or replace bridges to improve the safety, efficiency, and
reliability of the movement of people and freight over
bridge crossings, and for other purposes.
</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bridge Investment Act of 2021</short-title></quote>.</text></section><section id="H718B557992C845A2913352FA8883AD80" changed="not-changed"><enum>2.</enum><header>Bridge investment program</header><subsection id="HF13A8360083444E590A8700C5798485C" changed="not-changed"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/23/123">section 123</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H6472E444C4D44B6FBAA7D0C6BD1054BC" changed="not-changed"><section changed="not-changed" id="H5FA1DB95C49547C49717EEF96BEADD5C"><enum>124.</enum><header>Bridge investment program</header><subsection id="H5520182F7BE148DFB3E160FDBD01777D" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="HDAAC0B76F7974DE6914F6B1539F1758F" changed="not-changed"><enum>(1)</enum><header>Eligible project</header><subparagraph commented="no" id="H2B8E130AA024494FA3BD07214C9DD925" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The term <term>eligible project</term> means a project to replace, rehabilitate, preserve, or protect 1 or more bridges on the National Bridge Inventory under section 144(b).</text></subparagraph><subparagraph commented="no" id="H0F7A1CB0EEA142A89D332FBEC443CBA9" changed="not-changed"><enum>(B)</enum><header>Inclusions</header><text>The term <term>eligible project</term> includes—</text><clause commented="no" id="H65EB35BA00E548F6AF121CF55BAABBEE" changed="not-changed"><enum>(i)</enum><text>a bundle of projects described in subparagraph (A), regardless of whether the bundle of projects meets the requirements of section 144(j)(5); and</text></clause><clause commented="no" id="HCCCCB9DBFEAF4B48AAAFA37169338E32" changed="not-changed"><enum>(ii)</enum><text>a project to replace or rehabilitate culverts for the purpose of improving flood control and improved habitat connectivity for aquatic species.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H63018ABF715B4F65B462990E006BD415" changed="not-changed"><enum>(2)</enum><header>Large project</header><text>The term <term>large project</term> means an eligible project with total eligible project costs of greater than $100,000,000.</text></paragraph><paragraph commented="no" id="H915FF51480F04199B13851D8ABFBACFF" changed="not-changed"><enum>(3)</enum><header>Program</header><text>The term <term>program</term> means the bridge investment program established by subsection (b)(1).</text></paragraph></subsection><subsection id="HEFCAFCCF60914ED48C4512E38100E9DF" changed="not-changed"><enum>(b)</enum><header>Establishment of bridge investment program</header><paragraph id="H7CC76CB19A8E41A0B8DAADF6CBBA6D89" changed="not-changed"><enum>(1)</enum><header>In general</header><text>There is established a bridge investment program to provide financial assistance for eligible projects under this section.</text></paragraph><paragraph id="H84D257ACC88E4F4DA7AB526D1D88C286" changed="not-changed"><enum>(2)</enum><header>Goals</header><text>The goals of the program shall be—</text><subparagraph id="H337E4ECC9EF741A087635C1E03BAFF13" changed="not-changed"><enum>(A)</enum><text>to improve the safety, efficiency, and reliability of the movement of people and freight over bridges;</text></subparagraph><subparagraph id="H238AD6B464ED4656A0C3A56F71944832" changed="not-changed"><enum>(B)</enum><text>to improve the condition of bridges in the United States by reducing—</text><clause id="H651A51D8C62F4EFF81D7E490FF1806F5" changed="not-changed"><enum>(i)</enum><text>the number of bridges—</text><subclause id="H2D33CA77CA614882A68571A163CAD124" changed="not-changed"><enum>(I)</enum><text>in poor condition; or</text></subclause><subclause id="H420465B0FB46448B8CD8E20DE4186A95" changed="not-changed"><enum>(II)</enum><text>in fair condition and at risk of falling into poor condition within the next 3 years;</text></subclause></clause><clause id="H2A8079E0A1D540D7892CA01D58C389B9" changed="not-changed"><enum>(ii)</enum><text>the total person miles traveled over bridges—</text><subclause id="HBE45361A800B42D8A840264B5E324865" changed="not-changed"><enum>(I)</enum><text>in poor condition; or</text></subclause><subclause id="HF29ADCB36BDE49EDACB052BAF4160E42" changed="not-changed"><enum>(II)</enum><text>in fair condition and at risk of falling into poor condition within the next 3 years;</text></subclause></clause><clause id="H01ABA75DD2794BA18615356C5F787284" changed="not-changed"><enum>(iii)</enum><text>the number of bridges that—</text><subclause id="HFE95D502CD0441D98D7B27304FE1CBB7" changed="not-changed"><enum>(I)</enum><text>do not meet current geometric design standards; or</text></subclause><subclause id="HD8DC5E88CDA64EE6A91252D67A9A2327" changed="not-changed"><enum>(II)</enum><text>cannot meet the load and traffic requirements typical of the regional transportation network; and</text></subclause></clause><clause id="HC74540F115FB412AA39647FF55427086" changed="not-changed"><enum>(iv)</enum><text>the total person miles traveled over bridges that—</text><subclause id="HA5805A70B4EB43FCB7E48A43F7E46728" changed="not-changed"><enum>(I)</enum><text>do not meet current geometric design standards; or</text></subclause><subclause id="H04F2944949954504803244997ED5DE23" changed="not-changed"><enum>(II)</enum><text>cannot meet the load and traffic requirements typical of the regional transportation network; and</text></subclause></clause></subparagraph><subparagraph id="H5DB608A3971D4473A6F64A40633E761E" changed="not-changed"><enum>(C)</enum><text>to provide financial assistance that leverages and encourages non-Federal contributions from sponsors and stakeholders involved in the planning, design, and construction of eligible projects.</text></subparagraph></paragraph></subsection><subsection id="HF79D99D8451E4199AB78DD30FF348D1B" changed="not-changed"><enum>(c)</enum><header>Grant authority</header><paragraph id="H69F43D765280430D9BBBB714D394381D" changed="not-changed"><enum>(1)</enum><header>In general</header><text>In carrying out the program, the Secretary may award grants, on a competitive basis, in accordance with this section.