which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Consumer Product Safety Act to direct the Consumer Product Safety Commission to establish consumer product safety standards for firearm locks and firearm safes, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5B141F712A8C4962AAE6F58E82901319"><section section-type="section-one" id="H58DDA009BDEF4032B2F2E34BD6CCD132"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Gun Storage Act of 2021</short-title></quote>.</text></section><section display-inline="no-display-inline" id="H772BE29A8B584A1C978CC29FB07C1EC1"><enum>2.</enum><header>Consumer product safety standards for firearm locks and firearm safes</header><subsection id="HF247955A7EFA4C18BA896BFE7462FE5F"><enum>(a)</enum><header>In general</header><text>The <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/2051">15 U.S.C. 2051</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block act-name="Consumer Product Safety Act" id="H5BB94E7BB48941928C15CF0F25126A8C"><section id="H523B6C477C964062BBEBE6C63E51B795"><enum>43.</enum><header>Consumer product safety standards for firearm locks and firearm safes</header><subsection id="HC191AD512DC5426B9750DCA7F1453C0E"><enum>(a)</enum><header>Establishment of standards</header><paragraph id="H15334CB7B44F40A28BC663F83B4B6EFC"><enum>(1)</enum><header>Rulemaking required</header><subparagraph id="H199DA91D8F3144289CE53FA0A9A696E3"><enum>(A)</enum><header>Rulemaking proceeding</header><text>Notwithstanding section 3(a)(5)(E), the Commission shall initiate a rulemaking proceeding under section 553 of title 5, United States Code, within 90 days after the date of the enactment of this section to establish—</text><clause id="HD09D762DBBC147EEB2EFF90CE7B52D52"><enum>(i)</enum><text>a consumer product safety standard for firearm locks; and</text></clause><clause id="H06C60E8276AF4D9DB01A5E992DB81072"><enum>(ii)</enum><text>a consumer product safety standard for firearm safes.</text></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H2A3B431CBFFD4EA9903F93524ABFA4B9"><enum>(B)</enum><header>Final rule</header><text>Notwithstanding any other provision of law, including <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, the Commission shall promulgate final consumer product safety standards under this paragraph within 12 months after the date on which the Commission initiates the rulemaking proceeding under subparagraph (A).</text></subparagraph><subparagraph id="H0682B855066C4C58987C15FD69377D39"><enum>(C)</enum><header>Effective date</header><text>Each final consumer product safety standard promulgated under this paragraph shall take effect 6 months after the date on which such standard is promulgated.</text></subparagraph></paragraph><paragraph id="H58C18C0E0ED14EADB11E63F87AD4D041"><enum>(2)</enum><header>Requirements for firearm lock standard</header><text>The standard for firearm locks promulgated under paragraph (1) shall require firearm locks that—</text><subparagraph id="H083B287929F94CBF85F66CB94E7FCB9A"><enum>(A)</enum><text display-inline="yes-display-inline">are sufficiently difficult for an unauthorized user to de-activate or remove; and</text></subparagraph><subparagraph id="H781DC121D7EC49A8A105CD74F5EF7B9B"><enum>(B)</enum><text>prevent the discharge of the firearm unless the firearm lock has been de-activated or removed.</text></subparagraph></paragraph><paragraph id="H0051BF8E02DA428296A9CCAFD1D468B1"><enum>(3)</enum><header>Requirements for firearm safe standard</header><text display-inline="yes-display-inline">The standard for firearm safes promulgated under paragraph (1) shall require firearm safes that reliably secure firearms from unauthorized users, and include reliable security features, quality, and construction to reliably prevent unauthorized users from gaining access to a firearm by damaging or physically manipulating the safe.</text></paragraph></subsection><subsection id="H81B78582577C4DC7BCD1C3E57C0E34E4"><enum>(b)</enum><header>Certain provisions not To apply</header><paragraph id="H24E7836334C947BA932729C98C588099"><enum>(1)</enum><header>Provisions of this Act</header><text>Sections 7 and 9 of this Act do not apply to the rulemaking proceeding under paragraph (1) of subsection (a).</text></paragraph><paragraph id="H32D80621BCFC4EE7B2383B973E1BD7CD"><enum>(2)</enum><header>Chapter 5 of title 5</header><text>Except for section 553, <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, does not apply to this section.</text></paragraph><paragraph id="HAE3AF2F355854B7BB6384433AD1703E8"><enum>(3)</enum><header>Chapter 6 of title 5</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">Chapter 6</external-xref> of title 5, United States Code, does not apply to this section.</text></paragraph><paragraph id="HCF6ADE2E8DC444F2B577B56902516235"><enum>(4)</enum><header>National Environmental Policy Act</header><text>The <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) does not apply to this section.</text></paragraph></subsection><subsection id="H44C424D2C4F04880BD10B84E43A9E935"><enum>(c)</enum><header>No effect on State law</header><text display-inline="yes-display-inline">Notwithstanding section 26 of this Act, this section does not annul, alter, impair, affect, or exempt any person subject to a consumer product safety standard promulgated under subsection (a)(1) from complying with any provision of the law of any State or any political subdivision thereof, except to the extent that such provision is inconsistent with any such standard, and then only to the extent of the inconsistency. A provision of the law of a State or a political subdivision thereof is not inconsistent with a consumer product safety standard promulgated under subsection (a)(1) if such provision affords greater protection to individuals with respect to firearms than is afforded by such standard.</text></subsection><subsection id="H2AE0CD8149394F2984BB33392C0FB1EE"><enum>(d)</enum><header>Enforcement</header><text>Notwithstanding subsection (b)(1), the consumer product safety standards promulgated by the Commission under subsection (a)(1) shall be enforced under this Act as if such standards were consumer product safety standards described in section 7(a).</text></subsection><subsection id="H323FAE54DA724C648FB11E11B6ACC6F2"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HDDAE196D32D34E638DFF74D4E76C4D3A"><enum>(1)</enum><header>Firearm</header><text display-inline="yes-display-inline">The term <term>firearm</term> has the meaning given the term in section 921(a) of title 18, United States Code.</text></paragraph><paragraph id="H015345F077254715B29B736666664BF9"><enum>(2)</enum><header>Firearm lock</header><text>The term <term>firearm lock</term> means any disabling or locking device that is not built into the firearm at the time of manufacture and that is designed to prevent the firearm from being discharged unless the device has been deactivated or removed.</text></paragraph><paragraph id="HAFC0F89ECF234D62AC1439C0DA6B3C6C"><enum>(3)</enum><header>Firearm safe</header><text display-inline="yes-display-inline">The term <term>firearm safe</term> means a container that is advertised to be used to store a firearm and that is designed to be unlocked only by means of a key, a combination, or other similar means.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1307547ABF1C476AB2E09374B126410E"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1 of the <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name> is amended by adding at the end of the table of contents the following:</text><quoted-block style="USC" act-name="Consumer Product Safety Act" id="H6062AAFF89D643D38EFF63073F532993"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 43. Consumer product safety standards for firearm locks and firearm safes. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H7065B4B38D1941B982EBE2799FCB978B"><enum>3.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Consumer Product Safety Commission $2,000,000 to carry out the provisions of section 43 of the <act-name parsable-cite="CPSA">Consumer Product Safety Act</act-name>, as added by section 1, such sums to remain available until expended.</text></section></legis-body></bill>
