Effective date.</toc-entry></toc></subsection></section><section id="id9113926D98D34A3EB48B39B9BF449B14"><enum>2.</enum><header>Findings; sense of Congress</header><subsection id="id827B53727A02468DA713432E31E668E0"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds as follows:</text><paragraph id="id9E46726247674F5DBC8B80194AD266D5"><enum>(1)</enum><text>Many means-tested public assistance programs limit eligibility for benefits on the basis of the assets of a family, such as savings and other resources. Such asset limits impede the ability of needy families to improve their financial circumstances and thereby reduce their dependence on public assistance programs.</text></paragraph><paragraph id="id6F27BCB34B2E4BCDBAF199AEEDFCE521"><enum>(2)</enum><text>Restricting eligibility for public assistance programs on the basis of assets negatively affects the financial security of low-income families. For example, to avoid losing eligibility for public assistance under an asset limit, a family may avoid mainstream financial services such as bank accounts, or refrain from acquiring and saving resources that would enable the family to weather an unanticipated expense.</text></paragraph><paragraph id="id6F2AE7EA927A49368760F30B38D7F38B"><enum>(3)</enum><text>The risk that people who don't need public assistance will take advantage of public assistance programs in the absence of asset limits is low, in part because most applicants for public assistance have very few assets, must meet strict work requirements, and usually may only participate in a program for a limited time.</text></paragraph><paragraph id="id766664100FCE44C2BDEE0EDA7014B46C"><enum>(4)</enum><text>Evidence from States that have eliminated asset limits suggests that the administrative cost savings associated with the elimination of asset limits outweigh any increases in payments made to beneficiaries.</text></paragraph></subsection><subsection id="id3F38D09F01AC402ABE9D0ADF42748C7F"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that certain federally funded means-tested public assistance programs should not utilize asset limits to restrict eligibility for assistance under those programs.</text></subsection></section><section id="idE801335A01D540C5B83A3B346E2F5974"><enum>3.</enum><header>States prohibited from imposing asset limits on programs funded by Temporary Assistance for Needy
 Families (TANF) grants</header><subsection id="id677D0D4AF33D4E1E9A53191991AF5001"><enum>(a)</enum><header>No State limitation on allowable financial resources</header><text>Section 408(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC3F95B04CF7546AFB5C80DE73CB362C3"><paragraph id="id9BCED64F44EB4B1DBCD692B02D7C1E86"><enum>(13)</enum><header>No asset or resource limit</header><text>A State to which a grant is made under section 403 shall not apply any asset or resource limit for eligibility of a family for any benefit, assistance, or service provided under the State program funded under this part.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id1803F74D6147458AA8D7023F48345F45"><enum>(b)</enum><header>Conforming amendments</header><text>Section 408(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(f)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idE708AF1922994A79868DF90E70A89D12"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>or resources</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC6FE50ED77E04AC4AD06CC704B201042"><enum>(2)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idE9D4FFB9A398411EBBD6D1A3E9F3929A"><enum>(A)</enum><text>in the paragraph header, by striking <quote><header-in-text level="paragraph" style="traditional">and resources</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63B946DC8013483FAAF5D29EE962470D"><enum>(B)</enum><text>by striking subparagraph (B);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE7D14EC6BE354C8C89C932891F13D7D3"><enum>(C)</enum><text>by redesignating subparagraph (C) as subparagraph (B); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCBD6371EFE124B549B1E5E97920D1E7E"><enum>(D)</enum><text>in subparagraph (B) (as so redesignated), by striking <quote>and resources</quote> each place it appears.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0A6A4B9EB2864E4F8F51A583437F70DF"><enum>(c)</enum><header>Delay permitted if State legislation required</header><paragraph commented="no" display-inline="no-display-inline" id="idBC2B588372B64991B1FC6107716F70C3"><enum>(1)</enum><header>In general</header><text>In the case of a State to which a grant is made under section 403 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/603">42 U.S.C. 603</external-xref>) that the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) to meet the requirements of paragraph (13) of section 408(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/608">42 U.S.C. 608(a)</external-xref>), such State shall not be regarded as failing to comply with the requirements of such paragraph before the first day of the first calendar quarter that begins after the close of the first regular session of the State legislature that begins after the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1420AABBE71B4E0CB833C2BB8A573AA6"><enum>(2)</enum><header>2-year legislative session</header><text>For purposes of paragraph (1), in the case of a State that has a 2-year legislative session, each year of the session shall be considered to be a separate regular session of the State legislature.</text></paragraph></subsection></section><section id="id404C9A2BD4AD4C1B9404062ABAEE1DC2"><enum>4.