which was read twice and referred to the <committee-name committee-id="SSFR00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Foreign Agents Registration Act of 1938 to repeal the exemption from registration under such Act for persons providing private and nonpolitical representation of trade and commercial interests, and the exemption from registration under such Act for persons filing disclosure reports under the Lobbying Disclosure Act of 1995, in connection with the representation of business organizations organized under the laws of or having their principal place of business in the People’s Republic of China, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1E0C0D45F4374DDB98F93698BD65B90D"><section section-type="section-one" id="H6B3080F79D4D4003B13CD9CD8A24AC86"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chinese Communist Party Influence Transparency Act</short-title></quote>.</text></section><section id="HFAC1081328F5473495DF694F0A226B57"><enum>2.</enum><header>Repealing certain exemptions from registration under Foreign Agents Registration Act of 1938 by agents representing Chinese business organizations</header><subsection id="HF04FFF56A290467DA865D0F06A8B8DA5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref> et seq.) is amended by inserting after section 3 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEFD0134F5F694A7492A372651A482D87"><section id="HC949D2BCA5154B82AF800DF2786866E6"><enum>3A.</enum><header>Special rules for agents representing Chinese business organizations</header><subsection id="H6E3D96249B1F422393A5444278E3C3BC"><enum>(a)</enum><header>Repeal of exemption from registration for persons providing private and nonpolitical representation of bona fide trade or commercial interests</header><text display-inline="yes-display-inline">Section 3(d)(1) shall not apply to an agent of a covered Chinese business organization.</text></subsection><subsection id="H53117D813BCB4D7CB5E70FDBF3A6335D"><enum>(b)</enum><header>Repeal of exemption from registration for persons filing disclosure reports under Lobbying Disclosure Act of 1995</header><paragraph id="HB0C2A90E585F44119A7192DD32C7BD41"><enum>(1)</enum><header>Repeal</header><text>Section 3(h) shall not apply to an agent of a covered Chinese business organization.</text></paragraph><paragraph id="HE41160E8F85E42DCB45457089B97ED7E"><enum>(2)</enum><header>Timing for filing of registration statements</header><text>In the case of an agent of a covered Chinese business organization who has registered under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601</external-xref> et seq.), after the agent files the first registration required under section 2(a) in connection with the agent’s representation of the covered Chinese business organization, the agent shall file all subsequent statements, information, or documents required under section 2 at the same time, and in the same frequency, as the reports filed with the Clerk of the House of Representatives or the Secretary of the Senate (as the case may be) under section 5 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604</external-xref>) in connection with the agent’s representation of the covered Chinese business organization.</text></paragraph></subsection><subsection id="id429FB231F8AE46708F806389DB9A4126"><enum>(c)</enum><header>Covered Chinese business organization defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered Chinese business organization</term> means—</text><paragraph id="idB2F626FE75754132A53C0F15D08C3C67"><enum>(1)</enum><text>an entity described in section 1(b)(3) which is organized under the laws of, or has its principal place of business in, the People’s Republic of China (including any subsidiary or affiliate of such an entity), except that such term does not include a subsidiary or affiliate of an entity which is organized under the laws of, and has its principal place of business in, a country other than the People’s Republic of China; or</text></paragraph><paragraph id="id6B7324D1D63143EDA33593298C3CEBDA"><enum>(2)</enum><text display-inline="yes-display-inline">an entity designated by the Attorney General as subject to the extrajudicial direction of the Chinese Communist Party.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBC1194359AD645BE871BDA946822135C"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="HD9D891E091334970BADD2200631B277B"><enum>(1)</enum><header>Repeal of exemption</header><text display-inline="yes-display-inline">Section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/613">22 U.S.C. 613</external-xref>) is amended—</text><subparagraph id="H4FC5D8836B274499A46C1DD052D7BF78"><enum>(A)</enum><text>in subsection (d)(1), by striking <quote>in private</quote> and inserting <quote>except as provided in section 3A(a), in private</quote>; and </text></subparagraph><subparagraph id="H9CCDCC4121F24FD185B3844A042DCA2D"><enum>(B)</enum><text>in subsection (h), by striking <quote>Any agent</quote> and inserting <quote>Except as provided in section 3A(b), any agent</quote>.</text></subparagraph></paragraph><paragraph id="H36F66C482E0A46E2B2096D236086AE5E"><enum>(2)</enum><header>Timing of filing of registration statements</header><text>Section 2(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/612">22 U.S.C. 612(b)</external-xref>) is amended in the first sentence by striking <quote>six months succeeding such filing</quote> and inserting <quote>six months succeeding such filing (except as provided in section 3A(b)(2))</quote>.</text></paragraph></subsection><subsection id="H0AC3612F8C8942F5A6C416F2ACDF98B3"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this Act shall take effect 180 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
