which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Child Abuse Prevention and Treatment Act to provide for alternative pathways of addressing child abuse and neglect.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alternative Pathways to Child Abuse Prevention Act</short-title></quote>.</text></section><section id="idDDC76960FF8D4EF38E6177D6C4888B75"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Section 2 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5101">42 U.S.C. 5101</external-xref> note) is amended—</text><paragraph id="id636187A2AA2E4FBB840E290111D9A2A4"><enum>(1)</enum><text>in paragraph (11), by inserting <quote>trauma-informed,</quote> after <quote>child-centered,</quote>;</text></paragraph><paragraph id="id14E1BF96A94040029A17A45BEB7165EF"><enum>(2)</enum><text>in paragraphs (12) and (14), by inserting <quote>, Indian Tribes,</quote> after <quote>States</quote> each place such term appears; and</text></paragraph><paragraph id="idAAC3E76855E24FEA8BF15C1205F8B921"><enum>(3)</enum><text>in subparagraphs (C) and (D) of paragraph (15), by inserting <quote>and Indian Tribes</quote> after <quote>States</quote> each place such term appears.</text></paragraph></section><section id="id2A46001828D44175B3B74CA064731457"><enum>3.</enum><header>Advisory board on child abuse and neglect</header><text display-inline="no-display-inline">Section 102 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5102">42 U.S.C. 5102</external-xref>) is amended—</text><paragraph id="id507482455C0B4AF0B1B49671E9AA56FF"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="id044917DF3AAF4D67AC6143D6E385F43F"><enum>(A)</enum><text>in paragraph (13), by striking <quote>and</quote>;</text></subparagraph><subparagraph id="idCAD74145FED54B15B5D7DA02344851AA"><enum>(B)</enum><text>in paragraph (14), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id5317BBD1BDF64DEFB985AA66BC3CA949"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25C6D0E0E2AC4B3193A731665A2226EF"><paragraph id="idE0EFF060432F4291A1C564FA6AC463B0"><enum>(15)</enum><text>domestic violence advocates and experts.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idEE46BF70F4464771B2DE4FF2BD461904"><enum>(2)</enum><text>in subsection (f)—</text><subparagraph id="id76004FD147ED4F7298355CE28B14C507"><enum>(A)</enum><text>in paragraph (2), by striking <quote>; and</quote>;</text></subparagraph><subparagraph id="id0B34C0ACC91945FC9048FC87F43B661E"><enum>(B)</enum><text>in paragraph (3), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idF7D67073DB1D43B0A1E73DDA1D70FA4D"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB66DF6C42E3247E19770F6F4A2E88B54"><paragraph id="idEDC796826A76466899D1BD3E365A5B88"><enum>(4)</enum><text>recommendations for actions Federal, State, Tribal, and local public agencies can take to safely reduce the number of families referred to child protective services and direct such families to alternative pathways of preventive, family-centered services for support.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id0F4EE10D945D4863B79864B18CCCA5D2"><enum>4.</enum><header>National clearinghouse for information relating to child abuse</header><text display-inline="no-display-inline">Section 103 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5104">42 U.S.C. 5104</external-xref>) is amended—</text><paragraph id="id9FE81E4984FF4F79B7C4E3937B51DB1C"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id3782F95EB42947168EAEB886658D3B24"><enum>(A)</enum><text>in paragraph (3), by striking <quote>relating to differential response;</quote> and inserting “relating to—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id97100A39B9954C54A74A64842B802C36"><subparagraph id="id3CD17C9412C04950A9195CBB01DF2205"><enum>(A)</enum><text>differential response; and</text></subparagraph><subparagraph id="idCD06799C763D44E0BA6665F21E0BDB83"><enum>(B)</enum><text>the use of alternative pathways that connect families experiencing difficulty meeting basic needs or other risk factors associated with child abuse and neglect, such as parental stress, family violence, and isolation, to community-based systems and programs that strengthen families seeking support instead of to the child protection system, such as—</text><clause id="id32F8D24733C7478DB14EC60BC5B9CDF5"><enum>(i)</enum><text>State, Tribal, or local helplines that provide information or assistance and connect families to voluntary community-based support services; and </text></clause><clause id="idE59F9D72D8054BA380F81A9D016742AC"><enum>(ii)</enum><text>alternative pathways for mandated reporters and other concerned adults to use to refer families for voluntary supports outside of the child protection system;</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="idC406C50787E746DC854C97D11FB96B80"><enum>(B)</enum><text>in