Authorization of appropriations.</toc-entry></toc></subsection></section><section id="id4829C4F762864F08984F541913B2B214"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of the Interior.</text></section><title id="H2751A346ACDB46088E8294433AD83105"><enum>I</enum><header>North America Butterfly Conservation Fund Act of 2021</header><section id="HFC00FBC4890E475D9044A448F791076E"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>North America Butterfly Conservation Fund Act of 2021</short-title></quote>.</text></section><section id="H2E973B677A4241899A4EC674C065E688"><enum>102.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this title are—</text><paragraph id="HAB3D74AD60344A32B81AADD990963F6A"><enum>(1)</enum><text>to perpetuate healthy populations of butterflies in North America;</text></paragraph><paragraph id="HBCEFFC6C3EDF4392AAD919705033799B"><enum>(2)</enum><text>to assist in the conservation of threatened and endangered butterflies by supporting conservation initiatives in North America; and</text></paragraph><paragraph id="H5BE0D841C68C4611A514B4AE01E4C9D1"><enum>(3)</enum><text>to provide financial resources and to foster international cooperation for the conservation initiatives described in paragraph (2).</text></paragraph></section><section id="H342EAA1B35684522BDAB5EF2690C0E44"><enum>103.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph commented="no" display-inline="no-display-inline" id="idF147A59F89324934B60AB4D20C4FBBCD"><enum>(1)</enum><header display-inline="yes-display-inline">Butterfly</header><text display-inline="yes-display-inline">The term <term>butterfly</term> means any member of the order Lepidoptera.</text></paragraph><paragraph id="idBD1C3E84B3F743428B2E670CA699792F"><enum>(2)</enum><header>Conservation</header><text>The term <term>conservation</term> means the use of all methods and procedures necessary to protect the habitats of butterflies in North America and the butterflies in those habitats, including—</text><subparagraph id="H85C4BA7FF53C494481105FDBBD65BFBB"><enum>(A)</enum><text>protection, restoration, and management of the habitats;</text></subparagraph><subparagraph id="H2F7B0BFCE0154F4BACA20DA2477845DA"><enum>(B)</enum><text>onsite research and monitoring of—</text><clause id="idF85795D76B4E40A88BF58691FE4E19D4"><enum>(i)</enum><text>butterfly populations;</text></clause><clause id="id7FE92CA029894C0AAC6A0F8823DDA143"><enum>(ii)</enum><text>butterfly habitats;</text></clause><clause id="id10422D0F7E3C4907A1299721E066EF0D"><enum>(iii)</enum><text>annual butterfly reproduction; and</text></clause><clause id="id51A97D7110364913BF84F79A46B9E606"><enum>(iv)</enum><text>butterfly species population trends;</text></clause></subparagraph><subparagraph id="HBC70A260A86143EDBE1A4CF5B35D47C8"><enum>(C)</enum><text>assistance in the development, implementation, and improvement of national and regional management plans;</text></subparagraph><subparagraph id="H262B12E72E114761B2730030C399D3C4"><enum>(D)</enum><text>enforcement and implementation of applicable conservation laws; and</text></subparagraph><subparagraph id="H7FA667BEDA634FC1A687794399621BDB"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph><paragraph id="HD6128D7E8BF241F88D266B22DF5E96C8"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the North America Butterfly Conservation Fund established by section 105(a).</text></paragraph><paragraph id="HE1D0460CFE97464995158AEB8C3BDD5C"><enum>(4)</enum><header>North America</header><text>The term <term>North America</term> means—</text><subparagraph id="id7AA283BB02C24B9E876A47A37019507E"><enum>(A)</enum><text>Antigua and Barbuda;</text></subparagraph><subparagraph id="idAC749F9C9EB14902A1940BA553F5AB7F"><enum>(B)</enum><text>the Bahamas;</text></subparagraph><subparagraph id="id9ADB027AD9834A4FAC16730E3E13F1AA"><enum>(C)</enum><text>Barbados;</text></subparagraph><subparagraph id="idB4C4B2DB5BDF41E1AA3F957B4C40A141"><enum>(D)</enum><text>Belize;</text></subparagraph><subparagraph id="id611E41AFAFC44514B70C994EA20AC5E3"><enum>(E)</enum><text>Canada;</text></subparagraph><subparagraph id="idF062A73B1D6349958479ADF088905F5E"><enum>(F)</enum><text>Costa Rica;</text></subparagraph><subparagraph id="id106FB57D2C044E46B6DCD745E851DAFD"><enum>(G)</enum><text>Cuba;</text></subparagraph><subparagraph id="idACFC15E323954869B6D3FB49A9D360F0"><enum>(H)</enum><text>Dominica;</text></subparagraph><subparagraph id="id7AD743A3DE814978BFD93E3CF7AD5B90"><enum>(I)</enum><text>the Dominican Republic;</text></subparagraph><subparagraph id="id5FF26F208BA2456DA1E27F4947932B6B"><enum>(J)</enum><text>El Salvador;</text></subparagraph><subparagraph id="id1F21F71AC5264906AAF212CB7171289C"><enum>(K)</enum><text>Grenada;</text></subparagraph><subparagraph id="id2DC520AF045445B196B6FD1EF2E74510"><enum>(L)</enum><text>Guatemala;</text></subparagraph><subparagraph id="id03216CF59EEA441FB750F341D74F346F"><enum>(M)</enum><text>Haiti;</text></subparagraph><subparagraph id="id75BE3C2FFDDB43C797F5760A53D28885"><enum>(N)</enum><text>Honduras;</text></subparagraph><subparagraph id="idCC4C5E0B904E4DC29FDF9A4CBF7B141D"><enum>(O)</enum><text>Jamaica;</text></subparagraph><subparagraph id="id4371E25309A34C718FAA80F0BECE56CA"><enum>(P)</enum><text>Mexico;</text></subparagraph><subparagraph id="id16A58BD8D5CB46189966354CE9E2F793"><enum>(Q)</enum><text>Nicaragua;</text></subparagraph><subparagraph id="id1BE4ABF3C9ED4DFBBFFACC1CFE2268A0"><enum>(R)</enum><text>Panama;</text></subparagraph><subparagraph id="idAC3A04493A5A475EBCAD1AC95C30D3B6"><enum>(S)</enum><text>Saint Kitts and Nevis;</text></subparagraph><subparagraph id="id4B147740134340178BB51A5FAA249CE5"><enum>(T)</enum><text>Saint Lucia;</text></subparagraph><subparagraph id="idD36D505AD9BA4669A726479BF32C227E"><enum>(U)</enum><text>Saint Vincent and the Grenadines;</text></subparagraph><subparagraph id="id88A3FE5C713444C99D3D6E4EECFEF46E"><enum>(V)</enum><text>Trinidad and Tobago; and</text></subparagraph><subparagraph id="id06C0C8BF502D4FA9B0B6FB2322A82F2C"><enum>(W)</enum><text>the United States.</text></subparagraph></paragraph></section><section id="HA7783F55ED11414E9FDD77FEB397304C"><enum>104.</enum><header>North America butterfly conservation assistance</header><subsection id="H9FD355A50196441FB7D73D21D15CF1E9"><enum>(a)</enum><header>Assistance</header><paragraph id="H732AE3A4FBFD43EFBFBBD70CB5FD64AD"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds, and in consultation with other Federal officials, the Secretary shall use amounts in the Fund to provide financial assistance for projects for the conservation of butterflies and for which a project proposal is approved by the Secretary under subsection (c).</text></paragraph><paragraph id="H976CB4BFF4FE47B1986FE7AA10120E70"><enum>(2)</enum><header>Use of existing authorities</header><text>Assistance provided under this section shall be carried out in a manner consistent with authorities available to the Secretary under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></paragraph></subsection><subsection id="H58A28EBACC794640A2C7B44BA759C0D0"><enum>(b)</enum><header>Project proposals</header><paragraph id="HC92F81C102644B4DA705405D1D7FC10D"><enum>(1)</enum><header>Eligible applicants</header><text>A proposal for a project for the conservation of butterflies may be submitted to the Secretary by—</text><subparagraph id="H65F57EE177F44EFABCF958791C9C5321"><enum>(A)</enum><text>a State that has within its boundaries butterfly habitat;</text></subparagraph><subparagraph id="idC660E137AD0849F3A6EF255A45F8C359"><enum>(B)</enum><text>a Tribal agency of an Indian Tribe the Tribal land of which contains butterfly habitat;</text></subparagraph><subparagraph id="id0C599B386432422D9C443B965A4E80B2"><enum>(C)</enum><text>a relevant State agency, Tribal agency, research institution, nonprofit organization, or wildlife management authority in North America that directly or indirectly affects butterfly conservation, as determined by the Secretary; or</text></subparagraph><subparagraph id="H92536E09A232442A9926E9AEF3EDFA36"><enum>(D)</enum><text>any other individual or entity, as determined appropriate by the Secretary, with the demonstrated expertise required for the conservation of butterflies in North America.</text></subparagraph></paragraph><paragraph id="H5EA18EEB6CA64A28B52EA77B5DFD8632"><enum>(2)</enum><header>Federal partnership opportunities</header><subparagraph id="idDD5C4B6FBCEB490E92A52D60909A13ED"><enum>(A)</enum><header>In general</header><text>A Federal agency may be included as a partner or a collaborator on a project that receives funding under this section.