which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Energy to establish a grant program to facilitate tree planting that reduces residential energy consumption, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4EE2D79AB68D4F048CA3976215B4C312"><section section-type="section-one" id="H6B86A61EBC30460CB86AF7B1FE46E0AF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trees for Residential Energy and Economic Savings Act of 2021</short-title></quote> or the <quote><short-title>TREES Act of 2021</short-title></quote>.</text></section><section id="H17DE1479C38F484CA020467E9667B155"><enum>2.</enum><header>Tree planting grant program</header><subsection id="H1C773824BF58441A95049D6D68C3D522"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" id="H9C4E4D8AB6B84591B4B6E1B0FE903CCF"><enum>(1)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a tree planting project that reduces residential energy consumption.</text></paragraph><paragraph id="H6E049D8B6207413B98B6A908C79699F9"><enum>(2)</enum><header>Eligible cost</header><text display-inline="yes-display-inline">The term <term>eligible cost</term> means, with respect to a covered project—</text><subparagraph id="H10C889857DD840F89A3341459F77B375"><enum>(A)</enum><text>the cost of carrying out the project, including—</text><clause id="HD8EF3538C0D74E748B784CDA5D8121FD"><enum>(i)</enum><text display-inline="yes-display-inline">planning and design activities; </text></clause><clause id="HD29771FF32204C1AAAD242E5C1E6E92A"><enum>(ii)</enum><text>establishing nurseries to supply trees; </text></clause><clause id="H46F006766E274E80B9D572A82EF53919"><enum>(iii)</enum><text>purchasing trees; and </text></clause><clause id="H33EAEA7E8A584C6B8D460FCA2418405D"><enum>(iv)</enum><text>preparing sites and planting trees;</text></clause></subparagraph><subparagraph id="HE0BE0168B1534360ABD085A70389AAE8"><enum>(B)</enum><text display-inline="yes-display-inline">the cost of maintaining and monitoring trees planted under the project for a period of not more than 3 years;</text></subparagraph><subparagraph id="H1EA0E05E0F9645C08E81F24AF10D60B3"><enum>(C)</enum><text>the cost of training activities; and</text></subparagraph><subparagraph id="HD28CED1D92AA4028A1A5E5645A9C236E"><enum>(D)</enum><text>any other cost determined appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="HE4574730C5204E5FB9471AF410FB93CC"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="HEC2A5076A5994626A54F7B7BF50282D2"><enum>(A)</enum><text>a State government entity;</text></subparagraph><subparagraph id="H4BE07A9C498744DEB7B6BFEDA2C45BF6"><enum>(B)</enum><text>a local government entity;</text></subparagraph><subparagraph id="H6C69E7B0A23C472FAB791AD6497C8127"><enum>(C)</enum><text>an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); </text></subparagraph><subparagraph id="H709CBDEBCBF744BF8775B937E34825EC"><enum>(D)</enum><text>a nonprofit organization; and</text></subparagraph><subparagraph id="H3F779A2A68C54E96895C99FA373BD936"><enum>(E)</enum><text>a retail power provider.</text></subparagraph></paragraph><paragraph id="H865495B7E08F405389A5C953659C6329"><enum>(4)</enum><header>Energy burden</header><text>The term <term>energy burden</term> means the percentage of household income spent on residential energy bills.</text></paragraph><paragraph id="HCB9FE1C82F194C16926BF491B021ADB9"><enum>(5)</enum><header>Local government entity</header><text display-inline="yes-display-inline">The term <term>local government entity</term> means any municipal government or county government entity with jurisdiction over local land use decisions.</text></paragraph><paragraph commented="no" id="H8F6E2C43813A427DB17B45F1DFA55D8F"><enum>(6)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code.</text></paragraph><paragraph id="HA39597A061E346498ACA5A13CE675C0F"><enum>(7)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>Program</term> means the program established under subsection (b). </text></paragraph><paragraph id="HE14D863DBF5446ACA49D7732230C7F3E"><enum>(8)</enum><header>Retail power provider</header><text display-inline="yes-display-inline">The term <term>retail power provider</term> means any entity authorized under State or Federal law to generate, distribute, or provide retail electricity, natural gas, or fuel oil service.