</text></paragraph><paragraph id="H930308AC6278429AA801485C76C664C1" changed="not-changed"><enum>(2)</enum><header>Grant amounts</header><text>Except as otherwise provided, a grant under the program shall be—</text><subparagraph id="H2C2B93A844944ED5B4B325A044A5FD03" changed="not-changed"><enum>(A)</enum><text>in the case of a large project, in an amount that is—</text><clause id="HA5345476BAAB441287FE73CA3BCF52D6" changed="not-changed"><enum>(i)</enum><text>adequate to fully fund the project (in combination with other financial resources identified in the application); and</text></clause><clause id="H581798060CF74AA4B4D8EFE3F61BBEAF" changed="not-changed"><enum>(ii)</enum><text>not less than $50,000,000; and</text></clause></subparagraph><subparagraph id="H0393903BCF2E4CD1941BBA1650E13C29" changed="not-changed"><enum>(B)</enum><text>in the case of any other eligible project, in an amount that is—</text><clause id="H7F09571B2E76413C9EA18C51CEF42C29" changed="not-changed"><enum>(i)</enum><text>adequate to fully fund the project (in combination with other financial resources identified in the application); and</text></clause><clause id="H929BB14C370F45A1A47F205859ED0FA2" changed="not-changed"><enum>(ii)</enum><text>not less than $2,500,000.</text></clause></subparagraph></paragraph><paragraph id="H9E9941BD2A4A4DCDB0D215D08D6127BF" changed="not-changed"><enum>(3)</enum><header>Maximum amount</header><text>Except as otherwise provided, for an eligible project receiving assistance under the program, the amount of assistance provided by the Secretary under this section, as a share of eligible project costs, shall be—</text><subparagraph id="H350D85D1957D48FA897B92B10DC29384" changed="not-changed"><enum>(A)</enum><text>in the case of a large project, not more than 50 percent; and</text></subparagraph><subparagraph id="H241977B25F854453B69B099BC4848576" changed="not-changed"><enum>(B)</enum><text>in the case of any other eligible project, not more than 80 percent.</text></subparagraph></paragraph><paragraph id="H676550356156436E9A0044AE1E72E49C" changed="not-changed"><enum>(4)</enum><header>Federal share</header><subparagraph id="HE6BBB0F4738541B09BF120A34481AABC" changed="not-changed"><enum>(A)</enum><header>Maximum Federal involvement</header><text>Federal assistance other than a grant under the program may be used to satisfy the non-Federal share of the cost of a project for which a grant is made, except that the total Federal assistance provided for a project receiving a grant under the program may not exceed the Federal share for the project under section 120.</text></subparagraph><subparagraph id="H2C49585221A14D1F976A5CAD69B3C4EE" changed="not-changed"><enum>(B)</enum><header>Off-system bridges</header><text>In the case of an eligible project for an off-system bridge (as defined in section 133(f)(1))—</text><clause id="HDB4BE22F3D634A0CB53BF8A91A86D1EE" changed="not-changed"><enum>(i)</enum><text>Federal assistance other than a grant under the program may be used to satisfy the non-Federal share of the cost of a project; and</text></clause><clause id="H64A970D33DE747949F217A997E08ECB6" changed="not-changed"><enum>(ii)</enum><text>notwithstanding subparagraph (A), the total Federal assistance provided for the project shall not exceed 90 percent of the total eligible project costs.</text></clause></subparagraph><subparagraph id="H50BCB4A742D04D3AB7ED62DDDE395D82" changed="not-changed"><enum>(C)</enum><header>Federal land management agencies and Tribal governments</header><text>Notwithstanding any other provision of law, Federal funds other than Federal funds made available under this section may be used to pay the remaining share of the cost of a project under the program by a Federal land management agency or a Tribal government or consortium of Tribal governments.</text></subparagraph></paragraph><paragraph id="HD0C7124586314A619EC2DFEC31B7C046" changed="not-changed"><enum>(5)</enum><header>Considerations</header><subparagraph id="H35D1B063DCC34E149599FEE198CA07FF" changed="not-changed"><enum>(A)</enum><header>In general</header><text>In awarding grants under the program, the Secretary shall consider—</text><clause id="H78FA2F0EF6A847C3A87FE665A7BF1F07" changed="not-changed"><enum>(i)</enum><text>in the case of a large project, the ratings assigned under subsection (g)(5)(A);</text></clause><clause id="H7C95BB17FA7C4A31916601CBC368DD1D" changed="not-changed"><enum>(ii)</enum><text>in the case of an eligible project other than a large project, the quality rating assigned under subsection (f)(3)(A)(ii);</text></clause><clause id="H3A13E8B104FC4F9B8C42310BCF7C4DEB" changed="not-changed"><enum>(iii)</enum><text>the average daily person and freight throughput supported by the eligible project;</text></clause><clause id="H0C4F72AE006943349C0AC38883C4B615" changed="not-changed"><enum>(iv)</enum><text>the number and percentage of bridges within the same State as the eligible project that are in poor condition;</text></clause><clause id="H080BBA5372B64397995997BBFD1C5478" changed="not-changed"><enum>(v)</enum><text>the extent to which the eligible project demonstrates cost savings by bundling multiple bridge projects;</text></clause><clause id="HCEE29D99BC134C5C93254D8D2C6F2381" changed="not-changed"><enum>(vi)</enum><text>in the case of an eligible project of a Federal land management agency, the extent to which the grant would reduce a Federal liability or Federal infrastructure maintenance backlog;</text></clause><clause id="HE87F25781AC743BCAB01FF039D67269D" changed="not-changed"><enum>(vii)</enum><text>geographic diversity among grant recipients, including the need for a balance between the needs of rural and urban communities; and</text></clause><clause id="H59BC939C67CE411D8F0150BD7EEE43F2" changed="not-changed"><enum>(viii)</enum><text>the extent to which a bridge that would be assisted with a grant—</text><subclause id="H91A386F6468D4213998FF52200A7D563" changed="not-changed"><enum>(I)</enum><text>is, without that assistance—</text><item id="H0421AE4A64C147DDB1CA5F2D5E20C889" changed="not-changed"><enum>(aa)</enum><text>at risk of falling into or remaining in poor condition; or</text></item><item id="H31602C834CBD44DCBBCD41D1608DE7A7" changed="not-changed"><enum>(bb)</enum><text>in fair condition and at risk of falling into poor condition within the next 3 years;</text></item></subclause><subclause id="H408ABFB73F4B4C4DA8C8301BFFDA2B99" changed="not-changed"><enum>(II)</enum><text>does not meet current geometric design standards based on—</text><item id="H974C13F3CF36432E9A00FF421FB3D20E" changed="not-changed"><enum>(aa)</enum><text>the current use of the bridge; or</text></item><item id="HC59A5BC20E114E1FA217F9A7AF1DB062" changed="not-changed"><enum>(bb)</enum><text>load and traffic requirements typical of the regional corridor or local network in which the bridge is located; or</text></item></subclause><subclause id="H059EFCA781E1438BAEAE7C8058077AA1" changed="not-changed"><enum>(III)</enum><text>does not meet current seismic design standards.