<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1877</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210527">May 27, 2021</action-date><action-desc><sponsor name-id="S384">Mr. Tillis</sponsor> (for himself, <cosponsor name-id="S300">Mr. Burr</cosponsor>, <cosponsor name-id="S287">Mr. Cornyn</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, and <cosponsor name-id="S378">Mr. Lankford</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify eligibility requirements for certain hazard mitigation assistance programs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0F9BEE10F1D24C1BA93022C45971CDE2"><section section-type="section-one" id="H8EE5039C914F4B58A221043012E9732A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hazard Eligibility and Local Projects Act</short-title></quote>.</text></section><section id="HA68E461A212C4BF78CD497A05A0098C1"><enum>2.</enum><header>Authority to begin implementation of acquisition or relocation projects<editorial></editorial></header><subsection id="H029DC38C9A564AF79AC796F8802EE24E"><enum>(a)</enum><header>Eligibility for Assistance for Initiated Projects</header><paragraph id="HAE9F9B6289C540E49D426669DBCA9738"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, an entity seeking assistance under a hazard mitigation assistance program shall be eligible to receive such assistance for a covered project if the entity—</text><subparagraph id="HB842F7CC2C8641429AC648DE6C564E17"><enum>(A)</enum><text display-inline="yes-display-inline">complies with all other eligibility requirements of the hazard mitigation assistance program for acquisition or relocation projects, including extinguishing all incompatible encumbrances; and</text></subparagraph><subparagraph id="H4D5E9A5803F64EA4B6C7411363F6820F"><enum>(B)</enum><text>complies with all Federal requirements for the project.</text></subparagraph></paragraph><paragraph id="HAAC063A2B71840DCAA7F8A00F2B8E40F"><enum>(2)</enum><header>Costs incurred</header><text display-inline="yes-display-inline">An entity seeking assistance under a hazard mitigation assistance program shall be responsible for any project costs incurred by the entity for a covered project if the covered project is not awarded, or is determined to be ineligible for, assistance.</text></paragraph></subsection><subsection id="HD9C51714213B46CB8D6701C53BEAFEB4"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HCEA38A20898E408DAACC06D19EF59C9B"><enum>(1)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means—</text><subparagraph id="HF089C4A1E8DB4E70A0F9AF9F69CDEF63"><enum>(A)</enum><text display-inline="yes-display-inline">an acquisition or relocation project for which an entity began implementation prior to grant award under a hazard mitigation assistance program; and</text></subparagraph><subparagraph id="HB77C813FF68546EA96F10C712AFF6E14"><enum>(B)</enum><text>a project for which an entity initiated planning or construction before or after requesting assistance for the project under a hazard mitigation assistance program qualifying for a categorical exemption under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>). </text></subparagraph></paragraph><paragraph id="H6F7D50F630B0487BA7384C44A1A0E51E"><enum>(2)</enum><header>Hazard mitigation assistance program</header><text>The term <term>hazard mitigation assistance program</term> means—</text><subparagraph id="H6C0DB20337664AB9AECBB9848771B29F"><enum>(A)</enum><text>the predisaster hazard mitigation grant program authorized under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5133">42 U.S.C. 5133</external-xref>);</text></subparagraph><subparagraph id="HBF0020B7B2124E34B043EE048D74968A"><enum>(B)</enum><text>the hazard mitigation grant program authorized under section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170c">42 U.S.C. 5170c</external-xref>); and</text></subparagraph><subparagraph id="H30A4C2500302457F91D6D8C04F1992CF"><enum>(C)</enum><text>the flood mitigation assistance program authorized under section 1366 of the National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4104c">42 U.S.C. 4104c</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H693CD52D11E94C318C19F8149C42BB43"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section shall apply to funds appropriated on or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
