<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1836</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210526">May 26, 2021</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself and <cosponsor name-id="S406">Mr. Kelly</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to provide eligibility for certain emergency maintenance projects under the emergency relief program, and for other purposes.</official-title></form><legis-body><section id="idC2BAEC8BEE0C4EA288D9F64D49AFFAF2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fixing Infrastructure Damaged by Disasters Act </short-title></quote>.</text></section><section id="idC68101B71DBF489C8A92C8470D464FFD"><enum>2.</enum><header>Emergency relief</header><text display-inline="no-display-inline">Section 125 of title 23, United States Code, is amended—</text><paragraph id="id2F951EFC5BF24994A2F121E5E26DF541"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by inserting <quote>blizzard, ice storm, wildfire,</quote> before <quote>flood</quote>;</text></paragraph><paragraph id="idD0AB4C16D68A44ECAC538ED8A918937A"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id025590A5CC6241F18C8F9D0AB0B478E1"><paragraph id="id15355E21202E47049B2D54B40FCA43F1"><enum>(4)</enum><header>Emergency maintenance</header><text>Notwithstanding any other provision of this section, on the request of a Governor of a State and with the approval of the Secretary, the cost of an emergency maintenance project that is necessary due to an event described in subsection (a), including maintenance that would be considered heavy or routine maintenance, but for the event, shall be an eligible expense under this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id18FDA56DDF98462E83C3E392F0BFC22E"><enum>(3)</enum><text>in subsection (g)—</text><subparagraph id="id8D95F2648300457E870281D3DD94FB99"><enum>(A)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDC7133D9DC7247BAB1865BC78E098AA8"><paragraph id="id2609DCAF22F64EC39F6CCA30537EA685"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id95AA124914A5452E8446DC2599F5087C"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id859FBCA2F50B404C95112D8C234D88DC"><paragraph id="id2236504EB03548D0B16F0EAFCD0E0161"><enum>(2)</enum><header>Waiver</header><text>On the request of a Governor of a State, the Secretary may increase the amount under paragraph (1) to not more than 25 percent.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
