which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit procurement, purchasing, and sale by the Department of Defense of certain items containing perfluoroalkyl substances and polyfluoroalkyl substances.</official-title></form><legis-body><section id="id3599C6384E794C3282935A3E0442C0CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS Free Military Purchasing Act</short-title></quote>.</text></section><section id="id60167b90aec64e47a418148be3c26d65"><enum>2.</enum><header>Prohibition on procurement, purchasing, and sale by Department of Defense of certain items containing perfluoroalkyl substances and polyfluoroalkyl substances</header><subsection id="ide7f31e6b902848db984604f6990e2c71"><enum>(a)</enum><header>Prohibition on procurement and purchasing</header><text>The Secretary of Defense may not procure or purchase any covered item containing a perfluoroalkyl substance or polyfluoroalkyl substance.</text></subsection><subsection id="id553b376a97234136b4c8e558aa5efc4e"><enum>(b)</enum><header>Prohibition on sale</header><text>The Secretary of Defense may not permit the sale of any covered item containing a perfluoroalkyl substance or polyfluoroalkyl substance on property under the jurisdiction of the Department of Defense.</text></subsection><subsection id="id606f4761217d47438cecee535586506b"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id5c7fb28dc5ad4ca5869f6639198e9cab"><enum>(1)</enum><header>Covered item</header><text>The term <term>covered item</term> means—</text><subparagraph id="idb6e0a27034344f41aded63a4c96e09b5"><enum>(A)</enum><text>non-stick cookware or food service ware for use in galleys or dining facilities;</text></subparagraph><subparagraph id="id56911e3409634631befd4611fca8a121"><enum>(B)</enum><text>food packaging materials;</text></subparagraph><subparagraph id="ideebd6a5658394a7aac4f253a7d6636b5"><enum>(C)</enum><text>floor waxes;</text></subparagraph><subparagraph id="id288949c4161f46948b29d14e629e039e"><enum>(D)</enum><text>carpeting, rugs, curtains, or upholstered furniture;</text></subparagraph><subparagraph id="id77c456afa0da4031a85734c4b705f7aa"><enum>(E)</enum><text>personal care items;</text></subparagraph><subparagraph id="id141b63152cd8499cb99ec205f5e4c12a"><enum>(F)</enum><text>dental floss or toothpaste;</text></subparagraph><subparagraph id="idbc63ae2428364f27961930c964c2728e"><enum>(G)</enum><text>sunscreen;</text></subparagraph><subparagraph id="idc6816df6d2954498b872bafc7fe6d7e8"><enum>(H)</enum><text>umbrellas, luggage, or bags;</text></subparagraph><subparagraph id="idae36a2a33ff44172ba86a30c62ecbde7"><enum>(I)</enum><text>ski wax;</text></subparagraph><subparagraph id="id1023220d169243f1a851b32fe2042c26"><enum>(J)</enum><text>car wax and car window treatments;</text></subparagraph><subparagraph id="id12282ec9d2e245b09f74fbad674680be"><enum>(K)</enum><text>cleaning products; and</text></subparagraph><subparagraph id="id6429e3dd6a9c4d1fbc7658c99ff27656"><enum>(L)</enum><text>shoes and clothing for which treatment with a perfluoroalkyl substance or polyfluoroalkyl substance is not currently necessary for an essential function. </text></subparagraph></paragraph><paragraph id="id7e8a55b9d51143998fb6c2842a752195"><enum>(2)</enum><header>Perfluoroalkyl substance</header><text>The term <term>perfluoroalkyl substance</term> means a man-made chemical of which all of the carbon atoms are fully fluorinated carbon atoms.</text></paragraph><paragraph id="id12ff39f0afa8482b9be34a5221d582a6"><enum>(3)</enum><header>Polyfluoroalkyl substance</header><text>The term <term>polyfluoroalkyl substance</term> means a man-made chemical containing at least one fully fluorinated carbon atom and at least one nonfluorinated carbon atom.</text></paragraph><paragraph id="id7c00c0e998f7401ba44386896ef377ac"><enum>(4)</enum><header>Property under the jurisdiction of the Department of Defense</header><text>The term <term>property under the jurisdiction of the Department of Defense</term> includes commissaries, facilities operated by the Army and Air Force Exchange Service, the Navy Exchange Service Command, the Navy Resale and Services Support Office, Marine Corps exchanges, online exchange shops, and ships’ stores.</text></paragraph></subsection><subsection id="idC8543BBB00B546058BF72E3DF5630964"><enum>(d)</enum><header>Repeal of superseded authority</header><text>Section 333 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is repealed.</text></subsection><subsection id="id19BF333CDADC4A89B49D0B63F9C649D7"><enum>(e)</enum><header>Effective date</header><text>This section and the amendment made by this section shall take effect on the date that is one year after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
