which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to establish a Motorcyclist Advisory Council.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2B15B8C685F348EBAB9A20B9C4F63344"><section section-type="section-one" id="id6798C22D7E9E49EEB9B4B09D8E7A9279"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Motorcyclist Advisory Council Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="idA856896C8A6E44359315437DF4619B71"><enum>2.</enum><header>Motorcyclist Advisory Council</header><subsection id="id0BE1702B82BC4691BF691B48AC8B6E6E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/3">chapter 3</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id02270475ED14414BB757D646AB505049"><section id="id3A8757D52BA244D3B37C57E870641F44"><enum>355.</enum><header>Motorcyclist Advisory Council</header><subsection id="H90D3C986BE3148549A0595122097BEE5"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this section, the Secretary of Transportation (referred to in this section as the <term>Secretary</term>) shall establish or designate a council, to be known as the <quote>Motorcyclist Advisory Council</quote> (referred to in this section as the <term>Council</term>).</text></subsection><subsection id="H7EDA1159E86F42A89909314AECC396A7"><enum>(b)</enum><header>Membership</header><paragraph id="HFF751CEC5D9446269DB69C6D5A9EA7D2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Council shall be comprised of 13 members, to be appointed by the Secretary, of whom—</text><subparagraph id="HAFB8134B8F264694976AEBC5309C7A17"><enum>(A)</enum><text>5 shall be representatives of units of State or local government with expertise relating to highway engineering and safety issues, including—</text><clause id="H3B651365FCE740DFA02DBCE9C854420D"><enum>(i)</enum><text>motorcycle and motorcyclist safety;</text></clause><clause id="idAA04C99473AA4FE5BE1CE93790343DDD"><enum>(ii)</enum><text>barrier and road design, construction, and maintenance; or</text></clause><clause id="H3CF8FD72CDA44F88B4F70A58DB90D8CE"><enum>(iii)</enum><text>intelligent transportation systems;</text></clause></subparagraph><subparagraph id="HC67B59552F484501845AD5DEE64F28C9"><enum>(B)</enum><text>1 shall be a motorcyclist who serves as a State or local—</text><clause id="id25C4ED28E34C4279AC053E4D20801984"><enum>(i)</enum><text>traffic and safety engineer;</text></clause><clause id="id6C7D1AD65B144BF4A7F8279BC561B607"><enum>(ii)</enum><text>design engineer; or</text></clause><clause id="idC06DA57D7FFB4E5B95712AB22CBEFC75"><enum>(iii)</enum><text>other transportation department official;</text></clause></subparagraph><subparagraph id="H92106372F8B548F2BCCBF48352933E63"><enum>(C)</enum><text>1 shall be a representative of a national association of State transportation officials;</text></subparagraph><subparagraph id="HCCDE2A268B904DF4951B71AAB076E87D"><enum>(D)</enum><text>1 shall be a representative of a national motorcyclist association;</text></subparagraph><subparagraph id="HB8F90FEDB04A4FAFAE065367F363914F"><enum>(E)</enum><text>1 shall be a representative of a national motorcyclist foundation;</text></subparagraph><subparagraph id="H5BA84E351A7E4416B1BDD7D644773238"><enum>(F)</enum><text>1 shall be a representative of a national motorcycle manufacturing association;</text></subparagraph><subparagraph id="idBB60C6C98F9A41F084B6608013B2F16D"><enum>(G)</enum><text>1 shall be a representative of a motorcycle manufacturing company headquartered in the United States;</text></subparagraph><subparagraph id="H17F8508D968D4079A15EFC31430914BF"><enum>(H)</enum><text>1 shall be a roadway safety data expert with expertise relating to crash testing and analysis; and</text></subparagraph><subparagraph id="H98E1328869A34663AB16F72734B89A5A"><enum>(I)</enum><text>1 shall be a member of a national safety organization that represents the traffic safety systems industry.</text></subparagraph></paragraph><paragraph id="H9F52FDF3282A41419CB7630E51E99676"><enum>(2)</enum><header>Term</header><subparagraph id="id8F036D01EDD242D2AF3CC4FE36540091"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), each member shall serve on the Council for a single term of 2 years.