Maintenance of funding.</toc-entry></toc></subsection></section><section id="HC819732FADFF4DCAAC0594FDFBA83991"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" id="HB12BEEDC4B6F433B82C79661C6405F17"><enum>(1)</enum><header>Aggregator</header><text display-inline="yes-display-inline">The term <term>aggregator</term> means a gas utility, electric utility, or commercial, nonprofit, or government entity that may receive rebates provided under a State program under this Act for one or more portfolios, consisting of one or more energy efficiency retrofits. </text></paragraph><paragraph commented="no" id="HE00823F994E949FDA0E958244559C882"><enum>(2)</enum><header>Contractor certification</header><text>The term <term>contractor certification</term> means an industry recognized certification that may be obtained by a residential contractor to advance the expertise and education of the contractor in energy efficiency retrofits of residential buildings, including—</text><subparagraph id="H9BE0A07CD22445F3835512954A3A54C0"><enum>(A)</enum><text display-inline="yes-display-inline">a certification provided by—</text><clause commented="no" id="HFC32A89D259B441592E4A0734B66170B"><enum>(i)</enum><text>the Building Performance Institute;</text></clause><clause commented="no" id="H7E68FBDA88CC495B97FE6BBCE5597C91"><enum>(ii)</enum><text>the Air Conditioning Contractors of America;</text></clause><clause commented="no" id="H46ED1A5044B247D7ABD87AC13870A806"><enum>(iii)</enum><text>the National Comfort Institute;</text></clause><clause commented="no" id="HB2D58272E622448D9B2C7E5D0E19591B"><enum>(iv)</enum><text>the North American Technician Excellence;</text></clause><clause commented="no" id="HC1058118C0584C9BB8264962DF6ADE8E"><enum>(v)</enum><text display-inline="yes-display-inline">RESNET;</text></clause><clause commented="no" id="H8C3557B7EE0241A689FBB7359D985046"><enum>(vi)</enum><text>the United States Green Building Council; or</text></clause><clause id="HCF77C33E16B44E87A9CC256E73063B66"><enum>(vii)</enum><text>Home Innovation Research Labs; and</text></clause></subparagraph><subparagraph commented="no" id="H9AE3EA09AB2740489EACADA1E463A684"><enum>(B)</enum><text>any other certification the Secretary determines appropriate for purposes of the Home Energy Savings Retrofit Rebate Program. </text></subparagraph></paragraph><paragraph commented="no" id="HD71A27DFDB3C4792A92B16A1C13EDDE3"><enum>(3)</enum><header>Contractor company</header><text display-inline="yes-display-inline">The term <term>contractor company</term> means a company—</text><subparagraph commented="no" id="HDCD3EE2F134E4492AA620455797BD6AF"><enum>(A)</enum><text>the business of which is to provide services to residential building owners with respect to HVAC systems, insulation, air sealing, or other services that are approved by the Secretary; </text></subparagraph><subparagraph commented="no" id="H32EFA900CD5A42738FBAE02F65E04D07"><enum>(B)</enum><text display-inline="yes-display-inline">that holds the licenses and insurance required by the State in which the company provides services; and</text></subparagraph><subparagraph commented="no" id="H445F5CDF99E24D6386FF6FB6235AC792"><enum>(C)</enum><text display-inline="yes-display-inline">that provides services for which a rebate may be provided pursuant to the Home Energy Savings Retrofit Rebate Program.</text></subparagraph></paragraph><paragraph commented="no" id="H139E8C26F6AE4F91BDD1443ADB668CD9"><enum>(4)</enum><header>Electric consumer</header><text>The term <term>electric consumer</term> has the meaning given such term in section 3 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602</external-xref>).</text></paragraph><paragraph commented="no" id="HFAE02C5F9EBE47D6B124F4B5B0B696BB"><enum>(5)</enum><header>Electric utility</header><text>The term <term>electric utility</term> has the meaning given such term in section 3 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2602">16 U.S.C. 2602</external-xref>).</text></paragraph><paragraph commented="no" id="HA9B8474310394659BA60F95A8C3C68A9"><enum>(6)</enum><header>Energy audit</header><text>The term <term>energy audit</term> means an inspection, survey, and analysis of the energy use of a building, including the building envelope and HVAC system.</text></paragraph><paragraph commented="no" id="H4E22AAD32098492CADFBAAA4835759AD"><enum>(7)</enum><header>Gas consumer</header><text>The term <term>gas consumer</term> has the meaning given such term in section 302 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/15/3202">15 U.S.C. 3202</external-xref>).</text></paragraph><paragraph commented="no" id="HAE6BAED6126340EDAA7C75DBA305D885"><enum>(8)</enum><header>Gas utility</header><text>The term <term>gas utility</term> has the meaning given such term in section 302 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/15/3202">15 U.S.C. 3202</external-xref>).</text></paragraph><paragraph commented="no" id="HCE14C04C3F564F3792DB810DFC29F74E"><enum>(9)</enum><header>Home</header><text display-inline="yes-display-inline">The term <term>home</term> means a building with no more than 4 dwelling units, or a manufactured housing unit, including units built before June 15, 1976, that—</text><subparagraph commented="no" id="H811248670F554736AC0A1D7F045F3D17"><enum>(A)</enum><text display-inline="yes-display-inline">is located in the United States;</text></subparagraph><subparagraph commented="no" id="H1C8B48454C7447C7BDAEB53F90B34F66"><enum>(B)</enum><text>was constructed before the date of enactment of this Act; and</text></subparagraph><subparagraph commented="no" id="HC30A014A3F494112A7F9FFBC3BC38796"><enum>(C)</enum><text>is occupied at least 6 months out of the year.</text></subparagraph></paragraph><paragraph commented="no" id="H155D83D6AAA14B59891A3A1F4BC6E5CD"><enum>(10)</enum><header>Home Energy Savings Retrofit Rebate Program</header><text>The term <term>Home Energy Savings Retrofit Rebate Program</term> means the Home Energy Savings Retrofit Rebate Program established under section 201.</text></paragraph><paragraph commented="no" id="H80FF11604E784FDC9EDB03DA2B2C530A"><enum>(11)</enum><header>Homeowner</header><text>The term <term>homeowner</term> means the owner of an owner-occupied home or a tenant-occupied home. </text></paragraph><paragraph commented="no" id="H4D2A17B902E94B2B8CBE171814BD10E7"><enum>(12)</enum><header>Home valuation certification</header><text>The term <term>home valuation certification</term> means one of the following home assessments:</text><subparagraph commented="no" id="HE436D01FD08549D1B46B4CD0BEFD92EF"><enum>(A)</enum><text>Home Energy Score.</text></subparagraph><subparagraph commented="no" id="HF3C3E94B27294A489202A5E00876AADE"><enum>(B)</enum><text>PEARL Certification.</text></subparagraph><subparagraph commented="no" id="HCEE45F2BCCD44032A2958B8DD27B251F"><enum>(C)</enum><text>National Green Building Standard.</text></subparagraph><subparagraph commented="no" id="H69CC224355E14AE1898D4067D0473243"><enum>(D)</enum><text>LEED.</text></subparagraph><subparagraph commented="no" id="H69325A07F3D845189D6848C54A055D4D"><enum>(E)</enum><text display-inline="yes-display-inline">Any other assessment the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="H0A831CC81EE242E1B77CBDAC780DC978"><enum>(13)</enum><header>HOPE Qualification</header><text>The term <term>HOPE Qualification</term> means the qualification described in section 103.</text></paragraph><paragraph id="H2965045CB0DA4E87A074E1CC39AA60DE"><enum>(14)</enum><header>HOPE training credit</header><text>The term <term>HOPE training credit</term> means a HOPE training task credit or a HOPE training supplemental credit.</text></paragraph><paragraph id="HC8244C9FAC8B4E138017AD46D1445CA1"><enum>(15)</enum><header>HOPE training task credit</header><text>The term <term>HOPE training task credit</term> means a credit described in section 102(a). </text></paragraph><paragraph id="H49555D0D56B9415F8292A5FFEB4BCD69"><enum>(16)</enum><header>HOPE training supplemental credit</header><text>The term <term>HOPE training supplemental credit</term> means a credit described in section 102(b). </text></paragraph><paragraph commented="no" id="HF831FD90AE284245B1910B10B265BCB6"><enum>(17)</enum><header>HVAC system</header><text>The term <term>HVAC system</term> means a system—</text><subparagraph commented="no" id="H0CE5F5174BD34F1BA44B65ECBD6E9700"><enum>(A)</enum><text>consisting of a heating component, a ventilation component, and an air-conditioning component; and</text></subparagraph><subparagraph commented="no" id="HA5486E6598304409813D7CA952977A11"><enum>(B)</enum><text>which components may include central air conditioning, a heat pump, a furnace, a boiler, a rooftop unit, and a window unit.</text></subparagraph></paragraph><paragraph commented="no" id="HEA584FCB1BEF427A847838484C68BB60"><enum>(18)</enum><header>Measured performance home rebate</header><text display-inline="yes-display-inline">The term <term>measured performance home rebate</term> means a rebate provided in accordance with section 203 and described in subsection (e) of that section.</text></paragraph><paragraph commented="no" id="HC4B398D121A64CCB9276D530E0DF9FCF"><enum>(19)</enum><header>Measured performance multifamily building rebate</header><text>The term <term>measured performance multifamily building rebate</term> means a rebate provided in accordance with section 205 and described in subsection (e) of that section. </text></paragraph><paragraph id="H32B8AABADE9A4BB3BD818B48F5E35878"><enum>(20)</enum><header>Meter</header><text display-inline="yes-display-inline">The term <term>meter</term> means a device that measures and records energy usage data at any interval.</text></paragraph><paragraph commented="no" id="HED3F6F2D55DF4D80AEA2226A421277D2"><enum>(21)</enum><header>Modeled performance home rebate</header><text>The term <term>modeled performance rebate</term> means a rebate provided in accordance with section 203 and described in subsection (d) of that section.</text></paragraph><paragraph commented="no" id="H43C9CB6A7EAB4667B4CBC1DF225BF5ED"><enum>(22)</enum><header>Modeled performance multifamily building rebate</header><text>The term <term>modeled performance multifamily building rebate</term> means a rebate provided in accordance with section 205 and described in subsection (d) of that section. </text></paragraph><paragraph id="HFFAE881663F14153BBCD2F96FDBFE310"><enum>(23)</enum><header>Moderate income</header><text>The term <term>moderate income</term> means, with respect to a household, a household with an annual income that is less than 80 percent of the area median income, as determined annually by the Department of Housing and Urban Development.</text></paragraph><paragraph commented="no" id="HBDA8BCA4BAD548429B99D327FF97E605"><enum>(24)</enum><header>Multifamily building</header><text>The term <term>multifamily building</term> means a building with 5 or more dwelling units.</text></paragraph><paragraph commented="no" id="HD7E2BF1164BD49289D2FAD11515263CE"><enum>(25)</enum><header>Partial system rebate</header><text>The term <term>partial system rebate</term> means a rebate provided in accordance with section 202.</text></paragraph><paragraph commented="no" id="HDC54C747380547E3AC650BB65781296D"><enum>(26)</enum><header>Retail electric energy information</header><text>The term <term>retail electric energy information</term> means—</text><subparagraph commented="no" id="H42D6B1FED0EA4D98905CFC2E65CB9F3F"><enum>(A)</enum><text>the electric energy usage of an electric consumer over a time interval, as measured and recorded by the applicable meter;</text></subparagraph><subparagraph commented="no" id="H4324B86D18EC44DE8387791ECA10E9DC"><enum>(B)</enum><text>the retail electric energy prices or rates applied to the electric energy usage for the time interval described in subparagraph (A) for the electric consumer;</text></subparagraph><subparagraph commented="no" id="H3FF7753EF6A0416793700EAFB89B943D"><enum>(C)</enum><text>the cost of service provided to an electric consumer, as displayed on billing information provided to such electric consumer; and</text></subparagraph><subparagraph commented="no" id="H0D5F3BF787764743BB23921EA29A1986"><enum>(D)</enum><text>in the case of nonresidential electric meters, any other electrical information that the meter is programmed to record that is used for billing purposes (such as demand measured in kilowatts, voltage, frequency, current, and power factor).</text></subparagraph></paragraph><paragraph commented="no" id="H68A89C095ABC44968112136AF0EE37A5"><enum>(27)</enum><header>Retail natural gas information</header><text>The term <term>retail natural gas information</term> means—</text><subparagraph commented="no" id="H63862A490ACE43E0AD9FFB465281FD14"><enum>(A)</enum><text>the natural gas usage of a gas consumer, as measured and recorded by the applicable gas utility;</text></subparagraph><subparagraph commented="no" id="H62D1D1177D7C4DC4BADEFF08715B3301"><enum>(B)</enum><text>the retail natural gas prices or rates applied to the natural gas usage described in subparagraph (A) for the gas consumer;</text></subparagraph><subparagraph commented="no" id="H35A15BBAEC38456FBD680B8091153337"><enum>(C)</enum><text>the cost of service provided to a gas consumer, as displayed on billing information provided to such gas consumer; and</text></subparagraph><subparagraph commented="no" id="H4E062D82A574412E8CCFA24EE59AC29A"><enum>(D)</enum><text>in the case of nonresidential natural gas meters, any other information that the meter is programmed to record that is used for billing purposes.</text></subparagraph></paragraph><paragraph id="H133EEF999D1D437B83132A17144A4CE9"><enum>(28)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="HED830ADFF92E4D84B138719857D575BE"><enum>(29)</enum><header>State</header><text>The term <term>State</term> includes—</text><subparagraph id="HB7DA37EA66764845ADEC4324F8AD3052"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="H7AB815E75487436493E7F221CEF8064D"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="HB6F0C60D85644BB7B7847C5DD98DDBFB"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph id="H1188897510F144508EA7D217DDDE8A05"><enum>(D)</enum><text>Guam;</text></subparagraph><subparagraph id="HEA71FBF9A90349C0B667A8724F26D76A"><enum>(E)</enum><text>American Samoa;</text></subparagraph><subparagraph id="H192048BE203E480E821829F22B80C886"><enum>(F)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></subparagraph><subparagraph id="H9AE940E38FB647F3A19CEBD00DA49D66"><enum>(G)</enum><text>the United States Virgin Islands; and</text></subparagraph><subparagraph id="H0B48FD6BBA704BE99A003118FFD77468"><enum>(H)</enum><text>any other territory or possession of the United States.