Pekoske; </text></paragraph><paragraph commented="no" id="H3556357833884838A5E2188A5AE6FE11"><enum>(2)</enum><text>the term <term>adjusted basic pay</term> means—</text><subparagraph commented="no" id="H24BEF87266114289899382295191438C"><enum>(A)</enum><text>the rate of pay fixed by law or administrative action for a position occupied by a covered employee, before any deductions; and</text></subparagraph><subparagraph commented="no" id="H9E1DA0057E2D4D449EA4D1337525EB20"><enum>(B)</enum><text>any regular, fixed supplemental payment for non-overtime hours of work creditable as basic pay for retirement purposes, including any applicable locality payment and any special rate supplement;</text></subparagraph></paragraph><paragraph commented="no" id="H6FC3B2BFFD744D6395B8FB9A467043EC"><enum>(3)</enum><text>the term <term>Administrator</term> means the Administrator of the Transportation Security Administration;</text></paragraph><paragraph id="HF2482BC97F544A03A5B40A04A7618EDC"><enum>(4)</enum><text>the term <term>conversion date</term> means the date on which paragraphs (1) through (4) of section 3(c) take effect; </text></paragraph><paragraph commented="no" id="HA71D0870276049B297C3E072C8A71FDD"><enum>(5)</enum><text>the term <term>covered employee</term> means an employee who occupies a covered position;</text></paragraph><paragraph id="H15F007170E3B445E8B3782C3E0A52F72"><enum>(6)</enum><text>the term <term>covered position</term> means a position within the Transportation Security Administration;</text></paragraph><paragraph id="HAE9A1B739BF0408CA488EFD1A9642807"><enum>(7)</enum><text>the term <term>employee</term> has the meaning given the term in section 2105 of title 5, United States Code, which shall be determined without regard to any provision of law cited in paragraph (9);</text></paragraph><paragraph id="HDC13C3592BFD4951B2EA2895961ED015"><enum>(8)</enum><text>the term <term>Secretary</term> means the Secretary of Homeland Security; and</text></paragraph><paragraph commented="no" id="HE656EEBA998641F0B683BD1D84F2D5C5"><enum>(9)</enum><text>the term <term>TSA personnel management system</term> means any personnel management system established or modified under—</text><subparagraph commented="no" id="H19B559A763E146F696C73791EF34E8CF"><enum>(A)</enum><text>section 111(d) of the Aviation and Transportation Security Act (<external-xref legal-doc="usc" parsable-cite="usc/49/44935">49 U.S.C. 44935</external-xref> note); or</text></subparagraph><subparagraph commented="no" id="H4BBBFF1E913A4305ADFD65CB4DAC783D"><enum>(B)</enum><text>section 114(n) of title 49, United States Code.</text></subparagraph></paragraph></section><section id="HA3ACBEEC842D431086F42489206608CC"><enum>3.</enum><header>Conversion of TSA personnel</header><subsection id="H790F05963D374D2B833E4B2E10159818"><enum>(a)</enum><header>Restrictions on certain personnel authorities</header><text>Notwithstanding any other provision of law, effective as of the date of enactment of this Act—</text><paragraph commented="no" id="H85BEB216B23F4D02B85699B41594EEFD"><enum>(1)</enum><text display-inline="yes-display-inline">any TSA personnel management system in use for covered employees and covered positions on the day before that date of enactment, and any Transportation Security Administration personnel management policy, letters, guideline, or directive in effect on that day, may not be modified;</text></paragraph><paragraph commented="no" id="H000B66043CBE40E0AE97F2892F59BD3B"><enum>(2)</enum><text display-inline="yes-display-inline">no Transportation Security Administration personnel management policy, letter, guideline, or directive that was not established before that date issued under section 111(d) of the Aviation and Transportation Security Act (<external-xref legal-doc="usc" parsable-cite="usc/49/44935">49 U.S.C. 44935</external-xref> note) or section 114(n) of title 49, United States Code, may be established; and</text></paragraph><paragraph id="H4414DA175E6A489FB498E84B4818D183"><enum>(3)</enum><text>any authority to establish or adjust a human resources management system under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/97">chapter 97</external-xref> of title 5, United States Code, shall terminate with respect to covered employees and covered positions.</text></paragraph></subsection><subsection commented="no" id="HD0CB1F07FB394431A0EB8C3102C38E86"><enum>(b)</enum><header>Personnel authorities during transition period</header><text display-inline="yes-display-inline">Any TSA personnel management system in use for covered employees and covered positions on the day before the date of enactment of this Act and any Transportation Security Administration personnel management policy, letter, guideline, or directive in effect on the day before the date of enactment of this Act shall remain in effect until the effective date under subsection (c).