which was read twice and referred to the <committee-name committee-id="SSEG00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Energy and Natural Resources</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date>October 18, 2022</action-date><action-desc>Reported under authority of the order of the Senate of October 14, 2022, by <sponsor name-id="S338">Mr. Manchin</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To adjust the boundary of the Santa Monica Mountains National Recreation Area to include the Rim of the Valley Corridor, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rim of the Valley Corridor Preservation Act</short-title></quote>.</text></section><section id="idecf75445252c4975915a1204349040e0" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id885e484053a2420da07078c630161062"><enum>(1)</enum><text>the Santa Monica Mountains National Recreation Area was authorized as a unit of the National Park System on November 10, 1978;</text></paragraph><paragraph id="idad6339953f5e4f52ac8376cb5867b777"><enum>(2)</enum><text>the Santa Monica Mountains and the Rim of the Valley Corridor include—</text><subparagraph id="idf58bd9f31578430f897c1205d5f0c095"><enum>(A)</enum><text>nationally significant resources, including—</text><clause id="id869cc3525f72405d9a9a80bee2e9726a"><enum>(i)</enum><text>outstanding examples of geologic history, including the evolution of the Transverse Ranges Province;</text></clause><clause id="id5d39b54e0fdc427bb868636c26b31663"><enum>(ii)</enum><text>a diversity of well-preserved marine and terrestrial paleontological resources; and</text></clause><clause id="idf39f693c341b4524a4f221b1108bf000"><enum>(iii)</enum><text>high biodiversity, including outstanding examples of native grasslands, coastal sage scrub, chaparral, dry coniferous forests, and alluvian fan sage scrub; and</text></clause></subparagraph><subparagraph id="id9b8fbebbbe134b72ae2a6711e6428799"><enum>(B)</enum><text>nationally significant cultural resources that represent a wide range of themes relating to human use and settlement in the region, including—</text><clause id="idc197bde7a7194f559d80d0ffbdf55c05"><enum>(i)</enum><text>high concentrations of archeological resources that provide insight into more than 10,000 years of Tribal history; and</text></clause><clause id="id9c993b1b839044feb8c13821b9f3f86d"><enum>(ii)</enum><text>landmarks that represent topics such as architecture, recreation, and space exploration; and</text></clause></subparagraph></paragraph><paragraph id="id8ae94bab0b244f9b8a00a75513a6c14a"><enum>(3)</enum><text>expanding the Santa Monica Mountains National Recreation Area would provide new opportunities for the National Park Service to serve a broad range of urban communities, including many communities that are—</text><subparagraph id="idF28637C6D55A4DF9BD5E4068220FAAA3"><enum>(A)</enum><text>underrepresented in units of the National Park System; and</text></subparagraph><subparagraph id="idFE71799840934F64AC72EB8A43FD4D14"><enum>(B)</enum><text>underserved by State and local parks.</text></subparagraph></paragraph></section><section id="idd423627fdc374271b9c02f7af31c5c17" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><enum>3.</enum><header>Boundary adjustment; land acquisition; administration</header><subsection id="idb54996777ce2428ab60ad9402f711455"><enum>(a)</enum><header>Boundary adjustment</header><text>Section 507(c)(1) of the National Parks and Recreation Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/460kk">16 U.S.C. 460kk(c)(1)</external-xref>) is amended, in the first sentence, by striking <quote><quote>Santa Monica Mountains National Recreation Area and Santa Monica Mountains Zone, California, Boundary Map</quote>, numbered 80,047–C and dated August 2001</quote> and inserting <quote><quote>Rim of the Valley Unit—Santa Monica Mountains National Recreation Area</quote> and dated October 2017</quote>.</text></subsection><subsection id="id75cb110bed824ad9ba2c3ec80a090f37"><enum>(b)</enum><header>Rim of the valley unit</header><text>Section 507 of the National Parks and Recreation Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/460kk">16 U.S.C. 460kk</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id38E8E0BF49F044309F0D557CCDC89A65" changed="deleted" reported-display-style="strikethrough" committee-id="SSEG00"><subsection id="id9fae150df05d4c6db191cc246c790d27"><enum>(u)</enum><header>Rim of the valley unit</header><paragraph id="idEB493BF64B454231AA8871C4A6256A73"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id191CFC50410B4B2D85ADF45A65E4556A"><enum>(A)</enum><header>State</header><text>The term <quote>State</quote> means the State of California.