based organizations in carrying out activities under subsections (f) and (d), respectively, for the following purposes:</text><subparagraph id="id86ffe963e47e4ea39578cea5f26c6427"><enum>(A)</enum><text>To support the recruitment, placement, and training, as applicable, of eligible individuals seeking employment in contact tracing and related positions in accordance with the strategy established under section 2.</text></subparagraph><subparagraph id="idf668ed9675764dfba163ffb413f358e8"><enum>(B)</enum><text>To assist with the employment transition to new employment or education and training of individuals employed under this section in preparation for and upon termination of such employment.</text></subparagraph></paragraph><paragraph id="ida67659cf048e463593f02cc3f6487e2b"><enum>(2)</enum><header>Timeline</header><text>The Secretary shall—</text><subparagraph id="id768f0229beb2439b9657425ac6395f9a"><enum>(A)</enum><text>issue application requirements under subsection (c) not later than 10 days after the date of enactment of this section; and</text></subparagraph><subparagraph id="id739fd466ace744df96b8766db8491b16"><enum>(B)</enum><text>award grants to an eligible entity under paragraph (1) not later than 10 days after the date on which the Secretary receives an application from such entity.</text></subparagraph></paragraph></subsection><subsection id="id3f379406e6de4319b85940c91b7b614a"><enum>(c)</enum><header>Grant application</header><text>An eligible entity applying for a grant under this section shall submit an application to the Secretary, at such time and in such form and manner as the Secretary may reasonably require, which shall include a description of—</text><paragraph id="id7df1c48262ee46a586a4249b6d6a073e"><enum>(1)</enum><text>how the eligible entity will support the recruitment, placement, and training, as applicable, of eligible individuals seeking employment in contact tracing and related positions by partnering with—</text><subparagraph id="id3afe8fa670114e1d809ea720b84e1c06"><enum>(A)</enum><text>a State, local, Tribal, or territorial health department; or</text></subparagraph><subparagraph id="id7076d62d49704baf80c320941160a07a"><enum>(B)</enum><text>a community-based organization partnering with such health departments;</text></subparagraph></paragraph><paragraph id="idbe7f337eab0b47b2b46373d041737fc5"><enum>(2)</enum><text>how the activities described in paragraph (1) will support State efforts to address the demand for contact tracing and related positions with respect to—</text><subparagraph id="idd6f131b683d842f0aa1ff34ea715d50e"><enum>(A)</enum><text>the State plans referred to in the heading <quote>Public Health and Social Services Emergency Fund</quote> in title I of division B of the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>);</text></subparagraph><subparagraph id="idd528cdc257db40eba98af535af6f6c16"><enum>(B)</enum><text>the strategy established under section 2; and</text></subparagraph><subparagraph id="id44e15e8b68f14612b37203e4a87d75ff"><enum>(C)</enum><text>the number of eligible individuals that the State plans to recruit and train under the plans and strategies described in subparagraphs (A) and (B);</text></subparagraph></paragraph><paragraph id="idb59f825aeb59451ebd2c066844edb310"><enum>(3)</enum><text>the specific strategies for recruiting and placement of eligible individuals from or residing within the communities in which they will work, including—</text><subparagraph id="idb40c0f9ae5f24dbaa0d93704bbdcde50"><enum>(A)</enum><text>plans for the recruitment of eligible individuals to serve as contact tracers and related positions, including dislocated workers, individuals with barriers to employment, veterans, new entrants in the workforce, or underemployed or furloughed workers, who are from or reside in or near the local area in which they will serve, and who, to the extent practicable—</text><clause id="id4be69243536e452a825e92c78191b474"><enum>(i)</enum><text>have experience or a background in industry-sectors and occupations such as public health, social services, customer service, case management, or occupations that require related qualifications, skills, or competencies, such as strong interpersonal and communication skills, needed for contact tracing or related positions; or</text></clause><clause id="id76da26e5c45a4309aadf75757f3b9eab"><enum>(ii)</enum><text>seek to transition to public health and public health related occupations upon the conclusion of employment in contact tracing or related