</text></subclause></clause></subparagraph><subparagraph id="H9D07ADB52D144A7390EEB2E818E6124F" changed="not-changed"><enum>(B)</enum><header>Requirement</header><text>The Secretary shall—</text><clause id="HA5D65403BC06474791D0E066D23C8F6B" changed="not-changed"><enum>(i)</enum><text>give priority to an application for an eligible project that is located within a State for which—</text><subclause id="HE09676653F1B4C5E88756B1DD67ACE49" changed="not-changed"><enum>(I)</enum><text>2 or more applications for eligible projects within the State were submitted for the current fiscal year and an average of 2 or more applications for eligible projects within the State were submitted in prior fiscal years of the program; and</text></subclause><subclause id="H8FD37D1E002C47D2A1EFC7262FEF1E97" changed="not-changed"><enum>(II)</enum><text>fewer than 2 grants have been awarded for eligible projects within the State under the program;</text></subclause></clause><clause id="H8D789DD375924D19A7FE3DC4566BF691" changed="not-changed"><enum>(ii)</enum><text>during the period of fiscal years 2022 through 2026, for each State described in clause (i), select—</text><subclause id="H7CCF4F65A9B5421A87D900AB1CEC3BBD" changed="not-changed"><enum>(I)</enum><text>not fewer than 1 large project that the Secretary determines is justified under the evaluation under subsection (g)(4); or</text></subclause><subclause id="H548C52ED2B85481694DADF781A6E5BAF" changed="not-changed"><enum>(II)</enum><text>2 eligible projects that are not large projects that the Secretary determines are justified under the evaluation under subsection (f)(3); and</text></subclause></clause><clause id="HAAB33B03F49348379BA6196884EFF022" changed="not-changed"><enum>(iii)</enum><text>not be required to award a grant for an eligible project that the Secretary does not determine is justified under an evaluation under subsection (f)(3) or (g)(4).</text></clause></subparagraph></paragraph><paragraph commented="no" id="H64BDAE0B660942F595A3D251FB0E64B9" changed="not-changed"><enum>(6)</enum><header>Culvert limitation</header><text>Not more than 5 percent of the amounts made available for each fiscal year for grants under the program may be used for eligible projects that consist solely of culvert replacement or rehabilitation.</text></paragraph></subsection><subsection id="H0C178405C86440D28C323A048E9695E0" changed="not-changed"><enum>(d)</enum><header>Eligible entity</header><text>The Secretary may make a grant under the program to any of the following:</text><paragraph id="H8F9182128CE345EF91AA93BA8E881D4F" changed="not-changed"><enum>(1)</enum><text>A State or a group of States.</text></paragraph><paragraph id="H6FEEBDE4492C4A2B8CC3A9323FB3E89C" changed="not-changed"><enum>(2)</enum><text>A metropolitan planning organization that serves an urbanized area (as designated by the Bureau of the Census) with a population of over 200,000.</text></paragraph><paragraph id="H166EC35D50684548B69CC6E5510C197C" changed="not-changed"><enum>(3)</enum><text>A unit of local government or a group of local governments.</text></paragraph><paragraph id="HC850413C77054FF5909E82A0500523B9" changed="not-changed"><enum>(4)</enum><text>A political subdivision of a State or local government.</text></paragraph><paragraph id="H05E39B4B573D4545A1195BB4EB479C19" changed="not-changed"><enum>(5)</enum><text>A special purpose district or public authority with a transportation function.</text></paragraph><paragraph id="HD15BD7F6308243318FDCA8FA58389A13" changed="not-changed"><enum>(6)</enum><text>A Federal land management agency.</text></paragraph><paragraph id="HBCE3416F982740749CC3CCD10EB4BCE4" changed="not-changed"><enum>(7)</enum><text>A Tribal government or a consortium of Tribal governments.</text></paragraph><paragraph id="H2F8DEED75B764F1B842DDD9892EDEB94" changed="not-changed"><enum>(8)</enum><text>A multistate or multijurisdictional group of entities described in paragraphs (1) through (7).</text></paragraph></subsection><subsection id="H3B2A5103110F44718727A5BCD37AAFA2" changed="not-changed"><enum>(e)</enum><header>Eligible project requirements</header><text>The Secretary may make a grant under the program only to an eligible entity for an eligible project that—</text><paragraph id="H92DD5E5329D74D979AFF566679AD706B" changed="not-changed"><enum>(1)</enum><text>in the case of a large project, the Secretary recommends for funding in the annual report on funding recommendations under subsection (g)(6);</text></paragraph><paragraph id="H0133BAFABF8C4C229162034DDD4BD11E" changed="not-changed"><enum>(2)</enum><text>is reasonably expected to begin construction not later than 18 months after the date on which funds are obligated for the project; and</text></paragraph><paragraph id="HAC06FC475F2849D7B4A9CDDCB3A035CE" changed="not-changed"><enum>(3)</enum><text>is based on the results of preliminary engineering.</text></paragraph></subsection><subsection id="HE8DEE64DBE0A4B00BD8F36D9C18E3A50" changed="not-changed"><enum>(f)</enum><header>Competitive process and evaluation of eligible projects other than large projects</header><paragraph id="HF3A0B014102C408D86E95C58BD40B32C" changed="not-changed"><enum>(1)</enum><header>Competitive process</header><subparagraph id="HCE8986D92C2A484BBA08FE33C3B27B8C" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The Secretary shall—</text><clause id="H2B492E7ECEB84CDEBEFEC86A35483AAC" changed="not-changed"><enum>(i)</enum><text>for the first fiscal year for which funds are made available for obligation under the program, not later than 60 days after the date on which the template under subparagraph (B)(i) is developed, and in subsequent fiscal years, not later than 60 days after the date on which amounts are made available for obligation under the program, solicit grant applications for eligible projects other than large projects; and</text></clause><clause id="H1C40BBBED2244A099F02E5611D3C0C7C" changed="not-changed"><enum>(ii)</enum><text>not later than 120 days after the date on which the solicitation under clause (i) expires, conduct evaluations under paragraph (3).</text></clause></subparagraph><subparagraph id="H01E1B7F2E3CA46DDAB36F6369F7E6B72" changed="not-changed"><enum>(B)</enum><header>Requirements</header><text>In carrying out subparagraph (A), the Secretary shall—</text><clause id="H9CC8949CCD94436D8E9BE0A873CF2E36" changed="not-changed"><enum>(i)</enum><text>develop a template for applicants to use to summarize project needs and benefits, including benefits described in paragraph (3)(B)(i); and</text></clause><clause id="H065B941661804E0BBD55DF9C070E92F6" changed="not-changed"><enum>(ii)</enum><text>enable applicants to use data from the National Bridge Inventory under section 144(b) to populate templates described in clause (i), as applicable.