<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 184</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210202">February 2, 2021</action-date><action-desc><sponsor name-id="S338">Mr. Manchin</sponsor> (for himself, <cosponsor name-id="S327">Mr. Warner</cosponsor>, <cosponsor name-id="S372">Mrs. Capito</cosponsor>, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, <cosponsor name-id="S362">Mr. Kaine</cosponsor>, <cosponsor name-id="S309">Mr. Casey</cosponsor>, and <cosponsor name-id="S307">Mr. Brown</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Labor to issue an emergency temporary standard that requires operators to develop and implement a comprehensive infectious disease exposure control plan to protect miners from exposure to SARS–CoV–2, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3008C1DCDF1A48E1B90CA73AD007C03F"><section section-type="section-one" id="HBF4214D8DBB6442090124D4D5E6A47B1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 Mine Worker Protection Act</short-title></quote>.</text></section><section id="HF2449DBB57254C5BB0546214885F42B2"><enum>2.</enum><header>Emergency temporary and permanent standards</header><subsection id="H7025C1A8F5824AB885B725E9397C811E"><enum>(a)</enum><header>Emergency temporary health or safety standard</header><paragraph id="HD01ECA58C38545F887D7A9074795FD4F"><enum>(1)</enum><header>In general</header><text>In consideration of the grave risk presented by COVID–19 and the need to strengthen protections for miners, pursuant to section 101(b) of the Federal Mine Safety and Health Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/811">30 U.S.C. 811(b)</external-xref>) and notwithstanding the provisions of law and the Executive order listed in paragraph (3), not later than 7 days after the date of enactment of this Act, the Secretary of Labor shall promulgate an emergency temporary health or safety standard to protect miners from occupational exposure to SARS–CoV–2.</text></paragraph><paragraph id="HD44DF1406A094A00B98AC13A427B6A5B"><enum>(2)</enum><header>Application of standard</header><text display-inline="yes-display-inline">Pursuant to section 101(b)(2) of the Federal Mine Safety and Health Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/811">30 U.S.C. 811(b)</external-xref>), the emergency temporary health or safety standard promulgated under paragraph (1) shall be effective until superseded by a mandatory health or safety standard promulgated under subsection (b).</text></paragraph><paragraph id="H73F3EE711CB145F7BF641D07BC0D4A9C"><enum>(3)</enum><header>Inapplicable provisions of law and executive order</header><text display-inline="yes-display-inline">The provisions of law and the Executive order listed in this paragraph are as follows:</text><subparagraph id="H02FAAF46473B4EDD83ED12E31DA9ADF7"><enum>(A)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">Chapter 6</external-xref> of title 5, United States Code (commonly referred to as the <quote>Regulatory Flexibility Act</quote>).</text></subparagraph><subparagraph id="HE6AA6D96A592417DA5CA4CB0303C670D"><enum>(B)</enum><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>).</text></subparagraph><subparagraph id="H9C025919530D4C2CB179213CCB9BA594"><enum>(C)</enum><text>The Unfunded Mandates Reform Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1501">2 U.S.C. 1501</external-xref> et seq.).</text></subparagraph><subparagraph id="H90730727F314447598602FC903F0D472"><enum>(D)</enum><text>Executive Order 12866 (58 Fed. Reg. 190; relating to regulatory planning and review), as amended.</text></subparagraph></paragraph></subsection><subsection id="HBDF0D27E2CA047C2A8DAB5C9FB5A4059"><enum>(b)</enum><header>Permanent standard</header><text display-inline="yes-display-inline">Pursuant to section 101(b)(3) of the Federal Mine Safety and Health Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/811">30 U.S.C. 811(b)(3)</external-xref>), the Secretary shall promulgate a mandatory standard to protect miners from occupational exposure to SARS–CoV–2. </text></subsection><subsection id="HF4D24EAAB38D420D888AFBFE15B1750E"><enum>(c)</enum><header>Requirements</header><text>The standards promulgated under this section shall—</text><paragraph id="H69699437C47942E5BAC8739A550C9DBF"><enum>(1)</enum><text>include a requirement that operators—</text><subparagraph id="HF7B1F098B2A54C5CB8364AAE8501CC64"><enum>(A)</enum><text>with the input and involvement of miners or, where applicable, the representatives of miners develop and implement a comprehensive infectious disease exposure control plan to address the risk of occupational exposure to SARS–CoV–2; and</text></subparagraph><subparagraph id="HE8146F1508644CAD951650E5E33AAAD4"><enum>(B)</enum><text>provide to miners the necessary personal protective equipment, disinfectant, ancillary medical supplies, and other applicable supplies determined necessary by the Secretary to reduce and limit exposure to SARS–CoV–2 in coal or other mines;</text></subparagraph></paragraph><paragraph id="HCE4D230500AE45149D270536C2414C08"><enum>(2)</enum><text>incorporate guidelines—</text><subparagraph id="H9A02B57909D44BA5AC2E911D4EF04FEF"><enum>(A)</enum><text>issued by the Centers for Disease Control and Prevention and the National Institute for Occupational Safety and Health, which are designed to prevent the transmission of infectious agents in occupational settings; and</text></subparagraph><subparagraph id="H724DBF80C1E842929016540F3BD2C189"><enum>(B)</enum><text>from relevant scientific research on novel pathogens; and</text></subparagraph></paragraph><paragraph id="H68F6D1AF02584FD789F7FA22F3DEF0A7"><enum>(3)</enum><text>include a requirement for the recording and reporting of all work-related COVID–19 infections and deaths as set forth in part 50 of title 30, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></paragraph></subsection></section><section id="H73741AA847984FCB90C3EF66C7E6975B"><enum>3.</enum><header>Surveillance, tracking, and investigation of mining-related cases of COVID–19</header><text display-inline="no-display-inline">The Secretary of Labor (acting through the Assistant Secretary for Mine Safety and Health), in coordination with the Director of the Centers for Disease Control and Prevention and the Director of the National Institute for Occupational Safety and Health, shall—</text><paragraph id="H9C4B714ABAA14AEA8E241D70E09C6AF8"><enum>(1)</enum><text>collect and analyze case reports and other data on COVID–19 to identify and evaluate the extent, nature, and source of COVID–19 among miners, including the prevalence of and consequences of COVID–19 diagnoses among miners also diagnosed with pneumoconiosis;</text></paragraph><paragraph id="H240E193863A840FDA81DDABE26487923"><enum>(2)</enum><text>investigate, as appropriate, individual cases of COVID–19 among miners to evaluate the source of exposure and adequacy of infectious disease exposure control plans; </text></paragraph><paragraph id="H879F76BA504E4C29A839E28A9E2E3B53"><enum>(3)</enum><text>provide regular periodic reports on COVID–19 among miners to the public; and</text></paragraph><paragraph id="HB6A75F38EB0C4B41876B065E6BE253C3"><enum>(4)</enum><text>based on such reports and investigations, make recommendations on needed actions or guidance to protect miners from COVID–19.</text></paragraph></section><section id="H52FEC3518ECB4B338DA68CC45367D203"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">The terms used in this Act have the meanings given the terms in section 3 of the Federal Mine Safety and Health Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/802">30 U.S.C. 802</external-xref>). </text></section></legis-body></bill>