positions; and</text></clause></subparagraph><subparagraph id="id861bee597cfa48f18573cd36f08c3355"><enum>(B)</enum><text>how such strategies will take into account the diversity of such community, including racial, ethnic, socioeconomic, linguistic, or geographic diversity;</text></subparagraph></paragraph><paragraph id="ida5cf81f693ff403798d25b5726319867"><enum>(4)</enum><text>the amount, timing, and mechanisms for distribution of funds provided to local boards or through subgrants as described in subsection (d);</text></paragraph><paragraph id="idaded9e0c99474681a5625b788f523bdb"><enum>(5)</enum><text>for eligible entities described in subparagraphs (A) through (C) of subsection (a)(4), a description of how the eligible entity will ensure the equitable distribution of funds with respect to—</text><subparagraph id="id9bf67f7aff0d456cbebe8c01013606e8"><enum>(A)</enum><text>geography (such as urban and rural distribution);</text></subparagraph><subparagraph id="id1ad40acf5c02452f98441105af5a1e96"><enum>(B)</enum><text>medically underserved populations (as defined in section 330(b)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b(b)</external-xref>));</text></subparagraph><subparagraph id="idc12dd043a3474685847892f8550a464c"><enum>(C)</enum><text>health professional shortage areas (as defined under section 332(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254e">42 U.S.C. 254e(a)</external-xref>)); and</text></subparagraph><subparagraph id="id1b09a4da24594a89a675900365a254c3"><enum>(D)</enum><text>the racial and ethnic diversity of the area; and</text></subparagraph></paragraph><paragraph id="id9462bf490f534534a99eaa87fb079a55"><enum>(6)</enum><text>for eligible entities who are local boards, a description of how a grant to such eligible entity would serve the equitable distribution of funds as described in paragraph (5).</text></paragraph></subsection><subsection id="id3a3bbbb56155483799a2d626312ec5b7"><enum>(d)</enum><header>Subgrant authorization and application process</header><paragraph id="idbe61077335da42e89b1b2222bed0858b"><enum>(1)</enum><header>In general</header><text>An eligible entity may award a subgrant to a community-based organization for the purposes of partnering with a State or local board to conduct outreach and education activities to inform potentially eligible individuals about employment opportunities in contact tracing and related positions.</text></paragraph><paragraph id="id123c39bd70524a23a9c77d8642441bfc"><enum>(2)</enum><header>Application</header><text>A community-based organization shall submit an application at such time and in such manner as the eligible entity may reasonably require, including—</text><subparagraph id="idf3420e80f7a043219f45efdfd4920be1"><enum>(A)</enum><text>a demonstration of the community-based organization’s established expertise and effectiveness in community outreach in the local area that such organization plans to serve;</text></subparagraph><subparagraph id="id025de053eb8946359e07acaa16c09d75"><enum>(B)</enum><text>a demonstration of the community-based organization’s expertise in providing employment or public health information to the local areas in which such organization plans to serve; and</text></subparagraph><subparagraph id="id77d98853a2c0456db47b194b4b0ebb4a"><enum>(C)</enum><text>a description of the expertise of the community-based organization in utilizing culturally competent and multilingual strategies in the provision of services.</text></subparagraph></paragraph></subsection><subsection id="id20fe47baaf804205aeca1af101f531fa"><enum>(e)</enum><header>Grant distribution</header><paragraph id="id744c91dfa8854bee8fcd63038f2c7a58"><enum>(1)</enum><header>Federal distribution</header><subparagraph id="idf20aa57ed06e4e1dae7105456d9f0134"><enum>(A)</enum><header>Use of funds</header><text>The Secretary shall use funds appropriated to carry out this section as follows:</text><clause id="idd28f0635dd4e48bd8e4c785743d84760"><enum>(i)</enum><text>Subject to clause (ii), the Secretary shall distribute funds among eligible entities in accordance with a formula to be established by the Secretary that provides a minimum level of funding to each eligible entity that seeks a grant under this section and allocates additional funding based on a formula that shall give first priority based on the number and proportion of contact tracing and related positions that the State plans to recruit, place, and train individuals as a part of the State strategy described in subsection (c)(2)(A).