</text></subparagraph></paragraph><paragraph id="H2D2C215267C14BA7A3043F6D4C6A4689"><enum>(30)</enum><header>State energy office</header><text display-inline="yes-display-inline">The term <term>State energy office</term> means the office or agency of a State responsible for developing the State energy conservation plan for the State under section 362 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322</external-xref>). </text></paragraph><paragraph commented="no" id="H5B2FA8C34A3B4872B70D45922FFA1765"><enum>(31)</enum><header>Underserved community</header><text>The term <term>underserved community</term> means—</text><subparagraph commented="no" id="H032AC8B5B71E4CE5BF4C0AFBA974713F"><enum>(A)</enum><text display-inline="yes-display-inline">a community located in a ZIP Code that includes one or more census tracts that are identified as—</text><clause commented="no" id="H95EC7BF7428B4C08A84945515CD7D24E"><enum>(i)</enum><text>a low-income community; or</text></clause><clause commented="no" id="H7A79A743B06C4A8D9428BB8397A1A6C5"><enum>(ii)</enum><text display-inline="yes-display-inline">a community of racial or ethnic minority concentration; or</text></clause></subparagraph><subparagraph commented="no" id="H02600E7630434C09B9E0B290C445A41E"><enum>(B)</enum><text>any other community that the Secretary determines is disproportionately vulnerable to, or bears a disproportionate burden of, any combination of economic, social, and environmental stressors. </text></subparagraph></paragraph></section><title id="HD52FBEAF904E4B9A87F8C62EFD5CF3BB"><enum>I</enum><header>HOPE Training</header><section commented="no" id="H559C171398534FD2B942C6F26D16F8DE"><enum>101.</enum><header>Notice for HOPE Qualification training and grants</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Secretary, acting through the Director of the Building Technologies Office of the Department of Energy, shall issue a notice that includes—</text><paragraph commented="no" id="H395F3C86A4D444D2A6958ECCAA5FDE20"><enum>(1)</enum><text display-inline="yes-display-inline">criteria established under section 102 for approval by the Secretary of courses for which credits may be issued for purposes of a HOPE Qualification;</text></paragraph><paragraph commented="no" id="H0FE74D5247404D11AF854AEA13F41D33"><enum>(2)</enum><text display-inline="yes-display-inline">a list of courses that meet such criteria and are so approved; and</text></paragraph><paragraph commented="no" id="H6B4177711C4246079CB04A9CE53B9867"><enum>(3)</enum><text>information on how individuals and entities may apply for grants under this title.</text></paragraph></section><section id="H71ED5485E9954B4AA24A1456018E09EE"><enum>102.</enum><header>Course criteria</header><subsection id="H9C409646C9BC4A7081FA9939DFEC3C98"><enum>(a)</enum><header>HOPE training task credit</header><paragraph id="H3072436334E64B2F8F27CDB6F2460FC2"><enum>(1)</enum><header>Criteria</header><text display-inline="yes-display-inline">The Secretary shall establish criteria for approval of a course for which a credit, to be known as a HOPE training task credit, may be issued, including that such course—</text><subparagraph id="H3F8B079047D54967A058853E132D6D00"><enum>(A)</enum><text display-inline="yes-display-inline">is equivalent to at least 30 hours in total course time; </text></subparagraph><subparagraph commented="no" id="HFF8084105BCD43B688D5BB1A3F6E5A8B"><enum>(B)</enum><text display-inline="yes-display-inline">is provided by a provider accredited by the Interstate Renewable Energy Council or has other accreditation determined to be equivalent by the Secretary;</text></subparagraph><subparagraph id="HCCDE3BA19927499695071274A78B05EF"><enum>(C)</enum><text>is, with respect to a particular job, aligned with the relevant National Renewable Energy Laboratory Job Task Analysis, or other credentialing program foundation that helps identify the necessary core knowledge areas, critical work functions, or skills, as approved by the Secretary; </text></subparagraph><subparagraph id="HB4B7E0EBBC98458D9E00CE28803F2D03"><enum>(D)</enum><text>has established learning objectives; and</text></subparagraph><subparagraph id="HDA599B4A88F249D4B6AEEE21ACA1D294"><enum>(E)</enum><text display-inline="yes-display-inline">includes, as the Secretary determines appropriate, an appropriate assessment of such learning objectives that may include a final exam, to be proctored on-site or through remote proctoring, or an in-person field exam.</text></subparagraph></paragraph><paragraph id="HDEEA049922DD448F8F7F573224B7C7B3"><enum>(2)</enum><header>Included courses</header><text>The Secretary shall approve one or more courses that meet the criteria described in paragraph (1) for training related to—</text><subparagraph id="H6588739E577341259DD702B86FEDBFB4"><enum>(A)</enum><text>contractor certification;</text></subparagraph><subparagraph id="H2CCC269B5FE24B4C97B605D694867DF5"><enum>(B)</enum><text>energy auditing or assessment;</text></subparagraph><subparagraph commented="no" id="HFBC8D660A3B2498A8963EB61F19E5E3B"><enum>(C)</enum><text>home energy systems (including HVAC systems); </text></subparagraph><subparagraph id="HD01F1FBB0D3945CCA8D482660D00A007"><enum>(D)</enum><text>insulation installation and air leakage control;</text></subparagraph><subparagraph commented="no" id="H802A62FDE4F6464C9635974F8539985E"><enum>(E)</enum><text>health and safety regarding the installation of energy efficiency measures or health and safety impacts associated with energy efficiency retrofits; </text></subparagraph><subparagraph id="H21D5A0DFAD4846F6BDF4CE1E195F6CF5"><enum>(F)</enum><text>indoor air quality; and</text></subparagraph><subparagraph id="H79D5C9B6FE074D40923428B285190F02"><enum>(G)</enum><text display-inline="yes-display-inline">energy efficiency retrofits in manufactured housing.</text></subparagraph></paragraph></subsection><subsection id="H1D78A913638846B59783882B570F84DA"><enum>(b)</enum><header>HOPE training supplemental credit criteria</header><text>The Secretary shall establish criteria for approval of a course for which a credit, to be known as a HOPE training supplemental credit, may be issued, including that such course provides—</text><paragraph id="HD54E9D2F79AA44F8B920ECDE28440272"><enum>(1)</enum><text display-inline="yes-display-inline">training related to—</text><subparagraph id="HA1E615BF4ADD4D2CB602E81E5BD840E9"><enum>(A)</enum><text>small business success, including management, marketing, home energy efficiency software, or general accounting principles; </text></subparagraph><subparagraph commented="no" id="HAE3419B36579461792B939F5D6EA109C"><enum>(B)</enum><text display-inline="yes-display-inline">the issuance of a home valuation certification;</text></subparagraph><subparagraph commented="no" id="HA3E7C71E0DAA4059B33E48963415B34D"><enum>(C)</enum><text display-inline="yes-display-inline">the use of wifi-enabled technology in an energy efficiency upgrade; or </text></subparagraph><subparagraph commented="no" id="H1C4224C3F8AF4C9DB293056EE0A899E8"><enum>(D)</enum><text display-inline="yes-display-inline">understanding and being able to participate in the Home Energy Savings Retrofit Rebate Program; and </text></subparagraph></paragraph><paragraph id="H5A92692938AA415B91C01A98F4EBCD50"><enum>(2)</enum><text display-inline="yes-display-inline">as the Secretary determines appropriate, an appropriate assessment of such training that may include a final exam, to be proctored on-site or through remote proctoring, or an in-person field exam.</text></paragraph></subsection><subsection commented="no" id="H49D41F78BB0D4A8B87BF79B707FD0BDF"><enum>(c)</enum><header>Existing approved courses</header><text display-inline="yes-display-inline">The Secretary may approve a course that meets the applicable criteria established under this section that is approved by the applicable State energy office or relevant State agency with oversight authority for residential energy efficiency programs.</text></subsection><subsection commented="no" id="HE38735AFE43D4F039FCE520B51E322D2"><enum>(d)</enum><header>In-Person and online training</header><text display-inline="yes-display-inline">A course approved pursuant to this section shall be available online, except as needed for training in, or assessing, course content, but may also be conducted in-person. </text></subsection></section><section id="H0A755D7A221B42C4BFA77AA47039CDE1"><enum>103.</enum><header>HOPE Qualification</header><subsection id="H55486CD318A64E5991D2E5D8CF791763"><enum>(a)</enum><header>Issuance of credits</header><paragraph commented="no" id="HCE21E060AB56472486331F3280683313"><enum>(1)</enum><header>In general</header><text>The Secretary, or an entity authorized by the Secretary pursuant to paragraph (2), may issue—</text><subparagraph commented="no" id="HDC986C8134F34B3BB4425BA74B41A30F"><enum>(A)</enum><text display-inline="yes-display-inline">a HOPE training task credit to any individual that completes a course that meets applicable criteria under section 102; and</text></subparagraph><subparagraph commented="no" id="H96721C2F1C914738A7235094B5DF7374"><enum>(B)</enum><text display-inline="yes-display-inline">a HOPE training supplemental credit to any individual that completes a course that meets the applicable criteria under section 102.</text></subparagraph></paragraph><paragraph id="H4E8E7F973F8C4FA5AD553E7F44935F35"><enum>(2)</enum><header>Other entities</header><text display-inline="yes-display-inline">The Secretary may authorize a State energy office implementing an authorized program under subsection (b)(2), an organization described in section 104(b), and any other entity the Secretary determines appropriate, to issue HOPE training credits in accordance with paragraph (1). </text></paragraph></subsection><subsection id="H228B15D205024E2984A8AE07C756B8E9"><enum>(b)</enum><header>HOPE Qualification</header><paragraph id="HCC2F571AD2F54B3C9467FC4C8EF4C7E4"><enum>(1)</enum><header>In general</header><text>The Secretary may certify that an individual has achieved a qualification, to be known as a HOPE Qualification, that indicates that the individual has received at least 3 HOPE training credits, of which at least 2 shall be HOPE training task credits. </text></paragraph><paragraph commented="no" id="H379EE5B04378492486A0DCC471798386"><enum>(2)</enum><header>State programs</header><text display-inline="yes-display-inline">The Secretary may authorize a State energy office to implement a program to provide HOPE Qualifications in accordance with this title.</text></paragraph></subsection></section><section id="H0BB43DBAB6FB4AB19268854E821E88C7"><enum>104.</enum><header>Grants</header><subsection id="H433C7B6B28944142BAD4C534484E77B6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, to the extent amounts are made available in appropriations Acts for such purposes, provide grants to support the training of individuals toward the completion of a HOPE Qualification.</text></subsection><subsection id="HF06AF128A8984231973B506C03ED6B0C"><enum>(b)</enum><header>Provider organizations</header><paragraph commented="no" id="H7F279B3B4F9643D9965576ACAD3426F5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide a grant of up to $20,000 under this section to an organization to provide training online, including establishing, modifying, or maintaining the online systems, staff time, and software and online program management, through a course that meets the applicable criteria established under section 102. </text></paragraph><paragraph commented="no" id="HA60467B159864593A6ADF6F1732FEE64"><enum>(2)</enum><header>Criteria</header><text>In order to receive a grant under this subsection, an organization shall be—</text><subparagraph id="H043C0BEA50C64549840EE3B30A089A8B"><enum>(A)</enum><text>a nonprofit organization;</text></subparagraph><subparagraph id="HBC2826B943D249D0B64202380347C2DC"><enum>(B)</enum><text>an educational institution; or</text></subparagraph><subparagraph id="H38432C50894B4304BEC3594F7398E67E"><enum>(C)</enum><text>an organization that has experience providing training to contractors that work with the weatherization assistance program implemented under part A of title IV of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6861">42 U.S.C. 6861</external-xref> et seq.) or equivalent experience, as determined by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" id="HC72984A14D124446A57C0F0F264A6CAC"><enum>(3)</enum><header>Additional certifications</header><text>In addition to any grant provided under paragraph (1), the Secretary may provide an organization up to $5,000 for each additional course for which a HOPE training credit may be issued that is offered by the organization. </text></paragraph></subsection><subsection commented="no" id="HAFA2B169295D4133847637EE04DC4152"><enum>(c)</enum><header>Contractor company</header><text display-inline="yes-display-inline">The Secretary may provide a grant under this section of $1,000 per employee to a contractor company, up to a maximum of $10,000, to reimburse the contractor company for training costs for employees, and any home technology support needed for an employee to receive training pursuant to this section. Grant funds provided under this subsection may be used to support wages of employees during training.</text></subsection><subsection id="HB992BBB13B8B4E8895EFE59A2D5E121B"><enum>(d)</enum><header>Trainees</header><text>The Secretary may provide a grant of up to $1,000 under this section to an individual who receives a HOPE Qualification.</text></subsection><subsection commented="no" id="H37258C2B98F74D2B972CA86E2B8185FD"><enum>(e)</enum><header>State energy office</header><text>The Secretary may provide a grant under this section to a State energy office of up to $25,000 to implement an authorized program under section 103(b).</text></subsection></section><section id="HFCBC4CF4213A4047BBE9554CD00201B9"><enum>105.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this title $500,000,000 for the period of fiscal years 2022 through 2027.</text></section></title><title commented="no" id="H3F22E2102E8D41E28EB91402CB187FC9"><enum>II</enum><header>Home Energy Savings Retrofit Rebate Program</header><section commented="no" id="H64B01904EB5F47AE95C648048DCD109D"><enum>201.</enum><header>Establishment of Home Energy Savings Retrofit Rebate Program</header><text display-inline="no-display-inline"> The Secretary shall establish a program, to be known as the Home Energy Savings Retrofit Rebate Program, to—</text><paragraph commented="no" id="HDC577D62E8124092A453C125BB48ED93"><enum>(1)</enum><text>provide rebates in accordance with section 202; and</text></paragraph><paragraph commented="no" id="H159EB196BCFD422D9B947FB133EEF7AB"><enum>(2)</enum><text>provide grants to States to carry out programs to provide rebates in accordance this title.</text></paragraph></section><section commented="no" id="H849247CFCEE349E4AF4BED6E003D80A6"><enum>202.