paragraph (8) , by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA51FB881D89446D4BFE936E0A952E9A0"><subparagraph id="id3FBB1972D6F9403FAAC41C45E1E34C1B"><enum>(B)</enum><text>appropriate State, Tribal, and local officials to assist in training law enforcement, legal, judicial, medical, physical, behavioral, and mental health, education, child welfare, substance use disorder treatment services, and domestic violence services personnel, including training on—</text><clause id="id09BFA3C3B5714A42A4DB133E367BEBD6"><enum>(i)</enum><text>the role of the child protective services system to identify children at risk of serious harm; and </text></clause><clause id="idDC0BE43F4F9E454BA23A1E422346AD28"><enum>(ii)</enum><text>how to direct families in need to alternative pathways to community-based systems and programs that strengthen such families in order to safely reduce the number of families unnecessarily referred to child protective services; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3425614FBCC540C5A1934C81389EF1F3"><enum>(C)</enum><text>in paragraph (9), by inserting <quote>for both victims and for people who use violence</quote> before the period; and</text></subparagraph></paragraph><paragraph id="idB7B086EE7A054CE8AEEA8F376F93D32E"><enum>(2)</enum><text>in subsection (c)(1)(C)—</text><subparagraph id="idAA95A250659E4ECD8B5C0C13C9BD9091"><enum>(A)</enum><text>in clause (iii), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id47AA8668BAFE4137B76AD6E227516570"><enum>(B)</enum><text>in clause (iv), by inserting <quote>and</quote> after the semicolon; and</text></subparagraph><subparagraph id="idD2EFD821230A4BFBB9E0063A1C713259"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id02E080E4D1094B73A46688C9C4221D22"><clause id="id80EAC63848B94D19AB33A8A2D1439F9B"><enum>(v)</enum><text>information on the presence of domestic violence in advance of a child death;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id7C6DA238432D40689D63768351ABE48C"><enum>5.</enum><header>Research and assistance activities</header><text display-inline="no-display-inline">Section 104 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5105">42 U.S.C. 5105</external-xref>) is amended—</text><paragraph id="id168EE52C91094538AD36B15D264BB3A3"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="idDA13FD08305C4A0A9066CEA2CD4995EE"><enum>(A)</enum><text>in subparagraph (L), by inserting <quote>and the use of alternative pathways that connect families to community-based prevention services where possible instead of system involvement</quote> after <quote>differential response</quote>; and</text></subparagraph><subparagraph id="id3F1139B92A404B5C972E327D8AD68F05"><enum>(B)</enum><text>in subparagraph (O)—</text><clause id="id7C4967105EB64F6192F1224933A19420"><enum>(i)</enum><text>in clause (ix), by inserting <quote>presence of domestic violence,</quote> after <quote>size),</quote>;</text></clause><clause id="id97CAB5905D624100A5186E599A5561A8"><enum>(ii)</enum><text>in clause (x), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="id8BD3CCEBACA546DB95199C32EE54C260"><enum>(iii)</enum><text>in clause (xi), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause id="id1DAA7D2D32C942D1A86ABB29651CE3E8"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC12F66161E11410A986A10DD35BFC0DB"><clause id="idB0AF910FE43D47868DF48204ED59B886"><enum>(xii)</enum><text>the prevalence of domestic violence in child abuse and neglect reports and open cases.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id64123E66DDD547848B200A9089510A20"><enum>(2)</enum><text>in subsection (b)(2)—</text><subparagraph id="idFECA487BF86242C29B9BB25DCFA344FA"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id1CEE70E9B6DF44DE987435D8908A1609"><enum>(B)</enum><text>in subparagraph (D), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id1F80F456BF4D48F296530A0F20DDD314"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id324AF49486A2480483F321270FD68405"><subparagraph id="idA1A786B4B57B4BFAAB69D1C01B825639"><enum>(E)</enum><text>ways to safely decrease the number of families being referred to child protective services and instead provide them with alternative pathways to community-based child abuse prevention services that strengthen families.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1A5D4088986F42898C919D84B86B2459"><enum>(3)</enum><text>in subsection (e)(3), by inserting <quote>and for demonstration projects that focus on building research-based protective factors in community organizations, health care, and schools for adult and child survivors of domestic violence as a strategy for keeping children out of the child protective services system</quote> before the period.