</text></subparagraph><subparagraph id="id83FC46D8FCDD4D89BFC3C8335397F263"><enum>(B)</enum><header>Unit</header><text>The term <quote>Unit</quote> means the Rim of the Valley Unit included within the boundaries of the recreation area, as depicted on the map described in subsection (c)(1).</text></subparagraph><subparagraph id="id16969E889E1642378A2B79D0517BF2C7"><enum>(C)</enum><header>Utility facility</header><text>The term <term>utility facility</term> means—</text><clause id="id178FCFA5A83449689DB72AE8ED29D192"><enum>(i)</enum><text>electric substations, communication facilities, towers, poles, and lines;</text></clause><clause id="id18E1A4B56CA041DD81204AF1F38064B1"><enum>(ii)</enum><text>ground wires;</text></clause><clause id="idABD077E6837040DB94CE60DFA36F0FED"><enum>(iii)</enum><text>communications circuits;</text></clause><clause id="idAC491EFF164D42138DCA6802FFF39F6C"><enum>(iv)</enum><text>other utility structures; and</text></clause><clause id="id491CB3F15BF844D9A1A49302935BB2F9"><enum>(v)</enum><text>related infrastructure.</text></clause></subparagraph><subparagraph id="id29E4801FAA5A421BBF0F3708BB10A6E2"><enum>(D)</enum><header>Water resource facility</header><text>The term <term>water resource facility</term> means—</text><clause id="idF398D0DD025D4D16B9B8D33ABFFF3E7B"><enum>(i)</enum><text>irrigation and pumping facilities;</text></clause><clause id="idBCDD909A2CC94B029CD20F78207F0D67"><enum>(ii)</enum><text>dams and reservoirs;</text></clause><clause id="idB16E48BF7BFA451880D5D7BFFA2D28E2"><enum>(iii)</enum><text>flood control facilities;</text></clause><clause id="id588C0987AF2F4E4EA0AE7BDF37E60312"><enum>(iv)</enum><text>water conservation works, including debris protection facilities, sediment placement sites, rain gauges, and stream gauges;</text></clause><clause id="id083EA27097FD4E86AB3103FF1FFBBC41"><enum>(v)</enum><text>water quality, recycled water, and pumping facilities;</text></clause><clause id="id68AB3DB71B34476AA65A129E19F58B11"><enum>(vi)</enum><text>conveyance distribution systems;</text></clause><clause id="id6A9BA1AB07B94EB28790A3CA3D06BA7D"><enum>(vii)</enum><text>water treatment facilities;</text></clause><clause id="id23929A4076DE49508B4F5BE23D34BCEE"><enum>(viii)</enum><text>aqueducts;</text></clause><clause id="id1F2E8FC25A6A4C89A2E579FEEC265505"><enum>(ix)</enum><text>canals;</text></clause><clause id="id9DE65DD7EB3D4AC0AFF052C3E0E0CA66"><enum>(x)</enum><text>ditches;</text></clause><clause id="id9888DB7134D345EFB73AA576F17C6ACB"><enum>(xi)</enum><text>pipelines;</text></clause><clause id="idF8D2D6BCA0EE46368845A9C18B7D9E05"><enum>(xii)</enum><text>wells;</text></clause><clause id="idBE987CA13151456BA40129F49FBE6982"><enum>(xiii)</enum><text>hydropower projects;</text></clause><clause id="id066062C1190D475E90FDB8F86A550550"><enum>(xiv)</enum><text>transmission facilities; and</text></clause><clause id="idC21C3BF01DDF4BB9AAE10AEF845A29C0"><enum>(xv)</enum><text>other ancillary facilities, groundwater recharge facilities, water conservation, water filtration plants, and other water diversion, conservation, groundwater recharge, storage, and carriage structures.</text></clause></subparagraph></paragraph><paragraph id="idF6E21F6905BD4E66917B728CD78F900F"><enum>(2)</enum><header>Boundaries</header><text>Not later than 3 years after the date of enactment of this subsection, the Secretary shall update the general management plan for the recreation area developed under subsection (t) to reflect the boundaries designated on the map referred to in subsection (c)(1) to include the area known as the <quote>Rim of the Valley Unit</quote>.</text></paragraph><paragraph id="id2C255D643A9747E3A4E5C8FF40290D95"><enum>(3)</enum><header>Administration</header><text>Subject to valid existing rights, the Secretary shall administer the Unit and any land or interest in land acquired by the United States located within the boundaries of the Unit—</text><subparagraph id="idE412A4BCDD944624B65821CD47EE8CAE"><enum>(A)</enum><text>as part of the recreation area; and</text></subparagraph><subparagraph id="idC113D59916994CEB921E5644193C1B55"><enum>(B)</enum><text>in accordance with—</text><clause id="idA37C7A1AA7064B25A60B544F658217FE"><enum>(i)</enum><text>this section; and</text></clause><clause id="id604E3F6083E34B4B8454EC844B876DF6"><enum>(ii)</enum><text>applicable laws (including regulations).