</enum><header>Partial system rebates</header><subsection commented="no" id="H72167CB1560645CE9C95DD95BE78FDFB"><enum>(a)</enum><header>Amount of rebate</header><text display-inline="yes-display-inline">In carrying out the Home Energy Savings Retrofit Rebate Program, and subject to the availability of appropriations for such purpose, the Secretary shall provide a homeowner a rebate, to be known as a partial system rebate, of, except as provided in section 206—</text><paragraph commented="no" id="HFDB14C4AEDCC41DABDFEF46F5073150E"><enum>(1)</enum><text>up to $800 for the purchase and installation of insulation and air sealing within a home of the homeowner; and</text></paragraph><paragraph commented="no" id="H820508B95C1342E4A1928A13E857CCD7"><enum>(2)</enum><text display-inline="yes-display-inline">up to—</text><subparagraph id="HDEDEC2F852FA4C788F8355C042E2CB22"><enum>(A)</enum><text>except as provided in subparagraph (B), $1,500 for—</text><clause commented="no" id="HA3615C2E6ED44544BF51718F037B2C66"><enum>(i)</enum><text>the purchase and installation of insulation and air sealing within a home of the homeowner; and</text></clause><clause commented="no" id="H09FFCDF0044E412481667A9636ACD6B5"><enum>(ii)</enum><text>the replacement of—</text><subclause commented="no" id="HC012CA70797F439BBBC0CFAD87825356"><enum>(I)</enum><text>an HVAC system of such home;</text></subclause><subclause commented="no" id="H6579E9EBA93743EAB26C91757D5BC3FC"><enum>(II)</enum><text>the heating component of an HVAC system of such home; or</text></subclause><subclause commented="no" id="HD36479B427AF42E89EFCA1DC6AA03060"><enum>(III)</enum><text>the cooling component of an HVAC system of such home; or</text></subclause></clause></subparagraph><subparagraph commented="no" id="H08BB309148F2476EBDB9C092EC91EB0E"><enum>(B)</enum><text display-inline="yes-display-inline">$2,500 for—</text><clause commented="no" id="H620E142312C04F0799C7966B09AC0FA7"><enum>(i)</enum><text display-inline="yes-display-inline">the purchase and installation of insulation and air sealing within a home of the homeowner; and</text></clause><clause commented="no" id="H7D8A5D2FB669433FBD595BA922CC5CA3"><enum>(ii)</enum><text display-inline="yes-display-inline">the replacement of the heating component of an HVAC system of such home where the heating component installed is an air source or ground source heat pump.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="HDEB0E201B4464B399E2E6082C0A23C48"><enum>(b)</enum><header>Specifications</header><paragraph commented="no" id="H17444C25AA5641AE9352A84A24E06EEA"><enum>(1)</enum><header>Cost</header><text display-inline="yes-display-inline">The amount of a partial system rebate provided under this section shall, except as provided in section 206, not exceed 30 percent of cost of the purchase and installation of insulation and air sealing under subsection (a)(1), or the purchase and installation of insulation and air sealing and replacement of an HVAC system, the heating component of an HVAC system, or the cooling component of an HVAC system, under subsection (a)(2). Labor may be included in such cost but may not exceed—</text><subparagraph commented="no" id="H0C8D83E5D1FF4C2E8BDEB9AB96136C3D"><enum>(A)</enum><text>in the case of a rebate under subsection (a)(1), 50 percent of such cost; and</text></subparagraph><subparagraph commented="no" id="H3DF6D3A2E8974E44B907DB2B7DC79FA5"><enum>(B)</enum><text>in the case of a rebate under subsection (a)(2), 25 percent of such cost.</text></subparagraph></paragraph><paragraph commented="no" id="H7587DE05ACF84F8DA0268383839DDA02"><enum>(2)</enum><header>Replacement of an HVAC system, the heating component of an HVAC system, or the cooling component of an HVAC system</header><text display-inline="yes-display-inline">In order to qualify for a partial system rebate described in subsection (a)(2)—</text><subparagraph commented="no" id="H50679A81A95443A3BE3F4A9171EDE552"><enum>(A)</enum><text>any HVAC system, heating component of an HVAC system, or cooling component of an HVAC system installed shall be Energy Star Most Efficient certified;</text></subparagraph><subparagraph commented="no" id="HE3EEB52C6B614EFE90ED59A699CCA63E"><enum>(B)</enum><text display-inline="yes-display-inline">installation of such an HVAC system, the heating component of an HVAC system, or the cooling component of an HVAC system, shall be completed in accordance with standards specified by the Secretary that are at least as stringent as the applicable guidelines of the Air Conditioning Contractors of America that are in effect on the date of enactment of this Act; </text></subparagraph><subparagraph commented="no" id="H27EAA1729FB64763BC8CCBC8AE36AD6C"><enum>(C)</enum><text display-inline="yes-display-inline">if ducts are present, replacement of an HVAC system, the heating component of an HVAC system, or the cooling component of an HVAC system shall include duct sealing; and </text></subparagraph><subparagraph commented="no" id="HB6D1546F42294A79AD8CA7D93C800038"><enum>(D)</enum><text display-inline="yes-display-inline">the installation of insulation and air sealing shall occur within 6 months of the replacement of the HVAC system, the heating component of an HVAC system, or the cooling component of an HVAC system.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H65013DE53DD547AC8840BA027D2F9DDF"><enum>(c)</enum><header>Additional incentives for contractors</header><text display-inline="yes-display-inline">In carrying out the Home Energy Savings Retrofit Rebate Program, the Secretary may provide a $250 payment to a contractor per home for which—</text><paragraph commented="no" id="HF78BEB668A4C49498F1FA6966D781DCB"><enum>(1)</enum><text display-inline="yes-display-inline">a partial system rebate is provided under this section for the installation of insulation and air sealing, or installation of insulation and air sealing and replacement of an HVAC system, the heating component of an HVAC system, or the cooling component of an HVAC system, by the contractor;</text></paragraph><paragraph commented="no" id="H79E6F16DB76E4805863FC737973558C8"><enum>(2)</enum><text>the applicable homeowner has signed and submitted to the Secretary a release form made available pursuant to section 210(b) authorizing the contractor access, in accordance with guidelines established under section 208(b), to information in the utility bills of the homeowner; and</text></paragraph><paragraph commented="no" id="H00639D8F2B2E455B8244238C78303048"><enum>(3)</enum><text display-inline="yes-display-inline">the contractor inputs, into the Department of Energy’s Building Performance Database or a State database that has an agreement with the Department of Energy—</text><subparagraph commented="no" id="H06C4C43DE9B14D4C9425A1E71567DC81"><enum>(A)</enum><text display-inline="yes-display-inline">the energy usage for the home for the 13 months preceding, and the 24 months following, the installation of insulation and air sealing or installation of insulation and air sealing and replacement of an HVAC system, the heating component of an HVAC system, or the cooling component of an HVAC system;</text></subparagraph><subparagraph commented="no" id="H030F88E747B148A685856D8790C27748"><enum>(B)</enum><text>a description of such installation or installation and replacement; and</text></subparagraph><subparagraph commented="no" id="HF29A2A00A4A04B28ABC0062DED5D887B"><enum>(C)</enum><text>the total cost to the homeowner for such installation or installation and replacement.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H502C024902404F489362899DB77125A8"><enum>(d)</enum><header>Process</header><paragraph commented="no" id="HDF83642EA286432893BB5609FF4F47AC"><enum>(1)</enum><header>Forms; rebate processing system</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary, in consultation with the Secretary of the Treasury, shall—</text><subparagraph commented="no" id="H14CF20FDFCDE4822A44800D3D9274D4F"><enum>(A)</enum><text display-inline="yes-display-inline">develop and make available rebate forms required to receive a partial system rebate under this section;</text></subparagraph><subparagraph commented="no" id="H11F14624DD144BCC93F4E072AA68B865"><enum>(B)</enum><text>establish a Federal rebate processing system which shall serve as a database and information technology system that will allow homeowners to submit required rebate forms; and</text></subparagraph><subparagraph commented="no" id="HD35AC307B093469BBD93CBF63DCF9718"><enum>(C)</enum><text>establish a website that provides information on partial system rebates provided under this section, including how to determine whether particular measures qualify for a rebate under this section and how to receive such a rebate.</text></subparagraph></paragraph><paragraph commented="no" id="HAC914415055A4880B674B79B2640595D"><enum>(2)</enum><header>Submission of forms</header><text>In order to receive a partial system rebate under this section, a homeowner shall submit the required rebate forms, and any other information the Secretary determines appropriate, to the Federal rebate processing system established pursuant to paragraph (1).</text></paragraph></subsection><subsection commented="no" id="H14E151E678EE46EE89B4D6E89254B381"><enum>(e)</enum><header>Funding</header><paragraph commented="no" id="HDB1F651ACF5D497F8885C5FA1F63FE42"><enum>(1)</enum><header>Limitation</header><text>For each fiscal year, the Secretary may not use more than 40 percent of the amounts made available to carry out this title to carry out this section.</text></paragraph><paragraph commented="no" id="H56C3EABA7BE04F87A1CDAACDE1A4C817"><enum>(2)</enum><header>Allocation</header><text display-inline="yes-display-inline">The Secretary shall, to the extent practicable, allocate amounts made available to carry out this section for partial system rebates among the States using the same formula as is used to allocate funds for States under part D of title III of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6321">42 U.S.C. 6321</external-xref> et seq.). </text></paragraph></subsection></section><section commented="no" id="H4DE92D55DC85491B856635204907F6E0"><enum>203.</enum><header>State administered rebates for home energy efficiency retrofits</header><subsection commented="no" id="H40E410999D4D4DCA8EFDA7226711BC30"><enum>(a)</enum><header>Funding</header><text display-inline="yes-display-inline">In carrying out the Home Energy Savings Retrofit Rebate Program, and subject to the availability of appropriations for such purpose, the Secretary shall provide grants to States to carry out programs to provide rebates for home energy efficiency retrofits in accordance with this section. </text></subsection><subsection commented="no" id="HDF0852A4CAAA423BB4B072E41E58C794"><enum>(b)</enum><header>State participation</header><paragraph commented="no" id="HFE8D0494CF864E9A8FAEE53ED3674CE6"><enum>(1)</enum><header>Plan</header><text display-inline="yes-display-inline">In order to receive a grant under this section a State shall submit to the Secretary an application that includes a plan to implement a State program that meets the minimum criteria under subsection (c). </text></paragraph><paragraph commented="no" id="H13FBAC4DDB594E00B6E3E917B3C2D887"><enum>(2)</enum><header>Approval</header><text>Not later than 60 days after receipt of a completed application for a grant under this section, the Secretary shall either approve the application or provide to the applicant an explanation for denying the application.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA65F297E153B4D978EFDFBFC70F49588"><enum>(c)</enum><header>Minimum criteria for State programs</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Secretary shall establish and publish minimum criteria for a State program to meet to qualify for funding under this section, including—</text><paragraph commented="no" id="H6C5D2B28D3064E1782FA5F533EE357CC"><enum>(1)</enum><text>that the State program be carried out by the applicable State energy office or its designee;</text></paragraph><paragraph commented="no" id="H742142A6CAD149AE9E90B02158590644"><enum>(2)</enum><text>that a rebate be provided under a State program only for a home energy efficiency retrofit that—</text><subparagraph commented="no" id="H12D09902DC214DBB8319958D7910E10F"><enum>(A)</enum><text>is completed by a contractor who meets minimum training requirements, certification requirements, and other requirements established by the Secretary; </text></subparagraph><subparagraph commented="no" id="H81D82DAB1E7B4B459AB9CBB8B1F91BDE"><enum>(B)</enum><text>includes installation of one or more home energy efficiency retrofit measures that together are modeled to achieve, or are shown to achieve, the minimum reduction required under this section—</text><clause commented="no" id="HA9B1EDFF10334E8ABD90E0B35301B94B"><enum>(i)</enum><text>in home energy use; or</text></clause><clause commented="no" id="HF41B28BF9A4646348A24074A6A3DF062"><enum>(ii)</enum><text>with respect to a portfolio of home energy efficiency retrofits, in aggregated home energy use for such portfolio;</text></clause></subparagraph><subparagraph commented="no" id="H07658A8BEE3141A4BFA3B7A9378FD6B6"><enum>(C)</enum><text display-inline="yes-display-inline">does not include installation of any measure that the Secretary determines does not improve whole building energy performance of the home, such as a pool pump, pool heater, or spa; and </text></subparagraph><subparagraph commented="no" id="HE0964D0781A942B0AAE31C19D3C59814"><enum>(D)</enum><text>includes, after installation of the applicable home energy efficiency retrofit measures, a test-out procedure conducted in accordance with guidelines issued by the Secretary of such measures to ensure—</text><clause commented="no" id="H9C5B713923CC42D9896CA319E67555B5"><enum>(i)</enum><text>the safe operation of all systems post retrofit; and</text></clause><clause commented="no" id="HBA376113A0F24E279FFCDCD14F8215FC"><enum>(ii)</enum><text>that all improvements are included in, and have been installed according to—</text><subclause commented="no" id="H1C294CCB9E2F46769DEEF35E1CAD7EB4"><enum>(I)</enum><text>manufacturers’ installation specifications; and</text></subclause><subclause commented="no" id="HD8DB33D718BB45BC914D07F6FADC5D87"><enum>(II)</enum><text>all applicable State and local codes or equivalent standards approved by the Secretary;</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="HEAA39229AB3140E0AA11BC8A495C8095"><enum>(3)</enum><text>that the State program utilize—</text><subparagraph commented="no" id="H3DEEA95FBEEC4ECE874C6CC28929B2D7"><enum>(A)</enum><text>for purposes of modeled performance home rebates, modeling software, methods, and procedures—</text><clause commented="no" id="HFA2458D5240C4D0D95FBF26DB077DD5C"><enum>(i)</enum><text> for determining and documenting the reductions in home energy use resulting from the implementation of a home energy efficiency retrofit that can be calibrated to historical energy usage for a home consistent with BPI 2400; </text></clause><clause commented="no" id="HA4053D63FDC243DF95417FBA1352BD4F"><enum>(ii)</enum><text>that are approved by the Secretary;</text></clause><clause commented="no" id="H9D7A64BF8ACF46F9B83F4713BB0E00FF"><enum>(iii)</enum><text>that can provide evidence for necessary improvements to a State program; and</text></clause><clause commented="no" id="H43FB40160F274BDB83B71256963BD05E"><enum>(iv)</enum><text>that can help to calibrate models for accuracy; </text></clause></subparagraph><subparagraph commented="no" id="HF94C27F6B17F41F18BA56A98F1AEBEF7"><enum>(B)</enum><text display-inline="yes-display-inline">for purposes of measured performance home rebates, methods