</text></subparagraph><subparagraph id="idE76C1747BD5B4FE092B18E89494F61B1"><enum>(B)</enum><header>Prohibition</header><text>A Federal agency may not—</text><clause id="id2A8AB4B5144743768D8C016475BFE3B0"><enum>(i)</enum><text>be a lead entity on a project that receives funding under this section; or</text></clause><clause id="id551D17DAE73841B2A691EFB568089BD7"><enum>(ii)</enum><text>receive funding for a project under this section.</text></clause></subparagraph></paragraph><paragraph id="H19F3DB6B52E74BF99CEACE4A7AF90B36"><enum>(3)</enum><header>Required elements</header><text>A project proposal shall include—</text><subparagraph id="H5C50E0DEB1144903B7351B7E1D7A9220"><enum>(A)</enum><text>a statement of the purposes of the project;</text></subparagraph><subparagraph id="H7D5701CA279F49F3A4F573B38413FCBD"><enum>(B)</enum><text>the name of the entity or individual with overall responsibility for the project;</text></subparagraph><subparagraph id="H459CD7000704432EA2299AACDEA7DC4A"><enum>(C)</enum><text>a description of—</text><clause id="H7563B8CB012846C0A446DC0D7504BBE5"><enum>(i)</enum><text display-inline="yes-display-inline">the qualifications of the entity or individuals that will carry out the project;</text></clause><clause id="H6C3C5837117042D1A9823DC115757202"><enum>(ii)</enum><text>methods for project implementation and outcome assessment;</text></clause><clause id="HB169ECA40CAA42A2B0B6F5D44560E8D3"><enum>(iii)</enum><text>staffing and stakeholder engagement for the project;</text></clause><clause id="H4BAF8944AF1646D0B377C4683F4137F6"><enum>(iv)</enum><text>the logistics of the project, including cost estimates and timelines;</text></clause><clause id="H632C74DF43F84AFD955E9F9D8324D9D1"><enum>(v)</enum><text>anticipated outcomes of the project; and</text></clause><clause id="H9C58C3E610BB4E0180DD4F0EC13216D2"><enum>(vi)</enum><text>mechanisms to encourage adequate local public participation in project development and implementation;</text></clause></subparagraph><subparagraph id="H0D465DE85FF8462295DB23166005E1C5"><enum>(D)</enum><text>assurances that the project will be implemented in consultation with relevant wildlife management authorities, Indian Tribes, and other appropriate government officials;</text></subparagraph><subparagraph id="H735EB41EBD0B43A185175FB2D625E66D"><enum>(E)</enum><text>evidence of free, informed, and prior consent by indigenous communities in the areas in which the project will be conducted, if the Secretary determines that the consent is required for the success of the project;</text></subparagraph><subparagraph id="H80C49B95150247B28B12A159C37193C8"><enum>(F)</enum><text>demonstrated sensitivity to—</text><clause id="id70D97AEA243F4A1887DCE5FAC3452223"><enum>(i)</enum><text>local historic and cultural resources; and</text></clause><clause id="idD4B8D8FC27B8492FB98E732C4AE3487B"><enum>(ii)</enum><text>compliance with applicable laws;</text></clause></subparagraph><subparagraph id="H431A765DB864421EBEBEE79F264F7B17"><enum>(G)</enum><text>information that demonstrates the potential of the project to contribute to the conservation of butterfly populations in North America;</text></subparagraph><subparagraph id="H5488692A85A44AC684A77B5487E49E74"><enum>(H)</enum><text>evidence of support for the project by appropriate governmental entities of the countries, Indian Tribes, and indigenous communities in which the project will be conducted, if the Secretary determines that the support is required for the success of the project;</text></subparagraph><subparagraph id="H690AEF8F75F14CE1AD98535F248ACD1B"><enum>(I)</enum><text display-inline="yes-display-inline">information regarding the source and amount of any matching funding available for the project; and</text></subparagraph><subparagraph id="H5AFF3040EB1B413395F1C2B23C6A8252"><enum>(J)</enum><text>such other information as the Secretary may require.</text></subparagraph></paragraph></subsection><subsection id="H6D9489A5ACF24D1C9C5FF09916BC6C0D"><enum>(c)</enum><header>Project review and approval</header><paragraph id="H912683E038B8424A96A333113DB877D0"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="H9B75612A332A4CFCBE01483D528D5DF9"><enum>(A)</enum><text>not later than 30 days after receiving a project proposal, provide a copy of the proposal to other Federal officials, as appropriate; and</text></subparagraph><subparagraph id="H4740C8B9A1CB43729BB43BF49FC8D899"><enum>(B)</enum><text>review each project proposal in a timely manner to determine whether the proposal meets the criteria described in paragraph (3).</text></subparagraph></paragraph><paragraph id="HFE10940B2B274D369E1EFCB09C0FFE11"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Subject to the availability of funds, not later than 180 days after receiving a project proposal, the Secretary, after consulting with other Federal officials, as appropriate, shall—</text><subparagraph id="H078362D2FF9B445EAE79CFAA54DC8812"><enum>(A)</enum><text>consult with the government of each country in which the project is to be carried out regarding the proposal;</text></subparagraph><subparagraph id="H19043BAC62874B39BD6F13DD0CC4E87B"><enum>(B)</enum><text>after taking into consideration any comments resulting from the consultation under subparagraph (A), approve or disapprove the project proposal; and</text></subparagraph><subparagraph id="H706BBCBA1A0C409BAA88650AF9C013C9"><enum>(C)</enum><text>provide written notification of the approval or disapproval of the project proposal to—</text><clause id="id188DCEDCB81D4646B6E27D47687CF314"><enum>(i)</enum><text>the person that submitted the project proposal;</text></clause><clause id="idE985066A0F184EDA8E78A9A276194A49"><enum>(ii)</enum><text>other appropriate Federal officials; and</text></clause><clause id="id51D944611B9D479BA202813CBE5F7140"><enum>(iii)</enum><text>each country described in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="H496689D93B9D4CB6912415AB6F16D900"><enum>(3)</enum><header>Criteria for Approval</header><subparagraph id="H4B8D7A34A4B04529BB4A053E6B3EEBEC"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may approve a project proposal under this section if the project will help recover and sustain viable populations of butterflies in the wild by assisting efforts in North America to implement butterfly conservation programs.</text></subparagraph><subparagraph id="HEAAFD3438D9541B8BA2B0D706C0D33AE"><enum>(B)</enum><header>Priority</header><text>In determining whether to approve a project proposal under this section, the Secretary shall give the highest priority to projects that conserve species listed as threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></subparagraph><subparagraph id="HC867ECEB14B44E00AC351F1106377961"><enum>(C)</enum><header>Preferences</header><text>In determining whether to approve a project proposal under this section, the Secretary, to the maximum extent practicable, shall give preference to—</text><clause id="id4B2E9A8713E44FBC87BF8B1476FB0D0B"><enum>(i)</enum><text>conservation projects that are designed to ensure effective, long-term conservation of butterflies and butterfly habitats; and</text></clause><clause id="id6FC64F20894B40929BA18F758F2E3572"><enum>(ii)</enum><text>projects for which matching funds are available.</text></clause></subparagraph><subparagraph id="HB6E79A2F44F34147B606CD9545A9EC6A"><enum>(D)</enum><header>Waiver</header><text>The Secretary may waive the application of subparagraphs (B) and (C) if the Secretary determines that the waiver is necessary to support a conservation project that the Secretary has identified as being of high priority.</text></subparagraph></paragraph></subsection><subsection id="HE723061D6FDC4332BCE88275A9A882FC"><enum>(d)</enum><header>Project reporting</header><paragraph id="HAE7C7C9683C048E0A083E274325BAD56"><enum>(1)</enum><header>In general</header><text>Each person that receives assistance for a project under this section shall submit to the Secretary, at such intervals as the Secretary may require, periodic reports that include all information that the Secretary, after consultation with other Federal Government officials, determines is necessary to evaluate the progress and success of the project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph><paragraph id="H836E19A67C664B4EABA95AB045EA2ABA"><enum>(2)</enum><header>Availability to the public</header><text>Each report under paragraph (1) and any other document relating to a project for which financial assistance is provided under this title shall be made available to the public in a timely manner.