</text></clause></subparagraph></paragraph><paragraph id="id04b727d198d746d8ae9d409ee59a011c"><enum>(4)</enum><header>Acquisition of land</header><subparagraph id="idDFA092D2002745008C37369DE1266442"><enum>(A)</enum><header>In general</header><text>The Secretary may acquire non-Federal land within the boundaries of the Unit only through exchange, donation, or purchase from a willing seller.</text></subparagraph><subparagraph id="idBA7B9602A2D244ACA161A1CAC1D58AF8"><enum>(B)</enum><header>Use of eminent domain</header><text>Nothing in this subsection authorizes the use of eminent domain to acquire land or interests in land within the boundaries of the Unit.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCF6CD69AB4C044A5B2CAA439D7CF588A"><enum>(5)</enum><header display-inline="yes-display-inline">Outside activities</header><text display-inline="yes-display-inline">The fact that certain activities or land uses can be seen or heard from within the Unit shall not preclude the activities or land uses outside the boundary of the Unit.</text></paragraph><paragraph id="id6769A3F9B4B741B6B2C17810F8F34098"><enum>(6)</enum><header>Effect of subsection</header><text>Nothing in this subsection or the application of the applicable management plan to the Unit—</text><subparagraph id="idbf3e668821c14c38881537a9142fd3ca"><enum>(A)</enum><text>modifies any provision of Federal, State, or local law with respect to public access to, or use of, non-Federal land;</text></subparagraph><subparagraph id="id5e36078e08c4464097956f712bfc5bfb"><enum>(B)</enum><text>creates any liability, or affects any liability under any other law, of any private property owner or other owner of non-Federal land with respect to any person injured on private property or other non- Federal land;</text></subparagraph><subparagraph id="id22c21faf3fef46c18fee8dbe8d9b4ed1"><enum>(C)</enum><text>affects the ownership, management, or other rights relating to any non-Federal land (including any interest in any non-Federal land);</text></subparagraph><subparagraph id="idb8062000dcb946dbbf3e086e07efd92e"><enum>(D)</enum><text>requires any unit of local government to participate in any program administered by the Secretary;</text></subparagraph><subparagraph id="id0e91ab2e34804dd389638447dca1cda8"><enum>(E)</enum><text>alters, modifies, or diminishes any right, responsibility, power, authority, jurisdiction, or entitlement of the State, any political subdivision of the State, or any State or local agency under existing Federal, State, or local law (including regulations);</text></subparagraph><subparagraph id="id95e61a0fedf843ca843d8cf585e6f70e"><enum>(F)</enum><text>requires the creation of protective perimeters or buffer zones around the Unit;</text></subparagraph><subparagraph id="idd3227aa37b6d4410bf35e1b0c8c62d80"><enum>(G)</enum><text>requires or promotes the use of, or encourages trespass on, land, facilities, or rights-of-way owned by non-Federal entities, including water resource facilities and public utilities, without the written consent of the owner of the land;</text></subparagraph><subparagraph id="idd8f1775806334abc9b2ba8feb6f31163"><enum>(H)</enum><text>affects the operation, maintenance, modification, construction, or expansion of any water resource facility or utility facility located within or adjacent to the Unit;</text></subparagraph><subparagraph id="id915c06d1416749d58fbb3afbbe910013"><enum>(I)</enum><text>terminates the fee title to land, or the customary operation, maintenance, repair, and replacement activities on or under the land, granted to public agencies that are authorized under Federal or State law;</text></subparagraph><subparagraph id="id9e6ae409face47f3a815ac8e796edf65"><enum>(J)</enum><text>interferes with, obstructs, hinders, or delays the exercise of any right to, or access to any water resource facility or other facility or property necessary or useful to access any water right to operate any public water or utility system; or</text></subparagraph><subparagraph id="id6a93364846604b12a6cecaf3f6641088"><enum>(K)</enum><text>requires initiation or reinitiation of consultation with the Director of the United States Fish and Wildlife Service under, or the application of provisions of, the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), or division A of subtitle III of title 54, United States Code, relating to any action or activity affecting water, water rights, water management, or water resource facilities within the Unit.