</text></clause><clause id="id3859e8771f574448a344b996c355aeef"><enum>(ii)</enum><text>Not more than 2 percent of the funding for administration of the grants and for providing technical assistance to recipients of funds under this section.</text></clause></subparagraph><subparagraph id="ideb43b7096bcb4374b6f13b8bf0d017ba"><enum>(B)</enum><header>Equitable distribution</header><text>If the geographic region served by 1 or more eligible entities overlaps, the Secretary shall distribute funds among such entities in such a manner that ensures equitable distribution with respect to the factors under in subsection (c)(5).</text></subparagraph></paragraph><paragraph id="id29b3b0ca46174af896cff14e37a368f0"><enum>(2)</enum><header>Eligible entity use of funds</header><text>An eligible entity described in subparagraphs (A) through (C) of subsection (a)(4)—</text><subparagraph id="idb0966a21916b4def84a9deb2b60f5385"><enum>(A)</enum><text>shall, not later than 30 days after the date on which the entity receives grant funds under this section, provide not less than 70 percent of grant funds to local boards for the purpose of carrying out activities in subsection (f);</text></subparagraph><subparagraph id="idd0d47315be3047c2ab21fd7689a6cce2"><enum>(B)</enum><text>may use up to 20 percent of such funds to make subgrants to community-based organizations in the service area to conduct outreach, to potential eligible individuals, as described in subsection (d);</text></subparagraph><subparagraph id="idfae9381d3f7b4d6aa636fa517d2ca83d"><enum>(C)</enum><text>in providing funds to local boards and awarding subgrants under this subsection shall ensure the equitable distribution with respect to the factors described in subsection (c)(5); and</text></subparagraph><subparagraph id="idc84b310f549647d3808641534e7fe9b1"><enum>(D)</enum><text>may use not more than 10 percent of the funds awarded under this section for the administrative costs of carrying out the grant and for providing technical assistance to local boards and community-based organizations.</text></subparagraph></paragraph><paragraph id="id24db05c0070d4e56821db8d2f7e1d669"><enum>(3)</enum><header>Local board use of funds</header><text>A local board, or an eligible entity that is a local board, shall use—</text><subparagraph id="id6abe233d3a1741abaab00bb9d3ea6ba8"><enum>(A)</enum><text>not less than 60 percent of the funds for recruitment and training for activities in accordance with the strategy established under section 2;</text></subparagraph><subparagraph id="ide996fe4c79e742c0a66bd0103f7e459a"><enum>(B)</enum><text>not less than 30 of the funds to support the transition of individuals hired as contact tracers and related positions into an education or training program, or unsubsidized employment upon completion of such positions; and</text></subparagraph><subparagraph id="idcc7834cc2f5e4e81bd81434ec3d329fa"><enum>(C)</enum><text>not more than 10 percent of the funds for administrative costs.</text></subparagraph></paragraph></subsection><subsection id="id751ac1c9c7ce4aeca437c567733562d0"><enum>(f)</enum><header>Eligible activities</header><text>The State or local boards shall use funds awarded under this section to support the recruitment and placement of eligible individuals, training and employment transition as related to contact tracing and related positions, and for the following activities:</text><paragraph id="id59580a8233b244aebb107d94fa6b4328"><enum>(1)</enum><text>Establishing or expanding partnerships with—</text><subparagraph id="idd8d4989891cd459f850554ebb8b24233"><enum>(A)</enum><text>State, local, Tribal, and territorial public health departments;</text></subparagraph><subparagraph id="id116a426f18fc492e97e88ac99483010d"><enum>(B)</enum><text>community-based health providers, including community health centers and rural health clinics;</text></subparagraph><subparagraph id="id4d1cd3fa3a1146e2bbfbb99c3b81c94c"><enum>(C)</enum><text>labor organizations or joint labor management organizations;</text></subparagraph><subparagraph id="id5a7ab0d543f142d9b02c6ff29a66ad6d"><enum>(D)</enum><text>2-year and 4-year institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)), including institutions eligible to receive funds under section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>); and</text></subparagraph><subparagraph id="id0fe03f44aa35418a9cbb99a37c432dc4"><enum>(E)</enum><text>community action agencies or other community-based organizations serving local areas in which there is a demand for contact tracers and related positions.