</text></paragraph></section><section id="id7B08067604A648799686BECE69424A81"><enum>6.</enum><header>Grants to States, Indian Tribes or Tribal organizations, and public or private agencies and organizations</header><text display-inline="no-display-inline">Section 105(a) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106">42 U.S.C. 5106(a)</external-xref>) is amended—</text><paragraph id="id98201C4B41FF4A6DBEE7E5CC0FA3A5D3"><enum>(1)</enum><text>in paragraph (2)(B), by inserting <quote>and case management</quote> after <quote>through referral</quote>;</text></paragraph><paragraph id="id832009651BAB4663A58E61DE1081F35F"><enum>(2)</enum><text>in paragraph (5), by inserting <quote>for survivors or people who use violence</quote> after <quote>violence service agencies</quote>;</text></paragraph><paragraph id="id3CA1C6D08AE34C33A38D4A51C1B15C06"><enum>(3)</enum><text>in paragraph (6), by inserting <quote>accountability and meaningful pathways to change for the person using violence,</quote> after <quote>parent involved and children,</quote>; and</text></paragraph><paragraph id="idF5AC2AFD20624678B7EA5BDE4F00CF03"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5AEA44144A784A7FA0E97A196569BA26"><paragraph id="id92A37BB501124A69B051E44009ABE6A9"><enum>(8)</enum><header>Alternative pathways to community-based family-strengthening services and programs</header><text>The Secretary may award grants to collaborations of State, Tribal, and local child welfare agencies with community-based providers to support the development and implementation of alternative pathways and systems and supports that connect families experiencing difficulty meeting basic needs or risk factors associated with child abuse and neglect to community-based systems and programs that assist families seeking support as an alternative to the child protection system, such as supporting—</text><subparagraph id="id4FFA8759258C4825A44D735BFD4612FE"><enum>(A)</enum><text>the development and implementation of— </text><clause id="idB0CF77C065604287906C949C8F76DA1D"><enum>(i)</enum><text>local or State helplines, websites, or mobile applications that provide information or assistance and connect families to voluntary community-based support services, including local programs supported under title II;</text></clause><clause id="idCB924BAA666A47F99A9E138D353073B1"><enum>(ii)</enum><text>a continuum of preventive services that strengthen families and promote child, parent, and family well-being; and</text></clause><clause id="id822F73C59072449BA147F07D8884B207"><enum>(iii)</enum><text>alternative pathways for mandatory reporters and other concerned adults to use to connect families to voluntary supports outside of child protection systems and educating adults about such pathways; and</text></clause></subparagraph><subparagraph id="id7FDE4506C17B4D3EB333A4F8B9A44356"><enum>(B)</enum><text>the hiring of personnel to help connect families to voluntary supports outside of child protection systems, navigate barriers to accessing these services, and ensure services exist where families live and work.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idCF100385B9DE49FD9E3649C0517AAA34"><enum>7.</enum><header>Grants to States for child abuse or neglect prevention and treatment programs</header><text display-inline="no-display-inline">Section 106 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106a">42 U.S.C. 5106a</external-xref>) is amended—</text><paragraph id="idA0B0326A6CE94E42858C99F79036B717"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idE1794546E8A24AC9AF81E51E3ED14421"><enum>(A)</enum><text>in paragraph (13)(B), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id2706B9BAA9154480A7968AE8A3485856"><enum>(B)</enum><text>in paragraph (14)(B), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id35B49969E4754AD594FAFF754C69BD0E"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25CCE092FDD34CE389BDE72F42E2B459"><paragraph id="idBB3E0CE67E324BC3B945FA6561EEFBE2"><enum>(15)</enum><text>improving the child protective system to focus children at most serious risk of harm and safely reduce the number of families investigated for child abuse and neglect by increasing the number of families connected to voluntary, community-based systems and programs that assist families in need of supports and services, including by developing, implementing, and expanding—</text><subparagraph id="idd04f1f649d0e415baf38113f712ed749"><enum>(A)</enum><text>local or State helplines, websites, and mobile applications that connect families to voluntary community-based resources, including local programs funded under title II;</text></subparagraph><subparagraph id="id8d366967d21640769cbe99c3ce21b177"><enum>(B)</enum><text>a continuum of preventive services that strengthen families and promote child, parent, and family well-being;</text></subparagraph><subparagraph id="idc70c7bfcb05b48b8b67ba06ac81347ac"><enum>(C)</enum><text>alternative pathways for mandatory reporters and other concerned adults to use to refer families for voluntary supports outside of child protection systems and educating adults about such systems; and</text></subparagraph><subparagraph id="id04cc9f0cd32e4e97ad47d3d75701089f"><enum>(D)</enum><text>personnel to help connect families to voluntary supports outside of child protection systems, navigate barriers to accessing these services, and ensure services exist where families live and work.