and procedures approved by the Secretary for determining and documenting—</text><clause commented="no" id="H8AC51024EE7C466EA48BCD6F59FAD2E0"><enum>(i)</enum><text display-inline="yes-display-inline">the monthly and hourly (if available) weather-normalized baseline energy use of a home; and </text></clause><clause id="H944E2044F19B4A5C8B703D91DA43BEA7"><enum>(ii)</enum><text display-inline="yes-display-inline">the reductions in monthly and hourly (if available) weather-normalized energy use of a home resulting from the implementation of a home energy efficiency retrofit; and</text></clause></subparagraph><subparagraph commented="no" id="H3F73328040D74CFABA302E288FCC728F"><enum>(C)</enum><text>open-source advanced measurement and verification software approved by the Secretary;</text></subparagraph></paragraph><paragraph commented="no" id="H9B9D0B9022514D99B34D6A5CFE20D309"><enum>(4)</enum><text display-inline="yes-display-inline">that the State program include implementation of a quality assurance program—</text><subparagraph commented="no" id="H147CB4D4C795437BB99BE7907C5856A8"><enum>(A)</enum><text>to ensure that home energy efficiency retrofits are achieving the stated level of energy savings, that efficiency measures were installed correctly, and that work is performed in accordance with procedures developed by the Secretary, including through quality-control inspections for a portion of home energy efficiency retrofits completed by each applicable contractor; and</text></subparagraph><subparagraph commented="no" id="H7A27EE14B43443F8AA3BE3E34ECC0CD4"><enum>(B)</enum><text>under which a quality-control inspection of a home energy efficiency retrofit is performed by a quality assurance provider who—</text><clause commented="no" id="H35EEAC1765114312AA9AEBFF537765D7"><enum>(i)</enum><text display-inline="yes-display-inline"> is independent of the contractor for such retrofit; and</text></clause><clause commented="no" id="H013C97658E0445FB877FD19F289C116B"><enum>(ii)</enum><text display-inline="yes-display-inline">will confirm that such contractor is a contractor who meets the minimum requirements described in paragraph (2);</text></clause></subparagraph></paragraph><paragraph commented="no" id="HA92E826DA2BA448DB0A2F0D12F037484"><enum>(5)</enum><text display-inline="yes-display-inline">that, if the State program will provide measured performance home rebates, the State program—</text><subparagraph commented="no" id="H5CC48387AF224D37955C12C895AA626C"><enum>(A)</enum><text display-inline="yes-display-inline">only provide such a measured performance home rebate with respect to a home energy efficiency retrofit after collecting at least 13 months of data on home energy usage after completion of such retrofit;</text></subparagraph><subparagraph commented="no" id="HC3DCFEB357BB4C42B83AF6828EC300A3"><enum>(B)</enum><text display-inline="yes-display-inline">establish and utilize, in accordance with guidance issued by the Secretary, a maximum fractional savings uncertainty for any portfolio of home energy efficiency retrofits; and</text></subparagraph><subparagraph commented="no" id="H5BB37BCF644D4510B6DA45E837D4A6BA"><enum>(C)</enum><text display-inline="yes-display-inline">publicly report annual aggregated reductions in home energy use for homes for which measured performance home rebates are provided;</text></subparagraph></paragraph><paragraph commented="no" id="HB5A8B6AABC494D769E56963F8CC02B3E"><enum>(6)</enum><text>that the State program include procedures for a homeowner to transfer the right to claim a rebate to the contractor performing the applicable home energy efficiency retrofit or to an aggregator, if the State program will utilize aggregators;</text></paragraph><paragraph commented="no" id="HEB1B50B923B24A6D99F7456E1E45B813"><enum>(7)</enum><text display-inline="yes-display-inline">that if the State program will utilize aggregators to facilitate delivery of rebates to homeowners or contractors, that the State program include requirements for an entity to be eligible to serve as an aggregator;</text></paragraph><paragraph commented="no" id="H7F960ED0966B478BB1A5EB30ECB694C6"><enum>(8)</enum><text display-inline="yes-display-inline">that the State program include requirements for a homeowner, contractor, or aggregator to claim a rebate, including that the homeowner, contractor, or aggregator submit to the State any applicable forms that are approved by the Secretary, including a copy of the certificate provided by the applicable contractor certifying projected or measured reduction of home energy use; </text></paragraph><paragraph commented="no" id="HB4E769209C82413799185E862AD16400"><enum>(9)</enum><text display-inline="yes-display-inline">that the State program provide that a homeowner, contractor, or aggregator may claim more than one rebate under the State program, and may claim a rebate under the State program after receiving a partial system rebate under section 202, provided that no 2 rebates may be provided with respect to a home using the same baseline energy use of such home; and</text></paragraph><paragraph id="H909B0F26BEE8413C82046F059334E676"><enum>(10)</enum><text display-inline="yes-display-inline">that the State program include a procedure for providing, with respect to each home located in an underserved community that receives a home energy efficiency retrofit for which a rebate is provided under the program, the contractor performing such home energy efficiency retrofit, or an aggregator who has the right to claim such rebate, $200.</text></paragraph></subsection><subsection commented="no" id="H2119E847026640B8BB1F59069C43F5A2"><enum>(d)</enum><header>Modeled performance home rebates</header><paragraph commented="no" id="H6B20CE39D7DA415CBE7BDAD1E238B2EF"><enum>(1)</enum><header>In general</header><text>In carrying out a State program under this section, a State may provide a homeowner, contractor, or aggregator a rebate, to be known as a modeled performance home rebate, for an energy audit of a home and a home energy efficiency retrofit that is projected, using modeling software approved by the Secretary, to reduce home energy use by at least 20 percent.</text></paragraph><paragraph commented="no" id="HD751AE89034B45529F8DF0EA7C53E109"><enum>(2)</enum><header>Amount</header><subparagraph commented="no" id="H17DDF6C196724D8399B645F4F2C8B26B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in section 206, and subject to subparagraph (B), the amount of a modeled performance home rebate provided under a State program shall be equal to not more than 50 percent of the cost of the applicable energy audit of a home and home energy efficiency retrofit, including the cost of diagnostic procedures, labor, reporting, and modeling.</text></subparagraph><subparagraph commented="no" id="HE698AD0D179244E3B79F8A0A1FDE4D33"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">Except as provided in section 206, with respect to an energy audit and home energy efficiency retrofit that is projected to reduce home energy use by— </text><clause commented="no" id="H08D09D6160F64CFFAF1A7A90F532189F"><enum>(i)</enum><text display-inline="yes-display-inline">at least 20 percent, but less than 35 percent, the maximum amount of a modeled performance home rebate shall be $2,000; and</text></clause><clause commented="no" id="HA6AECD6CF80C4DE9B7D045FE1F48F94A"><enum>(ii)</enum><text>at least 35 percent, the maximum amount of a modeled performance home rebate shall be $4,000.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H6A642F62693E4D89910924C4C7289BFF"><enum>(e)</enum><header>Measured performance home rebates</header><paragraph commented="no" id="HA1093CF0B1714EEE9434EF9209ACA3DF"><enum>(1)</enum><header>In general</header><subparagraph id="HC3CD01C1FF4345D1A5795C59E5396AD6"><enum>(A)</enum><header>Minimum reduction in home energy use</header><text>In carrying out a State program under this section, a State may provide a homeowner, contractor, or an aggregator a rebate, to be known as a measured performance home rebate, for a home energy efficiency retrofit, or portfolio of home energy efficiency retrofits, where—</text><clause commented="no" id="H60F0183DC4E04DC3B91392121F82C0FE"><enum>(i)</enum><text>for a home energy efficiency retrofit that is not part of a portfolio, there is reduction in home energy use of at least 15 percent; and</text></clause><clause commented="no" id="HB2FC074BC0604F77A6321EC078893A19"><enum>(ii)</enum><text display-inline="yes-display-inline">for home energy efficiency retrofits that are part of a portfolio, there is an aggregate reduction in home energy use of at least 15 percent.</text></clause></subparagraph><subparagraph id="HB5B1EECC30434FA09DA2784F9CEA0EB7"><enum>(B)</enum><header>Measured reduction</header><text>For purposes of a measured performance home rebate, reductions in home energy use shall be measured—</text><clause id="H64894BEB97E34769AD322CF668A13F6E"><enum>(i)</enum><text>at the meter; </text></clause><clause id="H068FEFA48AD6472B805197C192EBA615"><enum>(ii)</enum><text>in terms of reductions in kilowatt hour, or kilowatt hour-equivalent, use; and</text></clause><clause id="H506C1B1866A34880943BE303ECF2FCB2"><enum>(iii)</enum><text>using methods and procedures approved by the Secretary.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H7519E14AF5394D8FBDC9C242B606E7B9"><enum>(2)</enum><header>Amount</header><text display-inline="yes-display-inline">Except as provided in section 206—</text><subparagraph commented="no" id="H27B99C8ED69B47AA9935D68B1306D424"><enum>(A)</enum><text>in the case of a home energy efficiency retrofit—</text><clause commented="no" id="HB42F46B011C94CAE8D3144AA99A6E9F3"><enum>(i)</enum><text display-inline="yes-display-inline">that is not part of a portfolio, the amount of a measured performance home rebate provided under a State program shall be not more than 50 percent of the direct costs of the home energy efficiency retrofit to the homeowner; and</text></clause><clause commented="no" id="H77F74825C6E944BCBB4788F963D81F15"><enum>(ii)</enum><text display-inline="yes-display-inline">that is part of a portfolio, the aggregated amount for measured performance home rebates provided for such portfolio under a State program shall be not more than 50 percent of the aggregated direct costs of the home energy efficiency retrofits that are part of the portfolio;</text></clause></subparagraph><subparagraph commented="no" id="H0C3154308D784362AB2F83F627842544"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of a measured performance home rebate provided under a State program shall be determined—</text><clause commented="no" id="H83706A4E4EF2478D9A1257CB4ABEFD30"><enum>(i)</enum><text>in the case of a home energy efficiency retrofit that is not part of a portfolio, based on the amount that home energy use for the home is reduced, provided such reduction is at least 15 percent; and</text></clause><clause commented="no" id="H9C01C46AE5C34ACD81ED9400039D8D1A"><enum>(ii)</enum><text>in the case of a home energy efficiency retrofit that is part of a portfolio, based on the amount that home energy use for the home is reduced, regardless of whether such reduction is at least 15 percent; and </text></clause></subparagraph><subparagraph commented="no" id="H50913DE75E274C398E09C34C2F70C926"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of a measured performance home rebate provided under a State program shall be determined using a payment rate per kilowatt hour or kilowatt hour-equivalent of reduction in home energy use that is—</text><clause commented="no" id="H9558D2A82E5149D089A8EC859330E99B"><enum>(i)</enum><text>established by the State energy office and approved by the Secretary; and</text></clause><clause commented="no" id="H2AFA0B3E27A44CF2A0B5F8DBA37CB0D9"><enum>(ii)</enum><text>not more than a payment rate that would equal, for a 20 percent reduction in average home energy use, based on State energy data, a rebate of not more than $2000.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H94CE7A74AD9C432BB1CBEF6E8C605CCD"><enum>(f)</enum><header>Oversight</header><text display-inline="yes-display-inline">If the Secretary determines that a State is not implementing a State program that was approved pursuant to subsection (b) and that meets the minimum criteria under subsection (c), the Secretary may, after providing the State a period of at least 90 days to meet such criteria, withhold grant funds under this section from the State.</text></subsection><subsection id="HA5A87CC60DFB4A79B5F20ECF670873BE"><enum>(g)</enum><header>Administrative expenses</header><text>A State may use up to 10 percent of a grant received under this section for the costs of administering a State program approved pursuant to subsection (b) and that meets the minimum criteria under subsection (c). </text></subsection></section><section id="H3D4B110C86CB40EBA32FCF8EBAEC03C1"><enum>204.</enum><header>State administered rebates for reductions in home energy use not measured by meters</header><subsection commented="no" id="H95FF1571FEFF4B86B099BDA6409EE3E2"><enum>(a)</enum><header>Funding</header><text display-inline="yes-display-inline">In carrying out the Home Energy Savings Retrofit Rebate Program, and subject to the availability of appropriations for such purpose, the Secretary shall provide grants to States to carry out programs that to provide rebates in accordance with this section for home energy efficiency retrofits for which the reductions in home energy use are not able to be modeled or measured in a manner that would qualify for a rebate under section 203.</text></subsection><subsection commented="no" id="H5D1EBD85B52A4C339CBD2CA8F2AE29D1"><enum>(b)</enum><header>State participation</header><paragraph commented="no" id="H5E7C75BE0A3847539754091483D0A5B6"><enum>(1)</enum><header>Plan</header><text display-inline="yes-display-inline">In order to receive a grant under this section a State shall submit to the Secretary an application that includes a plan to implement a State program that meets the minimum criteria under subsection (c). </text></paragraph><paragraph commented="no" id="H444432D1FABB40FF95A69717FA2BA9D4"><enum>(2)</enum><header>Approval</header><text>Not later than 60 days after receipt of a completed application for a grant under this section, the Secretary shall either approve the application or provide to the applicant an explanation for denying the application.