which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish an intercity passenger rail service investment grant program.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Building Rail Across Intercity Networks To Ride Around Interior of the Nation Act</short-title></quote> or the <quote><short-title>BRAIN TRAIN Act</short-title></quote>.</text></section><section id="id06dd165d6d974bb492c964367f2041ba"><enum>2.</enum><header>Establishment of grant program for high-performance intercity passenger rail service</header><subsection id="id32E7B235CADD4888A64C62E0AB43D477"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/261">Chapter 261</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id06016103418A45E489D73F4EA8EA0768"><section id="id983ABAF3529F4BEE910B73AA6A314B1A"><enum>26107.</enum><header>Intercity passenger rail service investment program</header><subsection id="id8bb45543536b4ca0bb29d6e31821c65b"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7b506ac4e9894e789c7249593228f349"><enum>(1)</enum><header>Applicant</header><text>The term <term>applicant</term> means Amtrak or a State, group of States, interstate compact, or public agency established by 1 or more States with responsibility for providing intercity passenger rail service.</text></paragraph><paragraph id="id63d85a97e8d44cbe8823effc2885241a"><enum>(2)</enum><header>Capital project</header><text>The term <term>capital project</term> means a project or program in a State rail plan developed under chapter 227 for—</text><subparagraph id="id20A4CE282C654F90B4B8E525E809C0FC"><enum>(A)</enum><text>acquiring, constructing, improving, or inspecting equipment, track, and track structures, or a facility of use in or for the primary benefit of intercity passenger rail service;</text></subparagraph><subparagraph id="idEFFEC394700344D3B3D7F4184C4061B4"><enum>(B)</enum><text>expenses incidental to the acquisition or construction (including designing, engineering, location surveying, mapping, environmental studies, and acquiring active or out of service rights-of-way); and</text></subparagraph><subparagraph id="idC22E553C3F5E43118361D0435E8F1C18"><enum>(C)</enum><text>payments for the capital portions of rail trackage rights agreements, highway-rail grade crossing improvements related to intercity passenger rail service, mitigating environmental impacts, communication and signalization improvements, relocation assistance, acquiring replacement housing sites, and acquiring, constructing, relocating, and rehabilitating replacement housing.</text></subparagraph></paragraph><paragraph id="id704c879c7bbc4f5da806b3435fac618f"><enum>(3)</enum><header>High-performance rail</header><text>The term <term>high-performance rail</term> means intercity passenger rail service that is designed to meet the current and future market demand for the transportation of people, in terms of capacity, travel times, reliability, and efficiency.</text></paragraph><paragraph id="id1f455bb9671c492a8b814c8aaf1e6947"><enum>(4)</enum><header>Intercity passenger rail service</header><text>The term <term>intercity passenger rail service</term> has the meaning given the term <term>intercity rail passenger transportation</term> in section 24102.</text></paragraph><paragraph id="id7DC927ADF950419FA9036D476582323C"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="ida62dcda695e245d0992e076d733bcc49"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means any of the 50 States or the District of Columbia.</text></paragraph></subsection><subsection id="idc360e26ba52d4ee797fa7fe117653051"><enum>(b)</enum><header>Establishment</header><paragraph id="idA6693E23226748ACBC96BB55469E8252"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an intercity passenger rail service investment program to promote high-performance rail transportation options. </text></paragraph><paragraph id="idfd5f921fe4724168bf84dbb7e2613269"><enum>(2)</enum><header>Grants authorized</header><text>The Secretary may award grants under this section to an applicant to finance capital projects for high-performance rail, including grants awarded in installments for projects lasting longer than 1 year.</text></paragraph></subsection><subsection id="idb6e00eab92b5451fb49eb51628780fea"><enum>(c)</enum><header>Applications</header><text>Each applicant seeking a grant under this section shall submit an application to the Secretary in such form and containing such information as the Secretary shall reasonably require.</text></subsection><subsection id="idb91019a5ffa249fa9960d0c4031e7f7e"><enum>(d)</enum><header>Competitive grant selection and criteria for grants</header><paragraph id="id17ba4f9606ba4d17b0dd796e01637144"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="id9d20508ca965463fb4eda353b35e32ac"><enum>(A)</enum><text>establish criteria for selecting among capital projects that meet the criteria specified in paragraph (2);</text></subparagraph><subparagraph id="id3e87529e9d194defa430516e1062e56c"><enum>(B)</enum><text>conduct a national solicitation for applications; and</text></subparagraph><subparagraph id="idce193f6d91a74ad3ad97348104a92e1e"><enum>(C)</enum><text>award grants on a competitive basis.