</text></subsection><subsection id="H4917B52FFDC44F02809CB99A21EDD3CE"><enum>(c)</enum><header>Transition to general personnel management system applicable to civil service employees</header><text>Effective as of a date determined by the Secretary, but in no event later than 180 days after the date of enactment of this Act—</text><paragraph commented="no" id="HFB2BE7CF9B6145019957A5F7D618638A"><enum>(1)</enum><text display-inline="yes-display-inline">each provision of law cited in section 2(9) is repealed;</text></paragraph><paragraph commented="no" id="H5451944E516A4BAC821F88FC429D579F"><enum>(2)</enum><text display-inline="yes-display-inline">any Transportation Security Administration personnel management policy, letter, guideline, or directive, including the 2019 Determination, shall cease to be effective;</text></paragraph><paragraph id="H4D8AD464028742B08AFA9F19BB3FCCDA"><enum>(3)</enum><text>any human resources management system established or adjusted under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/97">chapter 97</external-xref> of title 5, United States Code, with respect to covered employees or covered positions shall cease to be effective; and</text></paragraph><paragraph id="H7F10AE5147074AE3A8C16C2102E72F3A"><enum>(4)</enum><text>covered employees and covered positions shall be subject to the provisions of title 5, United States Code.</text></paragraph></subsection><subsection id="H3E6AEFD299324B13AB62320F894ECE28"><enum>(d)</enum><header>Safeguards on grievances</header><text display-inline="yes-display-inline">In carrying out this Act, the Secretary shall take such actions as are necessary to provide an opportunity to each covered employee with a grievance or disciplinary action (including an adverse action) pending within the Transportation Security Administration on the date of enactment of this Act, or at any time during the transition period described in subsection (c), to have that grievance removed to proceedings pursuant to title 5, United States Code, or continued within the Administration.</text></subsection></section><section id="HE520711CB5594D9394792A8D4431A3A5"><enum>4.</enum><header>Transition rules</header><subsection id="HF99122C012BD46C0BC043B9892065481"><enum>(a)</enum><header>Nonreduction in pay and compensation</header><paragraph id="id6CF3783071ED4F9581E43EB61466C418"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), under pay conversion rules as the Secretary may prescribe to carry out this Act, a covered employee converted from a TSA personnel management system to the provisions of title 5, United States Code, under section 3(c)(4) shall not be subject to any reduction in the rate of adjusted basic pay payable, or total compensation provided, to that covered employee.</text></paragraph><paragraph id="idE9E109A91D1040A5AAA979B43517AABF"><enum>(2)</enum><header>Federal Air Marshal Service</header><text>An employee of the Federal Air Marshal Service converted from a TSA personnel management system to the provisions of title 5, United States Code, under section 3(c)(4) shall be converted such that the rate of adjusted basic pay payable to the employee is not less than that rate for a position at GS–13 of the General Schedule.</text></paragraph></subsection><subsection id="H9127EE059F504AAF8F021C40FDAEFB3F"><enum>(b)</enum><header>Preservation of other rights</header><text>With respect to each covered employee, as of the conversion date, the Secretary shall take any actions necessary to ensure that—</text><paragraph id="H76DCE629AD66406B88555AF943DDC67D"><enum>(1)</enum><text>any annual leave, sick leave, or other paid leave accrued, accumulated, or otherwise available to the covered employee, as of the day before the conversion date, shall remain available to the covered employee until used; and</text></paragraph><paragraph commented="no" id="H65C0BF5C96FF4920994CE7E308F1A8FA"><enum>(2)</enum><text>the Government share of any premiums or other periodic charges under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code, governing group health insurance shall be paid in an amount that is not less than the amount paid for those premiums and other periodic charges, as of the day before the conversion date.</text></paragraph></subsection><subsection id="HFDC172456F8E4BF4B493FB5362CC8C37"><enum>(c)</enum><header>GAO study on TSA pay rates</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the differences in rates of pay, classified by pay system, between Transportation Security Administration employees—</text><paragraph id="H0D8EEE50B990427DACDF73BE7040569F"><enum>(1)</enum><text>with duty stations in the contiguous 48 States; and</text></paragraph><paragraph id="H76207B93CBE24989826F663957839D23"><enum>(2)</enum><text>with duty stations outside of the States described in paragraph (1), including those employees located in any territory or possession of the United States.</text></paragraph></subsection><subsection id="H607E208D3E7843128F829B178A0EEAA5"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">During the transition period described in section 3(c), and after the conversion date, the Secretary shall ensure that the Transportation Security Administration continues to prevent the appointment of individuals who have been convicted of a sex crime, an offense involving a minor, a crime of violence, or terrorism. </text></subsection></section><section id="HED612C179CBC4B1399D1915B14B4DEB1"><enum>5.