which was read twice and referred to the <committee-name committee-id="SSCM00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>December 17, 2021</action-date><action-desc>Reported by <sponsor name-id="S275">Ms. Cantwell</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To ensure that the Federal Communications Commission does not approve radio frequency devices that pose a national security risk.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Equipment Act of 2021</short-title></quote>.</text></section><section id="id4BB85F3BAE1B4D7C9994AF1ED3966414" changed="deleted" reported-display-style="strikethrough" committee-id="SSCM00"><enum>2.</enum><header>Updates to equipment authorization process of Federal Communications Commission</header><subsection id="idD2AF64C076F64A718F7EA53BD9E316BA"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Commission</term> means the Federal Communications Commission.</text></subsection><subsection id="id1F5274CD9928442EA1EB83BDE07E90C5"><enum>(b)</enum><header>Rulemaking</header><paragraph id="id2AF80464FFFA4FF79642343CD71E265C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Commission shall initiate a rulemaking proceeding, in accordance with paragraph (2), to update the equipment authorization procedures of the Commission.</text></paragraph><paragraph id="id7F07B362DD464A9485CF6837E9C666F5"><enum>(2)</enum><header>Updates required</header><text>In the rulemaking proceeding conducted under paragraph (1), the Commission shall clarify that the Commission will no longer review or approve any application for equipment authorization for equipment that is on the list of covered communications equipment or services published by the Commission under section 2(a) of the Secure and Trusted Communications Network Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1601">47 U.S.C. 1601(a)</external-xref>).</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="H168B3829C6FD44C7994BDBC926B2B2DF" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Equipment Act of 2021</short-title></quote>.</text></section><section id="HF05562B35E6941D69D2A850E5B1BEB59" changed="added" reported-display-style="italic" committee-id="SSCM00"><enum>2.</enum><header>Updates to equipment authorization process of Federal Communications Commission</header><subsection id="H9FC3CC531B0E401789244621111D021F"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>Commission</term> means the Federal Communications Commission.</text></subsection><subsection id="HAEFE20703BD047D7A54AD071305D87E9"><enum>(b)</enum><header>Rulemaking</header><paragraph id="HD820EFD21F1C46B1BD1A67F0F7976602"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall adopt rules in the proceeding initiated in the Notice of Proposed Rulemaking in the matter of Protecting Against National Security Threats to the Communications Supply Chain through the Equipment Authorization Program adopted on June 17, 2021 (ET Docket No. 21–232; FCC 21–73), in accordance with paragraph (2), to update the equipment authorization procedures of the Commission.</text></paragraph><paragraph id="H2F58ACED3C65415BA0A34C78E6A01D30"><enum>(2)</enum><header>Updates required</header><text>In the rules adopted under paragraph (1), the Commission shall clarify that the Commission will no longer review or approve any application for equipment authorization for equipment that is on the list of covered communications equipment or services published by the Commission under section 2(a) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1601">47 U.S.C. 1601(a)</external-xref>).</text></paragraph><paragraph id="H7FAFD8964974445E83F2CE108DFB3FCD"><enum>(3)</enum><header>Applicability</header><subparagraph id="H2D2740CC54F341A3B9B39B3B9997E57F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the rules adopted under paragraph (1), the Commission may not provide for review or revocation of any equipment authorization granted before the date on which the rules are adopted on the basis of the equipment being on the list described in paragraph (2).</text></subparagraph><subparagraph id="H22F0FC7F604E4814BEE8725A7C08F92A"><enum>(B)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to prohibit the Commission, other than in the rules adopted under paragraph (1), from—</text><clause id="H2E77119EF7FA471FB6CDA07D1A23769C"><enum>(i)</enum><text display-inline="yes-display-inline">examining the necessity of review or revocation of any equipment authorization on the basis of the equipment being on the list described in paragraph (2); or</text></clause><clause id="HEE44333C95234BC78BCD1251DC67A668"><enum>(ii)</enum><text>adopting rules providing for any review or revocation described in clause (i).</text></clause></subparagraph></paragraph></subsection></section></legis-body><endorsement><action-date>December 17, 2021</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