</text></paragraph></subsection><subsection commented="no" id="HA76061FF7D344D3D857753FCF65BB79B"><enum>(c)</enum><header>Criteria</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall establish and publish minimum criteria for a State program to meet to qualify for funding under this section, including—</text><paragraph commented="no" id="H02A2DF309A904018B61C4EA7721A6C34"><enum>(1)</enum><text display-inline="yes-display-inline">that the State program be carried out by the applicable State energy office or a designee with an established history carrying out data-driven, evaluated, and verified programs;</text></paragraph><paragraph commented="no" id="H0AD6479E90C74AAD8DD8753EB3D8EAB2"><enum>(2)</enum><text>that a rebate be provided under a State program only for a home energy efficiency retrofit that—</text><subparagraph commented="no" id="HB32738A6E46C4F7A8D2DE60ECEE32412"><enum>(A)</enum><text display-inline="yes-display-inline">is completed by a contractor who meets minimum training requirements, certification requirements, and other requirements established by the Secretary; </text></subparagraph><subparagraph commented="no" id="HEA7B72E48AD1456B9D25059F789E6A79"><enum>(B)</enum><text display-inline="yes-display-inline">includes installation of one or more home energy efficiency retrofit measures for a home that together are shown to achieve, a minimum of a 20 percent reduction in home energy use from the baseline energy use of the home, where such energy use is not measured through a meter;</text></subparagraph><subparagraph commented="no" id="HA8F22C5166844352B85EDC70223BFE47"><enum>(C)</enum><text display-inline="yes-display-inline">does not include installation of any measure that the Secretary determines does not improve whole building energy performance of the home, such as a pool pump, pool heater, or spa; and</text></subparagraph><subparagraph commented="no" id="HE7FE25F0C20D4926AF522FE3D9116B1D"><enum>(D)</enum><text display-inline="yes-display-inline">includes, after installation of the applicable home energy efficiency retrofit measures, a test-out procedure conducted in accordance with guidelines issued by the Secretary of such measures to ensure—</text><clause commented="no" id="H5045E4E648E443B19585D29C774CC99F"><enum>(i)</enum><text>the safe operation of all systems post retrofit; and</text></clause><clause commented="no" id="H013340E7FA434D32883704E277A20238"><enum>(ii)</enum><text>that all improvements are included in, and have been installed according to—</text><subclause commented="no" id="HCD3B169ACE2747F89E504CE791156460"><enum>(I)</enum><text>manufacturers’ installation specifications; and</text></subclause><subclause commented="no" id="H1D997F4F62CD4A6C8F4518C7E231D3C7"><enum>(II)</enum><text>all applicable State and local codes or equivalent standards approved by the Secretary;</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H9AC6242066A447CB82772590DE96CAE7"><enum>(3)</enum><text>that the State program utilize methods and procedures approved by the Secretary for determining and documenting—</text><subparagraph commented="no" id="H3EF606E0F08F4403A2BDB2AF33EF4F21"><enum>(A)</enum><text>the baseline energy use of a home; and</text></subparagraph><subparagraph commented="no" id="HDB02FBA455264E94A329878305E6CB2C"><enum>(B)</enum><text>the reductions in weather-normalized energy use of a home resulting from the implementation of a home energy efficiency retrofit; and</text></subparagraph></paragraph><paragraph commented="no" id="H0DAB2B5F6CC24C918E7E95B0222886B1"><enum>(4)</enum><text>that the State program provide that a rebate may not be claimed with respect to a home for a home energy efficiency retrofit if a rebate may be provided for such home energy efficiency retrofit under a State program under section 203. </text></paragraph></subsection><subsection id="HBAE63245C81C4CE1A112208AE8DB12A6"><enum>(d)</enum><header>Oversight</header><text display-inline="yes-display-inline">If the Secretary determines that a State is not implementing a State program that was approved pursuant to subsection (b) and that meets the minimum criteria under subsection (c), the Secretary may, after providing the State a period of at least 90 days to meet such criteria, withhold grant funds under this section from the State.</text></subsection><subsection id="H46B46C9B9EC04887A2C4A0B4C7C1F8FC"><enum>(e)</enum><header>Administrative expenses</header><text>A State may use up to 10 percent of a grant received under this section for the costs of administering a State program approved pursuant to subsection (b) and that meets the minimum criteria under subsection (c). </text></subsection></section><section commented="no" id="H85878EE9A0C542219133C8152FDD38A2"><enum>205.</enum><header>State administered rebates for multifamily building energy efficiency retrofits</header><subsection commented="no" id="HE34F687DD7694BFAA275F3ADC43D39DA"><enum>(a)</enum><header>Funding</header><text>In carrying out the Home Energy Savings Retrofit Rebate Program, and subject to the availability of appropriations for such purpose, the Secretary shall provide grants to States to carry out programs to provide rebates for multifamily building energy efficiency retrofits in accordance with this section.</text></subsection><subsection commented="no" id="HF0254661F0B64DF9B7301182227651F6"><enum>(b)</enum><header>State participation</header><paragraph commented="no" id="H1B046368B6CD44D885D5964517435D16"><enum>(1)</enum><header>Plan</header><text>In order to receive a grant under this section a State shall submit to the Secretary an application that includes a plan to implement a State program that meets the minimum criteria under subsection (c).</text></paragraph><paragraph commented="no" id="H182C3C3C5B224C8E8713D182E830F856"><enum>(2)</enum><header>Approval</header><text>Not later than 60 days after receipt of a completed application for a grant under this section, the Secretary shall either approve the application or provide to the applicant an explanation for denying the application.</text></paragraph></subsection><subsection commented="no" id="HE952888411414AE68BAEBB201786E74C"><enum>(c)</enum><header>Minimum criteria for State programs</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall establish and publish minimum criteria for a State program to meet to qualify for funding under this section, including—</text><paragraph commented="no" id="HA9B865AD81384D5CB65CC65A5D4299C0"><enum>(1)</enum><text>that the State program be carried out by the applicable State energy office or its designee;</text></paragraph><paragraph commented="no" id="H7697F07EAEE14858AB9B5BB09163CE1D"><enum>(2)</enum><text>that a rebate be provided under a State program only for a whole-building multifamily building energy efficiency retrofit that—</text><subparagraph commented="no" id="HD2DA98CF059A46F1A7D28F9456D02539"><enum>(A)</enum><text display-inline="yes-display-inline">is completed by a contractor who meets minimum training requirements, certification requirements, and other requirements established by the Secretary; </text></subparagraph><subparagraph commented="no" id="H1360C3762CB4488AA1BD867C6E1F3E55"><enum>(B)</enum><text display-inline="yes-display-inline">includes installation of one or more multifamily building energy efficiency retrofit measures for the multifamily building that are modeled to achieve, or are shown to achieve, the minimum reduction required under this section—</text><clause id="H5D69403F11CB4BAFB19C022A95C9209A"><enum>(i)</enum><text>in whole building energy use; or</text></clause><clause id="H9A0C3F7B5AE44EC097AC80F89B9E6637"><enum>(ii)</enum><text>with respect to a portfolio of multifamily energy efficiency retrofits, in aggregated multifamily building energy use for such portfolio;</text></clause></subparagraph><subparagraph commented="no" id="HE16774DBF3884D2BB3CA125D70508139"><enum>(C)</enum><text>does not include installation of any measure that the Secretary determines does not improve the whole building energy performance of the building, such as a pool pump, pool heater, or spa; and</text></subparagraph><subparagraph commented="no" id="H2E0F1A0282E4418CA03C26461FB9A4E9"><enum>(D)</enum><text>includes, after installation of the applicable whole building energy efficiency retrofit measures, a test-out procedure conducted in accordance with guidelines issued by the Secretary of such measures to ensure—</text><clause commented="no" id="H956BD104DFB04589958809F5A1A7D246"><enum>(i)</enum><text>the safe operation of all systems post-retrofit; and</text></clause><clause commented="no" id="HAD2871A64ED148418244A90EDAC213DB"><enum>(ii)</enum><text>that all improvements are included in, and have been installed according to—</text><subclause commented="no" id="HA6B6721BAB07478AAEFC033A56FE5E7C"><enum>(I)</enum><text>manufacturers’ installation specifications; and</text></subclause><subclause commented="no" id="H89B7812B219549AFADFE2822B41DDCDC"><enum>(II)</enum><text>all applicable State and local codes or equivalent standards approved by the Secretary;</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H904688BC6ACD4E828248D424BEA11C39"><enum>(3)</enum><text>that the State program utilize—</text><subparagraph commented="no" id="H249D61E05BA54EE6925AA30781E22670"><enum>(A)</enum><text display-inline="yes-display-inline">for purposes of modeled performance multifamily building rebates, modeling software, methods, and procedures—</text><clause commented="no" id="H8DAE98A3FEC04EDEA2B9383B1F94DE73"><enum>(i)</enum><text> for determining and documenting the reductions in multifamily building energy use resulting from the implementation of a multifamily building energy efficiency retrofit that can be calibrated to historical energy usage for a multifamily building consistent with BPI 2400; </text></clause><clause commented="no" id="H0535E5EF49C64D549EB642B164F3456D"><enum>(ii)</enum><text>that are approved by the Secretary;</text></clause><clause commented="no" id="HE98B14822A384D9492C0F902BF009B0E"><enum>(iii)</enum><text>that can provide evidence for necessary improvements to a State program; and</text></clause><clause commented="no" id="HD001B3A2428C4851BEE18D7912ADF78B"><enum>(iv)</enum><text>that can help to calibrate models for accuracy; </text></clause></subparagraph><subparagraph commented="no" id="H2046D69332144032A7EEC06276DCF368"><enum>(B)</enum><text display-inline="yes-display-inline">for purposes of measured performance multifamily building rebates, methods and procedures approved by the Secretary for determining and documenting—</text><clause commented="no" id="H5DBA2737670C434A8F7DF3034001AA6E"><enum>(i)</enum><text display-inline="yes-display-inline">the monthly and hourly (if available) weather-normalized baseline energy use of a multifamily building; and </text></clause><clause commented="no" id="HA7AF32D0E27B4C8C9FE4196558B1AAEB"><enum>(ii)</enum><text display-inline="yes-display-inline">the reductions in monthly and hourly (if available) weather-normalized energy use of a multifamily building resulting from the implementation of a multifamily building efficiency retrofit; and</text></clause></subparagraph><subparagraph commented="no" id="H9CEF2C96AFD94A7694F79E4A9E57A815"><enum>(C)</enum><text>open-source advanced measurement and verification software approved by the Secretary;</text></subparagraph></paragraph><paragraph commented="no" id="H02C30C01A86D4BD191913F3DC4EEEEAF"><enum>(4)</enum><text display-inline="yes-display-inline">that the State program include implementation of a quality assurance program—</text><subparagraph commented="no" id="HCAF5FC80D9D6490896F8124CDC3916D8"><enum>(A)</enum><text>to ensure that multifamily building energy efficiency retrofits are achieving the stated level of energy savings, that efficiency measures were installed correctly, and that work is performed in accordance with procedures developed by the Secretary, including through quality-control inspections for a portion of multifamily building energy efficiency retrofits completed by each applicable contractor; and</text></subparagraph><subparagraph commented="no" id="HC425AF73EE44404CB255796CD6D5E7C6"><enum>(B)</enum><text>under which a quality-control inspection of a multifamily building energy efficiency retrofit is performed by a quality assurance provider who—</text><clause commented="no" id="HFEEBC762558F478BA6504D39489A8724"><enum>(i)</enum><text display-inline="yes-display-inline">is independent of the contractor for such retrofit; and</text></clause><clause commented="no" id="H47E52B14923D47E5851424918F374E0D"><enum>(ii)</enum><text display-inline="yes-display-inline">will confirm that such contractor is a contractor who meets the minimum requirements described in paragraph (2);</text></clause></subparagraph></paragraph><paragraph commented="no" id="H0C92FE22345C4A5980E484042A3E5D20"><enum>(5)</enum><text display-inline="yes-display-inline">that, if the State program will provide measured performance multifamily building rebates, the State program—</text><subparagraph commented="no" id="HFA86E403F06C4611BE20B50B52BEFC04"><enum>(A)</enum><text display-inline="yes-display-inline">only provide such a measured performance multifamily building rebate with respect to a multifamily building energy efficiency retrofit after collecting at least 13 months of data on multifamily building energy usage after completion of such retrofit;</text></subparagraph><subparagraph commented="no" id="HD3232A5B4911423AA8522C42AC6EDC7A"><enum>(B)</enum><text display-inline="yes-display-inline">establish and utilize, in accordance with guidance issued by the Secretary, a maximum fractional savings uncertainty for any portfolio of multifamily building energy efficiency retrofits; </text></subparagraph><subparagraph commented="no" id="H5382C8077AD14C2E98B845791FD8C89F"><enum>(C)</enum><text display-inline="yes-display-inline">publicly report annual aggregated reductions in multifamily building energy use for homes for which measured performance multifamily building rebates are provided;</text></subparagraph></paragraph><paragraph commented="no" id="H19EDC112D65A4EB5ACBA525D0E175F79"><enum>(6)</enum><text>that the State program include requirements for a multifamily building owner, contractor, or aggregator to claim a rebate, including that the building owner, contractor, or aggregator submit to the State any applicable forms approved by the Secretary, including a copy of the certificate provided by the applicable contractor certifying projected or measured reduction of multifamily building energy use;</text></paragraph><paragraph commented="no" id="H760FD47958FB4674AB37C98F6126EB8D"><enum>(7)</enum><text display-inline="yes-display-inline">that the State program include procedures for a multifamily building owner to transfer the right to claim a rebate to the contractor performing the applicable multifamily building energy efficiency retrofit or to an aggregator, if the State program will utilize aggregators;</text></paragraph><paragraph id="HC3A1806BA7734A15AE6FFA5F6E8B3D11"><enum>(8)</enum><text>that if the State program will utilize aggregators to facilitate delivery of rebates to multifamily building owners or contractors, that the State program include requirements for an entity to be eligible to serve as an aggregator;</text></paragraph><paragraph commented="no" id="HF6E5FC54E7ED46EBA8CAE3374D2C603F"><enum>(9)</enum><text display-inline="yes-display-inline">that the State program provide that a multifamily building owner or contractor may claim more than one rebate under the State program, provided that no 2 rebates may be provided with respect to a multifamily building using the same baseline energy use of such multifamily building; and</text></paragraph><paragraph id="H12F6DDCC72764AA3BFE557B54D20E3BC"><enum>(10)</enum><text>that the State program include a procedure for providing, with respect to each multifamily building located in an underserved community that receives a multifamily building energy efficiency retrofit for which a rebate is provided under the program, the contractor performing such multifamily building energy efficiency retrofit, or an aggregator who has the right to claim such rebate, $50 per dwelling unit in the multifamily building. </text></paragraph></subsection><subsection commented="no" id="H23582A44D63E4BCF9AE01323B5AE0263"><enum>(d)</enum><header>Modeled performance multifamily building rebates</header><paragraph commented="no" id="H0A79F65358AA4825B9FDF22BAAA3CEA9"><enum>(1)</enum><header>In general</header><text>In carrying out a State program under this section, a State may provide a building owner or contractor a rebate, to be known as a modeled performance multifamily building rebate, for an energy audit of a multifamily building and a multifamily building energy efficiency retrofit that is projected, using modeling software approved by the Secretary, to reduce whole building energy use by at least 20 percent.