<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1786</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210524">May 24, 2021</action-date><action-desc><sponsor name-id="S311">Ms. Klobuchar</sponsor> (for herself, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, <cosponsor name-id="S370">Mr. Booker</cosponsor>, <cosponsor name-id="S363">Mr. King</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>, and <cosponsor name-id="S413">Mr. Padilla</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Election Campaign Act of 1971 to require disclosures to contributors regarding recurring contributions or donations.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rescuing Every Contributor from Unwanted Recurrences (RECUR) Act</short-title></quote>.</text></section><section id="id542B4F4877794212910600483766E235"><enum>2.</enum><header>Required disclosures to contributors regarding recurring contributions or donations</header><subsection id="idABE1D631E4A546CAB3322BADB6886938"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 318(d) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30120">52 U.S.C. 30120(d)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF85479BC635C452F8B971CCACF2DB055"><paragraph id="idee2329ad90154e839c104188373af74c"><enum>(3)</enum><header>Communications that solicit recurring contributions or donations</header><subparagraph id="id325362e8f6924a209210fc7e95809a01"><enum>(A)</enum><header>In general</header><text>Any person soliciting a recurring contribution to a political committee, a recurring contribution to fund an independent expenditure, or a recurring donation to fund an electioneering communication must receive the affirmative consent of the contributor or donor at the arrangement of the recurring contribution or donation. Passive action by the contributor or donor, such as failing to uncheck a pre-checked box authorizing a recurring contribution, shall not meet the requirement of affirmative consent under this subparagraph.</text></subparagraph><subparagraph id="id4368b2db662c4243a62cb97a290e199b"><enum>(B)</enum><header>Requirements</header><text>Any person accepting a recurring contribution or donation described in subparagraph (A) shall—</text><clause id="id6211d0210d894b2d815db43439e50ba8"><enum>(i)</enum><text>provide a receipt for an initial contribution or donation and each recurrence that clearly and conspicuously discloses all material terms;</text></clause><clause id="id447057fabb7d40e4a986ad51fb22463b"><enum>(ii)</enum><text>provide all information needed to cancel recurring contributions or donations in each communication with the contributor or donor that concerns the contribution or donation; and</text></clause><clause id="idd6eec0362fb84dd5a7994bacae2459eb"><enum>(iii)</enum><text>shall immediately cancel recurring contributions or donations upon request of the contributor or donor.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idC909CD75743C44D1A91842361C6339C6"><enum>(b)</enum><header>Deadline for regulations</header><text>Not later than 180 days after the date of enactment of this Act, the Federal Election Commission shall promulgate regulations to carry out this Act.</text></subsection></section></legis-body></bill>