</text></paragraph></subsection></section><section id="H5E3EE004E8CD4F27A6467CC145D1A09C"><enum>105.</enum><header>North America Butterfly Conservation Fund</header><subsection id="HD80195B8FC3F4E328400FDE2821E1D57"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a separate account, to be known as the <quote>North America Butterfly Conservation Fund</quote>, consisting of—</text><paragraph id="H874EDDC414BA40BC989E9758FA482589"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph><paragraph id="HCA28C13279834B9BA70B40F540AB35F4"><enum>(2)</enum><text>amounts appropriated to the Fund under section 107; and</text></paragraph><paragraph id="HC1DA8471A07E49AAB596B08D6FDDB116"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection><subsection id="H81A4FCD5EB21435BA45D0830178695F8"><enum>(b)</enum><header>Expenditures from fund</header><paragraph id="H8135800DEC5744869B3598C77BAA32A4"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 104.</text></paragraph><paragraph id="H4C430820863C468AADE2FBCCE47AE950"><enum>(2)</enum><header>Administrative expenses</header><text>To pay the administrative expenses necessary to carry out this title in a fiscal year, the Secretary may expend from the Fund not more than the greater of—</text><subparagraph id="id4B428D132BEB4E2C86FD4093B7279AFA"><enum>(A)</enum><text>3 percent of the amounts in the Fund that are available for the fiscal year; and</text></subparagraph><subparagraph id="id9D3D99183B5442DB94137644DD0ABEDF"><enum>(B)</enum><text>$80,000.</text></subparagraph></paragraph></subsection><subsection id="HEAA06B35D06446558E1433B4942561EE"><enum>(c)</enum><header>Investment of amounts</header><paragraph id="HC951715FACA644A1B82698FDA1C73D49"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest the portion of the Fund that is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals.</text></paragraph><paragraph id="id0635DD2F97C34DC085E83FD516C45B54"><enum>(2)</enum><header>Requirement</header><text>Investments under paragraph (1) may be made only in interest-bearing obligations of the United States.</text></paragraph><paragraph id="H492A9D91CE564A0385F090B19B4BAEC6"><enum>(3)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations of the United States may be acquired—</text><subparagraph id="H04189795AF2D4BA5A6121B62775F229C"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph><subparagraph id="HC300D116113045A290D644214B8B5E11"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph><paragraph id="HA506AFC0D845402B994CD8B31573A3A7"><enum>(4)</enum><header>Sale of obligations</header><text>Any obligation of the United States acquired by the Fund may be sold by the Secretary of the Treasury at market price.</text></paragraph><paragraph id="HE5ECFBD6DDFD4E7AB5D1439DAA701007"><enum>(5)</enum><header>Credits to fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection><subsection id="H1D265A034A1D46F486AEA5E4118432E9"><enum>(d)</enum><header>Transfers of amounts</header><paragraph id="HDDAD24ADEA4A455585A4AC179B6BBC95"><enum>(1)</enum><header>In general</header><text>Not less frequently than monthly, the Secretary of the Treasury shall transfer from the general fund of the Treasury to the Fund the amounts required to be transferred to the Fund under this section on the basis of estimates made by the Secretary of the Treasury.</text></paragraph><paragraph id="HA02AE7004A2D48CFA2483C27CA04E73C"><enum>(2)</enum><header>Adjustments</header><text>In carrying out paragraph (1), the Secretary of the Treasury shall make proper adjustments in amounts transferred to the Fund to the extent that prior estimates were in excess of or less than the amounts required to be transferred under this section.</text></paragraph></subsection><subsection id="HECDACE05C69D420DB7487E111262CC63"><enum>(e)</enum><header>Acceptance and use of donations</header><paragraph id="HA2328DD6E9D84DEEA7049B9932212795"><enum>(1)</enum><header>In general</header><text>The Secretary may accept for the Government, and shall transfer to the Secretary of the Treasury for deposit into the Fund, a gift to provide assistance under section 104 of—</text><subparagraph id="H3F1D8475B5AA42E9AAAF4E457FDC201E"><enum>(A)</enum><text display-inline="yes-display-inline">money;</text></subparagraph><subparagraph id="HC6D7C8394EF8461F9C48BA1CD65D06CB"><enum>(B)</enum><text>an obligation of the Government included in the public debt made only on the condition that the obligation be canceled and retired and not reissued; or</text></subparagraph><subparagraph id="H11ECB51933EE4F4B974D8F3146975204"><enum>(C)</enum><text>any other intangible personal property made only on the condition that the property is sold on the best terms available and the proceeds are deposited in the Fund.</text></subparagraph></paragraph><paragraph id="HF4B68A3818F34CA59C87060A92F4B307"><enum>(2)</enum><header>Discretion to reject a gift</header><text>The Secretary may reject a gift under this subsection when the rejection is in the interest of the Government, as determined by the Secretary.</text></paragraph><paragraph commented="no" id="HD9661B16DE1B443E995D0546A685E1A3"><enum>(3)</enum><header>Taxes</header><text>If a gift received under this subsection is subject to a gift or inheritance tax, the Secretary may pay the tax out of the proceeds of the gift or the proceeds of the redemption or sale of the gift.</text></paragraph></subsection></section><section id="H10EBA91431EF42089EE19F82F1D85992"><enum>106.</enum><header>Report to Congress</header><subsection id="id48EC9BA3E718499580F33B0A7E1CEA4B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 31 of each year, the Secretary shall submit to Congress a report regarding the Fund and the status of butterflies in North America.</text></subsection><subsection id="id071D244235694A44BBD36620163730ED"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include, for the year covered by the report, a description of—</text><paragraph id="HDD61CDA70303419998E8920B3C34F5A1"><enum>(1)</enum><text>the total amounts deposited into and expended from the Fund;</text></paragraph><paragraph id="H6D42B827F94647F1809934AC52D19075"><enum>(2)</enum><text>the costs associated with the administration of the Fund;</text></paragraph><paragraph id="H3269B683A31B41C2B4076A9B4446A1C2"><enum>(3)</enum><text>a summary of the projects for which the Secretary has provided assistance under section 104 and an evaluation of those projects; and</text></paragraph><paragraph id="HFBD2FFCD078F44DF9A22842CFFA608FE"><enum>(4)</enum><text>an evaluation of the status of threatened and endangered butterfly populations in North America.</text></paragraph></subsection></section><section id="HF62F6C2758D24CF2BFAE667FF739FD76"><enum>107.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Fund $5,000,000 for each of fiscal years 2021 through 2026.</text></section></title><title id="HCA8443A95593465A8F5CB2799B1311C4"><enum>II</enum><header>Pacific Islands Plant Conservation Fund Act of 2021</header><section id="H94439602AD554E299BDC48858D7A9A3D"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Pacific Islands Plant Conservation Fund Act of 2021</short-title></quote>.</text></section><section id="HB4A9CC52D2FC4254A7F5E7118C621560"><enum>202.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to assist in the conservation of threatened and endangered plant species in the Hawaiian Islands and the Pacific Island Territories of the United States by supporting and providing financial resources for projects—</text><paragraph id="id9196B895B7704AE088DED228C6248DED"><enum>(1)</enum><text display-inline="yes-display-inline">to conserve plant species;</text></paragraph><paragraph id="idFFEAAE7558D1448CB4A78E868D600997"><enum>(2)</enum><text display-inline="yes-display-inline">to conserve the ecosystems of those plant species; and</text></paragraph><paragraph id="id4648E1E93E094A368ED59649BE8D43EA"><enum>(3)</enum><text display-inline="yes-display-inline">to address other threats to the survival of those plant species.</text></paragraph></section><section id="H372EFB0C6BCE486B995865A34054A121"><enum>203.