provide for an equitable management of summer flounder based on geographic, scientific, and economic data, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fluke Fairness Act of 2021</short-title></quote>.</text></section><section id="idce888ca109e9407f9f879047e0f0296d"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id02e8851270024e67a0b40e316e9abd6a"><enum>(1)</enum><text>Summer flounder is an important economic fish stock for commercial and recreational fishermen across the Northeast and Mid-Atlantic United States.</text></paragraph><paragraph id="idd97351a7e47c4cf6a63599298fef9ed8"><enum>(2)</enum><text>The Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801</external-xref> et seq.) was reauthorized in 2006 and instituted annual catch limits and accountability measures for important fish stocks.</text></paragraph><paragraph id="idd628dbb7d5744736bb2131a7fbf2ef25"><enum>(3)</enum><text>That reauthorization prompted fishery managers to look at alternate management schemes to rebuild depleted stocks like summer flounder.</text></paragraph><paragraph id="id1be2e4e308d949e5891e1d22f9af7ee4"><enum>(4)</enum><text>Summer flounder occur in both State and Federal waters and are managed through a joint fishery management plan between the Council and the Commission.</text></paragraph><paragraph id="id8856b4bbc983433d828de253e7776bf5"><enum>(5)</enum><text>The Council and the Commission decided that each State’s recreational and commercial harvest limits for summer flounder would be based upon landings in previous years.</text></paragraph><paragraph id="id5679d8a52f844e4c9c6ba4139ec257db"><enum>(6)</enum><text>These historical landings were based on flawed data sets that no longer provide fairness or flexibility for fisheries managers to allocate resources based on the best science.</text></paragraph><paragraph id="idad6151e7cb3248639c25f8fbdcd5b5bb"><enum>(7)</enum><text>This allocation mechanism resulted in an uneven split among the States along the East Coast which is problematic.</text></paragraph><paragraph id="id50442ec61a9b4a0b8d6208c161fdc540"><enum>(8)</enum><text>The fishery management plan for summer flounder does not account for regional changes in the location of the fluke stock even though the stock has moved further to the north and changes in effort by anglers along the East Coast.</text></paragraph><paragraph id="idc1bb20ab270644d9a16e96f6ef8f5ee1"><enum>(9)</enum><text>The States have been locked in a management system based on data collected from 1981 to 1989, thus, the summer flounder stock is not being managed using the best available science and modern fishery management techniques.</text></paragraph><paragraph id="id05e097e040784cb3b5166d99315b22af"><enum>(10)</enum><text>It is in the interest of the Federal Government to establish a new fishery management plan for summer flounder that is based on current geographic, scientific, and economic realities.</text></paragraph></section><section id="id5a42d8e6cc494f9597b5d1215cf75a5a"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id6cc96d4292064e5db65668a3ab220879"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Atlantic States Marine Fisheries Commission.</text></paragraph><paragraph id="ida4009ac0bff44934b34ea40f1e2d0ac0"><enum>(2)</enum><header>Council</header><text>The term <term>Council</term> means the Mid-Atlantic Fishery Management Council established under section 302(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(a)</external-xref>).</text></paragraph><paragraph id="idf1d33182f2f642e8a56ce89fce441932"><enum>(3)</enum><header>National standards</header><text>The term <term>National Standards</term> means the national standards for fishery conservation and management set out in section 301(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851(a)</external-xref>).</text></paragraph><paragraph id="id2bdbbf7942354050b69ad20fbcd23df2"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="idbe9f8b3aaab94654b15ac117b269fbbc"><enum>(5)</enum><header>Summer flounder</header><text>The term <term>summer flounder</term> means the species Paralichthys dentatus.</text></paragraph></section><section id="id0e2971cc111f4740aa248549cd31051f"><enum>4.</enum><header>Summer flounder management reform</header><subsection id="id5394dc794316423290e87d30afd06057"><enum>(a)</enum><header>Fishery management plan modification</header><text>Not later than 1 year after the date of enactment of this Act, the Council shall submit to the Secretary, and the Secretary may approve, a modified fishery management plan for the commercial management of summer flounder under title III of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851</external-xref> et seq.) or an amendment to such plan that—</text><paragraph id="idfe32860fa9694379bf6170594cd102b6"><enum>(1)</enum><text>shall be based on the best scientific information available;</text></paragraph><paragraph id="id93949872ac3c42838c61613d1474d2b6"><enum>(2)</enum><text>establishes commercial quotas in direct proportion to the distribution, abundance, and location of summer flounder as reflected by fishery independent surveys conducted by the National Marine Fisheries Service and State agencies;</text></paragraph><paragraph id="id027c6443e5214cd5888495a86645aa96"><enum>(3)</enum><text>considers regional, coastwide, or other management measures for summer flounder that comply with the National Standards; and</text></paragraph><paragraph id="id24d86f129156436f9b3f955820738ec7"><enum>(4)</enum><text>prohibits the establishment of commercial catch quotas for summer flounder on a State-by-State basis using historical landings data that does not reflect the status of the summer flounder stock, based on the most recent scientific information.</text></paragraph></subsection><subsection id="idf8256f184b644cb188703a3d963974af"><enum>(b)</enum><header>Consultation with the commission</header><text>In preparing the modified fishery management plan or an amendment to such a plan as described in subsection (a), the Council shall consult with the Commission to ensure consistent management throughout the range of the summer flounder.</text></subsection><subsection id="id44f7820cbc1044c0a837d9551e6e3969"><enum>(c)</enum><header>Failure To submit plan</header><text>If the Council fails to submit a modified fishery management plan or an amendment to such a plan as described in subsection (a) that may be approved by the Secretary, the Secretary shall prepare and consider such a modified plan or amendment.</text></subsection></section><section id="idbf2f9a17c23e43e08ef69e246ff0d264"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the approval under section 4 of a modified fishery management plan for the commercial management of summer flounder or an amendment to such plan, the Comptroller General of the United States shall submit to Congress a report on the implementation of such modified plan or amendment that includes an assessment of whether such implementation complies with the National Standards.</text></section></legis-body></bill>