</enum><header>Eliminating asset limits in the supplemental nutrition assistance program (SNAP)</header><subsection id="id879F735940CE42628421D617F5BC5A62"><enum>(a)</enum><header>In general</header><paragraph id="idF936F5CED9BF47AEB7F89EDD68D7C14B"><enum>(1)</enum><header>Eligible households</header><text display-inline="yes-display-inline">Section 5 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014</external-xref>) is amended—</text><subparagraph id="id9064F21354BA477CB9001512856A3F1E"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), in the first sentence, by striking <quote>and other financial resources</quote>;</text></subparagraph><subparagraph id="id8B898C1766EB4EBAB4B9D91C7B6B6A79"><enum>(B)</enum><text>by striking subsections (g) and (j);</text></subparagraph><subparagraph id="idB9700089E90B4216A15D3062BFC91602"><enum>(C)</enum><text>by redesignating subsections (h), (i), (k), (l), (m), and (n) as subsections (g), (h), (i), (j), (k), and (l), respectively; and</text></subparagraph><subparagraph id="id2C4F2527494741E9BF3B5DE3DCE9BDC2"><enum>(D)</enum><text>in subsection (h) (as so redesignated)—</text><clause id="id62073349C2EB4F28A66A927F552753E7"><enum>(i)</enum><text>in paragraph (1), by striking <quote>and resources</quote> each place it appears; and</text></clause><clause the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>) is amended—</text><subparagraph id="id26DCD2FDF9714CBBA2F7BC0395D9E35D"><enum>(A)</enum><text>by striking subsection (h); and</text></subparagraph><subparagraph id="id0F6861B164F744FE880F429283AB0668"><enum>(B)</enum><text>by redesignating subsections (i) through (s) as subsections (h) through (r), respectively.</text></subparagraph></paragraph><paragraph id="id4E8E412D4B4A427BA53AF940872764C0"><enum>(3)</enum><header>Research, demonstration, and evaluations</header><text>Section 17 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2026">7 U.S.C. 2026</external-xref>) is amended—</text><subparagraph id="id970033EE00F2463A8621F7F159FCCC41"><enum>(A)</enum><text>by striking subsections (h) and (i); and</text></subparagraph><subparagraph id="id51A32A870F6A4D079E7E9AF01D301A11"><enum>(B)</enum><text>by redesignating subsections (j) through (n) as subsections (h) through (l), respectively.</text></subparagraph></paragraph></subsection><subsection id="idDB957965F9B6404298A862437298FEC3"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id7FBFF96A2D494D80A46D9224083DF9AD"><enum>(1)</enum><text>Section 5 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014</external-xref>) is amended—</text><subparagraph id="idF88562AE8DF14B8DA0A528489311FD26"><enum>(A)</enum><text>in subsection (a), in the second sentence, by striking <quote>and (r)</quote> and inserting <quote>and (q)</quote>; and</text></subparagraph><subparagraph id="idC7DB859998034E18AEBBBC86A499F337"><enum>(B)</enum><text>in subsection (d)—</text><clause id="id57E5E0205C634BE199B7C70A70C84DE9"><enum>(i)</enum><text>in paragraph (1), by striking <quote>subsection (k)</quote> and inserting <quote>subsection (i)</quote>; and</text></clause><clause striking <quote>subsection (o)</quote> each place it appears and inserting <quote>subsection (n)</quote>;</text></subparagraph><subparagraph 6(n)(2)</quote>.</text></paragraph><paragraph commented="no" id="id3297EA59E7FC42C59CBEE2B954498992"><enum>(4)</enum><text>Section 11(e)(22) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(e)(22)</external-xref>) is amended by striking <quote>section 6(i)</quote> and inserting <quote>section 6(h)</quote>.</text></paragraph><paragraph commented="no" id="id83E1F89D9769438AA0294B88B29BC72D"><enum>(5)</enum><text>Section 16 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" 2015(o)</external-xref>)</quote> and inserting <quote>section 6(n) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(n)</external-xref>)</quote>.</text></paragraph><paragraph id="idACAB1E66124A4FA69B32C1648321B117" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text>Section 121(b)(2)(B)(iv) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3151">29 U.S.C. 3151(b)(2)(B)(iv)</external-xref>) is amended by striking <quote>section 6(o) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(o)</external-xref>)</quote> and inserting <quote>section 6(n) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(n)</external-xref>)</quote>. </text></paragraph><paragraph commented="no" id="idF038A91A6C9D46B0A6A925A4367929F5"><enum>(B)</enum><text>in paragraph (6)(B)(i), by striking <quote>subsection (l) or (m) of section 6 of the Food and Nutrition Act of 2008</quote> and inserting <quote>subsection (k) or (l) of section 6 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015</external-xref>)</quote>; and</text></subparagraph><subparagraph commented="no" id="id9F71C696AFC3411084390538B4D11503"><enum>(C)</enum><text>in paragraph (29)(A)(ii), by striking <quote>section 6(l)(2) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(l)(2)</external-xref>)</quote> and inserting <quote>section 6(k)(2) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(k)(2)</external-xref>)</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6BA17B5F3B18464BA57FC5E3F2045B5B"><enum>(c)</enum><header>Delay permitted if State legislation required</header><paragraph commented="no" display-inline="no-display-inline" id="idB401955C21CB47C7963B5FFA226E812D"><enum>(1)</enum><header>In general</header><text>In the case of a State plan under section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) that the Secretary of Agriculture determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendments made by this section, the State plan shall not be regarded as failing to comply with the requirements of section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) solely on the basis of the failure of the plan to meet those additional requirements before the first day of the first calendar quarter that begins after the close of the first regular session of the State legislature that begins after the date of enactment of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id849437F17BF0461ABDADCCD1A58CE8B2"><enum>(2)</enum><header>Legislative session</header><text>For purposes of paragraph (1), in the case of a State that has a 2-year legislative session, each year of the session shall be considered a separate regular session of the State legislature.