</text></subparagraph><subparagraph id="HFD66150C5FCD4A11A7B976AF72C62195"><enum>(B)</enum><header>Additional term</header><text>If a successor is not appointed for a member of the Council before the expiration of the term of service of the member, the member may serve on the Council for a second term of not longer than 2 years.</text></subparagraph><subparagraph id="H987C858DFE0E408FA6D50F1759CBBE4B"><enum>(C)</enum><header>Appointment of replacements</header><text display-inline="yes-display-inline">If a member of the Council resigns before the expiration of the 2-year term of service of the member— </text><clause id="idAC2D04358D594BD89569840FD7AA030C"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary may appoint a replacement for the member, who shall serve the remaining portion of the term; and</text></clause><clause id="id93E7EDEC814C4B55B94CB227C95E99AE"><enum>(ii)</enum><text display-inline="yes-display-inline">the resigning member may continue to serve after resignation until the date on which a successor is appointed.</text></clause></subparagraph></paragraph><paragraph id="id3C787B24073247DDBE3A0A6909F563F9"><enum>(3)</enum><header>Vacancies</header><text display-inline="yes-display-inline">A vacancy on the Council shall be filled in the manner in which the original appointment was made.</text></paragraph><paragraph id="H3587C1EEF13447569C8E2C96D70E2B86"><enum>(4)</enum><header>Compensation</header><text>A member of the Council shall serve without compensation.</text></paragraph></subsection><subsection id="HD6B972F5147946C7A7B0AF97781BD708"><enum>(c)</enum><header>Duties</header><paragraph id="H486C4D1831F0415F9D0EC12DE94E96CB"><enum>(1)</enum><header>Advising</header><text>The Council shall advise the Secretary, the Administrator of the National Highway Traffic Safety Administration, and the Administrator of the Federal Highway Administration regarding transportation safety issues of concern to motorcyclists, including—</text><subparagraph id="HC8360DFB6AAF40BD9B45EBDA9B8AFD32"><enum>(A)</enum><text>motorcycle and motorcyclist safety;</text></subparagraph><subparagraph id="idD11AD45D51F8444693E1D96703A4601C"><enum>(B)</enum><text>barrier and road design, construction, and maintenance practices; and</text></subparagraph><subparagraph id="H75EE3C01736F4AFEA344DAB8F3CF2BA7"><enum>(C)</enum><text>the architecture and implementation of intelligent transportation system technologies.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C99C98BFC9642C5B336955AD5B0CC1B"><enum>(2)</enum><header>Biennial report</header><text>Not later than October 31 of the first calendar year beginning after the date on which the Council is established, and not less frequently than once every 2 years thereafter, the Council shall submit to the Secretary a report containing recommendations of the Council regarding the issues described in paragraph (1). </text></paragraph></subsection><subsection id="HD1ECFBF463B746C6989C6FD3FB927AD1"><enum>(d)</enum><header>Duties of Secretary</header><paragraph id="HEEC9B4574D9E47F7B67F2C4D89AFACF0"><enum>(1)</enum><header>Council recommendations</header><subparagraph id="HC7779949A3C8473B92DBCB49C1FED979"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall determine whether to accept or reject a recommendation contained in a report of the Council under subsection (c)(2).</text></subparagraph><subparagraph id="HE5EA31FB1D2245C780C7660462B87FC6"><enum>(B)</enum><header>Inclusion in review</header><clause id="H5ED6C60BCE94479F81953A771DC349EC"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall indicate in each review under paragraph (2) whether the Secretary accepts or rejects each recommendation of the Council covered by the review.</text></clause><clause id="H2853ED39F5A444F0A1038AF2FDC36789"><enum>(ii)</enum><header>Exception</header><text>The Secretary may indicate in a review under paragraph (2) that a recommendation of the Council is under consideration, subject to the condition that a recommendation so under consideration shall be accepted or rejected by the Secretary in the subsequent review of the Secretary under paragraph (2).