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H2BA0053C3D0C4ED2980851C370A5D253"><enum>(1)</enum><header>Conservation</header><text>The term <term>conservation</term> means the use of all methods and procedures necessary to protect plants in the Pacific Islands, including—</text><subparagraph id="H89FDD11C61DF4E01B399199E96315672"><enum>(A)</enum><text>protection, restoration, and management of ecosystems;</text></subparagraph><subparagraph id="H2864D0A9D9A74C51B6E2897DF71AB8F7"><enum>(B)</enum><text>onsite research and monitoring of—</text><clause id="id37B3671203F2411FBBE3B359A7667523"><enum>(i)</enum><text>plant populations;</text></clause><clause id="id727FD414991E4CAFAF232554576C877A"><enum>(ii)</enum><text>plant ecosystems;</text></clause><clause id="id1373AF3304BB4891B8DDF55F86E1CB1C"><enum>(iii)</enum><text>annual plant reproduction; and</text></clause><clause id="id418A02C3ACA34D11A8695620190025C6"><enum>(iv)</enum><text>plant population trends;</text></clause></subparagraph><subparagraph id="HC6C02C450DD54ADEBCA583B228821B68"><enum>(C)</enum><text>assistance in the development, implementation, and improvement of management plans;</text></subparagraph><subparagraph id="HDD29F88F39C14405ABDBD5542A5CE3C2"><enum>(D)</enum><text>enforcement and implementation of applicable conservation laws; and</text></subparagraph><subparagraph id="H34338A6F16ED41C2BE76A0C38BA5BA69"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph><paragraph id="HB175FB9F3BEE41E19EA63564D7F6B7E6"><enum>(2)</enum><header>Fund</header><text>The term <term>Fund</term> means the Pacific Islands Plant Conservation Fund established by section 205(a).</text></paragraph><paragraph id="H77300982AC0349489A8D69D7DCFA6097"><enum>(3)</enum><header>Pacific Islands</header><text>The term <term>Pacific Islands</term> means—</text><subparagraph id="idAF1B597976034439B456B4E1981A7655"><enum>(A)</enum><text>the Hawaiian Islands; and</text></subparagraph><subparagraph id="idEF1A8973DCFC4E2EABBF14F146479643"><enum>(B)</enum><text>the United States territories of—</text><clause id="id5A96424227EE48B68F4B9AB4F0192441"><enum>(i)</enum><text>Guam;</text></clause><clause id="id2CBE4F67CA2F4DB48374725735F45A29"><enum>(ii)</enum><text>American Samoa; and</text></clause><clause id="idB784E91BA87B455AB26AF724A44359B4"><enum>(iii)</enum><text>the Commonwealth of the Northern Mariana Islands.</text></clause></subparagraph></paragraph></section><section id="H529410924B9B4013B1285DB379AC0514"><enum>204.</enum><header>Pacific Islands plant conservation assistance</header><subsection id="HEA1D70FC35D74654BE77EA5A142D262E"><enum>(a)</enum><header>Assistance</header><paragraph id="HEA4AEA36BBB84AD88FA76987BBC68BDC"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds, and in consultation with other Federal officials, the Secretary of the Interior shall provide competitive financial assistance, including multiyear grants, for projects for the conservation of plant species on the Pacific Islands and for which a project proposal is approved by the Secretary under subsection (c).</text></paragraph><paragraph id="HC8FF9C48C5024CFE944D0023D58C5605"><enum>(2)</enum><header>Use of existing authorities</header><text display-inline="yes-display-inline">Assistance provided under this section shall be carried out in a manner consistent with authorities available to the Secretary under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></paragraph></subsection><subsection id="H7DEA1B8513824948A060638011233369"><enum>(b)</enum><header>Project proposals</header><paragraph id="H9D8318C7895E47CCAAD0CD119A453D57"><enum>(1)</enum><header>Eligible applicants</header><text>A project proposal may be submitted to the Secretary under this section by—</text><subparagraph id="H43C7745301D1417D843879E70CF00C12"><enum>(A)</enum><text>a relevant State, territory, or Tribal agency with the research expertise required for the conservation of plant species on the Pacific Islands; and</text></subparagraph><subparagraph id="HE6909672C279486592A640F6D4E1EF79"><enum>(B)</enum><text>any other individual or entity, as determined appropriate by the Secretary, with the expertise required for the conservation of plant species on the Pacific Islands.</text></subparagraph></paragraph><paragraph id="H20FA0A6D05614111BAFA4BFF335CC9EA"><enum>(2)</enum><header>Federal partnership opportunities</header><subparagraph id="id460F6C8339A64A83BD84AAE578B68904"><enum>(A)</enum><header>In general</header><text>A Federal agency may be included as a partner or a collaborator on a project that receives funding under this section.</text></subparagraph><subparagraph id="idFEBFB81B319B4C53A1791263EBDF9850"><enum>(B)</enum><header>Prohibition</header><text>A Federal agency may not—</text><clause id="idAA0899C3DE49488381EEEFC54B30C47B"><enum>(i)</enum><text>be a lead entity on a project that receives funding under this section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id9FB475AF4E6C4496893D32373953126E"><enum>(ii)</enum><text>receive funding for a project under this section.</text></clause></subparagraph></paragraph><paragraph id="H4001705C80B94B0D8986E2B975876860"><enum>(3)</enum><header>Required elements</header><text>A project proposal shall include—</text><subparagraph id="H56AE743496874336A6BBD290CE577734"><enum>(A)</enum><text>a statement of the purposes of the project;</text></subparagraph><subparagraph id="HC734D2C9DBB1454B8D9AD08A072490AD"><enum>(B)</enum><text>the name of the entity or individual with overall responsibility for the project;</text></subparagraph><subparagraph id="H1CD9882F6F5049F8A49283B75DC79677"><enum>(C)</enum><text>a description of—</text><clause id="H77F1F059F8254582825C369E71404FAF"><enum>(i)</enum><text>the qualifications of the entity or individuals that will carry out the project;</text></clause><clause id="H0DFB11172ED347C684B0A425AB4CE78A"><enum>(ii)</enum><text>methods for project implementation and outcome assessment;</text></clause><clause id="H59D65198852943A7B876049F9FE8497D"><enum>(iii)</enum><text>staffing and stakeholder engagement for the project;</text></clause><clause id="HCDD5237E333D4F94B0A1F8531A01B96C"><enum>(iv)</enum><text>the logistics of the project, including cost estimates and timelines;</text></clause><clause id="HFB233D4070CC4171BF7E332369DD2E82"><enum>(v)</enum><text>anticipated outcomes of the project;</text></clause><clause id="H35C7A0A882494E5D92E8544B408DA658"><enum>(vi)</enum><text>mechanisms to ensure adequate local public participation in project development and implementation; and</text></clause><clause id="H7B00DBE255F7427AB7C3CD702F5BAB4A"><enum>(vii)</enum><text>how the project will promote sustainable, effective, long-term programs to conserve plant populations on the Pacific Islands;</text></clause></subparagraph><subparagraph id="H0D2A9236C81D4A5FBF38B7A74684CC1D"><enum>(D)</enum><text>demonstrated sensitivity to—</text><clause id="idD1A1F62B4AB64FE081F617017E227169"><enum>(i)</enum><text>local historic and cultural resources; and</text></clause><clause id="id34A76050C22D41AC944158C4C2011810"><enum>(ii)</enum><text>compliance with applicable laws;</text></clause></subparagraph><subparagraph id="H4584F349DC2845E8BFC53ADF98867277"><enum>(E)</enum><text>assurances that the project will be implemented in consultation with relevant wildlife management authorities, Indian Tribes, and other appropriate government officials;</text></subparagraph><subparagraph id="H022D60197CC246C9AA4B959863FD2EBF"><enum>(F)</enum><text>information that demonstrates the clear potential of the project to contribute to the conservation of threatened and endangered plant species on the Pacific Islands;</text></subparagraph><subparagraph id="H92CA0131569C4AFC9BB9DF0568A3F2E4"><enum>(G)</enum><text>information regarding the source and amount of any matching funding available for the project; and</text></subparagraph><subparagraph id="H31F5B93C3F414D40966A8DE7D0F0EED9"><enum>(H)</enum><text>such other information as the Secretary may require.</text></subparagraph></paragraph></subsection><subsection id="H68D4127BFEDB45E6AAEF0A785578E0D5"><enum>(c)</enum><header>Project review and approval</header><paragraph id="H54BB5D75AEBC4BC3992D111CF821F0BB"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="H85F984EE328743709E642CBCB09AB363"><enum>(A)</enum><text>not later than 30 days after receiving a project proposal, provide a copy of the proposal to other Federal officials, as appropriate; and</text></subparagraph><subparagraph id="H7ADB363E8632434180A5846A44FF0C32"><enum>(B)</enum><text>review each project proposal in a timely manner to determine whether the proposal meets the criteria described in paragraph (3).