</text></paragraph></subsection></section><section id="idE490098876A047DA83C4A133E59AD3FD"><enum>5.</enum><header>Eliminating asset limit in Low-Income Home Energy Assistance Program (LIHEAP)</header><subsection id="id54151EE18A4442FB94E89739544A1823"><enum>(a)</enum><header>Elimination of limitations on allowable financial resources</header><text>Section 2605(b)(2) of the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8624">42 U.S.C. 8624(b)(2)</external-xref>) is amended, in the matter following subparagraph (B), by inserting <quote>, and agrees that a State may not exclude a household from eligibility in a fiscal year solely or partially on the basis of the assets of 1 or more members of the household</quote> before the semicolon.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id28A9E99C1F9C4011B972A5024091029D"><enum>(b)</enum><header>Delay permitted if State legislation required</header><paragraph commented="no" display-inline="no-display-inline" id="id4C98ABC742144567994241000EA53D12"><enum>(1)</enum><header>In general</header><text>In the case of a State plan under section 2605 of the Low-Income Home Energy Assistance Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/42/8624">42 U.S.C. 8624</external-xref>) that the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendment made by this section, the State plan shall not be regarded as failing to comply with the requirements of such section 2605 solely on the basis of the failure of the plan to meet those additional requirements </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id29721947B0AF41BF9613F8AD2970D6F2"><enum>6.</enum><header>Updating and indexing the resource limit for supplemental security income (SSI)</header><subsection id="id604EAC82D9374985A68E05326ADA2F8B"><enum>(a)</enum><header>In general</header><paragraph id="id018DEF9546354C96AE9D325B99B6323C"><enum>(1)</enum><header>Update in resource limit for individuals and couples</header><text>Section 1611(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382">42 U.S.C. 1382(a)(3)</external-xref>) is amended—</text><subparagraph id="id205430FE6D2F4884823F37459C086BEA"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>$2,250</quote> and all that follows through the end of the subparagraph and inserting <quote>$20,000 in calendar year 2021, and shall be increased as described in section 1617(d) for each subsequent calendar year.</quote>; and</text></subparagraph><subparagraph id="id672941CB7B4B480884BB10379833B496"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>$1,500</quote> and all that follows through the end of the subparagraph and inserting <quote>$10,000 in calendar year 2021, and shall be increased as described in section 1617(d) for each subsequent calendar year.</quote>.</text></subparagraph></paragraph><paragraph id="idCF65890FF11C437883BD8EB0EE4CFA48"><enum>(2)</enum><header>Inflation adjustment</header><text>Section 1617 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382f">42 U.S.C. 1382f</external-xref>) is amended—</text><subparagraph id="id311C722910FF46D298475F4836D9E480"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="traditional">; inflation adjustment</header-in-text></quote> after <quote><header-in-text level="section" style="traditional">benefits</header-in-text></quote>; and</text></subparagraph><subparagraph id="id6508761EA0144D63B04829E6459BC59D"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id7AA861819358426DAFD67F92116BEA82" style="OLC"><subsection id="idACE4723E840E4C3A90B3B17DADC09CD9"><enum>(d)</enum><text display-inline="yes-display-inline">In the case of any calendar year after 2021, each of the amounts specified in section 1611(a)(3) shall be increased by multiplying each such amount by the quotient (not less than 1) obtained by dividing—</text><paragraph id="idBC343A74207745D9B4154E260D74B9D9"><enum>(1)</enum><text>the average of the Consumer Price Index for Elderly Consumers (CPI–E, as published by the Bureau of Labor Statistics of the Department of Labor) for the 12-month period ending with September of the preceding calendar year, by</text></paragraph><paragraph id="id7D8DC03EBC2A472F81B93F166BC15C1D"><enum>(2)</enum><text>such average for the 12-month period ending with September 2020.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id5FC6B44B6C8F4FF995897C78477ECA55" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect as if enacted on January 1, 2021. </text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HBDFAB50ECD3E4D45BE85152175EC09C7"><enum>7.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as otherwise provided, the amendments made by this Act shall apply to benefits for calendar months beginning on or after the date that is 30 days after the date of enactment of this Act.</text></section></legis-body></bill>