</text></clause></subparagraph></paragraph><paragraph id="HA2CC6BF256774DF79542FD700768EAA1" changed="not-changed"><enum>(2)</enum><header>Applications</header><text>An eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="H9A9246343C96430A8A638E49608B6040" changed="not-changed"><enum>(3)</enum><header>Evaluation</header><subparagraph id="HC5BD746F60CC403796430056433CE952" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Prior to providing a grant under this subsection, the Secretary shall—</text><clause id="H7EA6A592F9EB421FA9C1D631FA64BE5B" changed="not-changed"><enum>(i)</enum><text>conduct an evaluation of each eligible project for which an application is received under this subsection; and</text></clause><clause id="HFB843B79B80A4C78BD9203DE5C1DF7A3" changed="not-changed"><enum>(ii)</enum><text>assign a quality rating to the eligible project on the basis of the evaluation under clause (i).</text></clause></subparagraph><subparagraph id="H8ABEEDE9F090431489ECB8DCF54C4391" changed="not-changed"><enum>(B)</enum><header>Requirements</header><text>In carrying out an evaluation under subparagraph (A), the Secretary shall—</text><clause id="H9FEC2FCD3AB64B6B93418C2C4DE4844A" changed="not-changed"><enum>(i)</enum><text>consider information on project benefits submitted by the applicant using the template developed under paragraph (1)(B)(i), including whether the project will generate, as determined by the Secretary—</text><subclause id="HA7B3CFE5B93D4009B9C215BD81DA6556" changed="not-changed"><enum>(I)</enum><text>costs avoided by the prevention of closure or reduced use of the bridge to be improved by the project;</text></subclause><subclause id="H5AE98CEC611942E58E72864A06850CC5" changed="not-changed"><enum>(II)</enum><text>in the case of a bundle of projects, benefits from executing the projects as a bundle compared to as individual projects;</text></subclause><subclause id="H5CDDAFE7642B4A88A24983753CE79D49" changed="not-changed"><enum>(III)</enum><text>safety benefits, including the reduction of accidents and related costs;</text></subclause><subclause id="H28FECAF84CE9469282FF6DBB7890CB9F" changed="not-changed"><enum>(IV)</enum><text>person and freight mobility benefits, including congestion reduction and reliability improvements;</text></subclause><subclause id="H12FB2FE022C64B5ABB27AA3179A732F6" changed="not-changed"><enum>(V)</enum><text>national or regional economic benefits;</text></subclause><subclause id="H5FBC572E3EA44C539F40BAD6A6A41E84" changed="not-changed"><enum>(VI)</enum><text>benefits from long-term resiliency to extreme weather events, flooding, or other natural disasters;</text></subclause><subclause id="H3C782D6472BF408CA4611EAE07C1A57C" changed="not-changed"><enum>(VII)</enum><text>benefits from protection (as described in section 133(b)(9)), including improving seismic or scour protection;</text></subclause><subclause id="H400212118217465CA854F15D1DB6AAFC" changed="not-changed"><enum>(VIII)</enum><text>environmental benefits, including wildlife connectivity;</text></subclause><subclause id="H5A9464C246BA4EFC9E423D6861B4F243" changed="not-changed"><enum>(IX)</enum><text>benefits to nonvehicular and public transportation users;</text></subclause><subclause id="H0AEF0CEFD1F64CA59100C8878A3EDBE1" changed="not-changed"><enum>(X)</enum><text>benefits of using—</text><item id="H039998EEE0C549CC80474D3EC1226F6B" changed="not-changed"><enum>(aa)</enum><text>innovative design and construction techniques; or</text></item><item id="H463D9B71022E458994FA76E923443805" changed="not-changed"><enum>(bb)</enum><text>innovative technologies; or</text></item></subclause><subclause id="HD12781B8DC284FE7BAD927814AE9D846" changed="not-changed"><enum>(XI)</enum><text>reductions in maintenance costs, including, in the case of a federally-owned bridge, cost savings to the Federal budget; and</text></subclause></clause><clause id="H11FE07A2A9D44ED9A13F1F63106FF01B" changed="not-changed"><enum>(ii)</enum><text>consider whether and the extent to which the benefits, including the benefits described in clause (i), are more likely than not to outweigh the total project costs.</text></clause></subparagraph></paragraph></subsection><subsection id="HAF310DB420294D85962AEFF396D716C1" changed="not-changed"><enum>(g)</enum><header>Competitive process, evaluation, and annual report for large projects</header><paragraph id="HCF5E0F5ED1B243889277B62702695F37" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish an annual date by which an eligible entity submitting an application for a large project shall submit to the Secretary such information as the Secretary may require, including information described in paragraph (2), in order for a large project to be considered for a recommendation by the Secretary for funding in the next annual report under paragraph (6).</text></paragraph><paragraph id="H94B440EA22744F3FBB91D87249F32231" changed="not-changed"><enum>(2)</enum><header>Information required</header><text>The information referred to in paragraph (1) includes—</text><subparagraph id="HFCF5C0B8C8334E78A038DEF393FB3605" changed="not-changed"><enum>(A)</enum><text>all necessary information required for the Secretary to evaluate the large project; and</text></subparagraph><subparagraph id="H99738C05B74D431EB8A3B8B1A66D1C12" changed="not-changed"><enum>(B)</enum><text>information sufficient for the Secretary to determine that—</text><clause id="HEF3E0BDB850541B396950A6686B0C971" changed="not-changed"><enum>(i)</enum><text>the large project meets the applicable requirements under this section; and</text></clause><clause id="H94354EEB22A442D3A9C30AB5BC6094CA" changed="not-changed"><enum>(ii)</enum><text>there is a reasonable likelihood that the large project will continue to meet the requirements under this section.</text></clause></subparagraph></paragraph><paragraph id="H5FED66BB7C65455D897AC86387D68618" changed="not-changed"><enum>(3)</enum><header>Determination; notice</header><text>On making a determination that information submitted to the Secretary under paragraph (1) is sufficient, the Secretary shall provide a written notice of that determination to—</text><subparagraph id="H9A7A68D4649642619EE11536D464536F" changed="not-changed"><enum>(A)</enum><text>the eligible entity that submitted the application;</text></subparagraph><subparagraph id="HBDA48A2510DC47C2BEB6055D1ADFB3E3" changed="not-changed"><enum>(B)</enum><text>the Committee on Environment and Public Works of the Senate; and</text></subparagraph><subparagraph id="H7861A094B93247209FCF1112D4154621" changed="not-changed"><enum>(C)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives.