Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that fixed broadband internet access service assisted by any Federal broadband support program meets a minimum level of service.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Parity Act of 2021</short-title></quote>.</text></section><section id="idB35DB7C465854CD6AE3831D5AAA78E21"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id53FC1BA0BE224C7AA3C20D5B868736AB"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="id8F325E596893445EBB9603804196BC16"><enum>(2)</enum><header>Federal broadband support program</header><text display-inline="yes-display-inline">The term <term>Federal broadband support program</term> means any of the following programs (or any other similar Federal program) to the extent the program offers fixed broadband internet access service or programs for promoting access to and adoption of fixed broadband internet access service for various demographic communities through various media for residential, commercial, or community providers, or academic establishments:</text><subparagraph id="H82AF12E21440494296A48B351C71A259"><enum>(A)</enum><text>The Telecommunications and Technology Program of the Appalachian Regional Commission.</text></subparagraph><subparagraph id="HB36FB989A8094007AB4616FA644C2D2D"><enum>(B)</enum><text>The following programs of the Rural Utilities Service of the Department of Agriculture:</text><clause id="id849CA42432FB49129D1C30B35071DD03"><enum>(i)</enum><text>The Telecommunications Infrastructure Loan and Loan Guarantee Program established under the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/901">7 U.S.C. 901 et seq.</external-xref>).</text></clause><clause id="id021DA9C69BD94425AF7992EC1AD09909"><enum>(ii)</enum><text>Any program to provide grants, loans, or loan guarantees under sections 601 through 603 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb et seq.</external-xref>).</text></clause><clause id="id14CEF403308C477D9C019F182B787E4B"><enum>(iii)</enum><text>The substantially underserved trust area initiative under section 306F of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/936f">7 U.S.C. 936f</external-xref>).</text></clause><clause id="idB8D9706BCAD940D09570E7CD5A396ED6"><enum>(iv)</enum><text>The Community Connect Grant Program established under section 604 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb-3">7 U.S.C. 950bb–3</external-xref>).</text></clause><clause id="id85B18843FCD9463A9913CC8DC96C6F4D"><enum>(v)</enum><text>The distance learning and telemedicine grant program established under chapter 1 of subtitle D of title XXII of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/950aaa">7 U.S.C. 950aaa et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="H09CE05A1D4C1432C820DD5EF09194436"><enum>(C)</enum><text>The following programs of the Economic Development Administration of the Department of Commerce:</text><clause id="idEEA1B6667BAB443EB904E7986F35042D"><enum>(i)</enum><text>The Public Works and Economic Adjustment Assistance Programs.</text></clause><clause id="id30C62FF227E04ADB97698F21FCA1927F"><enum>(ii)</enum><text>The Planning and Local Technical Assistance Programs.</text></clause></subparagraph><subparagraph id="H1E9452C5B58B4D789AD283A75BFB7011"><enum>(D)</enum><text>The following programs of the Department of Housing and Urban Development:</text><clause id="id9ABE86762E68424683980ED026A0F82F"><enum>(i)</enum><text>The Community Development Block Grant Program under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>).</text></clause><clause id="id7231DE28E8D64E4B8944D9AC98F9E7F0"><enum>(ii)</enum><text>The loan guarantee program under section 108 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5308">42 U.S.C. 5308</external-xref>) (commonly known as the <quote>Section 108 Loan Guarantee Program</quote>).</text></clause><clause id="idE8EA2979657B496CBAC07B5D1862EAF9"><enum>(iii)</enum><text>Assistance from the Public Housing Capital Fund established under section 9(d) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g(d)</external-xref>).</text></clause><clause id="id9F4F471F861C4E76AF8F8DD4E19D5A1B"><enum>(iv)</enum><text>Assistance from the Public Housing Operating Fund established under section 9(e) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437g">42 U.S.C. 1437g(e)</external-xref>).</text></clause><clause id="id46B9A1254A774F91BA42D34CC8D0F869"><enum>(v)</enum><text>The Multifamily Housing Programs.</text></clause><clause id="id600B6CA9273B4AF88D3612C7320A3A8D"><enum>(vi)</enum><text>The Indian Community Development Block Grant Program.</text></clause><clause id="id998E47580DC44C3A9C7A0408C4175151"><enum>(vii)</enum><text>The Indian Housing Block Grant Program under section 101 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>).</text></clause><clause id="id490FBAF524FE4B52B6769C2AC5F46DA9"><enum>(viii)</enum><text>Loan guarantees under title VI of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4191">25 U.S.C. 4191 et seq.</external-xref>) (commonly known as the <quote>Title VI Loan Guarantee Program</quote>).</text></clause><clause id="idC7F17353C175440A9A399EAFE399BE4C"><enum>(ix)</enum><text>The Choice Neighborhoods Initiative.</text></clause><clause id="id97E95D83A51A4990BD0F5A64E5B4EE52"><enum>(x)</enum><text>The HOME Investment Partnerships Program authorized under title II of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12721">42 U.S.C. 12721 et seq.</external-xref>).</text></clause><clause id="id246E126BF33E4AF38ECF590BEE97B228"><enum>(xi)</enum><text>The Housing Trust Fund established under section 1338 of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/4568">12 U.S.C. 4568</external-xref>).</text></clause><clause id="idD6AE9501A58E403283122F11D0BCBB4A"><enum>(xii)</enum><text>The Housing Opportunities for Persons With AIDS Program authorized under the AIDS Housing Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12901">42 U.S.C. 12901 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="HBDCDCF306F794E14BFE1F3EC29F973B2"><enum>(E)</enum><text>The American Job Centers of the Employment and Training Administration of the Department of Labor.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF5637584CF37426CB2AF336FFED8DB13"><enum>(F)</enum><text>The Library Services and Technology Grant Programs of the Institute of Museum and Library Services.