<section id="id718e46a750774d68884aaf4ddab944a7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Surveillance and free speech Protection Enhancement in Export controls for Censorship and Human rights Act of 2021</short-title></quote> or the <quote><short-title>SPEECH Act of 2021</short-title></quote>.</text></section> <section section-type="subsequent-section" id="id0CBFB830500A4273AA88EA96D5497F79"><enum>2.</enum><header>Review and controls on export of items with critical capabilities to enable human rights abuses</header> <subsection id="idc6cf33b7751344f2b12f91a31c2a4939"><enum>(a)</enum><header>Statement of policy</header><text>It is the policy of the United States to use export controls to the extent necessary to further the protection of internationally recognized human rights.</text></subsection>
<subsection id="id75b9587c794a4b4e992da1ff2d9a8081"><enum>(b)</enum><header>Review of items with critical capabilities To enable human rights abuses</header><text>Not later than 180 days after the date of the enactment of this Act, and as appropriate thereafter, the Secretary, in coordination with the Secretary of State, the Director of National Intelligence, and the heads of other Federal agencies as appropriate, shall conduct a review of items subject to controls for crime control reasons pursuant to section 742.7 of the Export Administration Regulations.</text></subsection> <subsection id="id52ad272501624425af5b628c7c791d20"><enum>(c)</enum><header>Controls</header><text>In furtherance of the policy set forth in subsection (a), not later than 60 days after completing the review required by subsection (b), the Secretary, in coordination with the heads of other Federal agencies as appropriate, shall determine whether additional export controls are needed to protect human rights, including whether—</text>
<paragraph id="id92477d6754c745b9b0a4134e859ca30f"><enum>(1)</enum><text>controls for crime control reasons pursuant to section 742.7 of the Export Administration Regulations should be imposed on additional items, including items with critical capabilities to enable human rights abuses involving—</text> <subparagraph id="id4abc62bd7637462c95640678668e3f49"><enum>(A)</enum><text>censorship or social control;</text></subparagraph>
<subparagraph id="id4088364cc4ee4704bf2577ae702d8447"><enum>(B)</enum><text>surveillance, interception, or restriction of communications;</text></subparagraph> <subparagraph id="id225a68eeb67d4b3c8df5b4c5341effc6"><enum>(C)</enum><text>monitoring or restricting access to or use of the internet;</text></subparagraph>
<subparagraph id="id3036a059b6a040b7ae75e0996469eb43"><enum>(D)</enum><text>identification of individuals through facial or voice recognition or biometric indicators; or</text></subparagraph> <subparagraph id="id30651196ffff40dbae1b48e43caf0c8b"><enum>(E)</enum><text>DNA sequencing; or</text></subparagraph></paragraph>
<paragraph id="id8be10ceb08444521b874e8f20d960032"><enum>(2)</enum><text>end-use and end-user controls should be imposed on the export, reexport, or in-country transfer of certain items with critical capabilities to enable human rights abuses that are subject to the Export Administration Regulations if the person seeking to export, reexport, or transfer the item has knowledge, or the Secretary determines and so informs that person, that the end-user or ultimate consignee will use the item to enable human rights abuses.</text></paragraph></subsection> <subsection id="idc3e68c9b9c964b1f90e18a9ff41e61ee"><enum>(d)</enum><header>Cooperation of other agencies</header><text>Upon request from the Secretary, the head of a Federal agency shall provide full support and cooperation to the Secretary in carrying out this section.</text></subsection>
<subsection id="id48f95500b1c34dbab41ecc18a383ccf9"><enum>(e)</enum><header>International coordination on controls To protect human rights</header><text>It shall be the policy of the United States to seek to secure the cooperation of other governments to impose export controls that are consistent, to the extent possible, with the controls imposed under this section.</text></subsection> <subsection id="idd644a014e35546fd851f57abe93e0dcb"><enum>(f)</enum><header>Conforming amendment</header><text>Section 1752(2)(A) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4811">50 U.S.C. 4811(2)(A)</external-xref>) is amended—</text>
<paragraph id="id5f8d4707e3ba423fa137fd726372e476"><enum>(1)</enum><text>in clause (iv), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph> <paragraph id="id991a919059ef41b69559a30a001cd711"><enum>(2)</enum><text>in clause (v), by striking the period and inserting <quote>; or</quote>; and</text></paragraph>
<paragraph id="idb93e220e07134489aeecdea81d863e4d"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idcfd87238576745c39e43a5700a64a3b9"> <clause id="id7af555676c2848a6b49fb0d7ea83ddcd"><enum>(vi)</enum><text>serious human rights abuses.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id666495604766437ea0a13e23df2c0690"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id32a775f1c8494e0090272264e0304792"><enum>(1)</enum><header>End-user; knowledge; ultimate consignee</header><text>The terms <quote>end-user</quote>, <quote>knowledge</quote>, and <quote>ultimate consignee</quote> have the meanings given those terms in section 772.1 of the Export Administration Regulations.</text></paragraph>
<paragraph id="idb4c6a726b7684c658404863da5139ae7"><enum>(2)</enum><header>Export; export administration regulations; in-country transfer; item; reexport</header><text>The terms <quote>export</quote>, <quote>Export Administration Regulations</quote>, <quote>in-country transfer</quote>, <quote>item</quote>, and <quote>reexport</quote> have the meanings given those terms in section 1742 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref>).</text></paragraph> <paragraph id="id181294d8decc46d990b3f9df4b84c5ac"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce. </text></paragraph></subsection></section>