</text></subparagraph></paragraph><paragraph id="HEB9E802F759C4D6CB797F8DCB9DC457B" changed="not-changed"><enum>(4)</enum><header>Evaluation</header><text>The Secretary may recommend a large project for funding in the annual report under paragraph (6) only if the Secretary evaluates the proposed project and determines that the project is justified because the project—</text><subparagraph id="HBBBDB93E811C493FA7929F3C20E86FCA" changed="not-changed"><enum>(A)</enum><text>addresses a need to improve the condition of the bridge, as determined by the Secretary, consistent with the goals of the program under subsection (b)(2);</text></subparagraph><subparagraph id="H01625BAC83114A87AEE74C5C9C9E1FF1" changed="not-changed"><enum>(B)</enum><text>will generate, as determined by the Secretary—</text><clause id="HA5C71BD852E144B4B626EFE9319944F8" changed="not-changed"><enum>(i)</enum><text>costs avoided by the prevention of closure or reduced use of the bridge to be improved by the project;</text></clause><clause id="H16B1A85DA3B94994B0A26E94BB4714CF" changed="not-changed"><enum>(ii)</enum><text>in the case of a bundle of projects, benefits from executing the projects as a bundle compared to as individual projects;</text></clause><clause id="HE5DCE88C83D24A2CAA752E040EE9BB47" changed="not-changed"><enum>(iii)</enum><text>safety benefits, including the reduction of accidents and related costs;</text></clause><clause id="HAD8F3FA834EC49649359CD01293ED48F" changed="not-changed"><enum>(iv)</enum><text>person and freight mobility benefits, including congestion reduction and reliability improvements;</text></clause><clause id="H6EBADDF343B949BAB2CA480E02EEFE4F" changed="not-changed"><enum>(v)</enum><text>national or regional economic benefits;</text></clause><clause id="HFA80FB8111A04ADA87E95CA8EAC2D2FA" changed="not-changed"><enum>(vi)</enum><text>benefits from long-term resiliency to extreme weather events, flooding, or other natural disasters;</text></clause><clause id="HC40424FF5F154799B6266C3B9C0DB8DB" changed="not-changed"><enum>(vii)</enum><text>benefits from protection (as described in section 133(b)(9)), including improving seismic or scour protection;</text></clause><clause id="H16908773282547038999821B98DDE430" changed="not-changed"><enum>(viii)</enum><text>environmental benefits, including wildlife connectivity;</text></clause><clause id="HC13408A57FAF488196DAD6116906ED8F" changed="not-changed"><enum>(ix)</enum><text>benefits to nonvehicular and public transportation users;</text></clause><clause id="H790456D73CF04BA39124C5FF0B567445" changed="not-changed"><enum>(x)</enum><text>benefits of using—</text><subclause id="H0B738DA2667C40628664F81DFC13BBC8" changed="not-changed"><enum>(I)</enum><text>innovative design and construction techniques; or</text></subclause><subclause id="H8D6505991B054A79A9791CE7107DD1A5" changed="not-changed"><enum>(II)</enum><text>innovative technologies; or</text></subclause></clause><clause id="H6B038D8E3A354D378CCB723CF29A90C7" changed="not-changed"><enum>(xi)</enum><text>reductions in maintenance costs, including, in the case of a federally-owned bridge, cost savings to the Federal budget;</text></clause></subparagraph><subparagraph id="HF760AF36B4F34B98B31AA4F7577FB438" changed="not-changed"><enum>(C)</enum><text>is cost effective based on an analysis of whether the benefits and avoided costs described in subparagraph (B) are expected to outweigh the project costs;</text></subparagraph><subparagraph id="HAB96F3E8CEDB46CB8AEBC9B2AB94F7A6" changed="not-changed"><enum>(D)</enum><text>is supported by other Federal or non-Federal financial commitments or revenues adequate to fund ongoing maintenance and preservation; and</text></subparagraph><subparagraph id="H94319EB0370D4AAAAFDB6C8F7A2AD13F" changed="not-changed"><enum>(E)</enum><text>is consistent with the objectives of an applicable asset management plan of the project sponsor, including a State asset management plan under section 119(e) in the case of a project on the National Highway System that is sponsored by a State.</text></subparagraph></paragraph><paragraph id="H32825ADF5A6046409096815A6883BE93" changed="not-changed"><enum>(5)</enum><header>Ratings</header><subparagraph id="H80582A94AFE34DB586FA45D2B54DA2A1" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The Secretary shall develop a methodology to evaluate and rate a large project on a 5-point scale (the points of which include <quote>high</quote>, <quote>medium-high</quote>, <quote>medium</quote>, <quote>medium-low</quote>, and <quote>low</quote>) for each of—</text><clause commented="no" id="H24D106F759C741D78694DA9F1ACCD54A" changed="not-changed"><enum>(i)</enum><text>paragraph (4)(B);</text></clause><clause commented="no" id="HBFD343F6449E4A46B23288F9D5D0D07A" changed="not-changed"><enum>(ii)</enum><text>paragraph (4)(C); and</text></clause><clause commented="no" id="H558CBF253FD14887B87875B8C9DE359C" changed="not-changed"><enum>(iii)</enum><text>paragraph (4)(D).</text></clause></subparagraph><subparagraph id="H97F6ADF284E54732A735982CF49FF326" changed="not-changed"><enum>(B)</enum><header>Requirement</header><text>To be considered justified and receive a recommendation for funding in the annual report under paragraph (6), a project shall receive a rating of not less than <quote>medium</quote> for each rating required under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H6B132F0374DC49AB904165400A168D20" changed="not-changed"><enum>(6)</enum><header>Annual report on funding recommendations for large projects</header><subparagraph id="HBFC85D1CD92042558AD911B670A3CE0E" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Not later than the first Monday in February of each year, the Secretary shall submit to the Committees on Transportation and Infrastructure and Appropriations of the House of Representatives and the Committees on Environment and Public Works and Appropriations of the Senate a report that includes—</text><clause id="HD8776D6EBDAD40D8A143577F3A7AB454" changed="not-changed"><enum>(i)</enum><text>a list of large projects that have requested a recommendation for funding under a new grant agreement from funds anticipated to be available to carry out this subsection in the next fiscal year;</text></clause><clause id="H38EDE3BBE32D4A219F3CABA3B8C15DC8" changed="not-changed"><enum>(ii)</enum><text>the evaluation under paragraph (4) and ratings under paragraph (5) for each project referred to in clause (i);</text></clause><clause id="H1AB88DDC05F84D4EAC4C5A3FC1E293E8" changed="not-changed"><enum>(iii)</enum><text>the grant amounts that the Secretary recommends providing to large projects in the next fiscal year, including—</text><subclause id="H0342998F8AAC46448A0BE8F68CF5CE58" changed="not-changed"><enum>(I)</enum><text>scheduled payments under previously signed multiyear grant agreements under subsection (j);</text></subclause><subclause id="H9B897F9FC2AE4E31B4C1305876D00C60" changed="not-changed"><enum>(II)</enum><text>payments for new grant agreements, including single-year grant agreements and multiyear grant agreements; and</text></subclause><subclause id="HC1FB7AE808694C05AA42CF25F0304DEA" changed="not-changed"><enum>(III)</enum><text>a description of how amounts anticipated to be available for the program from the Highway Trust Fund for that fiscal year will be distributed; and</text></subclause></clause><clause id="H0115FB3827014344A5F58B9DAD29204B" changed="not-changed"><enum>(iv)</enum><text>for each project for which the Secretary recommends a new multiyear grant agreement under subsection (j), the proposed payout schedule for the project.