which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish certain requirements for the small refineries exemption of the renewable fuels provisions under the Clean Air Act, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idF2146C1ABBCD4FB9B08750CEF75D52D4"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id40B2C69BE87C4293B4ACC96F903CBEC3"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idD6D27B33CB084DBA9413B88D19B3C0EC"><enum>(2)</enum><header>Petition</header><text>The term <term>petition</term> means a petition for an exemption from the requirements of paragraph (2) of section 211(o) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)</external-xref>) under paragraph (9) of that section for a calendar year.</text></paragraph></section><section id="id2DF7456103534E61B4CC7558B9CCFDA9"><enum>2.</enum><header>Annual deadline for petitions by small refineries for exemptions from renewable fuel requirements</header><subsection id="id6607C04E00F948C1BE6274CF70EC97C0"><enum>(a)</enum><header>Deadline</header><text>Notwithstanding any other provision of law, a petition shall be submitted to the Administrator not later than June 1 of the year preceding the year in which an exemption under the petition, if the petition were granted, would be in effect.</text></subsection><subsection id="id00F6CA5694F14304A62DD8FE34DB539E"><enum>(b)</enum><header>Effect of failure To meet deadline</header><text>If a petition described in subsection (a) is not submitted by the deadline described in that subsection, the petition shall be ineligible for consideration or approval.</text></subsection></section><section id="idD5ED19691C8C4AD79FF17479B4746DC5"><enum>3.</enum><header>Transparency</header><subsection id="idFDA8CCF6F69243BAB6D5E55677063919"><enum>(a)</enum><header>Information in petition subject to public disclosure</header><paragraph id="id73F18AD69CAF4F6781B0FE9A49A8BB91"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), information submitted to the Administrator by a person, including a small refinery, in a petition—</text><subparagraph id="id139004B03C7D45E48D478267E22D6AEA"><enum>(A)</enum><text>shall not be a trade secret or confidential information; and</text></subparagraph><subparagraph id="idC17D293E4A484FBF830E2F82B637824B"><enum>(B)</enum><text>notwithstanding section 552(b) of title 5, United States Code, and any other Federal law (including regulations), shall be subject to public disclosure.</text></subparagraph></paragraph><paragraph id="id7C0D05D72DA8434CBFFB59684BCCA5AD"><enum>(2)</enum><header>Applicability</header><text>Paragraph (1) applies only with respect to information submitted under a petition for calendar year 2021 or subsequent calendar years.</text></paragraph></subsection><subsection id="id9876B99EF51241359D7A1A3805755F5A"><enum>(b)</enum><header>Decision</header><text>The Administrator shall, at the same time that the Administrator informs the petitioner of a decision of whether to grant the petition—</text><paragraph id="idC1A1B3785D284148BD2001CF931F11C2"><enum>(1)</enum><text>make publicly available—</text><subparagraph id="idF0510481F3D941488507F7699ADD3180"><enum>(A)</enum><text>the name of the petitioner;</text></subparagraph><subparagraph id="id11F2DEEBBB644968BF4635061941974B"><enum>(B)</enum><text>the name and location of the facility for which relief under the petition was requested;</text></subparagraph><subparagraph id="id5C2E76B6B8AE47079A00718B4102392D"><enum>(C)</enum><text>the time period for which relief under the petition was requested; and</text></subparagraph><subparagraph id="idE90B6A6CBF684C7F93B078906CB1A0F8"><enum>(D)</enum><text>the extent to which the Administrator granted or denied the petition; and</text></subparagraph></paragraph><paragraph id="idC6A9A90234BA429C8B5FACEE07F41347"><enum>(2)</enum><text>submit to Congress a report—</text><subparagraph id="id871D1D7F963C434086DFBDDC18C64947"><enum>(A)</enum><text>describing the nature of the relief requested in the petition, including the factors identified by the petitioner to demonstrate disproportionate economic hardship under section 211(o)(9)(B)(i) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(9)(B)(i)</external-xref>); and</text></subparagraph><subparagraph id="id8006987A92324387B0BA3D28CAA71610"><enum>(B)</enum><text>that includes the detailed discussion required by section 80.1441(e)(2) of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), submitted by the petitioner describing the hardship the refinery would encounter in producing transportation fuel (as defined in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>) that meets the requirements of section 80.1405 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></subparagraph></paragraph></subsection></section><section id="idCA93CA83044A4B6EA3862D135AB35BC5"><enum>4.</enum><header>Annual renewable fuel standards</header><text display-inline="no-display-inline">When determining the annual value of the renewable fuel standard for a calendar year under section 80.1105 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act), the Administrator shall, for the variable GE<subscript>i </subscript>referenced in that section, which is the quantity of gasoline projected to be produced by exempt small refineries and small refiners in gallons for a calendar year, use the number that is the sum of the total number of gallons waived as a result of all petitions granted by the Administrator for that calendar year.</text></section></legis-body></bill>