</text></paragraph><paragraph id="HEE29742AAD534820A6B7BEE558F0434F" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H8D608FFA2E22454DA45E63EB1AFD2E8F"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a program under which the Secretary shall award grants to eligible entities to facilitate covered projects in accordance with this section.</text></subsection><subsection id="HBF7742F30C00406BB544C4EBD919555D"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out the Program, the Secretary shall consult with the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></subsection><subsection display-inline="no-display-inline" id="HD30C4964AFDA46649B0DDA7898DA28D0"><enum>(d)</enum><header>Applications</header><text display-inline="yes-display-inline">To receive a grant under the Program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including, with respect to the proposed covered project, a description of—</text><paragraph id="H4422F6250035411E8DCD533E1A51C1FE"><enum>(1)</enum><text display-inline="yes-display-inline">how the covered project will reduce residential energy consumption and the expected reduction in residential energy consumption;</text></paragraph><paragraph id="H023F33E8ECAF4F5B93D625080C56A0B9"><enum>(2)</enum><text>the total eligible costs of the covered project and other sources of funding for the covered project;</text></paragraph><paragraph id="H315F449C814E439A8E3C411F553490F9"><enum>(3)</enum><text>the anticipated community engagement in the covered project; and</text></paragraph><paragraph id="HBE734601555D47878C6C4369B00F9F2F"><enum>(4)</enum><text>the tree species to be planted under the covered project and the suitability of those species to the local environment.</text></paragraph></subsection><subsection id="H28C1CE9F127144C1A97D48C8E8EFF430"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under the Program, the Secretary shall give priority to eligible entities that propose covered projects that—</text><paragraph id="H9F4A1CAE18A34A59BCEF4F84C66486C9"><enum>(1)</enum><text display-inline="yes-display-inline">provide the largest potential reduction in residential energy consumption for households with a high energy burden;</text></paragraph><paragraph commented="no" id="HAB37F9B74FFC4ED0AF9CDEB301E9A8C9"><enum>(2)</enum><text>provide maximum amounts of—</text><subparagraph commented="no" id="H32653360963F43A584EC10FB74130E0A"><enum>(A)</enum><text>shade during periods when residences are exposed to the most sun intensity; and </text></subparagraph><subparagraph commented="no" id="H75EB3DA991944B48ADB8B12BF1A2E6C1"><enum>(B)</enum><text>wind protection during periods when residences are exposed to the most wind intensity;</text></subparagraph></paragraph><paragraph id="H1C6947C98954475C8BB0A3E0F47A6DD5"><enum>(3)</enum><text>are located in a neighborhood with a low percentage of tree canopy cover;</text></paragraph><paragraph id="HD4BC059064474BA1B45AC9F6BA1B8CFA"><enum>(4)</enum><text>are located in a neighborhood with a high percentage of senior citizens or children; </text></paragraph><paragraph id="H87025747B74545CBB48CA9FCDC1AD5BB"><enum>(5)</enum><text>are located in an area where the average annual income is below the regional median;</text></paragraph><paragraph id="HDA28C4936EE54B1E93DE3B1EC2A50FEA"><enum>(6)</enum><text>will collaboratively engage community members that will be affected by the tree planting; and</text></paragraph><paragraph id="H8783BAA333B5460F9E7BAED903569500"><enum>(7)</enum><text display-inline="yes-display-inline">will employ local residents as a substantial percentage of the workforce of the covered project, with a focus on local residents who are unemployed or underemployed.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H74AC32ECF35B484F8BAA4085F2A1A1BE"><enum>(f)</enum><header>Tree planting goals</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Secretary shall, to the maximum extent practicable, award grants under the Program in a manner that facilitates the planting of at least 300,000 trees each year.</text></subsection><subsection id="H5FCC1B11F3F241E2A0D607030A3B1384"><enum>(g)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of a covered project carried out using a grant awarded under the Program shall be 90 percent.</text></subsection><subsection id="H9720F3736FB74DC4B08CF63B6CCFFB65"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out the Program $50,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section></legis-body></bill>