</enum><header>Consultation requirement</header><subsection id="H0125C37A4AA74CC3B6567B49C82217A0"><enum>(a)</enum><header>Exclusive representative</header><paragraph id="id9711CCE78DCC48749B8AD8303AD69394"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The labor organization certified by the Federal Labor Relations Authority on June 29, 2011, or a successor labor organization, shall be— </text><subparagraph id="id35F83F88B58946EBA0C88755674D96EF"><enum>(A)</enum><text display-inline="yes-display-inline">treated as the exclusive representative of full- and part-time non-supervisory personnel of the Transportation Security Administration carrying out screening functions under section 44901 of title 49, United States Code; and </text></subparagraph><subparagraph id="id681526839512453386920BAD6DBDE17A"><enum>(B)</enum><text display-inline="yes-display-inline">the exclusive representative for the personnel described in subparagraph (A) under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code, with full rights under that chapter. </text></subparagraph></paragraph><paragraph id="idCC86005CB0CC4898B554D213E95C20B1"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">Any collective bargaining agreement covering the personnel described in paragraph (1)(A) that is in effect on the date of enactment of this Act shall remain in effect, consistent with subsection (d).</text></paragraph></subsection><subsection id="H11F518D397954DBCB692D150C29B3CA3"><enum>(b)</enum><header>Consultation rights</header><paragraph id="id9405DCC3F4C541BE8EF26992123B3F14"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 7 days after the date of enactment of this Act, the Secretary shall consult with the exclusive representative for the personnel described in subsection (a)(1)(A) under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code, as well as appropriate labor associations that represent a substantial percentage of employees, on the formulation of plans and deadlines to carry out the conversion of covered employees and covered positions under this Act. </text></paragraph><paragraph id="id7A00B692B47D465EA496001090B1D2A0"><enum>(2)</enum><header>Plans</header><text display-inline="yes-display-inline">Before the conversion date, the Secretary shall provide (in writing) to the exclusive representative and labor associations described in paragraph (1) the plans for how the Secretary intends to carry out the conversion of covered employees and covered positions under this Act, including with respect to such matters as—</text><subparagraph id="HCF17D8DD1B1346349FAF07CB8E1DF8AE"><enum>(A)</enum><text>the anticipated conversion date; and</text></subparagraph><subparagraph id="H819DB956E0C34874A8A00F3700CFDAC1"><enum>(B)</enum><text>measures to ensure compliance with sections 3 and 4.</text></subparagraph></paragraph></subsection><subsection id="H72706AC6AF77486982D83B0FBFB6786E"><enum>(c)</enum><header>Required agency response</header><text display-inline="yes-display-inline">If any views or recommendations are presented under subsection (b) by the exclusive representative, or the labor associations described in that subsection, the Secretary shall— </text><paragraph id="idC8C7F4A370674520A8236ED93E414539"><enum>(1)</enum><text display-inline="yes-display-inline">consider the views or recommendations before taking final action on any matter with respect to which the views or recommendations are presented; and </text></paragraph><paragraph id="id4F95349CE24C4F72976D68B115F5B102"><enum>(2)</enum><text display-inline="yes-display-inline">provide the exclusive representative and those labor associations a written statement of the reasons for the final actions to be taken.</text></paragraph></subsection><subsection id="HC4CAE5F277114AE6BEA99B0082965407"><enum>(d)</enum><header>Sunset provision</header><text>The provisions of this section shall cease to be effective as of the conversion date.</text></subsection></section><section id="H802C43DDE31147E6A64E58A1C778D92B"><enum>6.</enum><header>No right to strike</header><text display-inline="no-display-inline"> Nothing in this Act may be considered—</text><paragraph id="HE3BC828CE8164C2B96D14DDFA9B32C5D"><enum>(1)</enum><text>to repeal or otherwise affect—</text><subparagraph id="H21B5E42E6C6D4D4BB3D1B4E3B449742D"><enum>(A)</enum><text>section 1918 of title 18, United States Code (relating to disloyalty and asserting the right to strike against the Government); or</text></subparagraph><subparagraph id="H12A905B308EE436CA1805BEA25E1C2D0"><enum>(B)</enum><text>section 7311 of title 5, United States Code (relating to loyalty and striking); or</text></subparagraph></paragraph><paragraph id="HEF851988066C45EF886922FD55DB741A"><enum>(2)</enum><text>to otherwise authorize any activity that is not permitted under either provision of law cited in paragraph (1).</text></paragraph></section><section id="H893A2977BF294B06A9BEF0140ACC9FF9"><enum>7.