</text></clause></subparagraph><subparagraph id="H371E5EFA953049638F6DC286DAAB2609" changed="not-changed"><enum>(B)</enum><header>Limitations</header><clause id="H9C0BB01E19934BA9B4610B82C60E14D6" changed="not-changed"><enum>(i)</enum><header>In general</header><text>The Secretary shall not recommend in an annual report under this paragraph a new multiyear grant agreement provided from funds from the Highway Trust Fund unless the Secretary determines that the project can be completed using funds that are anticipated to be available from the Highway Trust Fund in future fiscal years.</text></clause><clause id="H7EF9D1AB1518444E91907BAA201D64FE" changed="not-changed"><enum>(ii)</enum><header>General fund projects</header><text>The Secretary—</text><subclause id="HD07D19623296481DA7F5A91D6E2A0FE8" changed="not-changed"><enum>(I)</enum><text>may recommend for funding in an annual report under this paragraph a large project using funds from the general fund of the Treasury; but</text></subclause><subclause id="HEDD22B04CAEB4EFFBBE914CDB3306262" changed="not-changed"><enum>(II)</enum><text>shall not execute a grant agreement for that project unless—</text><item id="HC886625F1B0A43448339E7B0B5725F66" changed="not-changed"><enum>(aa)</enum><text>funds other than from the Highway Trust Fund have been made available for the project; and</text></item><item id="H9611BAAF058245A19825A2A53F214412" changed="not-changed"><enum>(bb)</enum><text>the Secretary determines that the project can be completed using funds other than from the Highway Trust Fund that are anticipated to be available in future fiscal years.</text></item></subclause></clause></subparagraph><subparagraph id="H753D7914C00F4868BDE97BC17CA4D08B" changed="not-changed"><enum>(C)</enum><header>Considerations</header><text>In selecting projects to recommend for funding in the annual report under this paragraph, the Secretary shall—</text><clause id="H2705142FE0124A299DDD49AEDB932007" changed="not-changed"><enum>(i)</enum><text>consider the amount of funds available in future fiscal years for multiyear grant agreements as described in subparagraph (B); and</text></clause><clause id="HE4823BF2505843AF991A1FFF67F342A3" changed="not-changed"><enum>(ii)</enum><text>assume the availability of funds in future fiscal years for multiyear grant agreements that extend beyond the period of authorization based on the amount made available for large projects under the program in the last fiscal year of the period of authorization.</text></clause></subparagraph><subparagraph id="H3D2CF17C99694BC5A477B9A53FD8EA0D" changed="not-changed"><enum>(D)</enum><header>Project diversity</header><text>In selecting projects to recommend for funding in the annual report under this paragraph, the Secretary shall ensure diversity among projects recommended based on—</text><clause id="HC9DA2907A32D4A25A2792D97E1E0F735" changed="not-changed"><enum>(i)</enum><text>the amount of the grant requested; and</text></clause><clause id="H9E11866C8B324D91A9673E96874C5C0D" changed="not-changed"><enum>(ii)</enum><text>grants for an eligible project for 1 bridge compared to an eligible project that is a bundle of projects.</text></clause></subparagraph></paragraph></subsection><subsection id="HC7AA049299FF4A56A672BB8C8695DB22" changed="not-changed"><enum>(h)</enum><header>Eligible project costs</header><text>A grant received for an eligible project under the program may be used for—</text><paragraph id="H89322E5462D34DA8AB661C2847338124" changed="not-changed"><enum>(1)</enum><text>development phase activities, including planning, feasibility analysis, revenue forecasting, environmental review, preliminary engineering and design work, and other preconstruction activities;</text></paragraph><paragraph id="H10B54CA6CEF64FBC872AC4B29E0A08C4" changed="not-changed"><enum>(2)</enum><text>construction, reconstruction, rehabilitation, acquisition of real property (including land related to the project and improvements to the land), environmental mitigation, construction contingencies, acquisition of equipment, and operational improvements directly related to improving system performance; and</text></paragraph><paragraph id="H2E0E9F5835CD46D08D18EB4283D6D120" changed="not-changed"><enum>(3)</enum><text>expenses related to the protection (as described in section 133(b)(9)) of a bridge, including seismic or scour protection.</text></paragraph></subsection><subsection id="HC208AC354BBC43AD82AB934FDF359E41" changed="not-changed"><enum>(i)</enum><header>TIFIA program</header><text>On the request of an eligible entity carrying out an eligible project, the Secretary may use amounts awarded to the entity to pay subsidy and administrative costs necessary to provide to the entity Federal credit assistance under chapter 6 with respect to the eligible project for which the grant was awarded.</text></subsection><subsection id="H20DCB5246E3E495D972EA7656DE3C9AF" changed="not-changed"><enum>(j)</enum><header>Multiyear grant agreements for large projects</header><paragraph commented="no" id="HB9204BC6F7E14C67AF8399D2DF3CE68A" changed="not-changed"><enum>(1)</enum><header>In general</header><text>A large project that receives a grant under the program in an amount of not less than $100,000,000 may be carried out through a multiyear grant agreement in accordance with this subsection.