</text></subparagraph></paragraph><paragraph id="id6ae1bdf640624588a571eedff43642c5"><enum>(2)</enum><header>Grant criteria</header><text>In selecting the recipients of intercity passenger rail grants under subsection (b)(2), the Secretary shall—</text><subparagraph id="idd37aeb7da56b4b6fada71a915dd62138"><enum>(A)</enum><text>require—</text><clause id="idc4ea8dcb8b7b4242b7ab541b1690ec77"><enum>(i)</enum><text>the project to be part of a State rail plan developed under chapter 227, or under the plan required under section 211 of the Passenger Rail Investment and Improvement Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/49/24902">49 U.S.C. 24902</external-xref> note);</text></clause><clause id="id205487f5e45b4eb28a9a016fcbdb3294"><enum>(ii)</enum><text>the applicant or recipient to have the legal, financial, and technical capacity to carry out the project, satisfactory continuing control over the use of the equipment or facilities, and the capability and willingness to maintain the equipment or facilities;</text></clause><clause id="id1f122ea33394433a99baa678aaaeebfd"><enum>(iii)</enum><text>the project to be based on the results of preliminary engineering studies or other planning;</text></clause><clause id="id48b10984885b4f44a90780120a7a60af"><enum>(iv)</enum><text>the applicant to provide sufficient information upon which the Secretary can make the findings required under this subsection;</text></clause><clause id="id60578a4a424846c8881be578f3aa79d0"><enum>(v)</enum><text>if an applicant has selected the proposed operator of its service, the applicant to provide written justification to the Secretary showing why the proposed operator is the best, taking into account costs and other factors;</text></clause><clause id="id5623c727124e46f6beada8884d9a817b"><enum>(vi)</enum><text>each proposed project to meet all safety and security requirements that are applicable to the project under law; and</text></clause><clause id="idd867aca77987417297499e8e51f35c1c"><enum>(vii)</enum><text>each project to be compatible with, and operated in conformance with—</text><subclause id="ida09ccdf68b1f4799bf78fcad16709fb6"><enum>(I)</enum><text>plans developed pursuant to the requirements under section 135 of title 23; and</text></subclause><subclause id="idb17ae6acd8104b00bc60e4e29d54dcb5"><enum>(II)</enum><text>the national rail plan (if available);</text></subclause></clause></subparagraph><subparagraph id="id3c5c44f129274d0197b372bfb2e2779b"><enum>(B)</enum><text>select high-performance rail projects—</text><clause id="ida53220cce2b84e82844b2b9de0ff81c7"><enum>(i)</enum><text>that are anticipated to result in significant improvements to intercity rail passenger service, including consideration of the project’s—</text><subclause id="id5b6d4dd1c2d9411fb19bfc3768a57f9d"><enum>(I)</enum><text>levels of estimated ridership, increased on-time performance, reduced trip time, or additional service frequency to meet anticipated or existing demand;</text></subclause><subclause id="id9b3e5b0061ea4323b3006138a556d6b5"><enum>(II)</enum><text>anticipated provision of intercity passenger rail service in historically and persistently unconnected and under-connected regions; and</text></subclause><subclause id="ide68fca1f18b64e9f92a4ea0b9d624876"><enum>(III)</enum><text>anticipated favorable impact on air or highway traffic congestion, capacity, or safety;</text></subclause></clause><clause id="idee927076c21f4629a1d48c7d5bf1abff"><enum>(ii)</enum><text>for which there is a high degree of confidence that the proposed project is feasible and will result in the anticipated benefits, as indicated by—</text><subclause id="id795b589849e540d592d418193cea2966"><enum>(I)</enum><text>the project’s precommencement compliance with environmental protection requirements;</text></subclause><subclause id="id9bfdc35b6eb44a45a95977e437dfd9ce"><enum>(II)</enum><text>the readiness of the project to be commenced; and</text></subclause><subclause id="ida43682d0a9824f2b9bea68ba99718467"><enum>(III)</enum><text>other relevant factors determined by the Secretary; and</text></subclause></clause><clause id="id346e23262159484ba67c644bc48c4608"><enum>(iii)</enum><text>for which the level of the anticipated benefits compares favorably to the amount of Federal funding requested under this section; and</text></clause></subparagraph><subparagraph id="ide8a3f33d2a614eeda96f860407bde8e3"><enum>(C)</enum><text>give greater consideration to projects that—</text><clause id="id8f86c29a57f847298fa0df2f307119e6"><enum>(i)</enum><text>are anticipated to result in benefits to other modes of transportation and to the public at large, including consideration of the project’s—</text><subclause id="idc616a645ac094f27b0c9a1a4b930e7c0"><enum>(I)</enum><text>encouragement of intermodal connectivity through provision of direct connections between train and transit stations, airports, bus terminals, subway stations, ferry ports, and other modes of transportation;</text></subclause><subclause id="id0bfe786d5547477d8a34670f674d58c3"><enum>(II)</enum><text>anticipated improvement of conventional intercity passenger, freight, or commuter rail operations;</text></subclause><subclause id="ida0417f84e9644e1e9099509571ea4d38"><enum>(III)</enum><text>use of positive train control technologies;</text></subclause><subclause id="id9deb6af56ba04015a2efa2d0c86972ac"><enum>(IV)</enum><text>environmental benefits, including projects that involve the