which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To strengthen the requirements for reviews by the Committee on Foreign Investment in the United States of covered transactions involving genetic information, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Genomics Expenditures and National security Enhancement Act of 2021 </short-title></quote> or the <quote><short-title>GENE Act</short-title></quote>.</text></section><section id="idAFF777F4A70F45349C8857EEABD35150"><enum>2.</enum><header>Requirements for reviews of covered transactions involving genetic information</header><subsection id="id9552A5805EF74544A0048D1AD53DFC99"><enum>(a)</enum><header>Mandatory declarations</header><text display-inline="yes-display-inline">Section 721(b)(1)(C)(v)(IV) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(b)(1)(C)(v)(IV)</external-xref>) is amended—</text><paragraph id="idB8D777013FC94C6A8DD24241A9F92FAE"><enum>(1)</enum><text>by redesignating items (cc) through (gg) as items (dd) through (hh), respectively; and</text></paragraph><paragraph id="id8D14C17E305A4DCEBE9628B167BEEDDC"><enum>(2)</enum><text>by inserting after item (bb) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAF279D41A8244766BEABDB48C54D2B6A"><item id="id73934797E8EA42A083783BB09581452E"><enum>(cc)</enum><header>Covered transactions involving genetic information</header><text>The parties to a covered transaction shall submit a declaration described in subclause (I) with respect to the transaction if the transaction involves an investment described in subsection (a)(4)(B)(iii)(III) by a foreign person in a United States business that maintains or collects information about genetic tests of United States citizens, including any such information relating to genomic sequencing.</text></item><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idAD713F587947443A84E71C7EA073FC1C"><enum>(b)</enum><header>Consultation with Secretary of Health and Human Services</header><text>Section 721(k)(6) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(k)(6)</external-xref>) is amended—</text><paragraph id="id7EB7A2F61A554493A9CC272D06B6AFAF"><enum>(1)</enum><text>by striking <quote>The chairperson</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD2C1FC4A1CF942AEB65B347557E68582"><subparagraph id="idD93C9F8E0CA549DC87BF4D546AC143FB"><enum>(A)</enum><header>In general</header><text>The chairperson</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id4D75CDC9E395419C88B8396D1C85BEA7"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id23A8DE8AD90947E68393FB288014714A"><subparagraph id="idED255F96C7054CB6AACC1D404684D315"><enum>(B)</enum><header>Covered transactions involving genetic information</header><text>The chairperson shall consult with the Secretary of Health and Human Services in any review or investigation under subsection (a) of a covered transaction that involves an investment described in subsection (a)(4)(B)(iii)(III) by a foreign person in a United States business that maintains or collects information about genetic tests of United States citizens, including any such information relating to genomic sequencing.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idB1F19FC3282441EFB72BEB24D866B3FC"><enum>(c)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the Committee on Foreign Investment in the United States shall prescribe regulations to carry out the amendments made by this section.</text></subsection></section><section id="id9094EC419E4A4AC68BED278BB24BDE9E"><enum>3.</enum><header>Expansion of committees receiving annual testimony from Committee on Foreign Investment in the United States</header><text display-inline="no-display-inline">Section 721(o) of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565(o)</external-xref>) is amended—</text><paragraph id="id26EA037A7D4E4DFD9B48133B2325EAB3"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate</quote> and inserting <quote>the committees specified in paragraph (2)</quote>; </text></paragraph><paragraph id="id4F13C347093642ACB8EC53355CE1BA8B"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3); and</text></paragraph><paragraph id="id3D80C3AFF3AA46F08C613D71AA592EBD"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block id="idB171B551E2374387903D9305C175EF81" display-inline="no-display-inline" style="OLC"><paragraph id="id35670165BF844FB6870AB856846D937D"><enum>(2)</enum><header>Committees specified</header><text>The committees specified in this paragraph are—</text><subparagraph id="id79EED6A97BC04B4982980424A05CB6D7"><enum>(A)</enum><text>the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, and the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph id="idAF3524523E104E87815226C93E10DD78" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the Committee on Financial Services, the Committee on Foreign Affairs, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id92E99BF3CF5C4754BDEFA3A43F65F9AE"><enum>4.</enum><header>Effective date; applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall— </text><paragraph id="id7B499A54E17648D1AFEFC8F661404E95"><enum>(1)</enum><text>take effect on the date that is 90 days after the date of the enactment of this Act; and</text></paragraph><paragraph id="idE46A8B3C0E724797B0E140E7302462C2"><enum>(2)</enum><text>apply with respect to any covered transaction the review or investigation of which is initiated under section 721 of the Defense Production Act of 1950 on or after the date described in paragraph (1). </text></paragraph></section></legis-body></bill>
