which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to establish a high risk rural roads safety program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>High Risk Rural Roads Safety Act of 2021</short-title></quote>.</text></section><section id="idB4F2B63592554D79B3E25F7EB5DF4F8B"><enum>2.</enum><header>High risk rural roads safety grant program</header><text display-inline="no-display-inline">Section 148 of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5FE69ABD277940338159DF2F0C7F452B"><subsection id="id676E78BF04954D919527DC9902D649E6"><enum>(l)</enum><header>High risk rural roads program set-aside</header><paragraph id="idD8CEF1F05C4A41F895F7CD6317F0DDCB"><enum>(1)</enum><header>Definition of Indian Tribe</header><subparagraph id="idD17DCAC3FD3847289EDC4A3533199E12"><enum>(A)</enum><header>In general</header><text>In this subsection, the term <term>Indian Tribe</term> has the meaning given the term in section 207(m)(1).</text></subparagraph><subparagraph id="id3E0B6A8C298D4498B87775A81FD81789"><enum>(B)</enum><header>Inclusions</header><text>In this subsection, the term <term>Indian Tribe</term> includes a Native village and a Native Corporation (as those terms are defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)).</text></subparagraph></paragraph><paragraph id="id4FCFCE154A8742F7A1D54CFF567F7E96"><enum>(2)</enum><header>Reservation of funds</header><subparagraph id="idBDE499A8D8CD4AD99047D79E66EB5934"><enum>(A)</enum><header>In general</header><text>Of the funds apportioned to a State under section 104(b)(3) for each fiscal year, the Secretary shall reserve an amount such that the Secretary reserves a total under this subsection of $750,000,000, of which—</text><clause id="idB2557D55869C48DBA677E2DCF8CCD2BD"><enum>(i)</enum><text>$150,000,000 shall be for grants to Indian Tribes under paragraph (3); and</text></clause><clause id="idFE62D63BB5414CFEA378B2603166EC60"><enum>(ii)</enum><text>$600,000,000 shall be apportioned to States in accordance with paragraph (4).</text></clause></subparagraph><subparagraph id="id13B754E7DD034EB4978ED0B32E5DBEE9"><enum>(B)</enum><header>Not transferable</header><text>Amounts reserved under this paragraph shall not be transferable.</text></subparagraph></paragraph><paragraph id="idFEF0E31E2E3346E5A893A350C2CA285F"><enum>(3)</enum><header>Tribal grant program</header><subparagraph id="idF624C1B9488A4A7FB8CD43A71E2D3735"><enum>(A)</enum><header>In general</header><text>The Secretary, in consultation with the Secretary of the Interior, shall establish a program to provide grants to Indian Tribes to improve safety on high risk rural roads.</text></subparagraph><subparagraph id="idD836019A58EB4F4D8C033448D0428D15"><enum>(B)</enum><header>Applications</header><text>To be eligible to receive a grant under the program, an Indian Tribe shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph><subparagraph id="id9E187E6134DB4A2B806F2D67612D79DA"><enum>(C)</enum><header>Use of funds</header><text>An Indian Tribe may use funds from a grant under this paragraph only for a highway safety improvement project on a high risk rural road.</text></subparagraph><subparagraph id="id28943680658E4BBF9F0C6B792CCA40F2" commented="no"><enum>(D)</enum><header>State strategic highway safety plan</header><text>A project carried out under this paragraph shall not be required to be included in a State strategic highway safety plan.</text></subparagraph><subparagraph id="id8BD97E5A1D304A6588E0183BBBA8F2BC" commented="no"><enum>(E)</enum><header>Federal share</header><text>The Federal share of the cost of a project carried out with a grant under the program may be up to 100 percent.</text></subparagraph></paragraph><paragraph id="idBEBFAF3FB96A4FC09089106132F4A9F9"><enum>(4)</enum><header>State apportionment</header><subparagraph id="id8CB8053D992D481BA2445E07CEC57C03"><enum>(A)</enum><header>In general</header><text>The Secretary shall apportion amounts under paragraph (2)(A)(ii) to States based on the proportion that—</text><clause id="idE039A6409CFA4B81934DFBB179DC10D1"><enum>(i)</enum><text>the amount apportioned to the State under section 104(b)(3) for the fiscal year; bears to</text></clause><clause id="idF8038DE207D94E8EB65E91DCE2B5AD20"><enum>(ii)</enum><text>the amount apportioned to all States under section 104(b)(3) for the fiscal year.</text></clause></subparagraph><subparagraph id="idB4F4530001284DA0AEC3EE71D0C67E1A"><enum>(B)</enum><header>Allocation within a State</header><text>Funds apportioned to a State under this paragraph shall be obligated in areas of the State in which the population is not more than 50,000, based on the proportion that—</text><clause id="idB2D115B11F684F3091EBADB6F9FEA2BE" commented="no"><enum>(i)</enum><text>the population of the applicable area of the State; bears to</text></clause><clause id="id14B3F56BC9E44496A79B0E20AB99C92C" commented="no"><enum>(ii)</enum><text>the total population of all areas of the State with a population of not more than 50,000.</text></clause></subparagraph><subparagraph commented="no" id="id087512833A604C97B15D107C1AE06765"><enum>(C)</enum><header>Reservation</header><text>For each fiscal year, a State may reserve not more than 2 percent of the funds apportioned to a State under this paragraph to provide technical assistance to assist areas of the State described in subparagraph (B) in carrying out an eligible project under subparagraph (D).</text></subparagraph><subparagraph id="id1498276039D4489C9ED18D2286957233"><enum>(D)</enum><header>Eligible projects</header><clause id="id9CB434E30BA843F185D5295F75DAA9EA"><enum>(i)</enum><header>In general</header><text>A State may use amounts apportioned under this paragraph only for a highway safety improvement project on a high risk rural road.</text></clause><clause id="id07C040765D0C40578DB4941B159AA193"><enum>(ii)</enum><header>Selection</header><text>To the maximum extent practicable, in selecting projects to carry out under this paragraph, a State shall consult with the unit of local government representing the area in which the project will be carried out.</text></clause></subparagraph><subparagraph id="id72E9C0F5BF684156A5DF997F19550F19"><enum>(E)</enum><header>Federal share</header><text>The Federal share of the cost of a project carried out under this paragraph shall be 100 percent.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