</text></paragraph><paragraph commented="no" id="H0070F92974E84BA19D8175EADFE45A2B"><enum>(2)</enum><header>Amount</header><subparagraph commented="no" id="H811B160356FD4B62AB9B84649D26A78C"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in section 206 and subject to subparagraph (B), the amount of a modeled performance multifamily building rebate provided under a State program shall be equal to not more than 50 percent of the cost of the applicable energy audit of a multifamily building and multifamily building energy efficiency retrofit, including the cost of diagnostic procedures, labor, reporting, and modeling.</text></subparagraph><subparagraph commented="no" id="HC7FC971A6F0949139AF82C0B15C92A33"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">Except as provided in section 206, with respect to an energy audit and multifamily building energy efficiency retrofit that is projected to reduce multifamily building energy use by—</text><clause commented="no" id="H0D36268CFA0A42E8BF7C9FF07FC4B48A"><enum>(i)</enum><text display-inline="yes-display-inline">at least 20 percent, but less than 35 percent, the maximum amount of a modeled performance multifamily building rebate shall be $2,000 per dwelling unit in the multifamily building, up to a maximum of $200,000 per multifamily building or per complex, if such complex consists of multiple adjacent multifamily buildings owned by the same entity; and</text></clause><clause commented="no" id="HF6412F7D81F441BC9F3F15FDB6AB69C8"><enum>(ii)</enum><text display-inline="yes-display-inline">at least 35 percent, the maximum amount of a modeled performance multifamily building rebate shall be $4,000 per dwelling unit in the multifamily building, up to a maximum of $400,000 per multifamily building or per complex, if such complex consists of multiple adjacent multifamily buildings owned by the same entity.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H7A602CA12C164E7295639F441A2D2099"><enum>(e)</enum><header>Measured performance multifamily building rebates</header><paragraph commented="no" id="HFF9AB923C8A74D87B120C954B4EC9936"><enum>(1)</enum><header>In general</header><subparagraph id="H8F7761048CB74EF98E44C44467B8FBFD"><enum>(A)</enum><header>Minimum reduction in multifamily building energy use</header><text>In carrying out a State program under this section, a State may provide a building owner, contractor, or aggregator a rebate, to be known as a measured performance multifamily building rebate, for a multifamily building energy efficiency retrofit, or portfolio of multifamily energy efficiency retrofits, where—</text><clause commented="no" id="H305234CF0E044F92A792C0C4C7F87EC9"><enum>(i)</enum><text>for a multifamily building energy efficiency retrofit that is not part of a portfolio, there is reduction in multifamily building energy use of at least 15 percent; and</text></clause><clause commented="no" id="H54AF572F490945A890067CB2D2C7E4E6"><enum>(ii)</enum><text display-inline="yes-display-inline">for multifamily building energy efficiency retrofits that are part of a portfolio, there is an aggregate reduction in multifamily building energy use of at least 15 percent.</text></clause></subparagraph><subparagraph id="HAD67A20F3EBB4591A41A69739516AAE8"><enum>(B)</enum><header>Measured reduction</header><text>For purposes of a measured performance multifamily building rebate, reductions in multifamily building energy use shall be measured—</text><clause id="H940F6C95319D40EFAEAC11577018A580"><enum>(i)</enum><text>at the meter; </text></clause><clause id="H56FD468D40F44664965C38E547A26191"><enum>(ii)</enum><text>in terms of reductions in kilowatt hour, or kilowatt hour-equivalent, use; and</text></clause><clause id="H88AA5CBE91214CDAAA7307E6A35705BA"><enum>(iii)</enum><text>using methods and procedures approved by the Secretary.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H1B837FB6B3774191A343A93D5D0A72E2"><enum>(2)</enum><header>Amount</header><text display-inline="yes-display-inline">Except as provided in section 206—</text><subparagraph commented="no" id="H4F68083C3BCB4316AE28E73614ACF940"><enum>(A)</enum><text>in the case of a multifamily building energy efficiency retrofit—</text><clause commented="no" id="H7C54E2AEB0504F34879F33783A5616FA"><enum>(i)</enum><text>that is not part of a portfolio, the amount of a measured performance multifamily building rebate provided under a State program shall be not more than 50 percent of the direct costs of the multifamily building energy efficiency retrofit to the owner; and</text></clause><clause commented="no" id="HCF98BAD87E61412FA0DE92AE36A1C97C"><enum>(ii)</enum><text display-inline="yes-display-inline">that is part of a portfolio, the aggregated amount for measured performance multifamily building rebates provided for such portfolio under a State program shall be not more than 50 percent of the aggregated direct costs of the multifamily building energy efficiency retrofits that are part of the portfolio; </text></clause></subparagraph><subparagraph commented="no" id="H8A7FD6E18E114D139F552A99E3A93778"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of a measured performance multifamily building rebate provided under a State program shall be determined—</text><clause commented="no" id="H0804EF059770413B855095D0E915DBEE"><enum>(i)</enum><text>in the case of a multifamily building energy efficiency retrofit that is not part of a portfolio, based on the amount that energy use for the multifamily building is reduced, provided such reduction is at least 15 percent; and</text></clause><clause commented="no" id="H57FADEF2D1CB4D1FAB4DBEF3C10518BA"><enum>(ii)</enum><text>in the case of a multifamily building energy efficiency retrofit that is part of a portfolio, based on the amount that energy use for the multifamily building is reduced, regardless of whether such reduction is at least 15 percent; and </text></clause></subparagraph><subparagraph commented="no" id="HB7BDA79F92D74EDF89389008E1409F1F"><enum>(C)</enum><text display-inline="yes-display-inline">the amount of a measured performance multifamily building rebate provided under a State program shall be determined using a payment rate per kilowatt hour or kilowatt hour-equivalent of reduction in multifamily building energy use that is—</text><clause commented="no" id="H5284B87E75E8495FA44822459AC50E46"><enum>(i)</enum><text>established by the State energy office and approved by the Secretary; and</text></clause><clause commented="no" id="HEC014058633648A787A1E11427421E71"><enum>(ii)</enum><text display-inline="yes-display-inline">not more than a payment rate that would equal, for a 20 percent reduction in average multifamily building energy use, based on State energy data, a rebate of not more than $2000 per dwelling unit in the multifamily building.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H8DA34A457E0F447FBC027FDCE90D3F66"><enum>(f)</enum><header>Oversight</header><text>If the Secretary determines that a State is not implementing a State program that was approved pursuant to subsection (b) and that meets the minimum criteria under subsection (c), the Secretary may, after providing the State a period of at least 90 days to meet such criteria, withhold grant funds under this section from the State.</text></subsection><subsection commented="no" id="HB7BDF9CC071F485FA72A0047488A4835"><enum>(g)</enum><header>Administrative expenses</header><text>A State may use up to 10 percent of a grant received under this section for the costs of administering a State program approved pursuant to subsection (b) and that meets the minimum criteria under subsection (c). </text></subsection><subsection commented="no" id="H908BED123AAD415BB718E64B56E78728"><enum>(h)</enum><header>Contracting requirements</header><text display-inline="yes-display-inline">The minimum requirements described in subsection (c)(2) for contractors shall include a requirement that a contractor certify that all laborers and mechanics employed by the contractor or subcontractor thereof in the performance of construction, alteration, or repair work for which a rebate is provided under a State program under this section shall be paid wages at rates not less than those prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code. With respect to the labor standards in this subsection, the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code. </text></subsection></section><section commented="no" id="HE58D66B2892E4FEBBF7F5FA3F7D5EC97"><enum>206.</enum><header>Special provisions for moderate income households and multifamily buildings</header><subsection commented="no" id="H08D755D9A4734349BE8F18D174048773"><enum>(a)</enum><header>Certifications</header><text display-inline="yes-display-inline">The Secretary shall establish procedures for certifying as moderate income for purposes of this section—</text><paragraph id="HCB18A8DC79D74BFCB67D603E9BBB1DF8"><enum>(1)</enum><text>the household of a homeowner; or</text></paragraph><paragraph commented="no" id="H23987F34744D4C23AA5DDDCBC7A15560"><enum>(2)</enum><text>a multifamily building.</text></paragraph></subsection><subsection commented="no" id="HEADA7988C0A4485581575796BDD8D6DF"><enum>(b)</enum><header>Percentages</header><text display-inline="yes-display-inline">Subject to subsection (c), for households of homeowners and multifamily buildings that are certified pursuant to the procedures established under subsection (a) as moderate income the—</text><paragraph commented="no" id="HCB08F66FD96D456D906DF97A2C5044BC"><enum>(1)</enum><text display-inline="yes-display-inline">amount of a partial system rebate under section 202 shall not exceed 60 percent of the applicable purchase and installation and replacement costs described in section 202(b)(1); and</text></paragraph><paragraph commented="no" id="HB28B44D59120453A8C14E4F2E46B95F7"><enum>(2)</enum><text display-inline="yes-display-inline">amount of—</text><subparagraph commented="no" id="HF668868DB67C43C78599BED4B7E9EA96"><enum>(A)</enum><text>a modeled performance home rebate provided under section 203 shall be not more than 80 percent of the applicable costs described in section 203(d)(2)(A);</text></subparagraph><subparagraph commented="no" id="HC9C3BEEC155A4313AC4D8FE2E00A5FCA"><enum>(B)</enum><text>a modeled performance multifamily building rebate provided under section 205 shall be not more than 80 percent of the applicable costs described in section 205(d)(2)(A);</text></subparagraph><subparagraph commented="no" id="H62418BB2CDF04ECCBDFC3D14A5C00AC2"><enum>(C)</enum><text display-inline="yes-display-inline">a measured performance home rebate provided under section 203 shall be not more than 80 percent of the applicable costs described in section 203(e)(2)(A); and</text></subparagraph><subparagraph commented="no" id="HF9C5B8A5CD1E401AB9AE7FB150158B1E"><enum>(D)</enum><text>a measured performance multifamily building rebate provided under section 205 shall be not more than 80 percent of the applicable costs described in section 205(e)(2)(A).</text></subparagraph></paragraph></subsection><subsection commented="no" id="H0A12D5335D984673B1FA190F871FCDC5"><enum>(c)</enum><header>Maximum amounts</header><paragraph commented="no" id="H16E07B61FE33428AB1C8B03F93C52264"><enum>(1)</enum><header>Partial system rebates</header><text display-inline="yes-display-inline">For households of homeowners that are certified pursuant to the procedures established under subsection (a) as moderate income, the maximum amount of a partial system rebate—</text><subparagraph commented="no" id="H35C85125BCDD4E23A19CA6374BED0F85"><enum>(A)</enum><text>under section 202(a)(1) for the purchase and installation of insulation and air sealing within a home of the homeowner shall be $1,600; </text></subparagraph><subparagraph commented="no" id="HC153922D920D43E28CFECE99AC9BC7EF"><enum>(B)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (C), under section 202(a)(2) for the purchase and installation of insulation and air sealing within a home of the homeowner and replacement of an HVAC system, the heating component of an HVAC system, or the cooling component of an HVAC system, of such home, shall be $3,000; and</text></subparagraph><subparagraph commented="no" id="HAE53D8C15084442CAB7710B71B4F7EC8"><enum>(C)</enum><text display-inline="yes-display-inline">under section 202(a)(2)(B) for the purchase and installation of insulation and air sealing within a home of the homeowner and replacement of the heating component of an HVAC system of such home, where the heating component installed is an air source or ground source heat pump, shall be $5000.</text></subparagraph></paragraph><paragraph commented="no" id="H2AB3FAD713BD441CA1E1B1295D297A14"><enum>(2)</enum><header>Modeled performance home rebate</header><text display-inline="yes-display-inline">For households of homeowners that are certified pursuant to the procedures established under subsection (a) as moderate income, the maximum amount of a modeled performance home rebate under section 203 for an energy audit and home energy efficiency retrofit that is projected to reduce home energy use as described in—</text><subparagraph commented="no" id="HF3A7D6FEA86D44E197CF555C8A9B4EDF"><enum>(A)</enum><text display-inline="yes-display-inline">section 203(d)(2)(B)(i) shall be $4,000; and</text></subparagraph><subparagraph commented="no" id="H3E50696020DE4D119719A309F2440DE5"><enum>(B)</enum><text>section 203(d)(2)(B)(ii) shall be $8,000.