</text></clause></subparagraph></paragraph><paragraph id="H1A1C324DE37D41FD9B74C5B3C02F3E56"><enum>(2)</enum><header>Review</header><subparagraph id="H4F78AEAB70884D5399AB111956FCBA32"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date on which the Secretary receives a report from the Council under subsection (c)(2), the Secretary shall submit a review describing the response of the Secretary to the recommendations of the Council contained in the Council report to—</text><clause id="H2BB8E1A8166B4A1E8F690A3CFB988F2E"><enum>(i)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; </text></clause><clause id="H110A869CBC584A5D8BDA14685D3A83C1"><enum>(ii)</enum><text>the Committee on Environment and Public Works of the Senate;</text></clause><clause id="HBA2DDB18711841658B50C7A146B55DC8"><enum>(iii)</enum><text>the Subcommittee on Transportation, Housing and Urban Development, and Related Agencies of the Committee on Appropriations of the Senate;</text></clause><clause id="H22C53228AD9849F3ADC0044E05A152E4"><enum>(iv)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives; and </text></clause><clause id="HD3F15DCAB16E482394189CE72D35C4DD"><enum>(v)</enum><text>the Subcommittee on Transportation, and Housing and Urban Development, and Related Agencies of the Committee on Appropriations of the House of Representatives.</text></clause></subparagraph><subparagraph id="H50BC2CE6046B48ACA441173325742E3A"><enum>(B)</enum><header>Contents</header><text>A review of the Secretary under this paragraph shall include a description of—</text><clause id="HEB234651E4F04A84A76B178EC6452BF5"><enum>(i)</enum><text>each recommendation contained in the Council report covered by the review; and</text></clause><clause id="H92A07BE7EA1C4C7DA9E6DD21F5261BA1"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id781A4535529747C8ADA690F09E7860F4"><enum>(I)</enum><text>each recommendation of the Council that was categorized under paragraph (1)(B)(ii) as under consideration by the Secretary in the preceding review submitted under this paragraph; and</text></subclause><subclause id="HD16E7902B86641069EF1A59EF32777F7" indent="up1"><enum>(II)</enum><text>for each such recommendation, whether the recommendation—</text><item id="id67C44C718D194F978CE32C6B92A87F5F"><enum>(aa)</enum><text>is accepted or rejected by the Secretary; or</text></item><item id="idECD85F7BBA454341AF4A5004D36E5A84"><enum>(bb)</enum><text>remains under consideration by the Secretary.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="HF947F22CEF284E08B406C57E0A7EEA28"><enum>(3)</enum><header>Administrative and technical support</header><text>The Secretary shall provide to the Council such administrative support, staff, and technical assistance as the Secretary determines to be necessary to carry out the duties of the Council under this section.</text></paragraph></subsection><subsection id="HB79F51FCF86F4F628CB11DA3F30B618D"><enum>(e)</enum><header>Termination</header><text>The Council shall terminate on the date that is 6 years after the date on which the Council is established under subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE67CF8EF166C4F13AF69E9507CFD4AE9"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id2216AA8CF18B4ACD94103ADB70A28BBE"><enum>(1)</enum><text>Section 1426 of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/23/101">23 U.S.C. 101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>) is repealed.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id541BB4CBCD2F40D0B7B10F0BC642ABB7"><enum>(2)</enum><text>The table of contents for the FAST Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>; 129 Stat. 1313) is amended by striking the item relating to section 1426.</text></paragraph></subsection><subsection id="id9C84A27F541642E8A386DBB57566A5B8"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/3">chapter 3</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/354">section 354</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id6AFF54D87E7A4BC5BFB030FC21D3A95E"><toc><toc-entry bold="off" level="section">355.