</text></subparagraph></paragraph><paragraph id="idbbdd9d5aebd6488cb4c203722e74d48e"><enum>(2)</enum><text>Providing training for contact tracing and related positions in coordination with State, local, Tribal, or territorial health departments that is consistent with the State or territorial testing and contact tracing strategy and ensuring that eligible individuals receive compensation while participating in such training.</text></paragraph><paragraph id="id0fa5475e489540a38c4ee56af6ca5abd"><enum>(3)</enum><text>Providing eligible individuals with—</text><subparagraph id="id8cf25e9ee1504b088a6d9f7cf1622aa0"><enum>(A)</enum><text>adequate and safe equipment, environments, and facilities for training and supervision, as applicable;</text></subparagraph><subparagraph id="idb7da6354f7d640da88a1a4ae8488b14c"><enum>(B)</enum><text>information regarding the wages and benefits related to contact tracing and related positions, as compared to State, local, and national averages;</text></subparagraph><subparagraph id="id6863e2b00d7d4b46aa205966b499c3ce"><enum>(C)</enum><text>supplies and equipment needed by the program participants to support placement of an individual in contact tracing and related positions, as applicable;</text></subparagraph><subparagraph id="iddc36dbbf31a6442ebf41413e2b8550d9"><enum>(D)</enum><text>an individualized employment plan for each eligible individual, as applicable—</text><clause id="idc01e6fa20b6b417c89c8f7372c707513"><enum>(i)</enum><text>in coordination with the entity employing the eligible individual in a contact tracing or related position; and</text></clause><clause id="id00e0ab4402544dcb83ac0620a69e0fda"><enum>(ii)</enum><text>which shall include providing a case manager to work with each eligible individual to develop the plan, which may include—</text><subclause id="id5fca6163eeb94ff59989536eda07c863"><enum>(I)</enum><text>identifying employment and career goals, and setting appropriate achievement objectives to attain such goals; and</text></subclause><subclause id="id2d7a54833b404cfba91f5bfe5451a432"><enum>(II)</enum><text>exploring career pathways that lead to in-demand industries and sectors, including in public health and related occupations; and</text></subclause></clause></subparagraph><subparagraph id="id966534013ac14b408fa7a6870bfb6785"><enum>(E)</enum><text>services for the period during which the individual is employed in a contact tracing and related position to ensure job retention, which may include—</text><clause id="idfbcef5e4f2804b3c9367635b61f3fcf3"><enum>(i)</enum><text>supportive services throughout the term of employment;</text></clause><clause id="id1b42263054934efab4881b319060dd26"><enum>(ii)</enum><text>a continuation of skills training as related to employment as a contact tracer or related positions, that is conducted in collaboration with the employers of such participants;</text></clause><clause id="id8d33e441b0144ecfaa6e132a48d7481f"><enum>(iii)</enum><text>mentorship services and job retention support for eligible individuals; or</text></clause><clause id="idfff62afdbc3a4ed9b208d3a00ced5465"><enum>(iv)</enum><text>targeted training for managers and workers working with eligible individuals (such as mentors), and human resource representatives.</text></clause></subparagraph></paragraph><paragraph id="id58068319c4894b0b86c7b82dc10c164f"><enum>(4)</enum><text>Supporting the transition and placement in unsubsidized employment for eligible individuals serving in the contact tracing or related positions after such positions are no longer necessary in the State or local area, including—</text><subparagraph id="id2c617eaaa50a4eda9213b3d749c3975c"><enum>(A)</enum><text>any additional training and employment activities as described in section 170(d)(4) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3225">29 U.S.C. 3225(d)(4)</external-xref>);</text></subparagraph><subparagraph id="idb9358334709240ec9def538ac77c006e"><enum>(B)</enum><text>developing the appropriate combination of services to enable the eligible individual to achieve the employment and career goals identified under paragraph (3)(D)(ii)(I); and</text></subparagraph><subparagraph id="id40f4f58a988e4d5c9337aa79ffb72411"><enum>(C)</enum><text>services to assist eligible individuals in maintaining employment for not less than 12 months after the completion of employment in contact tracing or related positions, as appropriate.</text></subparagraph></paragraph><paragraph id="id98d6766231164dd6b799bb0dbc146443"><enum>(5)</enum><text>Any other activities as described in subsections (a)(3) and (b) of section 134 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174</external-xref>).