<section section-type="section-one" id="idDA95FECAA7A043C1BDE3E7E5511B53DE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe School Meals for Kids Act of 2021</short-title></quote>.</text></section> <section id="id7E2965016DD34C8BA50EEB69C92750F8"><enum>2.</enum><header>Preventing childhood dietary exposure to chlorpyrifos</header> <subsection id="idE5F1105B98884B46BD27C9DB576AD52B"><enum>(a)</enum><header>In general</header><text>Beginning with the 2021–2022 school year, the Secretary of Agriculture (referred to in this section as the <term>Secretary</term>) shall phase out all food that has been treated with, or has levels in excess of the threshold established by the Secretary under subsection (b)(1) of, chlorpyrifos residue in food—</text>
<paragraph id="id364092B4C4164F2AAD486D344E9F395E"><enum>(1)</enum><text>in school meals provided under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.);</text></paragraph> <paragraph id="idAC4DB69B373347CD94297CF169C8D2ED"><enum>(2)</enum><text>in school meals provided under the school breakfast program established by section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and</text></paragraph>
<paragraph id="idA5C897D200D5476792CA762F1AAE567B"><enum>(3)</enum><text>provided by the Department of Defense Fresh Fruit and Vegetable Program.</text></paragraph></subsection> <subsection id="id557032631DDD462EA7928B408EA59AC6"><enum>(b)</enum><header>Requirements</header><text>In carrying out subsection (a), the Secretary shall—</text>
<paragraph id="idD99A167F57E44D2F89278A8457D67E9B"><enum>(1)</enum><text>establish a threshold for chlorpyrifos for the food described in subsection (a) of not more than .001 micrograms of chlorpyrifos per kilogram of food, as the Secretary determines to be necessary;</text></paragraph> <paragraph id="id6E43B0037E45491CB9F020A71FE75293"><enum>(2)</enum><text>provide guidance, in consultation with State and local educational agencies, to eliminate chlor­pyr­i­fos from meals provided by schools, which may include guidance or criteria related to food procurement or supply contract policies;</text></paragraph>
<paragraph id="idEE3A006E1EB14B29ACC2C04017CC2B0E"><enum>(3)</enum><text>periodically update the guidance described in paragraph (2); and</text></paragraph> <paragraph id="id1CC6971E0FB446B0913589E92852DE5B"><enum>(4)</enum><text>provide technical assistance to State and local educational agencies to enforce the requirements of this section.</text></paragraph></subsection>
<subsection id="idEFC14C2C8DD6437D8DB8027BECFA19EC"><enum>(c)</enum><header>Review by the Secretary</header><text>Not later than January 1, 2021, and every 2 years thereafter until January 1, 2028, the Secretary shall conduct a review to evaluate whether, based on reports provided by State and local educational agencies, any of the food described in subsection (a) exceeds the threshold for chlorpyrifos established by the Secretary under subsection (b)(1).</text></subsection></section> </legis-body> </bill>