</text></subparagraph></paragraph><paragraph id="id170DEC354B254492998694C1C71E095C"><enum>(7)</enum><header>Utility facilities; water resource facilities</header><text>A utility facility or water resource facility shall conduct activities in a manner that reasonably avoids or reduces the impact of the activities on the resources of the Unit.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id2924727AEF0C4230B73B9136E12BFCC0" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rim of the Valley Corridor Preservation Act</short-title></quote>.</text></section><section id="id9b765957310f445caefc218514c6e392" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>2.</enum><header>Boundary adjustment</header><subsection id="iddc3089deca32473c9bf78c563e57d7e1"><enum>(a)</enum><header>Boundary adjustment</header><text>Section 507(c) of the National Parks and Recreation Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/460kk">16 U.S.C. 460kk(c)</external-xref>) is amended by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideb853cf0c25b4279ace615070f5ae624" changed="added" reported-display-style="italic" committee-id="SSEG00"><paragraph id="ida736eba2fc9444f2800b5a8a48a60132"><enum>(1)</enum><header>Boundary</header><subparagraph id="id077B11ECB5F54004829488625A2F1469"><enum>(A)</enum><header>In general</header><text>The recreation area shall consist of—</text><clause id="id761ceffd704c447a8461aa40a2d4d98f"><enum>(i)</enum><text>the land, water, and interests in land and water generally depicted as the recreation area on the map entitled <quote>Santa Monica Mountains National Recreation Area and Santa Monica Mountains Zone, California, Boundary Map</quote>, numbered 80,047–C, and dated August 2001; and</text></clause><clause id="id1e5f0c85f7534b35ab650373464d102d"><enum>(ii)</enum><text>the land, water, and interests in land and water, as generally depicted as <quote>Proposed Addition</quote> on the map entitled <quote>Rim of the Valley Unit—Santa Monica Mountains National Recreation Area</quote>, numbered 638/179670C, and dated July 12, 2022. </text></clause></subparagraph><subparagraph id="id8ef9bae48bfc41aebc460aee3b569c54"><enum>(B)</enum><header>Availability of maps</header><text>The maps described in subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></subparagraph><subparagraph id="id770c509283c14cd4b7a35900555d6721"><enum>(C)</enum><header>Revisions</header><text>After advising the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives, in writing, of the proposed revision, the Secretary may make minor revisions to the boundaries of the recreation area by publication of a revised drawing or other boundary description in the Federal Register.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idf16d417734fb4cc783c675e9a1f08e99" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>3.</enum><header>Administration</header><text display-inline="no-display-inline">Any land or interest in land acquired by the Secretary of the Interior within the Rim of the Valley Unit shall be administered as part of the Santa Monica Mountains National Recreation Area (referred to in this Act as the <quote>National Recreation Area</quote>) in accordance with the laws (including regulations) applicable to the National Recreation Area.</text></section><section id="id3ab9cc0ffb8c465ca6ea1db6beb3f933" changed="added" reported-display-style="italic" committee-id="SSEG00"><enum>4.</enum><header>Utilities and water resource facilities</header><text display-inline="no-display-inline">The addition of the Rim of the Valley Unit to the National Recreation Area shall not affect the operation, maintenance, or modification of water resource facilities or public utilities within the Rim of the Valley Unit, except that any utility or water resource facility activities in the Rim of the Valley Unit shall be conducted in a manner that reasonably avoids or reduces the impact of the activities on resources of the Rim of the Valley Unit.</text></section></legis-body><endorsement><action-date>October 18, 2022</action-date><action-desc>Reported under authority of the order of the Senate of October 14, 2022, with an amendment</action-desc></endorsement></bill>