</enum><header>Rule of construction with respect to certain crimes relating to terrorism</header><text display-inline="no-display-inline">Nothing in this Act may be construed to contradict <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18, United States Code, including with respect to—</text><paragraph id="H60A9CC5E178E424CBF425899A8A6BB98"><enum>(1)</enum><text>section 2332b (relating to acts of terrorism transcending national boundaries);</text></paragraph><paragraph id="HC47D9880B08F4D85B8E13B2962106C46"><enum>(2)</enum><text>section 2339 (relating to harboring or concealing terrorists); and</text></paragraph><paragraph id="HAC5225E6EC094E469D4C6C33F54193D6"><enum>(3)</enum><text>section 2339A (relating to providing material support to terrorists).</text></paragraph></section><section id="HAD2D5A71179440ADB9554C0EEEBC995A"><enum>8.</enum><header>Report by GAO regarding TSA recruitment</header><subsection id="idF92DBC530BBE4EC1A2052FB0D1C6C4DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the efforts of the Administrator regarding recruitment, including recruitment efforts relating to— </text><paragraph id="idC55026906C864F8C8114D6E6F9CE00D9"><enum>(1)</enum><text display-inline="yes-display-inline">veterans and the dependents of veterans; and </text></paragraph><paragraph id="idEE85AF1827F047C091DA90B343A19BBB"><enum>(2)</enum><text display-inline="yes-display-inline">members of the Armed Forces and the dependents of those members. </text></paragraph></subsection><subsection id="id96210E266E2E459CBE65F3E06B792CA1"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report required under subsection (a) shall include recommendations regarding how the Administrator may improve the recruitment efforts described in that subsection.</text></subsection></section><section id="H0B073523855B477B936FE996EBA242CB"><enum>9.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that— </text><paragraph id="id5D81A6A23D2943B3BC5C237A0204B71B"><enum>(1)</enum><text display-inline="yes-display-inline">the personnel system of the Transportation Security Administration provides insufficient benefits and workplace protections to the workforce that secures the transportation systems of the United States; and </text></paragraph><paragraph id="idF779D4BEC49946E3848A9CABA23B7FEA"><enum>(2)</enum><text display-inline="yes-display-inline">the workforce of the Transportation Security Administration should be provided protections and benefits under title 5, United States Code.</text></paragraph></section><section id="HCBD362FF1CF7414ABE5869BFD62952C0"><enum>10.</enum><header>Federal Air Marshal Service</header><text display-inline="no-display-inline">The Administrator shall—</text><paragraph id="idF3486F0E04DA4A2789E881F7B4355C74"><enum>(1)</enum><text display-inline="yes-display-inline">implement in-person or remote (by means of telecommunications) mental health programs at each field office of the Federal Air Marshal Service that offer, at a minimum, confidential and direct psychiatric counseling; and</text></paragraph><paragraph id="id621A9C6A395549709551D511A9C8F734"><enum>(2)</enum><text display-inline="yes-display-inline">consult with appropriate labor associations that represent a substantial percentage of Federal Air Marshal Service employees regarding, with respect to those employees—</text><subparagraph id="H60DDF527549946A38E6EA734B925F3DF"><enum>(A)</enum><text>mental health;</text></subparagraph><subparagraph id="HB37589F6FEB84EB8935E52E8A84713E9"><enum>(B)</enum><text>suicide rates;</text></subparagraph><subparagraph id="HAC53987AE6064334A72E24528AB31F8A"><enum>(C)</enum><text>morale and recruitment;</text></subparagraph><subparagraph id="idFAC102E0883C441DAF9B1BF7FFFC5AA3"><enum>(D)</enum><text>equipment and training; and</text></subparagraph><subparagraph id="H5044F8B10FDE4363A6D8564F08E21BE2"><enum>(E)</enum><text>any other personnel issues the Administrator determines appropriate.</text></subparagraph></paragraph></section><section id="HC8CA9DDEE2274EE3866B4E5403370879"><enum>11.</enum><header>Veterans hiring</header><subsection id="idA3A08B98068A4858B2054E2F9DCBA2BF"><enum>(a)</enum><header>Definitions</header><text>In this section, the terms <term>disabled veteran</term>, <term>preference eligible</term>, and <term>veteran</term> have the meanings given the terms in section 2108 of title 5, United States Code.</text></subsection><subsection id="id087C832A874A4714AE2B30229F787F4E"><enum>(b)</enum><header>Prioritization</header><text display-inline="yes-display-inline">The Secretary shall prioritize the appointment of veterans, including disabled veterans, and other preference eligibles, including widows and widowers of veterans, to covered positions.</text></subsection></section><section id="H60972D6FE32544ABAC5C80E632FDD667"><enum>12.</enum><header>Prevention and protection against certain illness</header><text display-inline="no-display-inline">The Administrator, in coordination with the Director of the Centers for Disease Control and Prevention and the Director of the National Institute of Allergy and Infectious Diseases, shall ensure that covered employees are provided proper guidance regarding prevention and protections against coronavirus, including appropriate resources.</text></section></legis-body></bill>