purchase of environmentally sensitive, fuel-efficient or electrified, and cost-effective passenger rail equipment;</text></subclause><subclause id="idacf41feeee8e40cd93f66e756354f55f"><enum>(V)</enum><text>anticipated reduction of greenhouse gas emissions;</text></subclause><subclause id="id720232604398436f9d5ad88010bb31ce"><enum>(VI)</enum><text>anticipated improvement of air quality and public health;</text></subclause><subclause id="id72ACE9A7171D41AEBAF1285DAF1FAF03"><enum>(VII)</enum><text>anticipated positive economic and employment impacts, including development in the areas near passenger stations, historic districts, or other opportunity zones;</text></subclause><subclause id="idd4b3ae32823440f5a6c747ceec09994f"><enum>(VIII)</enum><text>encouragement of State and private contributions toward station development, energy and environmental efficiency, and economic benefits; and</text></subclause><subclause id="id14f13498fdd94d168bef0b6e7bcc8216"><enum>(IX)</enum><text>provision of enhanced access for persons with disabilities to intercity passenger rail service; and</text></subclause></clause><clause id="ide2d1e86a142f463c8c7251d891413a6a"><enum>(ii)</enum><text>incorporate equitable financial participation in the project’s financing, including consideration of—</text><subclause id="idd3184afa842344548a92848b398afe55"><enum>(I)</enum><text>donated or discounted interests in real or personal property;</text></subclause><subclause id="id880c8946a4a64f9c8a908dd678b8b8ac"><enum>(II)</enum><text>donated services;</text></subclause><subclause id="idE2AA9CE4F18842998BBAF71AF37DAF70"><enum>(III)</enum><text>financial contributions by intercity passenger, freight, and commuter rail carriers commensurate with the benefit expected to their operations;</text></subclause><subclause id="id5cc5c3835c994d2e89a76c689e242bb0"><enum>(IV)</enum><text>financial commitments from host railroads, non-Federal governmental entities, nongovernmental entities, and others; and</text></subclause><subclause id="idF753CC2F9B6A43E3AB796CB74FA7E4FC"><enum>(V)</enum><text>Federal loans, including loans under title V of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/821">45 U.S.C. 821</external-xref> et seq.). </text></subclause></clause></subparagraph></paragraph><paragraph id="id4d5a339309424fa5919ae5a78f587dde"><enum>(3)</enum><header>Grant conditions</header><text>The Secretary shall require each recipient of a grant under this chapter to comply with the grant requirements under section 22905.</text></paragraph><paragraph id="id4eb18eab106a4187b0966cb6d89e6d05"><enum>(4)</enum><header>State rail plans</header><text>State rail plans completed before the date of enactment of the Passenger Rail Investment and Improvement Act of 2008 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/110/432">Public Law 110–432</external-xref>) that substantially meet the requirements of chapter 227 of this title, as determined by the Secretary pursuant to section 22706, shall be deemed by the Secretary to have met the requirements of paragraph (2)(A)(i).</text></paragraph></subsection><subsection id="iddbda7e8c4d914963b191624255a287a5"><enum>(e)</enum><header>Federal share</header><paragraph id="id3C5930DA63704755B7A0912B5493DA33"><enum>(1)</enum><header>In general</header><text>The Federal share of the cost of a capital project financed under this section shall not exceed 90 percent of the project’s net capital cost.</text></paragraph><paragraph id="id15ECF198ABF84204A878100203F3E33C"><enum>(2)</enum><header>In-kind match</header><text>The fair market value of in-kind contributions to a capital project financed under this section shall be treated as non-Federal matching funds for purposes of paragraph (1).</text></paragraph><paragraph id="id3221E749399F49C58DB568992A44652E"><enum>(3)</enum><header>Loans</header><text>The value of any Federal loans paid back with non-Federal funds shall be treated as non-Federal matching funds for purposes of paragraph (1).</text></paragraph></subsection><subsection id="id2c18c5fb704c4a00ad210a9fa7bc1c85"><enum>(f)</enum><header>Issuance of regulations</header><text>Not later than 1 year after the date of the enactment of this section, the Secretary shall issue regulations to carry out this section.</text></subsection><subsection id="id689f9b4bf62b45b188c90f21d34c6a79"><enum>(g)</enum><header>Authorization of appropriations</header><paragraph id="id9D54E27644484622AE3155E44D9665AD"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary to carry out this section $5,000,000,000 for each of the fiscal years 2022 through 2026.</text></paragraph><paragraph id="id9FE6EFFE7435485687AAE2F1CD938AD9"><enum>(2)</enum><header>Availability of funds</header><text>Any amounts appropriated for a fiscal year pursuant to paragraph (1) that remain unobligated at the end of such fiscal year shall be made available for eligible projects in the following fiscal year.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idB40F69E95AF74B3884CB7EE0B9C457FC"><enum>(b)</enum><header>Clerical amendment</header><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/261">chapter 261</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="id94efb4e3-ff2f-490c-804a-53e89bae72b4"><toc><toc-entry level="section" idref="id983ABAF3529F4BEE910B73AA6A314B1A">26107.