</text></subparagraph></paragraph><paragraph id="H3E1DDCA68CC740F48778300C14D4B17B"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Subject to the availability of funds, not later than 180 days after receiving a project proposal, the Secretary, after consulting with other Federal officials, as appropriate, shall—</text><subparagraph id="HA2E231F54D0744EC848A938BB1A77A77"><enum>(A)</enum><text>consult with the government of the State or territory in which the project is to be carried out regarding the proposal; and</text></subparagraph><subparagraph id="H3EEFE99F38464A33A3B84D13F26F18B1"><enum>(B)</enum><text>provide written notification of the approval or disapproval of the proposal to—</text><clause id="id6B91F816BA674EEF8FDACDBBBB7C65B2"><enum>(i)</enum><text>the individual or entity that submitted the project proposal;</text></clause><clause id="id1F4E64A0D95D48ACB5EDF23D5B13AAD5"><enum>(ii)</enum><text>other appropriate Federal officials; and</text></clause><clause id="id8422D7969FA64B479D7B9391A3C5E0A3"><enum>(iii)</enum><text>each State or territory described in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph id="H6FB280471F36412DA33E38A55E94640E"><enum>(3)</enum><header>Criteria for approval</header><subparagraph id="H6E37412F5F5E468F9445F68F583B7EAE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may approve a project proposal under this section if the project will help recover and sustain viable populations of threatened and endangered plants by assisting efforts on the Pacific Islands to implement plant conservation programs.</text></subparagraph><subparagraph id="HFEB22FB04423482E9B81081F78F2C2C3"><enum>(B)</enum><header>Priority</header><text>In determining whether to approve a project proposal under this section, the Secretary shall give the highest priority to projects that conserve species listed as threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></subparagraph><subparagraph id="HEDFFB6F053D54BF4AFFE079C633CD06F"><enum>(C)</enum><header>Preferences</header><text>In determining whether to approve a project proposal under this section, the Secretary, to the maximum extent practicable, shall give preference to—</text><clause id="id35D374063C3B4F5AA846BD0A4604D357"><enum>(i)</enum><text>conservation projects that are designed to ensure effective, long-term conservation of plants and plant ecosystems; and</text></clause><clause id="idD4C58CF1C4FD419D952DF2F00641A3A5"><enum>(ii)</enum><text>projects for which matching funds are available.</text></clause></subparagraph><subparagraph id="H9C4AF98F45464EC1815C3C1626992AAE"><enum>(D)</enum><header>Waiver</header><text>The Secretary may waive the application of subparagraphs (B) and (C) if the Secretary determines that the waiver is necessary to support a conservation project that the Secretary has identified as being of high priority.</text></subparagraph></paragraph></subsection><subsection id="H6527E4D4153045838D528BE2D1C48904"><enum>(d)</enum><header>Project reporting</header><paragraph id="H41D75D70C8434407AEC27CB754E42A11"><enum>(1)</enum><header>In general</header><text>Each individual or entity that receives assistance for a project under this section shall submit to the Secretary, at such intervals as the Secretary may require, periodic reports that include all information that the Secretary, after consultation with other government officials, determines is necessary to evaluate the progress and success of the project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph><paragraph id="H0532B904B2B748DEB8123B63C063B164"><enum>(2)</enum><header>Availability to the public</header><text>Each report under paragraph (1) and any other document relating to a project for which financial assistance is provided under this title shall be made available to the public in a timely manner.</text></paragraph></subsection></section><section id="H8F8EED3420234DC1B06F51CC87037213"><enum>205.</enum><header>Pacific Islands Plant Conservation Fund</header><subsection id="HAEBB54ABDA7D4BE49D7DA05AF5E06CE7"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a separate account, to be known as the <quote>Pacific Islands Plant Conservation Fund</quote>, consisting of—</text><paragraph id="HABBEB29A951D4CDF8B39926A58FF0EFD"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph><paragraph id="H3FE496FA59974210AFDB3D9F4769883D"><enum>(2)</enum><text>amounts appropriated to the Fund under section 207; and</text></paragraph><paragraph id="H9DFE1DAD9C20442C81F64132B0639727"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection><subsection id="H5D4DA92C2CAA4E339B92F7C3EE278AEF"><enum>(b)</enum><header>Expenditures from fund</header><paragraph id="H840BADE120064D779F9FBD3B78027604"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 204.</text></paragraph><paragraph id="idA25A83C19DE94470BD477D134398C934"><enum>(2)</enum><header>Administrative expenses</header><text>To pay the administrative expenses necessary to carry out this title in a fiscal year, the Secretary may expend from the Fund not more than the greater of—</text><subparagraph id="id76B2BC46C4324E048B61D4E06E685834"><enum>(A)</enum><text>3 percent of the amounts in the Fund that are available for the fiscal year; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id929A0B9B45C147F082EF113D5D7F26E4"><enum>(B)</enum><text>$80,000.</text></subparagraph></paragraph></subsection><subsection id="HE2EBDC4E57604325A925BDEB88C33AB3"><enum>(c)</enum><header>Investment of amounts</header><paragraph id="H5369F376C50141C4BEC79D0E673AC2C9"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest the portion of the Fund that is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals.</text></paragraph><paragraph id="id993CC28962CB4033BF6F2AFB86C90D6C"><enum>(2)</enum><header>Requirement</header><text>Investments under paragraph (1) may be made only in interest-bearing obligations of the United States.</text></paragraph><paragraph id="HF6F25B65140A4EE0903056A60E297F15"><enum>(3)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations of the United States may be acquired—</text><subparagraph id="HEBD3C512DDCF437CA1F3D8B30BF31F5D"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph><subparagraph id="HF92DD261E0C6434197CEC7CCE9CF5A5E"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph><paragraph id="H8265BEA5E4974161AD1B78EBFFCC8FE2"><enum>(4)</enum><header>Sale of obligations</header><text>Any obligation of the United States acquired by the Fund may be sold by the Secretary of the Treasury at market price.</text></paragraph><paragraph id="HB3BA43B68761410092BAEA6777953318"><enum>(5)</enum><header>Credits to fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection><subsection id="H1D63DBEBDFEC4F8EBB8BDFAB61634E6A"><enum>(d)</enum><header>Transfers of amounts</header><paragraph id="HB4ED6E6018514E1187198F5A402B9EF5"><enum>(1)</enum><header>In general</header><text>Not less frequently than monthly, the Secretary of the Treasury shall transfer from the general fund of the Treasury to the Fund the amounts required to be transferred to the Fund under this section on the basis of estimates made by the Secretary of the Treasury.</text></paragraph><paragraph id="H39D9566A7BAC4807A94CDDD3186F0F74"><enum>(2)</enum><header>Adjustments</header><text>In carrying out paragraph (1), the Secretary of the Treasury shall make proper adjustments in amounts transferred to the Fund to the extent that prior estimates were in excess of or less than the amounts required to be transferred under this section.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H7C976451367841DD95CA11A1DF067F07"><enum>(e)</enum><header>Acceptance and use of donations</header><paragraph id="H50F9EA9430E64EAB9D2DCF72FF00F367"><enum>(1)</enum><header>In general</header><text>The Secretary may accept for the Government, and shall transfer to the Secretary of the Treasury for deposit into the Fund, a gift to provide assistance under section 204 of—</text><subparagraph id="HBB74658452F74832858262C3AAA10DA8"><enum>(A)</enum><text display-inline="yes-display-inline">money;</text></subparagraph><subparagraph id="H768FEDB7E06049CF84E66FDCEA1607DF"><enum>(B)</enum><text>an obligation of the Government included in the public debt made only on the condition that the obligation be canceled and retired and not reissued; or</text></subparagraph><subparagraph id="HC75CB346D0004385BFA86E634F190A03"><enum>(C)</enum><text>any other intangible personal property made only on the condition that the property is sold on the best terms available and the proceeds are deposited in the Fund.