Russell National School Lunch Act to establish a permanent, nationwide electronic benefits transfer program for children during school closures, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6F5E31932E084F96B72D7A6EFDEB22B2"><section section-type="section-one" id="H9F40FAD3E0F440539BC64E4721630F38"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Child Hunger Act of 2021</short-title></quote>. </text></section><section id="H6DCA009391AE4F49A8BC2066A16726BB"><enum>2.</enum><header>Summer electronic benefits transfer for children program</header><text display-inline="no-display-inline">Section 13(a) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H331A06B1A8A84786B07FA6145CC9DFEC"><paragraph id="H6F8D09BA3A654BF5BD261D2E9FFEECB1"><enum>(13)</enum><header>School closure electronic benefits transfer for children program</header><subparagraph id="H7D1B135EC1794389AD080BA9A956E992"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="H64BDF2B739954F27B130E68ADF59F8AE"><enum>(i)</enum><header>Covered period</header><text>The term <term>covered period</term> means a period in which an elementary school or secondary school is closed, operating remotely, or operating in a hybrid manner for 5 or more consecutive weekdays during the calendar year. </text></clause><clause id="H13975EF71759453FB4530E67C49DDD05"><enum>(ii)</enum><header>Eligible household</header><text display-inline="yes-display-inline">The term <term>eligible household</term> means a household that includes 1 or more children who are eligible to receive free or reduced-price lunches under this Act or free or reduced-price breakfasts under the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771</external-xref> et seq.), including children eligible for such meals pursuant to section 11(a)(1)(F). </text></clause><clause id="H686CDE0078734072BE4568DFD476B898"><enum>(iii)</enum><header>Free rate</header><text display-inline="yes-display-inline">The term <term>free rate</term> has the meaning given the term in section 1101(j)(4) of the Families First Coronavirus Response Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> note). </text></clause><clause id="H05F36607A260430EB6D52D13EEEDCFA7"><enum>(iv)</enum><header>School closure EBT card</header><text>The term <term>school closure EBT card</term> means an electronic benefit transfer (EBT) card that is issued to an eligible household under this paragraph and limited to food purchases.</text></clause></subparagraph><subparagraph id="H0A7F6D001CD149CE8C6F8F0A58BF2DC0"><enum>(B)</enum><header>Program</header><text>The Secretary shall establish a program under which the Secretary shall provide to eligible households school closure EBT cards for the purpose of providing access to food for children during covered periods—</text><clause id="HAA81E8CC027B41C0A88A11DE67B74840"><enum>(i)</enum><text>to reduce or eliminate the food insecurity and hunger of children; and</text></clause><clause id="H5583786CE4074459B5F3629F6FFFBD76"><enum>(ii)</enum><text>to improve the nutritional status of children.</text></clause></subparagraph><subparagraph id="H6C7427A47290414AA115DB0525925E74"><enum>(C)</enum><header>Use</header><text>An eligible household may use a school closure EBT card only to purchase food from retail food stores that have been approved for participation in the supplemental nutrition assistance program established under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.), in accordance with section 7(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(b)</external-xref>).</text></subparagraph><subparagraph id="HCC59736524304C99B74E85695EDAF83B"><enum>(D)</enum><header>Amount</header><text>The amount of a school closure EBT card issued pursuant to this paragraph shall be, with respect to a covered period, not less than the value of meals at the free rate for each day of such covered period. </text></subparagraph><subparagraph id="HD8D8A38F6BAD424D9A59D0EDF67497CE"><enum>(E)</enum><header>Funding</header><clause id="HCFE67CAC97794BD3993283C2BD5F473E"><enum>(i)</enum><header>In general</header><text>On October 1, 2021, and on each October 1 thereafter, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary such sums as are necessary to carry out this paragraph (including administrative expenses), to remain available until expended.</text></clause><clause id="HEA99F0381EE34DDFA92EC929487344DF"><enum>(ii)</enum><header>Receipt and acceptance</header><text>The Secretary shall be entitled to receive, shall accept, and shall use to carry out this section the funds transferred under clause (i), without further appropriation. </text></clause></subparagraph><subparagraph id="H4A19C9D526F8452C9BA0A0CF69376FC1"><enum>(F)</enum><header>Regulations</header><clause id="H3F20BFF5FA7E4538BAF63895F516AF52"><enum>(i)</enum><header>In general</header><text>Not later than October 1, 2021, the Secretary shall issue regulations to carry out this paragraph.</text></clause><clause id="H78535ED84AD0420AB1BAB891E7D70179"><enum>(ii)</enum><header>Requirements</header><text>Regulations issued under this subparagraph shall require that—</text><subclause id="H13324B4357F3413EB00DBFA440D7B777"><enum>(I)</enum><text>children shall be eligible to participate and shall be enrolled into the program under this paragraph for a covered period without further application if the children are enrolled to participate in the free or reduced-price lunch program under this Act or the free or reduced-price breakfast program under the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771</external-xref> et seq.);</text></subclause><subclause id="H7CB28170D3AF4AD1B2EB139E69EEAC85"><enum>(II)</enum><text display-inline="yes-display-inline">local educational agencies shall support the administration of the program under this paragraph by—</text><item id="H820EE3535C9C430195E269E17E87B7BB"><enum>(aa)</enum><text>communicating to the State agency when any school is closed, operating remotely, or operating in a hybrid manner; and</text></item><item id="H7ADD4F02B0CC48ACB439F302CE3A45FF"><enum>(bb)</enum><text>providing data on the children eligible to participate in the program under this paragraph; </text></item></subclause><subclause id="HD95860F59B7E43D9A7B29A7BA3D20957"><enum>(III)</enum><text>State agencies shall provide information on children eligible to participate in the program under this paragraph with the State agency conducting eligibility determinations for the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.); and</text></subclause><subclause id="HD4E06E8921E441AEA870593479C179D9"><enum>(IV)</enum><text>State agencies conducting eligibility determinations described in subclause (III) shall—</text><item id="HBB5D6337C42649C7909AA9CC814C93DD"><enum>(aa)</enum><text>distribute the school closure EBT cards; </text></item><item id="idebaeae64f0274fe89362dc9a35aa9b58"><enum>(bb)</enum><text>provide information to households regarding the program under this paragraph, including eligibility rules and how children in eligible households that are not automatically enrolled under subclause (I) may apply for program benefits; and </text></item><item id="HBBE8E25A988C4C44B0A59F18198225C1"><enum>(cc)</enum><text>administer the program under this paragraph in accordance with regulations promulgated by the Secretary.</text></item></subclause></clause></subparagraph><subparagraph id="H3C6D01E4431E46B890F687406629B0A5"><enum>(G)</enum><header>Implementation grants</header><clause id="H23C3D8801A44467384FCA87006DC27B3"><enum>(i)</enum><header>In general</header><text>The Secretary shall carry out a program to make grants to States to support the development of data systems or upgrades to existing data systems that are necessary to implement this paragraph. </text></clause><clause id="H62F5A9847EB24F15911E497D64504F10"><enum>(ii)</enum><header>Funding</header><text>In addition to amounts made available under subparagraph (E), on October 1, 2021, out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary to carry out this subparagraph $50,000,000, to remain available until expended.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