</text></paragraph><paragraph id="HAFCC121BCB234131B519C8428B044AAB" changed="not-changed"><enum>(2)</enum><header>Requirements</header><text>A multiyear grant agreement for a large project described in paragraph (1) shall—</text><subparagraph id="H658B0ECAB1C648D1A1BE0E5FFEBBBC0F" changed="not-changed"><enum>(A)</enum><text>establish the terms of participation by the Federal Government in the project;</text></subparagraph><subparagraph id="H5692772B64FD429DA9BDAEC5D56906F1" changed="not-changed"><enum>(B)</enum><text>establish the maximum amount of Federal financial assistance for the project in accordance with paragraphs (3) and (4) of subsection (c);</text></subparagraph><subparagraph id="H8886414C38B04F239CE87EB19574AAD2" changed="not-changed"><enum>(C)</enum><text>establish a payout schedule for the project that provides for disbursement of the full grant amount by not later than 4 fiscal years after the fiscal year in which the initial amount is provided;</text></subparagraph><subparagraph id="H44572E0E365B477C84C93C57BE20A280" changed="not-changed"><enum>(D)</enum><text>determine the period of time for completing the project, even if that period extends beyond the period of an authorization; and</text></subparagraph><subparagraph id="HDAB23E2D0EBA45648E26F359DEB9CF3B" changed="not-changed"><enum>(E)</enum><text>attempt to improve timely and efficient management of the project, consistent with all applicable Federal laws (including regulations).</text></subparagraph></paragraph><paragraph id="HF7B23CE9478943DFB16D9FCC3827FF88" changed="not-changed"><enum>(3)</enum><header>Special financial rules</header><subparagraph id="HCE65438B0FC04147AF36E55978A0164F" changed="not-changed"><enum>(A)</enum><header>In general</header><text>A multiyear grant agreement under this subsection—</text><clause id="HB9B6AF33EE6741EBBC7742F37D9E4574" changed="not-changed"><enum>(i)</enum><text>shall obligate an amount of available budget authority specified in law; and</text></clause><clause id="H7C393AF256644EC4824C214DE8D35136" changed="not-changed"><enum>(ii)</enum><text>may include a commitment, contingent on amounts to be specified in law in advance for commitments under this paragraph, to obligate an additional amount from future available budget authority specified in law.</text></clause></subparagraph><subparagraph id="H19403321BFE24118BBB2BA656C8CF8D9" changed="not-changed"><enum>(B)</enum><header>Statement of contingent commitment</header><text>The agreement shall state that the contingent commitment is not an obligation of the Federal Government.</text></subparagraph><subparagraph id="H2EF9E4831EAA4B83BB4ED617911488F6" changed="not-changed"><enum>(C)</enum><header>Interest and other financing costs</header><clause id="H740908A802FA408D8C631BE8458FBBCB" changed="not-changed"><enum>(i)</enum><header>In general</header><text>Interest and other financing costs of carrying out a part of the project within a reasonable time shall be considered a cost of carrying out the project under a multiyear grant agreement, except that eligible costs may not be more than the cost of the most favorable financing terms reasonably available for the project at the time of borrowing.</text></clause><clause id="H0501784E6ACE49C8B64D7C2337A6237E" changed="not-changed"><enum>(ii)</enum><header>Certification</header><text>The applicant shall certify to the Secretary that the applicant has shown reasonable diligence in seeking the most favorable financing terms.</text></clause></subparagraph></paragraph><paragraph id="H99DA8DC1BFE8480FA03ADF6E2BEC8F0E" changed="not-changed"><enum>(4)</enum><header>Advance payment</header><text>Notwithstanding any other provision of law, an eligible entity carrying out a large project under a multiyear grant agreement—</text><subparagraph id="HC0E5E92ACDB1464F9F96D94C085A4484" changed="not-changed"><enum>(A)</enum><text>may use funds made available to the eligible entity under this title for eligible project costs of the large project until the amount specified in the multiyear grant agreement for the project for that fiscal year becomes available for obligation; and</text></subparagraph><subparagraph id="HF853F873B51F4ABA906CDD0BDB7E641C" changed="not-changed"><enum>(B)</enum><text>if the eligible entity uses funds as described in subparagraph (A), the funds used shall be reimbursed from the amount made available under the multiyear grant agreement for the project.</text></subparagraph></paragraph></subsection><subsection id="H894B901E48D84519A306111F7D726D5D" changed="not-changed"><enum>(k)</enum><header>Undertaking parts of projects in advance under letters of no prejudice</header><paragraph id="H6C1475CBB169455CAFA2174F9F97061D" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Secretary may pay to an applicant all eligible project costs under the program, including costs for an activity for an eligible project incurred prior to the date on which the project receives funding under the program if—</text><subparagraph id="HCC77661A726940D4AA64A762B4D280C8" changed="not-changed"><enum>(A)</enum><text>before the applicant carries out the activity, the Secretary approves through a letter to the applicant the activity in the same manner as the Secretary approves other activities as eligible under the program;</text></subparagraph><subparagraph id="H97B5E90FE31D447F9ED84B9CC634345B" changed="not-changed"><enum>(B)</enum><text>a record of decision, a finding of no significant impact, or a categorical exclusion under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) has been issued for the eligible project; and</text></subparagraph><subparagraph id="H2D7EE35E74BE44A2AA0227361823FAB5" changed="not-changed"><enum>(C)</enum><text>the activity is carried out without Federal assistance and in accordance with all applicable procedures and requirements.</text></subparagraph></paragraph><paragraph id="H2747E4B92AC943038657DCD9BF5CF95D" changed="not-changed"><enum>(2)</enum><header>Interest and other financing costs</header><subparagraph id="H8197ACB8C3164E1AB702D5EC33ED8C49" changed="not-changed"><enum>(A)</enum><header>In general</header><text>For purposes of paragraph (1), the cost of carrying out an activity for an eligible project includes the amount of interest and other financing costs, including any interest earned and payable on bonds, to the extent interest and other financing costs are expended in carrying out the activity for the eligible project, except that interest and other financing costs may not be more than the cost of the most favorable financing terms reasonably available for the eligible project at the time of borrowing.</text></subparagraph><subparagraph id="H88E771200B1E49789054E870AD66CE24" changed="not-changed"><enum>(B)</enum><header>Certification</header><text>The applicant shall certify to the Secretary that the applicant has shown reasonable diligence in seeking the most favorable financing terms under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HEF54307511BC42BAB7C6873698961BD7" changed="not-changed"><enum>(3)</enum><header>No obligation or influence on recommendations</header><text>An approval by the Secretary under paragraph (1)(A) shall not—</text><subparagraph id="H133AA90CB9C54269A500110A221502C4" changed="not-changed"><enum>(A)</enum><text>constitute an obligation of the Federal Government; or</text></subparagraph><subparagraph id="H950BD204DBD548C995726D9E9BA93BCB" changed="not-changed"><enum>(B)</enum><text>alter or influence any evaluation under subsection (f)(3)(A)(i) or (g)(4) or any recommendation by the Secretary for funding under the program.