</text></subparagraph></paragraph><paragraph id="H6002EE720D0A487C9C41C60C5652ED01"><enum>(2)</enum><header>Discretion to reject a gift</header><text>The Secretary may reject a gift under this subsection when the rejection is in the interest of the Government, as determined by the Secretary.</text></paragraph><paragraph commented="no" id="HE3E568C37FCE423896ED2AA0509131AB"><enum>(3)</enum><header>Taxes</header><text>If a gift received under this subsection is subject to a gift or inheritance tax, the Secretary may pay the tax out of the proceeds of the gift or the proceeds of the redemption or sale of the gift.</text></paragraph></subsection></section><section id="H788B0341EE384C788E0295A8A2A1E047"><enum>206.</enum><header>Report to Congress</header><subsection id="idFC36B942A805494680D6EF79E2A243A2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 31 of each year, the Secretary shall submit to Congress a report regarding the Fund and the status of threatened and endangered plant species on the Pacific Islands.</text></subsection><subsection id="idAC8C0CAB3C6A463FBE0015255479756F"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include, for the year covered by the report, a description of—</text><paragraph id="HA8FA23A3109941D482608D6ECFE31612"><enum>(1)</enum><text>the total amounts deposited into and expended from the Fund;</text></paragraph><paragraph id="H9F6D32D999E34DB882005F813F751F2E"><enum>(2)</enum><text>the costs associated with the administration of the Fund;</text></paragraph><paragraph id="H3A88265924C84040A29FE16AB4F1A53F"><enum>(3)</enum><text>a summary of the projects for which the Secretary has provided assistance under section 204 and an evaluation of those projects; and</text></paragraph><paragraph id="H1E7C330FD55D4C2CA62828B2E32F05C2"><enum>(4)</enum><text>an evaluation of the status of threatened and endangered plant populations on the Pacific Islands.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H22EC7809AE4A473A8534B51F46A0E90F"><enum>207.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Fund $5,000,000 for each of fiscal years 2021 through 2026.</text></section></title><title id="HE272A3DC3DD542B49695B8BDE3A00AE8"><enum>III</enum><header>Freshwater Mussel Conservation Fund Act of 2021</header><section id="H4CA5691CA42D4612A5129626826297A6"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Freshwater Mussel Conservation Fund Act of 2021</short-title></quote>.</text></section><section id="HBBADA77E6ABF4AA3B1300A2D3C04A281"><enum>302.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to assist in the conservation of threatened and endangered freshwater mussel species and the habitats of those species in the United States by supporting and providing financial resources for projects—</text><paragraph id="id1632E81140264B9A878A6CBFE76E801D"><enum>(1)</enum><text display-inline="yes-display-inline">to conserve freshwater mussel species;</text></paragraph><paragraph id="idB42D56A428304426AF7800006E30F4F7"><enum>(2)</enum><text display-inline="yes-display-inline">to conserve the habitats of those species; and</text></paragraph><paragraph id="idC2D31CEFBC064EB48E72758D851AAA96"><enum>(3)</enum><text display-inline="yes-display-inline">to address other threats to the survival of those species.</text></paragraph></section><section id="H4B6236B78084415A8B5B36E4DADE4E8B"><enum>303.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="HD2513DD976E84AE8B3E521C3091F3FC3"><enum>(1)</enum><header>Conservation</header><text>The term <term>conservation</term> means the use of all methods and procedures necessary to protect habitats of freshwater mussel species in the United States and the freshwater mussel species in those habitats, including—</text><subparagraph id="H0136C56B228646CEAA3E73FB81BAE837"><enum>(A)</enum><text>protection, restoration, and management of the habitats;</text></subparagraph><subparagraph id="H8C312E2E3CEA46E6A717FE26991A1CDA"><enum>(B)</enum><text>onsite research and monitoring of—</text><clause id="id4F9BCC0E0DE9485AB3CE0C00F4AF1213"><enum>(i)</enum><text>freshwater mussel populations;</text></clause><clause id="idB0D45471009944449F274E0F05232EBB"><enum>(ii)</enum><text>freshwater mussel habitats;</text></clause><clause id="id54420D4D895145659A1D713C0F3E143A"><enum>(iii)</enum><text>annual freshwater mussel reproduction; and</text></clause><clause id="id91B327F5D2F54306B19B617F98D8692A"><enum>(iv)</enum><text>freshwater mussel species population trends;</text></clause></subparagraph><subparagraph id="H20C0044F00D4481CA2E561B3847DE9D4"><enum>(C)</enum><text>assistance in the development, implementation, and improvement of national and regional management plans;</text></subparagraph><subparagraph id="HD31748EFA9154BAC8ECE15DA4203C064"><enum>(D)</enum><text>enforcement and implementation of applicable conservation laws; and</text></subparagraph><subparagraph id="H72C0045A99C54838B1530F1A28F85E98"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49436F83BED544E28C8ED2DB9F615932"><enum>(2)</enum><header display-inline="yes-display-inline">Freshwater mussel</header><text display-inline="yes-display-inline">The term <term>freshwater mussel</term> means any member of the order Unioinida.</text></paragraph><paragraph id="H39142610F40643EFA07D6A792C1A799A"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the Freshwater Mussel Conservation Fund established by section 305(a).</text></paragraph></section><section id="HF83E9C8C7B8C46338F044ECF4A664484"><enum>304.</enum><header>Freshwater mussel conservation assistance</header><subsection id="HE9F8B7DA8FC8404F88B0B3DF3BBC895F"><enum>(a)</enum><header>Assistance</header><paragraph id="idF1A584A279C443A3A070BA820D83B25A"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds, and in consultation with other Federal officials, the Secretary shall provide competitive financial assistance, including multiyear grants, for projects for the conservation of freshwater mussels in the United States and for which a project proposal is approved by the Secretary under subsection (c).</text></paragraph><paragraph id="H158F6BE57F7F4112B098206BEAE525AF"><enum>(2)</enum><header>Use of existing authorities</header><text>Assistance provided under this section shall be carried out in a manner consistent with authorities available to the Secretary under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></paragraph></subsection><subsection id="HC9AE5299C9FD4A22906E4CB8CCBE79A8"><enum>(b)</enum><header>Project proposals</header><paragraph id="HC9E933274E824FD2819D243CF939DECA"><enum>(1)</enum><header>Eligible applicants</header><text>A project proposal may be submitted to the Secretary under this section by—</text><subparagraph id="H41BD8FE4354E46E4890F4D78ACB94E07"><enum>(A)</enum><text>a relevant State or Tribal agency, research institution, or nonprofit organization with the expertise required for the conservation of freshwater mussels in the United States; and</text></subparagraph><subparagraph id="HF98E4B4A7934465F856CF43A3635D48E"><enum>(B)</enum><text>any other individual or entity, as determined appropriate by the Secretary, with the expertise required for the conservation of freshwater mussels in the United States.</text></subparagraph></paragraph><paragraph id="id255506927D874AFD808DF7869DE4EF23"><enum>(2)</enum><header>Federal partnership opportunities</header><subparagraph id="id207ADFA1F3F948A7AF5AF6584A412AE5"><enum>(A)</enum><header>In general</header><text>A Federal agency may be included as a partner or a collaborator on a project that receives funding under this section.</text></subparagraph><subparagraph id="idB1F838FF7F21485BB4B6F6A69F124503"><enum>(B)</enum><header>Prohibition</header><text>A Federal agency may not—</text><clause id="id1FA845C5B6F14CD888761DEB5E3A4F26"><enum>(i)</enum><text>be a lead entity on a project that receives funding under this section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id84033DE4758441EBAEAD72A174D75AE1"><enum>(ii)</enum><text>receive funding for a project under this section.