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id568FDFB0FA5E4775AB2BD54CA66E1F8D"><enum>(G)</enum><text>Any Universal Service Fund high-cost program authorized to help deploy fixed broadband internet access service.</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idA6D375415DA7424C81EAAB950759D875"><enum>(H)</enum><text>The following programs of the Department of the Treasury:</text><clause display-inline="no-display-inline" commented="no" id="idAC8840838D564254AB33B183733B4B46"><enum>(i)</enum><text>The Coronavirus State Fiscal Recovery Fund under section 602 of the Social Security Act, as added by section 9901(a) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>).</text></clause><clause display-inline="no-display-inline" commented="no" id="id08BAB348BF55450EA38ACD8514136B7A"><enum>(ii)</enum><text>The Coronavirus Local Fiscal Recovery Fund under section 603 of the Social Security Act, as added by section 9901(a) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>).</text></clause><clause display-inline="no-display-inline" commented="no" id="idB316E53E222948639A65254F69821825"><enum>(iii)</enum><text>The Coronavirus Capital Projects Fund under section 604 of the Social Security Act, as added by section 9901(a) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>).</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id33BE530C0E034BD09832CBB6C4134E2E"><enum>(3)</enum><header>Universal Service Fund high-cost program</header><text>The term <term>Universal Service Fund high-cost program</term> has the meaning given the term in section 903 of division FF of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1307">47 U.S.C. 1307</external-xref>).</text></paragraph></section><section id="id769C8D211421484497FF2ED12972D033"><enum>3.</enum><header>Universal minimum level of service for federally supported fixed broadband</header><subsection commented="no" display-inline="no-display-inline" id="id4B16E64EC9854EC486568576ED478AD6"><enum>(a)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Federal Communications Commission, in consultation with the Secretary of Agriculture, the Secretary of Commerce, the Secretary of Housing and Urban Development, and the head of each other agency that provides assistance under a Federal broadband support program, shall conduct a rulemaking to establish a minimum level of service for fixed broadband internet access service assisted by a Federal broadband support program to ensure that such service can support—</text><paragraph commented="no" display-inline="no-display-inline" id="id2DFAAC39BCBA4C458800AF9B638A1D86"><enum>(1)</enum><text>virtual learning;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id2207E156BD534FD0B82BA4AC744E43E2"><enum>(2)</enum><text>telehealth services; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id6110CB358FEC486EAF00CE1F60D5D44B"><enum>(3)</enum><text>telework.</text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="idDC7BE6962FBB4E4C922A22A59376CB84"><enum>(b)</enum><header>Minimum level of service</header><text>The minimum level of service established under subsection (a) shall, in a technology-neutral manner, include—</text><paragraph display-inline="no-display-inline" commented="no" id="id5B36C398A2E44D159BF9F123AF3C2175"><enum>(1)</enum><text>a minimum download speed;</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id5C3FD6C0BF12489D8A4417B1FB2FB409"><enum>(2)</enum><text>a minimum upload speed; and</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idB3A7287A86B947CC98D3383B3C97A3BC"><enum>(3)</enum><text>a maximum latency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8EA79953AB4046C0B25C45B6E33F2E9B"><enum>(c)</enum><header>Requirement</header><paragraph commented="no" display-inline="no-display-inline" id="idB0048D80E8AD4603A6BFDA472B9CCE2E"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), subject to subsection (e), and notwithstanding any other provision of law, an agency may not provide assistance under a Federal broadband support program unless the fixed broadband internet access service to be assisted meets or exceeds, or will meet or exceed when deployed, the minimum level of service established under subsection (a) that was in effect on the date on which the agency made the determination to provide the assistance.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id961CCE18DF8F48B2B40FAB6B2383C92C"><enum>(2)</enum><header>Infeasibility</header><text>Paragraph (1) shall not apply if the agency providing assistance determines that the provision of fixed broadband internet access service that meets or exceeds the minimum level of service described in that paragraph is infeasible.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAFE3AFDD1254472B859349E05C8AFA75"><enum>(d)</enum><header>Technical and conforming amendment</header><text>Section 601(e) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb(e)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7B4855DB4CBE4907ABC14EACB531F784"><enum>(1)</enum><text>in paragraph (1), by striking <quote>at least—</quote> and all that follows through the period at the end of subparagraph (B) and inserting <quote>not less than the minimum level of service established under section 3(a) of the <short-title>Broadband Parity Act of 2021</short-title>.</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB882D2FC8A04B028F36FA783AD4208F"><enum>(2)</enum><text>in paragraph (2), by inserting <quote>, subject to the condition that the minimum acceptable level of broadband service, as adjusted under this paragraph, may not be less than the minimum level of service described in paragraph (1)</quote> before the period at the end.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3BE4A55FD6FD46A0B2A7515E83AC541C"><enum>(e)</enum><header>Prospective applicability</header><text>This section and the amendments made by this section—</text><paragraph commented="no" display-inline="no-display-inline" id="idBB61CD5F52604C1F899B8228CFAF00C9"><enum>(1)</enum><text>shall apply to any determination of an agency to provide assistance under a Federal broadband support program that is made on or after the date of enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9EBB2B440ED745D68FB8CD0549A77323"><enum>(2)</enum><text>shall not affect any award of assistance made under a Federal broadband support program before the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