</text></subparagraph></paragraph><paragraph commented="no" id="H429ECC6A24D04BC18B361B43AAB034B6"><enum>(3)</enum><header>Modeled performance multifamily building rebate</header><text display-inline="yes-display-inline">For multifamily buildings that are certified pursuant to the procedures established under subsection (a) as moderate income, the maximum amount of a modeled performance multifamily building rebate under section 205 for an energy audit and multifamily building energy efficiency retrofit that is projected to reduce building energy as described in—</text><subparagraph commented="no" id="HA05C7BD0310B4A529BDA5C9A4E049C0D"><enum>(A)</enum><text display-inline="yes-display-inline">section 205(d)(2)(B)(i) shall be $4,000 per dwelling unit in the multifamily building, up to a maximum of $400,000 per multifamily building or per complex, if such complex consists of multiple adjacent multifamily buildings owned by the same entity; and</text></subparagraph><subparagraph commented="no" id="H9948353C51194BF5A471F5DF01DE4C46"><enum>(B)</enum><text display-inline="yes-display-inline">section 205(d)(2)(B)(ii) shall be $8,000 per dwelling unit in the multifamily building, up to a maximum of $800,000 per multifamily building or per complex, if such complex consists of multiple adjacent multifamily buildings owned by the same entity.</text></subparagraph></paragraph><paragraph commented="no" id="H813E91569303465C8A8B20CEA02D1AD7"><enum>(4)</enum><header>Measured performance home rebate</header><text display-inline="yes-display-inline">For households of homeowners that are certified pursuant to the procedures established under subsection (a) as moderate income, the maximum amount of a measured performance home rebate under section 203 for a home energy efficiency retrofit shall be determined using a payment rate per kilowatt hour or kilowatt hour-equivalent of reduction in home energy use that is equal to twice the payment rate described in section 203(e)(2).</text></paragraph><paragraph commented="no" id="HA3B88879FE874443A0B4EC9D3737AD57"><enum>(5)</enum><header>Measured performance multifamily building</header><text display-inline="yes-display-inline">For multifamily buildings that are certified pursuant to the procedures established under subsection (a) as moderate income, the maximum amount of a measured performance multifamily building rebate under section 205 for a multifamily building energy efficiency retrofit shall be determined using a payment rate per kilowatt hour or kilowatt hour-equivalent of reduction in multifamily building energy use that is equal to twice the payment rate described in section 205(e)(2).</text></paragraph></subsection><subsection commented="no" id="H0489794E42044C0297E3F1B09F7B8976"><enum>(d)</enum><header>Outreach</header><text display-inline="yes-display-inline">The Secretary shall establish procedures to—</text><paragraph commented="no" id="H81893617945F4EA489CB9F6E2204A3A4"><enum>(1)</enum><text display-inline="yes-display-inline">provide information to households of homeowners, and households in multifamily buildings, that are certified pursuant to the procedures established under subsection (a) as moderate income regarding other programs and resources relating to assistance for energy efficiency upgrades of homes and dwelling units of multifamily buildings, including the weatherization assistance program implemented under part A of title IV of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6861">42 U.S.C. 6861</external-xref> et seq.); and</text></paragraph><paragraph commented="no" id="HF7E2EDEC6E0C415DA20D845B9A2494EF"><enum>(2)</enum><text display-inline="yes-display-inline">refer such households, as applicable, to such other programs and resources.</text></paragraph></subsection><subsection commented="no" id="H51EE0F8D4925460B802A88832067CC73"><enum>(e)</enum><header>Requirements for multifamily buildings</header><paragraph commented="no" id="HAC2AB36DB1F74545B61186C831475F34"><enum>(1)</enum><header>All multifamily buildings</header><text display-inline="yes-display-inline">A rebate may not be made in accordance with this section with respect to a multifamily building unless the owner of the building demonstrates to the satisfaction of the Secretary that, at the time the rebate is made, not less than <fraction>2/3</fraction> of all dwelling units in such multifamily building—</text><subparagraph id="H6B884D4AB53C4F53969F394FA8BBC5DC"><enum>(A)</enum><text>are occupied by households having incomes not exceeding 80 percent of median income for the area in which the multifamily building is located; and</text></subparagraph><subparagraph id="HE44A113BBF78432FBFA3570190282F25"><enum>(B)</enum><text display-inline="yes-display-inline">have monthly rental prices that are equal to, or less than, an amount that is equal to 30 percent of the monthly household income of a household having an income at 80 percent of median household income for the area in which the multifamily building is located. </text></subparagraph></paragraph><paragraph commented="no" id="HC35D8C404AD3466A9FE61FA844EEE432"><enum>(2)</enum><header>Assisted multifamily buildings</header><text display-inline="yes-display-inline">A rebate may not be made in accordance with this section with respect to a multifamily building for which Federal rental assistance is provided unless the owner of such multifamily building demonstrates to the satisfaction of the Secretary that the remaining term of the affordability agreement for such building relating to such assistance is 5 years or longer.</text></paragraph><paragraph commented="no" id="H12BAFC14FABF4EB5B39AB2FE1B494A56"><enum>(3)</enum><header>Unassisted multifamily buildings</header><subparagraph commented="no" id="H3055F3403DED4CE1AC0C604B6571CAC1"><enum>(A)</enum><header>Requirements for rent increases</header><clause commented="no" id="HA02CDE28F54B4110A3029EE94B130ED6"><enum>(i)</enum><header>Limitation</header><text display-inline="yes-display-inline">A rebate may not be made in accordance with this section with respect to a multifamily building for which, during the 5-year period beginning on the date of issuance of such a rebate, no Federal rental assistance is provided, unless the owner of such multifamily building enters into such binding commitments as the Secretary shall require to ensure that any rent increase for any dwelling unit in the multifamily building made after the completion of any energy efficiency retrofit for which such rebate is made shall not exceed the amount of the existing rent as increased in accordance with any percentage increase in the Consumer Price Index for All Urban Consumers (CPI–U) for the applicable period, as determined by the Secretary.</text></clause><clause commented="no" id="HA2A35C808FAA4C7C94E68746E43DA9A1"><enum>(ii)</enum><header>Exemption</header><text>A rent increase for dwelling units subject to the limitation under clause (i) may exceed the amount provided under such clause if the owner of the multifamily building in which such dwelling units are located requests such exemption and provides to the applicable State documentation demonstrating actual, documented increases in specific operating expenses, which may include property taxes and maintenance costs, that meet such requirements as the Secretary shall establish.</text></clause></subparagraph><subparagraph commented="no" id="HB4977A81C82148FEA483C01B7AE93545"><enum>(B)</enum><header>Eviction protections</header><text display-inline="yes-display-inline">A rebate may not be provided in accordance with this section with respect to a multifamily building for which no Federal rental assistance is provided unless the owner of such multifamily building enters into such binding commitments as the Secretary shall require to ensure that, during a period prescribed by the Secretary, any moderate income household residing in a dwelling unit in the multifamily building may not be evicted, have their lease terminated, or fail to have their lease renewed for any reason other than breach of the lease or good cause, as defined by the jurisdiction in which the multifamily building is located.</text></subparagraph><subparagraph commented="no" id="H7E11704333B04D8CB58113D45782E9FB"><enum>(C)</enum><header>Regulatory agreements; sale</header><text>Any requirement under this paragraph or binding commitment required under this paragraph with respect to a multifamily building shall be set forth in a regulatory agreement entered into by the owner of the multifamily building and the State administering the rebate program under this title. Such regulatory agreement shall contain appropriate subordination provisions that allow for reasonable purchaser financing, shall be recorded, and shall apply notwithstanding any change in ownership of the building.</text></subparagraph><subparagraph commented="no" id="H619EBB3D43A74A64B017E00076D55E84"><enum>(D)</enum><header>Tenant notification</header><text>To provide rebates with respect to multifamily buildings in accordance with this section, a State shall develop and carry out a specific and verifiable mechanism for providing tenants of multifamily buildings for which such rebates are provided with written notice of their rights and their landlord’s obligations pursuant to this paragraph.</text></subparagraph><subparagraph commented="no" id="H011520FAEBFD4EAC9DC93FB8905A470A"><enum>(E)</enum><header>Enforcement</header><clause commented="no" id="H33CD8357F6264297965D0E92B2423D85"><enum>(i)</enum><header>Partnering with HFAS</header><text>States receiving grants to carry out rebate programs under this title are encouraged to partner with housing finance agencies to monitor compliance with and enforce the requirements under this paragraph, including developing and providing to owners of multifamily buildings with respect to which rebates are provided a standard regulatory agreement and lease addendum that sets forth the restrictions and requirements under this paragraph.</text></clause><clause commented="no" id="HF439C8D716DB4739A967A8A1DB5BBCB2"><enum>(ii)</enum><header>Penalties for noncompliance</header><text>To provide rebates with respect to multifamily buildings in accordance with this section, a State shall—</text><subclause commented="no" id="HF20494EDE1964250AAEE8737AF4549C3"><enum>(I)</enum><text>establish and carry out a compliance procedure for the requirements of this paragraph that provides specific response and resolution deadlines and utilizes standard and transparent criteria to resolve alleged violations; </text></subclause><subclause commented="no" id="HF5B31C946AD449B5A40C864BD378ACB3"><enum>(II)</enum><text>establish penalties that are sufficient, in the determination of such State, to deter violations of the requirements of this paragraph and the agreements entered into pursuant to this paragraph; and</text></subclause><subclause commented="no" id="H0986214A7F964207821A9A1514BB4778"><enum>(III)</enum><text>provide that tenants of multifamily buildings may bring an civil action to enforce the lease requirements under this paragraph and pursue restitution for violations of the applicable regulatory agreement, and provide that in such an action such tenants may recover damages and attorney’s fees.</text></subclause></clause></subparagraph></paragraph><paragraph id="H471DAB3D09DD4D1891532859C9EDF824"><enum>(4)</enum><header>Federal rental assistance defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>Federal rental assistance</term> means, with respect to a multifamily building, project-based assistance provided to the owner of the multifamily building pursuant to—</text><subparagraph id="HCF733E3323734A619BFD36876A714D1D"><enum>(A)</enum><text>section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/17012">12 U.S.C. 17012</external-xref>);</text></subparagraph><subparagraph id="HEF0BA42297384BCE99C0AD9DFF3610EF"><enum>(B)</enum><text>section 811 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>);</text></subparagraph><subparagraph id="HA2C428D24786430E863D70E61EC24F35"><enum>(C)</enum><text>section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>); or</text></subparagraph><subparagraph id="H75CA540DA91143D19AC66E3BA4EB3811"><enum>(D)</enum><text>section 538 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1490">42 U.S.C. 1490</external-xref>).</text></subparagraph></paragraph></subsection></section><section commented="no" id="H9113CDBBBC2C4DE292C424B5F53AC704"><enum>207.</enum><header>Coordination of rebate and existing State-Sponsored or utility-Sponsored programs</header><text display-inline="no-display-inline">A State that receives a grant under this title is encouraged to work with State agencies, electric utilities, gas utilities, nonprofits, and other entities—</text><paragraph commented="no" id="H3A579A56D44C47658466AB5407E74AAF"><enum>(1)</enum><text display-inline="yes-display-inline">to assist in marketing the availability of the rebates under the applicable State program;</text></paragraph><paragraph commented="no" id="H8FE7346530044C99BE98C7C2467A36DC"><enum>(2)</enum><text display-inline="yes-display-inline">to coordinate with utility or State managed financing programs; </text></paragraph><paragraph commented="no" id="H04D98007FBB94241B193D177A9AA85AD"><enum>(3)</enum><text display-inline="yes-display-inline">to assist in implementation of the applicable State program, including installation of energy efficiency retrofits; and</text></paragraph><paragraph commented="no" id="H45DA34E184734E88BB8C308023D9055C"><enum>(4)</enum><text display-inline="yes-display-inline">to coordinate with existing quality assurance programs.</text></paragraph></section><section commented="no" id="H852C741BC01C4D3BA23ECB9ADD0AE887"><enum>208.</enum><header>Consumer access to electric energy and natural gas information</header><subsection commented="no" id="H14A2074823E5485DB9B86FF37BE4C5C9"><enum>(a)</enum><header>Eligibility for state energy plans</header><text>Section 362(d) of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6322">42 U.S.C. 6322(d)</external-xref>) is amended—</text><paragraph commented="no" id="HC833768937BE4D5E96037B9B3C95D8A0"><enum>(1)</enum><text>in paragraph (16), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph><paragraph commented="no" id="HC2A6C41D3AD74566AEB33F015BC4AFC4"><enum>(2)</enum><text>by redesignating paragraph (17) as paragraph (18); and</text></paragraph><paragraph commented="no" id="H010B3E286C0B4AF3BA8F0F1C1E2D99AF"><enum>(3)</enum><text>by inserting after paragraph (16) the following:</text><quoted-block style="OLC" id="HDC70A67454AF4EA68A98A8CA48DCFB3F"><paragraph commented="no" id="HC2A589C7C25B48C3A69B95CB808AFA74"><enum>(17)</enum><text>programs—</text><subparagraph commented="no" id="HB3B59AF00CAD4F669E011BAF8C758331"><enum>(A)</enum><text display-inline="yes-display-inline">to enhance consumer access to and understanding of electric energy and natural gas usage and cost information, including consumers’ own residential and commercial retail electric energy information (as defined in section 2 of the <short-title>HOPE for HOMES Act of 2021</short-title>) and retail natural gas information (as defined in section 2 of the <short-title>HOPE for HOMES Act of 2021</short-title>); and</text></subparagraph><subparagraph commented="no" id="H7640F44A2045483A8EEBEE87B04AD627"><enum>(B)</enum><text>to facilitate the development and adoption of innovative products and services to assist consumers in managing energy consumption and expenditures; and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H0DD2C8349C9E4B0C8C58AF1814987D69"><enum>(b)</enum><header>Guidelines for electric consumer and gas consumer access</header><paragraph commented="no" id="H7E5C5C784F8E40378833B8A8C588AFEB"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act and subject to paragraph (2), the Secretary shall issue guidelines that establish model data sharing standards and policies for States to provide electric consumers and gas consumers, and third-party designees of such electric consumers and gas consumers, with access to retail electric energy information and retail natural gas information.