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id9C834F7CD3524E18B38053242F7D1865"><enum>(2)</enum><text>in subsection (b)(2)(D)—</text><subparagraph id="idF3B0F54DAC834FB28958D91170ADA05F"><enum>(A)</enum><text>in clause (v), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="idF3A7F9A45B9F41DE9C893D1B61D5793C"><enum>(B)</enum><text>in clause (vi), by adding <quote>and</quote> after the semicolon; and</text></subparagraph><subparagraph id="id9FACE225A77A479B9EFE4B050026C377"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id59651A00C59B421992B3B8FB2F9DC1AB"><clause id="idBDB173F498844FD6ABAF4FAD50E4EA29"><enum>(vii)</enum><text>changes in policies and procedures of State and local child welfare agencies that— </text><subclause id="idC1F36D7F72694082859233D854C708CA"><enum>(I)</enum><text>reduce the number of families referred to such agencies for incidents that are not child abuse or neglect, such as families referred to the child protective system solely based on circumstances related to poverty; </text></subclause><subclause id="id102BE2CC500243A195CD82FBF56BF647"><enum>(II)</enum><text>develop, implement, and scale systems of alternative pathways (in coordination with the lead entity and local programs supported by title II) that connect such families to voluntary community-based support to build protective factors that reduce the likelihood of child abuse and neglect, or that reduce harm as a result of domestic violence, including efforts to educate mandatory reporters and other concerned adults about such systems to refer families for voluntary supports outside of child protection systems; and</text></subclause><subclause id="id4730A6D572254A9E8FE14102D3890C37"><enum>(III)</enum><text>increase supports for families in navigating and accessing voluntary community-based support to reduce the likelihood of child abuse and neglect or that reduce harm as a result of domestic violence, including personnel and casework.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="idA59B22B13B5E4EF693B6BED87E1B1ABB"><enum>8.</enum><header>Grants to States for programs relating to the investigation and prosecution of child abuse and neglect cases</header><text display-inline="no-display-inline">Section 107(c)(1) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106c">42 U.S.C. 5106c(c)(1)</external-xref>) is amended—</text><paragraph id="idA35798B2D5624259846403A0904204AA"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="id026DCCBEEBBC437B91220C5B24E20520"><enum>(2)</enum><text>in subparagraph (J), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id88CF62E8EFC34FBDB6E68A1B032FEEA0"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id920C5C0A95D544CB9FAEE8932C7F6AA6"><subparagraph id="idEFD48D1874084D1195B055D593D35EB4"><enum>(K)</enum><text>domestic violence and sexual violence prevention and treatment advocates.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id23A96B4906884993AD40BB41C2886A6B"><enum>9.</enum><header>Authorization of appropriations</header><subsection id="idFC3D3E51A0D240EAA7E3AE19DB85AF06"><enum>(a)</enum><header>Title I</header><text display-inline="yes-display-inline">Section 112(a)(1) of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106h">42 U.S.C. 5106h(a)(1)</external-xref>) is amended by striking <quote>$120,000,000 for fiscal year 2010 and such sums as may be necessary for each of the fiscal years 2011 through 2015</quote> and inserting <quote>$500,000,000 for fiscal year 2022 and such sums as may be necessary for each of fiscal years 2023 through 2027</quote>.</text></subsection><subsection id="id6F65D022F7DD45A5AF612C7C6E7FFB7A"><enum>(b)</enum><header>Title II</header><text>Section 209 of the Child Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5116i">42 U.S.C. 5116i</external-xref>) is amended by striking <quote>$80,000,000 for fiscal year 2010 and such sums as may be necessary for each of the fiscal years 2011 through 2015</quote> and inserting <quote>$1,000,000,000 for fiscal year 2022 and such sums as may be necessary for each of fiscal years 2023 through 2027</quote>.</text></subsection></section></legis-body></bill>
