referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Child Abuse Prevention and Treatment Act to require that equitable distribution of assistance include equitable distribution to Indian Tribes and Tribal organizations, to increase amounts reserved for allotment to Indian Tribes and Tribal organizations under certain circumstances, and to reserve amounts for migrant programs under certain circumstances, and to provide for a Government Accountability Office report on child abuse and neglect in American Indian Tribal communities.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Indian and Alaska Native Child Abuse Prevention and Treatment Act</short-title></quote>, the <quote><short-title>AI/AN Child Abuse Prevention and Treatment Act</short-title></quote>, or <quote><short-title>AI/AN CAPTA</short-title></quote>.</text></section><section id="idF17A067B7E0A46F5BBB021DADB2AAB0F"><enum>2.</enum><header>Government Accountability Office report on child abuse and neglect in Indian Tribal communities</header><subsection id="idc526bb1ba70745bcbc052d2864a2856e"><enum>(a)</enum><header>In general</header><text>The Comptroller General of the United States (referred to in this section as the <quote>Comptroller General</quote>) shall conduct a study and issue a report on child abuse and neglect in Indian Tribal communities for the purpose of identifying vital information and making recommendations to the appropriate congressional committees concerning issues relating to child abuse and neglect in such communities.</text></subsection><subsection id="idac940f8e15a445d8982245b5845ab535"><enum>(b)</enum><header>Consultation with Indian Tribes</header><text>In carrying out this section, the Comptroller General shall consult with Indian Tribes from each of the 12 regions of the Bureau of Indian Affairs.</text></subsection><subsection id="id214ff5ca01d54e7780acb3884f40b042"><enum>(c)</enum><header>Duties</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General shall submit to the Committee on Health, Education, Labor, and Pensions and the Committee on Indian Affairs of the Senate and the Committee on Education and Labor and the Committee on Natural Resources of the House of Representatives a report on—</text><paragraph id="id985c21611e86449fb444ce99b6e17a8c"><enum>(1)</enum><text>the number of Indian Tribes providing primary child abuse and neglect prevention activities;</text></paragraph><paragraph id="id86b2e05e0d534a1bb026e152904cea96"><enum>(2)</enum><text>the number of Indian Tribes providing secondary child abuse and neglect prevention activities;</text></paragraph><paragraph id="idaf4de88cd8bf40dca36a69496b42ec26"><enum>(3)</enum><text>promising practices of Indian Tribes with respect to child abuse and neglect prevention that are culturally-based or culturally-adapted;</text></paragraph><paragraph id="id9D955A38DA2940F8B06BBEB37B5A8EEE"><enum>(4)</enum><text>information and recommendations on how such culturally-based or culturally-adapted child abuse and neglect prevention activities could become evidence-based;</text></paragraph><paragraph id="id52850AF400CA4D00BC6758B54969201D"><enum>(5)</enum><text>the number of Indian Tribes that have accessed Federal child abuse and neglect prevention programs;</text></paragraph><paragraph id="ida3dd352e61034d9bb35aaa5757522947"><enum>(6)</enum><text>child abuse and neglect prevention activities that Indian Tribes provide using State funds;</text></paragraph><paragraph id="id5261a0932baf4108a25cc7c5d0420aa6"><enum>(7)</enum><text>child abuse and neglect prevention activities that Indian Tribes provide using Tribal funds;</text></paragraph><paragraph id="idA0B1DEA37B574AB990C3B1C064D0C843"><enum>(8)</enum><text>Tribal access to State children’s trust fund resources;</text></paragraph><paragraph id="id91091c957cb340439494a85879562f1c"><enum>(9)</enum><text>how the children’s trust fund model could be used to support prevention efforts regarding child abuse and neglect of American Indian and Alaska Native children;</text></paragraph><paragraph id="idbd18b192042b459dad58983515b6a5e2"><enum>(10)</enum><text>Federal agency technical assistance efforts to address child abuse and neglect prevention and treatment of American Indian and Alaska Native children;</text></paragraph><paragraph id="idf888d779893b4e14aa638a52e2113f7b"><enum>(11)</enum><text>Federal agency cross-system collaboration to address child abuse and neglect prevention and treatment of American Indian and Alaska Native children;</text></paragraph><paragraph id="id13837477472c455a925b9fae7f96a3eb"><enum>(12)</enum><text>Tribal access to child abuse and neglect prevention research and demonstration grants under the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5101">42 U.S.C. 5101</external-xref> et seq.);</text></paragraph><paragraph id="idb231c0d848a54bed9c75edbad9623d59"><enum>(13)</enum><text>an examination of Federal child abuse and neglect data systems to identify what Tribal data is being submitted and barriers to submitting data; and</text></paragraph><paragraph id="idbfb7c88c220a42c9b328f4dac4f2b23c"><enum>(14)</enum><text>an examination of Federal child abuse and neglect data systems to identify recommendations on improving the collection of data from Indian Tribes.</text></paragraph></subsection></section><section id="idE89BB7A50CFD4155B914D57B0A0931DC"><enum>3.</enum><header>Other amendments</header><subsection id="idBD00673DE861443C80182076830D9F93"><enum>(a)</enum><header>Geographical distribution</header><text>Section 108(b) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106d">42 U.S.C. 5106d(b)</external-xref>) is amended by inserting <quote>Indian Tribes, and Tribal organizations,</quote> after <quote>the States,</quote>.</text></subsection><subsection id="idE4D45DFC17E04CE39D40B8941F1ABFFC"><enum>(b)</enum><header>Allocation of amounts</header><text>Section 203 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5116b">42 U.S.C. 5116b</external-xref>) is amended—</text><paragraph id="id75866E50B4A14356B35A0196EEAA06C4"><enum>(1)</enum><text>by striking <quote>section 210</quote> each place it appears and inserting <quote>section 209</quote>; and</text></paragraph><paragraph id="idAE087BA194FB49A6AA4A82303B199A84"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="id82EEEA817EDB4562BA1558CCB50E207A"><enum>(A)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1EE7ED1C9D4A46EFBCABE6BF05491B1E"><paragraph id="idBB99AE215D8540A0BF5DFB55C8FEC318"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3CA0CE8D96544777A194FA166964C8DB"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id70FFFB3CFC344F769F7C632382994AF9"><paragraph id="id69886B377D204A209348350CECA23F3F"><enum>(2)</enum><header>Allotment for increased appropriation years</header><text>In any fiscal year for which the amount appropriated under section 209 exceeds the amount appropriated under such section for fiscal year 2020 by more than $1,000,000, the Secretary shall reserve—</text><subparagraph id="id0134AAB31F384CB5A7ECB8C43FEF01DA"><enum>(A)</enum><text>5 percent of the amount appropriated for the applicable fiscal year to make allotments to Indian Tribes and Tribal organizations; and</text></subparagraph><subparagraph id="id5F91030DEE814626B0E6982207A4A865"><enum>(B)</enum><text>1 percent of the amount appropriated for the applicable fiscal year to make allotments to migrant programs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