</text></paragraph></subsection><subsection id="idadac5fd7db4644a3afefe62cd7507a19"><enum>(g)</enum><header>Limitation</header><text>Notwithstanding section 170(d)(3)(A) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3225">29 U.S.C. 3225(d)(3)(A)</external-xref>), a person may be employed in a contact tracing or related position using funds under this section for a period not greater than 2 years.</text></subsection><subsection id="id1edfce1690d548299b36c2a2c26fb620"><enum>(h)</enum><header>Reporting by the Department of Labor</header><paragraph id="idcd2c2a0411574c7eb3bf7c4e3135db61"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, and once grant funds have been expended under this section, the Secretary shall report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives, and make publicly available a report containing a description of—</text><subparagraph id="id5c139d41e6bc49d79ae385426d8b59b9"><enum>(A)</enum><text>the number of eligible individuals recruited, hired, or trained as contact tracers or in related positions;</text></subparagraph><subparagraph id="id2b167a0298694f9a93f0433eff60a170"><enum>(B)</enum><text>the number of individuals successfully transitioned to unsubsidized employment or training at the completion of employment in contact tracing or related positions using funds under this section;</text></subparagraph><subparagraph id="id2369e193bc8d40bdbe6e78fccef0da16"><enum>(C)</enum><text>the number of such individuals who were unemployed prior to being hired, trained, or deployed as described in paragraph (1);</text></subparagraph><subparagraph id="idf102b16ec01a421ca749e5f13fff87ab"><enum>(D)</enum><text>the performance of each program supported by funds under this section with respect to the indicators of performance under section 116 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141</external-xref>), as applicable;</text></subparagraph><subparagraph id="id81f41b1026d140fd8e1c24bd1335015f"><enum>(E)</enum><text>the number of individuals in unsubsidized employment within 6 months and 1 year, respectively, of the conclusion of employment in contact tracing or related positions and, of those, the number of individuals within a State, territorial, or local public health department in an occupation related to public health;</text></subparagraph><subparagraph id="id5dce8b4997c648d5bdc14cf57c74f475"><enum>(F)</enum><text>any information on how eligible entities, local boards, or community-based organizations that received funding under this section were able to support the goals of the strategy established under section 2; and</text></subparagraph><subparagraph id="id7d92ef971bf149b88b650ae4f94e8cee"><enum>(G)</enum><text>best practices for improving and increasing the transition of individuals employed in contact tracing or related positions to permanent, full-time employment.</text></subparagraph></paragraph><paragraph id="id51489aece5fc433c82080757eabad97b"><enum>(2)</enum><header>Disaggregation</header><text>All data reported under paragraph (1) shall be disaggregated by race, ethnicity, sex, age, and, with respect to individuals with barriers to employment, subpopulation of such individuals, except for when the number of participants in a category is insufficient to yield statistically reliable information or when the results would reveal personally identifiable information about an individual participant.</text></paragraph></subsection><subsection id="id08e2bad3f39b452bb1b9dcb8b7fa70d0"><enum>(i)</enum><header>Special rule</header><text>Any funds for programs under this section that are used to fund an apprenticeship or apprenticeship program shall only be used for, or provided to, an apprenticeship or apprenticeship program that meets the definition of such term under subsection (a), including any funds awarded for the purposes of grants, contracts, or cooperative agreements, or the development, implementation, or administration, of an apprenticeship or an apprenticeship program.</text></subsection><subsection id="id47d5bd3d4f9345dabe0df827497f76ea"><enum>(j)</enum><header>Displacement</header><paragraph id="id08b357bf13594bab8be4f8551b4caf7d"><enum>(1)</enum><header>Prohibition</header><text>A participant in a program or activity authorized under this Act (referred to in this subsection as a <quote>specified activity</quote>) shall not displace (including a partial displacement, such as a reduction in the hours of nonovertime work, wages, or employment benefits) any currently employed employee (as of the date of the participation).