</text></clause></subparagraph></paragraph><paragraph id="HA1602611837843A085E60184507CBE45"><enum>(3)</enum><header>Required elements</header><text>A project proposal shall include—</text><subparagraph id="H95D3FCDADCCB449B969326CFB9320C65"><enum>(A)</enum><text>a statement of the purposes of the project;</text></subparagraph><subparagraph id="H186D267FCAD64E8B924ECE6C7DE803C4"><enum>(B)</enum><text>the name of the entity or individual with overall responsibility for the project;</text></subparagraph><subparagraph id="H74A07FE64BF54CF39EE81976C6054A7A"><enum>(C)</enum><text>a description of—</text><clause id="H67AD0A57FFAD47D9B277358FF3722E26"><enum>(i)</enum><text>the qualifications of the entity or individuals that will carry out the project;</text></clause><clause id="H4821FBA48E9149B2876663EE5953D6D1"><enum>(ii)</enum><text>methods for project implementation and outcome assessment;</text></clause><clause id="HF79DAABD8EFF49B5A54B601EDD4C9D90"><enum>(iii)</enum><text>staffing and stakeholder engagement for the project;</text></clause><clause id="HEB8ABE0D73154A38A885E7BECEA9D5F3"><enum>(iv)</enum><text>the logistics of the project, including cost estimates and timelines;</text></clause><clause id="H9B5EB0B4844740DF979F53D2251309A0"><enum>(v)</enum><text>anticipated outcomes of the project;</text></clause><clause id="H1F76008B9EF448E3819AEB423DBE70B2"><enum>(vi)</enum><text>mechanisms to ensure adequate local public participation in project development and implementation; and</text></clause><clause id="H8F52CF22502A4D279373011854A6264B"><enum>(vii)</enum><text>how the project will promote sustainable, effective, long-term programs to conserve freshwater mussel populations in the United States;</text></clause></subparagraph><subparagraph id="HAB6D50C4C8A3481683C19E5D9E1D724B"><enum>(D)</enum><text>demonstrated sensitivity to—</text><clause id="id9EFF326BBCA64AE0A84F53FDCD3F1117"><enum>(i)</enum><text>local historic and cultural resources; and</text></clause><clause id="id37C79DBFE8C74B29977452B89E9D1C2E"><enum>(ii)</enum><text>compliance with applicable laws;</text></clause></subparagraph><subparagraph id="H5043D3EC80864ABF946BA87A6E0E164D"><enum>(E)</enum><text>assurances that the project will be implemented in consultation with relevant wildlife management authorities, Indian Tribes, and other appropriate government officials;</text></subparagraph><subparagraph id="H89AF2C91B785449091BE0950291FC01F"><enum>(F)</enum><text>information that demonstrates the clear potential of the project to contribute to the conservation of freshwater mussels in the United States;</text></subparagraph><subparagraph id="H2A7C91925BE74519A1125BA67645F4BE"><enum>(G)</enum><text>information regarding the source and amount of any matching funding available for the project; and</text></subparagraph><subparagraph id="H8CD0175A2C76464B9DD999423C272BE7"><enum>(H)</enum><text>such other information as the Secretary may require.</text></subparagraph></paragraph></subsection><subsection id="H96857D5FE3E546549F196660727F589E"><enum>(c)</enum><header>Project review and approval</header><paragraph id="HD97D25639DCA40C0B77D3E7FE424C416"><enum>(1)</enum><header>In general</header><text>The Secretary shall annually—</text><subparagraph id="HE1FF4A9C09134927A8818567C852C5DD"><enum>(A)</enum><text>solicit project proposals for grants under this section;</text></subparagraph><subparagraph id="HCDD296B0BC004D95987859097C2E0C49"><enum>(B)</enum><text>provide to other Federal officials, as appropriate, copies of each proposal submitted in response to the solicitation; and</text></subparagraph><subparagraph id="HE982C6F83C304D27B2AC5905428493A7"><enum>(C)</enum><text>review, on a timeline that recognizes the urgency of the declining number of freshwater mussel species in the United States, each project proposal submitted in response to the solicitation to determine whether the proposal meets the criteria described in paragraph (3).</text></subparagraph></paragraph><paragraph id="H4DB897566B714227938D36F34097CB8A"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Subject to the availability of funds, for each project proposal submitted to the Secretary under this section, the Secretary, after consulting with other Federal officials, as appropriate, shall—</text><subparagraph id="H501D30995DC24CB084BEB39497D1EC6D"><enum>(A)</enum><text>consult with the government of each State and territory in which the project is to be carried out regarding the proposal; and</text></subparagraph><subparagraph id="H627855C028524B0BBF011AE9BB96E4B0"><enum>(B)</enum><text>provide written notification of the approval or disapproval of the project proposal to—</text><clause id="id03F48AFAE61541D2B437A276B99CA0F1"><enum>(i)</enum><text>the individual or entity that submitted the project proposal;</text></clause><clause id="idAC900F3E9F68471B81DB26C9617BB819"><enum>(ii)</enum><text>other appropriate Federal officials; and</text></clause><clause id="id54159AE48D174D749D62BFF3A207ACE9"><enum>(iii)</enum><text>each State and territory described in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph commented="no" id="HE3DF67F6B0B94ADF865B599AB5B34454"><enum>(3)</enum><header>Criteria for approval</header><subparagraph commented="no" id="H289E6436F37748A5896F330CB51B0112"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may approve a project proposal under this section if the project shows promise for contributing to recovering and sustaining wild freshwater mussel populations in the United States.</text></subparagraph><subparagraph id="id561C5C5B86C04820BDE912500DA33947"><enum>(B)</enum><header>Priority</header><text>In determining whether to approve a project proposal under this section, the Secretary shall give the highest priority to projects that conserve species listed as threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></subparagraph><subparagraph id="id28C136A635FE4C808C0553851A4EC650"><enum>(C)</enum><header>Preferences</header><text>In determining whether to approve a project proposal under this section, the Secretary, to the maximum extent practicable, shall give preference to—</text><clause id="idF6CD19C96D104B1AAC0FF726DE08013B"><enum>(i)</enum><text>conservation projects that are designed to ensure effective, long-term conservation of freshwater mussels and freshwater mussel habitats; and</text></clause><clause id="idFD5C69E6EA264318A03D006EBC6F9ACE"><enum>(ii)</enum><text>projects for which matching funds are available.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF76CD58275EF415F9CEC7D8B10B90CDA"><enum>(D)</enum><header>Waiver</header><text>The Secretary may waive the application of subparagraphs (B) and (C) if the Secretary determines that the waiver is necessary to support a conservation project that the Secretary has identified as being of high priority.</text></subparagraph></paragraph></subsection><subsection id="H21D90B9098DA409AABCA138D43D875E7"><enum>(d)</enum><header>Project reporting</header><paragraph id="H9C0A4676B1A7493FA610CC4A7493F373"><enum>(1)</enum><header>In general</header><text>Each individual or entity that receives assistance for a project under this section shall submit to the Secretary, at such intervals as the Secretary may require, periodic reports that include all information that the Secretary, after consultation with other government officials, determines is necessary to evaluate the progress and success of the project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph><paragraph id="HF503AFA91E304899A9D2C945099FF383"><enum>(2)</enum><header>Availability to the public</header><text>Each report under paragraph (1) and any other document relating to a project for which financial assistance is provided under this title shall be made available to the public in a timely manner.</text></paragraph></subsection></section><section id="HCBBEC1E3ADED405D9BEB68C328E6A654"><enum>305.</enum><header>Freshwater Mussel Conservation Fund</header><subsection id="H1F1EBCD973B44EADA820501BBB2C2A02"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a separate account, to be known as the <quote>Freshwater Mussel Conservation Fund</quote>, consisting of—</text><paragraph id="H9232F16382E746BB83BC345CDEE7B26A"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph><paragraph id="HEE3A06FDC1A84892992FFE59A9074416"><enum>(2)</enum><text>amounts appropriated to the Fund under section 307; and</text></paragraph><paragraph id="H7E6322A01ED641A880F08B6E913B526E"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection><subsection id="H67C19C6022864BEDA3305C95AFE7FABD"><enum>(b)</enum><header>Expenditures from fund</header><paragraph id="H75B1151160B54534BF7245CD79C50295"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 304.