which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to eliminate copayments by the Department of Veterans Affairs for medicines relating to preventive health services, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HAA15084EB18B420E952D4C7EEA4A5686"><section section-type="section-one" id="HADCA39504DEE49B88BD34BD03C74D4B1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Preventive Health Coverage Fairness Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H6505C3A7302440C393EAE4699FBB9539"><enum>2.</enum><header>Improvement to preventive health services furnished by Department of Veterans Affairs</header><subsection id="HED72898FE6B64DB58AB906ADE1B8A901"><enum>(a)</enum><header>Elimination of medication copayments</header><text display-inline="yes-display-inline">Section 1722A(a)(3) of title 38, United States Code, is amended—</text><paragraph id="HB81B7BF97572496199F845C6B7F83774"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>or</quote>;</text></paragraph><paragraph id="H8586E96389F64182B79D9CF82A890F96"><enum>(2)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H2E5FDBB762504F4489CCDF616EBB9881"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="USC" display-inline="no-display-inline" id="HEB813E665F324B54953BD92C6FC9B6B1"><subparagraph id="H66388292CFC54726A829C8E01F56FE03" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">to medication that is or is part of a preventive health service.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H08728C2B2B6740CE87B076ED3B033737"><enum>(b)</enum><header>Elimination of hospital care and medical services copayments</header><text>Section 1710 of such title is amended—</text><paragraph id="H6F1B734E17B04864821C2E16E26A78CC"><enum>(1)</enum><text>in subsection (f)—</text><subparagraph id="HBCF92666F9384E9897165B2C642F89F3"><enum>(A)</enum><text>by redesignating paragraph (5) as paragraph (6); and</text></subparagraph><subparagraph id="HBE2F92A3363D4D949812509011212353"><enum>(B)</enum><text>by inserting after paragraph (4) the following new paragraph (5):</text><quoted-block style="OLC" id="H8A23C8B0B22C4F94B12271CD9663E88B"><paragraph id="H3EF44841BA244A8EB42A88F8EE69D296" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">A veteran shall not be liable to the United States under this subsection for any amounts for preventive health services.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3B7429B1A15B42FAA9194E5ED1C14188"><enum>(2)</enum><text>in subsection (g)(3), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HB3D8C45DB04C46BC84BE5DAE1F38FECA"><subparagraph id="H597C2697A8B4405BA863923644D12653" indent="up1"><enum>(C)</enum><text>Preventive health services.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H52170AD8B9604CF3A51062962810EB5F"><enum>(c)</enum><header>Definition</header><text>Section 1701(9) of such title is amended—</text><paragraph id="HE69A419521914C04ACA155DEE326C0A0"><enum>(1)</enum><text>in subparagraph (K), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H56DDFEE83C5C439D8F0F09EB82649610"><enum>(2)</enum><text>by redesignating subparagraph (L) as subparagraph (O); and</text></paragraph><paragraph id="H25A9B341384C4C2E8137E69382805AFB"><enum>(3)</enum><text>by inserting after subparagraph (K) the following new subparagraphs:</text><quoted-block style="USC" display-inline="no-display-inline" id="H90B31F5BD2CA4A3C88207BD2E07EE0FF"><subparagraph display-inline="no-display-inline" id="HDC4F19DE74734BA3A448D2DF7B87314B"><enum>(L)</enum><text display-inline="yes-display-inline">evidence-based items or services that have in effect a rating of <quote>A</quote> or <quote>B</quote> in the current recommendations of the United States Preventive Services Task Force;</text></subparagraph><subparagraph id="H9401722716E946EAA055A16A5936E4D8"><enum>(M)</enum><text display-inline="yes-display-inline">immunizations that have in effect a recommendation from the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention with respect to the individual involved;</text></subparagraph><subparagraph id="H38A5D24AEFA641D5A4F43B8FFC2B8BEA"><enum>(N)</enum><text display-inline="yes-display-inline">with respect to services for women, the preventive care and screenings provided for in the Health Resources and Services Administration Women's Preventive Services Guidelines in effect as of the date of the enactment of the <short-title>Veterans Preventive Health Coverage Fairness Act</short-title>, or successor similar guidelines; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