</text></paragraph><paragraph id="idcb8cb8b7cd6f435ea52d5e5470c78de8"><enum>(2)</enum><header>Prohibition on impairment of contracts</header><text>A specified activity shall not impair an existing contract for services or collective bargaining agreement, and no such activity that would be inconsistent with the terms of a collective bargaining agreement shall be undertaken without the written concurrence of the labor organization and employer concerned. </text></paragraph></subsection><subsection id="id1eac9f58ab9a438f83ee6ca5c4d78991"><enum>(k)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $500,000,000.</text></subsection></section><section id="idf59d49b498954396acbd87140d8a8668"><enum>7.</enum><header>Government Accountability Office study</header><subsection id="idce50164402f44d01bd9ef39cbf600c92"><enum>(a)</enum><header>Scope of study</header><text>The Comptroller General of the United States shall conduct a study to evaluate—</text><paragraph id="id8450d0675bca4e4a9e6f06b94054953d"><enum>(1)</enum><text>the strategies, components, policies, and practices used by recipients of funding under this Act to successfully assist—</text><subparagraph id="ide8fc04fb9d8045e29d473ea21b5bad06"><enum>(A)</enum><text>State, Tribal, and local health departments; and</text></subparagraph><subparagraph id="idd9f941848bd644b9a6449ca2e1cb27f8"><enum>(B)</enum><text>State, Tribal, and local workforce development systems; and</text></subparagraph></paragraph><paragraph id="id8bb86e501ac248c8886020b29dd5559f"><enum>(2)</enum><text>any challenges associated with implementation of such strategies, components, policies, and practices.</text></paragraph></subsection><subsection id="id099591358c424c4e8764e05ce1dc39ce"><enum>(b)</enum><header>Consultation</header><text>In carrying out the study under subsection (a), the Comptroller General shall consult with a geographically diverse (including urban, suburban, and rural) representation of individuals engaged in implementation of this Act, including the following:</text><paragraph id="ida21815e056e54ee3bfd4c86d561142a1"><enum>(1)</enum><text>Centers for Disease Control and Prevention employees.</text></paragraph><paragraph id="idc369ba71637540e08fc881d723e7f737"><enum>(2)</enum><text>Department of Labor employees.</text></paragraph><paragraph id="id89044e3e50224ce7a9d03c0eaa35fe98"><enum>(3)</enum><text>State and local public health departments.</text></paragraph><paragraph id="idb8bf60dd1be145359d43c72b5f2786cf"><enum>(4)</enum><text>State and local workforce development systems.</text></paragraph><paragraph id="id8ed72cd392cf4e24a38382ab25d07f4e"><enum>(5)</enum><text>Indian Tribes and Tribal organizations.</text></paragraph><paragraph id="id825b4c1175dd4ab787f05a85ac26ce7d"><enum>(6)</enum><text>Case investigators, contact tracers, and social support specialists.</text></paragraph></subsection><subsection id="idabaa5a64aab54194a2d9debaf92a80f5"><enum>(c)</enum><header>Submission</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General shall submit the study conducted under subsection (a) to the appropriate congressional committees.</text></subsection></section><section id="idbca6ec35665940388508eb8402948adb"><enum>8.</enum><header>Application of the Service Contract Act to contracts and grants</header><text display-inline="no-display-inline">Contracts and grants, which include contact tracing as part of the scope of work and that are awarded under this Act, shall require that contact tracers and related positions are paid not less than the prevailing wage and fringe rates required under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/67">chapter 67</external-xref> of title 41, United States Code (commonly known as the <quote>Service Contract Act</quote>), for the area in which the work is performed. To the extent that a nonstandard wage determination is required to establish a prevailing wage for contact tracers and related positions for purposes of this Act, the Secretary of Labor shall issue such determination not later than 14 days after the date of enactment of this Act, based on a job description used by the Centers for Disease Control and Prevention and contractors or grantees performing contact tracing for State public health agencies. </text></section><section id="ide439ee3535964c33b8d940961c50d921"><enum>9.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to restrict or in any way infringe upon individuals’ freedom of association. </text></section></legis-body></bill>