</text></subparagraph></paragraph></subsection><subsection id="H0DEFB3FA5D274205BF2DCA422D811425" changed="not-changed"><enum>(l)</enum><header>Federally-Owned bridges</header><paragraph id="H06D0D49201514CF5AB26F9C65C3A022C" changed="not-changed"><enum>(1)</enum><header>Divestiture consideration</header><text>In the case of a bridge owned by a Federal land management agency for which that agency applies for a grant under the program, the agency—</text><subparagraph id="HD08232633E234534BD97B05370DE835E" changed="not-changed"><enum>(A)</enum><text>shall consider options to divest the bridge to a State or local entity after completion of the project; and</text></subparagraph><subparagraph id="HC2769A23B664451A806DA630A07FE221" changed="not-changed"><enum>(B)</enum><text>may apply jointly with the State or local entity to which the bridge may be divested.</text></subparagraph></paragraph><paragraph id="H6932E33C05C54D14821EF2046B6A41C2" changed="not-changed"><enum>(2)</enum><header>Treatment</header><text>Notwithstanding any other provision of law, section 129 shall apply to a bridge that was previously owned by a Federal land management agency and has been transferred to a non-Federal entity under paragraph (1) in the same manner as if the bridge was never federally owned.</text></paragraph></subsection><subsection id="H354AE4A713464DCC927F694E98E7916E" changed="not-changed"><enum>(m)</enum><header>Congressional notification</header><text>Not later than 30 days before making a grant for an eligible project under the program, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a written notification of the proposed grant that includes—</text><paragraph id="HF5F11CD562EC47F381FF81BF022E62AA" changed="not-changed"><enum>(1)</enum><text>an evaluation and justification for the eligible project; and</text></paragraph><paragraph id="H0FD415D6572D4C31BAED848ACFEAEE82" changed="not-changed"><enum>(2)</enum><text>the amount of the proposed grant.</text></paragraph></subsection><subsection id="HEBDC108843A44214852A05B9DF962F4C" changed="not-changed"><enum>(n)</enum><header>Reports</header><paragraph id="HBF1F9A8602914E03A39111EB1B708A0F" changed="not-changed"><enum>(1)</enum><header>Annual report</header><text>Not later than August 1 of each fiscal year, the Secretary shall make available on the website of the Department of Transportation an annual report that lists each eligible project for which a grant has been provided under the program during the fiscal year.</text></paragraph><paragraph id="H6929E586CF92430EA810CFD38B1CD65E" changed="not-changed"><enum>(2)</enum><header>GAO assessment and report</header><text>Not later than 3 years after the date of enactment of the <short-title>Bridge Investment Act of 2021</short-title>, the Comptroller General of the United States shall—</text><subparagraph id="H91F599FAEEEA4F8983D526403F7F24B8" changed="not-changed"><enum>(A)</enum><text>conduct an assessment of the administrative establishment, solicitation, selection, and justification process with respect to the funding of grants under the program; and</text></subparagraph><subparagraph id="HBB626CF2523A4FBBB13AC1C831573DED" changed="not-changed"><enum>(B)</enum><text>submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report that describes—</text><clause id="H7D1F9AD8C4E543D5BDA6939DFC886088" changed="not-changed"><enum>(i)</enum><text>the adequacy and fairness of the process under which each eligible project that received a grant under the program was selected; and</text></clause><clause id="H632F52FDE52940E5822CB59BC48CFEC6" changed="not-changed"><enum>(ii)</enum><text>the justification and criteria used for the selection of each eligible project.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H7A17F3CD6BB345F0ACED3DCBC949E34F" changed="not-changed"><enum>(o)</enum><header>Limitation</header><paragraph commented="no" id="H08CC5EF2C47849BB98158178A37E5C47" changed="not-changed"><enum>(1)</enum><header>Large projects</header><text>Of the amounts made available out of the Highway Trust Fund (other than the Mass Transit Account) to carry out this section for each of fiscal years 2022 through 2026, not less than 50 percent, in aggregate, shall be used for large projects.</text></paragraph><paragraph commented="no" id="H17EFD9DDE8D348F1AE663A4F3247E7F9" changed="not-changed"><enum>(2)</enum><header>Unutilized amounts</header><text>If, in fiscal year 2026, the Secretary determines that grants under the program will not allow for the requirement under paragraph (1) to be met, the Secretary shall use the unutilized amounts to make other grants under the program during that fiscal year.</text></paragraph></subsection><subsection id="H1F6777B31EB74CF59B21D19BF5FB089D" changed="not-changed"><enum>(p)</enum><header>Tribal transportation facility bridge set aside</header><paragraph id="H0FA83533C6694A1FB0B4304ED756E154" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Of the amounts made available from the Highway Trust Fund (other than the Mass Transit Account) for a fiscal year to carry out this section, the Secretary shall use, to carry out section 202(d)—</text><subparagraph id="H064BFA1B3D8145699E80FFD6F1E8B63C" changed="not-changed"><enum>(A)</enum><text>$16,000,000 for fiscal year 2022;</text></subparagraph><subparagraph id="H8F832E36601142C6B0A11226B5D9B4E7" changed="not-changed"><enum>(B)</enum><text>$18,000,000 for fiscal year 2023;</text></subparagraph><subparagraph id="H60D172C3D2D84D0E9E3DB18B58272ED7" changed="not-changed"><enum>(C)</enum><text>$20,000,000 for fiscal year 2024;</text></subparagraph><subparagraph id="H9C7BAB971BDA4994BCABAC91AF4EA98A" changed="not-changed"><enum>(D)</enum><text>$22,000,000 for fiscal year 2025; and</text></subparagraph><subparagraph id="H174241D8BD0B4650BEAC2D287A59BBAD" changed="not-changed"><enum>(E)</enum><text>$24,000,000 for fiscal year 2026.</text></subparagraph></paragraph><paragraph id="HF4FA3A183A374DFC986604B7C90610D6" changed="not-changed"><enum>(2)</enum><header>Treatment</header><text>For purposes of section 201, funds made available for section 202(d) under paragraph (1) shall be considered to be part of the tribal transportation program.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2C241923D6684A7B8ED98127B6526270" changed="not-changed"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/23/123">section 123</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBA98882237854484830D25FD427ABE09" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" changed="not-changed" level="section">124.
