<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1834</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210526">May 26, 2021</action-date><action-desc><sponsor name-id="S229">Mrs. Murray</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Child Nutrition Act of 1966 to clarify the availability and appropriateness of training for local food service personnel, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Training for School Food Service Workers Act of 2021</short-title></quote>.</text></section><section id="idf9f0bc44af12425faee23558e45c26cc"><enum>2.</enum><header>Training and certification of all local food service personnel</header><text display-inline="no-display-inline">Section 7(g)(2)(B) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776(g)(2)(B)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfcc29929626d46c186cb427009533497"><clause id="idb1558fcf38a24faaa30581314e5d438b"><enum>(iv)</enum><header>Availability and appropriateness of training</header><subclause id="id9BDDA05401AC40498AAEA18FC852E227"><enum>(I)</enum><header>In general</header><text>A training program carried out under this subparagraph shall—</text><item id="id608eb5c515a5432ca0f1c51fc6294e71"><enum>(aa)</enum><text>be scheduled during regular, paid working hours;</text></item><item id="ida5f87b0d77da475aa982b91972aac634"><enum>(bb)</enum><text>be offered in-person, if appropriate;</text></item><item id="idE231151241074B4A85FF0B8CFC05FDA0"><enum>(cc)</enum><text>incorporate experiential learning; and</text></item><item id="idC01B0CEF86BF432586FAC2A7148B5444"><enum>(dd)</enum><text>be provided at no cost to food service personnel.</text></item></subclause><subclause id="id2B609C38B20C42179E9C11F07DC79FC1"><enum>(II)</enum><header>Program outside working hours</header><text>In the event that a training program carried out under this subparagraph is scheduled outside of regular, paid working hours—</text><item id="id3289fd58cc524753a3370a7817afd2bf"><enum>(aa)</enum><text>efforts shall be made to inform food service personnel of the necessity of the program to be scheduled outside of regular, paid working hours;</text></item><item id="idbe63963b67f54c1dbf3b7d357e51f3a0"><enum>(bb)</enum><text>food service personnel shall be consulted to schedule the program at a time that is minimally disruptive to the personnel participating in the training program;</text></item><item id="id3b9d9211d5694f7b9af40cacb7503f8c"><enum>(cc)</enum><text>compensation shall be provided to food service personnel attending the program at the regular rate of pay, including any applicable overtime rate; and</text></item><item id="id45930b9656324dcdb3c2eddd10e80c55"><enum>(dd)</enum><text>food service personnel shall not be penalized or in any other manner discriminated against for not being able to attend the program.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idEE8287E673734F9BA464C99B98C60D27"><enum>(v)</enum><header display-inline="yes-display-inline">Relationship to other laws</header><text display-inline="yes-display-inline">Nothing in this subparagraph supersedes or otherwise modifies any Federal, State, or local law or legal obligation governing the relationship between an employee and employer.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