</text></paragraph><paragraph commented="no" id="H73A2ED6D204C43B798C6B1BA09C6E77C"><enum>(2)</enum><header>Consultation</header><text>Before issuing the guidelines under paragraph (1), the Secretary shall—</text><subparagraph commented="no" id="H2C6AE5AED1004B3F9A2A191097205F95"><enum>(A)</enum><text>consult with—</text><clause commented="no" id="HAB79C6754C0D4B6AA693B8AC25C5B1A5"><enum>(i)</enum><text>State and local regulatory authorities;</text></clause><clause commented="no" id="H236C2C3AE9674999B53F041DFCDA36EB"><enum>(ii)</enum><text>other appropriate Federal agencies, including the National Institute of Standards and Technology;</text></clause><clause commented="no" id="H23FAB1818BF842D2A9A81C82C666B34C"><enum>(iii)</enum><text>consumer and privacy advocacy groups;</text></clause><clause commented="no" id="HFA07D77B33A64A6BA08E4334BCED4919"><enum>(iv)</enum><text>electric utilities and gas utilities;</text></clause><clause commented="no" id="HE3EE10BE86C24CE3A0F64EB21F9BB38E"><enum>(v)</enum><text>the National Association of State Energy Officials; and</text></clause><clause commented="no" id="H92610D75C0B64A0097F4E79E9D8486E0"><enum>(vi)</enum><text>other appropriate entities, including groups representing public utility commissions, commercial and residential building owners, residential contractors, and groups that represent demand response and electricity data devices and services; and</text></clause></subparagraph><subparagraph commented="no" id="H1490845395414B1592BF725B089164B3"><enum>(B)</enum><text>provide notice and opportunity for comment.</text></subparagraph></paragraph><paragraph commented="no" id="H9C1A0FC747804574B09604042449E06E"><enum>(3)</enum><header>State and local regulatory action</header><text>In issuing the guidelines under paragraph (1), the Secretary shall, to the maximum extent practicable, be guided by actions taken by State and local regulatory authorities to ensure electric consumer and gas consumer access to retail electric energy information and retail natural gas information, including actions taken after consideration of the standard established under section 111(d)(19) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)(19)</external-xref>).</text></paragraph><paragraph commented="no" id="H67AE2988433645C0AE1DBFC4AC888713"><enum>(4)</enum><header>Contents</header><text>The guidelines issued under paragraph (1) shall include guidelines—</text><subparagraph commented="no" id="H78D56B8F8600413CB04506A6BBF539A4"><enum>(A)</enum><text>specifying that retail electric energy information and retail natural gas information of an electric consumer or a gas consumer should be made available to the electric consumer or gas consumer (or a third-party designee of the electric consumer or gas consumer) by the electric utility or gas utility of the electric consumer or gas consumer (or such other entity as may be designated by the utility), in consultation with, or with approval from, as applicable, the utility’s applicable retail regulatory authority;</text></subparagraph><subparagraph commented="no" id="H3A06EEF03CEB4B1B92E11D240A8BAED7"><enum>(B)</enum><text>regarding the timeliness and specificity of retail electric energy information and retail natural gas information to be made available to an electric consumer or a gas consumer (or a third-party designee of such an electric consumer or such a gas consumer), including that such retail electric energy information and retail natural gas information should be made available to consumer-authorized entities—</text><clause commented="no" id="H782DB07481EA42678AA87CB3F837497F"><enum>(i)</enum><text>in an electronic machine readable form, without additional charge, in conformity with nationally recognized open standards and best practices;</text></clause><clause commented="no" id="H9A5908E7AFBD4DB3BEE6ECD0F0EF34A5"><enum>(ii)</enum><text>through a website or other electronic access authorized by the electric consumer or gas consumer, including at least 13 months of historical information;</text></clause><clause commented="no" id="HFB61571E992341CE88E3E105C8C60C6A"><enum>(iii)</enum><text>in as close to real-time as is reasonably practicable;</text></clause><clause commented="no" id="H2F3D6A7D37D947B1A555FA32612F6B31"><enum>(iv)</enum><text>at the level of specificity that the data is transmitted by the meter or as is reasonably practicable; and</text></clause><clause commented="no" id="H521F69ED32194CB5A851BFDFB2A5F63A"><enum>(v)</enum><text>in a manner that provides adequate protections for the security of the information and the privacy of the electric consumer or gas consumer;</text></clause></subparagraph><subparagraph commented="no" id="H50991270232744249593CD4DC6D9EA9A"><enum>(C)</enum><text>regarding appropriate nationally recognized open standards for data exchange;</text></subparagraph><subparagraph commented="no" id="H225859944846481F9572A6951E63DEFA"><enum>(D)</enum><text>regarding access of retail electric energy information and retail natural gas information for owners and managers of multitenant commercial and residential buildings;</text></subparagraph><subparagraph commented="no" id="H54031B8A47F14FD8BA247FD186B0CDCB"><enum>(E)</enum><text>regarding consumer consent requirements such that an electric consumer or gas consumer can conveniently and securely authorize a third-party designee access to the retail electric energy information or retail natural gas information of such electric consumer or gas consumer, including standardized authorization language to which an electric consumer or gas consumer will agree prior to such electric consumer or gas consumer authorizing, or the applicable electric utility or gas utility sharing, retail electric energy information or retail natural gas information of such electric consumer or gas consumer;</text></subparagraph><subparagraph commented="no" id="HC3F96059CB0E4D0A88974CAF79034ACB"><enum>(F)</enum><text>specifying that electric utilities and gas utilities should, when a capable meter is servicing an electric consumer or gas consumer, communicate usage and other information to a device or network of the electric consumer or gas consumer or a device or network of a third-party designee of such electric consumer or gas consumer, and where feasible should provide to the electric consumer or gas consumer or third-party designee, at a minimum, access to usage information (not including price information) of the electric consumer or gas consumer directly from the meter in as close to real-time as is reasonably practicable; </text></subparagraph><subparagraph commented="no" id="HBB2017C11B8E46FBB1C326D0BC8D4F59"><enum>(G)</enum><text>with respect to the terms and conditions, which shall be reasonable and non-discriminatory, to be agreed to by a third-party designee of an electric consumer or of a gas consumer and an electric utility or gas utility for access to the retail electric energy information or retail natural gas information of such electric consumer or gas consumer, including that—</text><clause commented="no" id="H802A40623F6C41418B842F194268BABA"><enum>(i)</enum><text>due process be afforded to such third-party by the applicable regulatory authority, including giving such third-party an opportunity to rebut allegations of wrongdoing by such third-party prior to any enforcement action being taken by the applicable regulatory authority;</text></clause><clause commented="no" id="H8C249130CDB34A358EF48597C949D4EA"><enum>(ii)</enum><text>the consumer’s online authentication match that used by the applicable gas utility or electric utility for the consumer-facing website of such gas utility or electric utility; and</text></clause><clause commented="no" id="HFCD12BA53D464D26954D90FD432F9D66"><enum>(iii)</enum><text>such third-party may receive retail electric energy information and retail natural gas information from an electric utility or gas utility with consumer consent, except if otherwise prohibited by Federal law or by a finding of a State court or other State adjudicatory body; and</text></clause></subparagraph><subparagraph commented="no" id="HA25C534D3B3149F9913A3256092737F8"><enum>(H)</enum><text>addressing appropriate circumstances in which analysis of retail electric energy information and retail natural gas information may be released publicly, without a consumer’s consent, by protecting individual consumers privacy, including—</text><clause commented="no" id="H48699C89493B47EBA57FE0A15CB686C5"><enum>(i)</enum><text>with mathematical methods known as differential privacy, in which consumers privacy can be ensured with provable guarantees; and</text></clause><clause commented="no" id="H7DE1E363189844F8B3A32B824D8FFE96"><enum>(ii)</enum><text>detailed descriptions and sample calculations by which the results of statistical analysis can be made differentially private.</text></clause></subparagraph></paragraph><paragraph commented="no" id="H3A125A68537D4FB7A0B956F583B4C2B1"><enum>(5)</enum><header>Revisions</header><text>The Secretary shall periodically review and, as necessary, revise the guidelines issued under paragraph (1) to reflect changes in technology, privacy needs, and the market for electric energy and natural gas and related services.</text></paragraph></subsection></section><section commented="no" id="H322D01F102E14D01835E1688738D1FDC"><enum>209.</enum><header>Evaluation reports to Congress</header><subsection commented="no" id="H88CE8B8C22AB4C7FBE7FECF6C27D926B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act and annually thereafter until the termination of the Home Energy Savings Retrofit Rebate Program, the Secretary shall submit to Congress a report on the use of funds made available to carry out this title.</text></subsection><subsection commented="no" id="H3F47D2103AED4C3380BDF0419E443462"><enum>(b)</enum><header>Contents</header><text>Each report submitted under subsection (a) shall include—</text><paragraph commented="no" id="HE329F1D0FA65458F86C7C1F30490061B"><enum>(1)</enum><text display-inline="yes-display-inline">how many home energy efficiency retrofits and multifamily building energy efficiency retrofits have been completed during the previous year under the Home Energy Savings Retrofit Rebate Program;</text></paragraph><paragraph commented="no" id="HD4744C8279374696B9C6055D585700AB"><enum>(2)</enum><text display-inline="yes-display-inline">an estimate of how many jobs have been created through the Home Energy Savings Retrofit Rebate Program, directly and indirectly;</text></paragraph><paragraph commented="no" id="HA83A7F7524F847219EEEC5B133778B19"><enum>(3)</enum><text>a description of what steps could be taken to promote further deployment of energy efficiency and renewable energy retrofits;</text></paragraph><paragraph commented="no" id="H2B4F7FB04628462DBBCD2D84F742EBFE"><enum>(4)</enum><text display-inline="yes-display-inline">a description of the quantity of verifiable energy savings, homeowner energy bill savings, and other benefits of the Home Energy Savings Retrofit Rebate Program;</text></paragraph><paragraph commented="no" id="H5ADC130BB3C6436BA88C11F036085048"><enum>(5)</enum><text display-inline="yes-display-inline">a description of any waste, fraud, or abuse with respect to funds made available to carry out this title; and</text></paragraph><paragraph commented="no" id="HAEF5832D742B44B68C1D899F709D2858"><enum>(6)</enum><text>any other information the Secretary considers appropriate.</text></paragraph></subsection></section><section commented="no" id="H7A3480F2B5104CC18D795D28E67A3A94"><enum>210.</enum><header>Administration</header><subsection commented="no" id="H44350025058B42DB8D3B1CDDB7047D9E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide such administrative and technical support to contractors, aggregators, States, and Indian Tribes as is necessary to carry out this title. </text></subsection><subsection commented="no" id="H8EEF5D7BE4AF4F5D8CE93CF2574179FD"><enum>(b)</enum><header>Information collection</header><text display-inline="yes-display-inline">The Secretary shall establish, and make available to a homeowner, multifamily building owner, or the homeowner’s or multifamily building owner’s designated representative, seeking a rebate under this title, release forms authorizing, in accordance with guidelines issued under section 208(b), access by the Secretary, or a designated third-party representative to information in the utility bills of the homeowner or the multifamily building owner.</text></subsection></section><section commented="no" id="H9AA84C5BD82E467E9B5F816A6315B749"><enum>211.</enum><header>Treatment of rebates</header><text display-inline="no-display-inline">For purposes of the Internal Revenue Code of 1986, gross income shall not include any rebate received under this title. </text></section><section commented="no" id="H8FB40D0A35A04C0396E3F1A893F0FF34"><enum>212.</enum><header>Authorization of appropriations</header><subsection commented="no" id="HE12AC189C1C14A99B105A91A551E68D9"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary to carry out this title $1,400,000,000 for each of fiscal years 2022 through 2027, to remain available until expended. </text></subsection><subsection commented="no" id="H80129CDA1F46486F8C0E23F7CDDE0417"><enum>(b)</enum><header>Tribal allocation</header><text display-inline="yes-display-inline">Of the amounts made available pursuant to subsection (a) for a fiscal year, the Secretary shall work with Indian Tribes and use 2 percent of such amounts to carry out a program or programs that as close as possible reflect the goals, requirements, and provisions of this title, taking into account any factors that the Secretary determines to be appropriate.</text></subsection></section></title><title id="H566C2A9478864CFA89BF002140C06206"><enum>III</enum><header>General provisions</header><section id="H3DB065DA769045FC93A88D20DC156799"><enum>301.</enum><header>Appointment of personnel</header><text display-inline="no-display-inline">Notwithstanding the provisions of title 5, United States Code, regarding appointments in the competitive service and General Schedule classifications and pay rates, the Secretary may appoint such professional and administrative personnel as the Secretary considers necessary to carry out this Act.</text></section><section id="HCE1298E081AC4AD985986858E2A7F972"><enum>302.</enum><header>Maintenance of funding</header><text display-inline="no-display-inline">Each State receiving Federal funds pursuant to this Act shall provide reasonable assurances to the Secretary that it has established policies and procedures designed to ensure that Federal funds provided under this Act will be used to supplement, and not to supplant, State and local funds.</text></section></title></legis-body></bill>