</text></paragraph><paragraph id="id129418DAF8C549219C398EB9EFCA20BE"><enum>(2)</enum><header>Administrative expenses</header><text>To pay the administrative expenses necessary to carry out this title in a fiscal year, the Secretary may expend from the Fund not more than the greater of—</text><subparagraph id="idC60A5D0AD1FD4C3DB972688440C42AB8"><enum>(A)</enum><text>3 percent of the amounts in the Fund that are available for the fiscal year; or</text></subparagraph><subparagraph id="H1B2D47AD29114081865D2DC33AF2F0B7"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph><paragraph id="H1308E25294734A709895050268E7396D"><enum>(4)</enum><header>Sale of obligations</header><text>Any obligation of the United States acquired by the Fund may be sold by the Secretary of the Treasury at market price.</text></paragraph><paragraph id="H5319157A482D44199C531096F358294B"><enum>(5)</enum><header>Credits to fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection><subsection id="H7C31CEE195784A0FA0D130481C173A61"><enum>(d)</enum><header>Transfers of amounts</header><paragraph id="HF6BA8EDFD6754F5D82921BAAD1F57671"><enum>(1)</enum><header>In general</header><text>Not less frequently than monthly, the Secretary of the Treasury shall transfer from the general fund of the Treasury to the Fund the amounts required to be transferred to the Fund under this section on the basis of estimates made by the Secretary of the Treasury.</text></paragraph><paragraph id="HBC6ACF9D7A914085962FF8D8F535C695"><enum>(2)</enum><header>Adjustments</header><text>In carrying out paragraph (1), the Secretary of the Treasury shall make proper adjustments in amounts transferred to the Fund to the extent that prior estimates were in excess of or less than the amounts required to be transferred under this section.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H9005216E018848258EAEF87AD25F13FF"><enum>(e)</enum><header>Acceptance and use of donations</header><paragraph id="H7DDFEA96201A4822B0DFCB1B4A62D425"><enum>(1)</enum><header>In general</header><text>The Secretary may accept for the Government, and shall transfer to the Secretary of the Treasury for deposit into the Fund, a gift to provide assistance under section 304 of—</text><subparagraph id="HDB059C7842CE44FBB30CF54E2B2300BF"><enum>(A)</enum><text display-inline="yes-display-inline">money;</text></subparagraph><subparagraph id="H6F5B91EF64FE4EA3942ADED49D8C6CF9"><enum>(B)</enum><text>an obligation of the Government included in the public debt made only on the condition that the obligation be canceled and retired and not reissued; or</text></subparagraph><subparagraph id="H282B6F5BA19F4DFEBAAF579AC852D3A1"><enum>(C)</enum><text>any other intangible personal property made only on the condition that the property is sold on the best terms available and the proceeds are deposited in the Fund.</text></subparagraph></paragraph><paragraph id="HD198AE4674224F528ADD2998AE36DE24"><enum>(2)</enum><header>Discretion to reject a gift</header><text>The Secretary may reject a gift under this subsection when the rejection is in the interest of the Government, as determined by the Secretary.</text></paragraph><paragraph commented="no" id="HD66E1F97D5064D74A33FD52F95D34FE1"><enum>(3)</enum><header>Taxes</header><text>If a gift received under this subsection is subject to a gift or inheritance tax, the Secretary may pay the tax out of the proceeds of the gift or the proceeds of the redemption or sale of the gift.</text></paragraph></subsection></section><section id="HD0EC4D98074E428F89F020214E546B84"><enum>306.</enum><header>Report to Congress</header><subsection id="idBB74720383504252AF287145E834B598"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 31 of each year, the Secretary shall submit to Congress a report regarding the Fund and the status of freshwater mussels in the United States.</text></subsection><subsection id="idA246771D205240F5B3DFB5A8F3AFDEF2"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include, for the year covered by the report, a description of—</text><paragraph id="HE4DDB7354A314C339F6832F0A25B2996"><enum>(1)</enum><text>the total amounts deposited into and expended from the Fund;</text></paragraph><paragraph id="HB35D645A4077452FAB797A94AF537A75"><enum>(2)</enum><text>the costs associated with the administration of the Fund;</text></paragraph><paragraph id="HD8CD738792884108B415752678D3C6C6"><enum>(3)</enum><text>a summary of the projects for which the Secretary has provided assistance under section 304 and an evaluation of those projects; and</text></paragraph><paragraph id="H73B19F24C4EB4B67A017957B4D3E5A16"><enum>(4)</enum><text>an evaluation of the status of threatened and endangered freshwater mussel populations in the United States.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H2B8AB8276F584837A656A4EFAB85F94B"><enum>307.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Fund $5,000,000 for each of fiscal years 2021 through 2026.</text></section></title><title id="HDDEB7A05CEB645C898D051C043015192"><enum>IV</enum><header>Southwest Desert Fish Conservation Fund Act of 2021</header><section id="H9778188E3FAC4B3E9E10DAEACEA37515"><enum>401.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Southwest Desert Fish Conservation Fund Act of 2021</short-title></quote>.</text></section><section id="H8DC3C22BEB364F018754F96CE73C3F48"><enum>402.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to assist in the conservation of threatened and endangered desert fish species and the habitats of those species in the Southwest by supporting and providing financial resources for projects—</text><paragraph id="idAC7563C6AB6A4EF7985B648E83307F7E"><enum>(1)</enum><text display-inline="yes-display-inline">to conserve desert fish species;</text></paragraph><paragraph id="id01B2665EDFAD4F3F953126D02D63CAFB"><enum>(2)</enum><text display-inline="yes-display-inline">to conserve the habitats of desert fish species; and</text></paragraph><paragraph id="id16B2301F71A542E0B875BA295C10D9D7"><enum>(3)</enum><text display-inline="yes-display-inline">to address other threats to the survival of desert fish species.</text></paragraph></section><section id="HA2409A278DF14D2E91F8CFEBF20275A3"><enum>403.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H286AA8E6F26A47E3842E1CED58AF2EA0"><enum>(1)</enum><header>Conservation</header><text>The term <term>conservation</term> means the use of all methods and procedures necessary to protect habitats of desert fish species in the Southwest and the desert fish species in those habitats, including—</text><subparagraph id="H10ABBEFCF4FB4BEFAA72ACFB6835E16A"><enum>(A)</enum><text>protection, restoration, and management of the habitats;</text></subparagraph><subparagraph id="H146E1CB5DBFB4FBD8AC35A0AA40C3E30"><enum>(B)</enum><text>onsite research and monitoring of—</text><clause id="id390C2FA5FE7641AF91D4BA3127D5FAA4"><enum>(i)</enum><text>desert fish populations;</text></clause><clause id="id478904525E33422FB2D5984E812D36A6"><enum>(ii)</enum><text>desert fish habitats;</text></clause><clause id="id02ADB3555EF84B8FA36C5504A993F8B5"><enum>(iii)</enum><text>annual desert fish reproduction; and</text></clause><clause id="idE02B47D2F6724349A703C75377BDFA04"><enum>(iv)</enum><text>desert fish species population trends;</text></clause></subparagraph><subparagraph id="HC70A19E448334B3B89EC09AFB83DE608"><enum>(C)</enum><text>assistance in the development, implementation, and improvement of national and regional management plans;</text></subparagraph><subparagraph id="H72FD1B0F62C84A9E8DA4B6BAF577D95B"><enum>(D)</enum><text>enforcement and implementation of applicable conservation laws; and</text></subparagraph><subparagraph id="H8C3B47E9CF8040CA8667EC49CF2A46DF"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7F509782581B44B69F373E96FFDE37E5"><enum>(2)</enum><header display-inline="yes-display-inline">Desert fish</header><text display-inline="yes-display-inline">The term <term>desert fish</term> means any member of the class Osteichthyes living in a desert ecosystem.</text></paragraph><paragraph id="HF7AE7FBD8921415580C72BEB1A52DDC0"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the Southwest Desert Fish Conservation Fund established by section 405(a).</text></paragraph><paragraph id="HE5FE2D03E48642F2A1529A64C743A702"><enum>(4)</enum><header>Southwest</header><text>The term <term>Southwest</term> means the States of—</text><subparagraph id="id2CAAB4D7175D453ABC92C4886712747C"><enum>(A)</enum><text>Arizona;</text></subparagraph><subparagraph id="id228488D8B42B4338B744C98B0966180C"><enum>(B)</enum><text>California;</text></subparagraph><subparagraph id="id39BCD7286A2F4590AEDE0814F5B46D81"><enum>(C)</enum><text>Colorado;</text></subparagraph><subparagraph id="idD62318DA2FF741269C601FFE190D4951"><enum>(D)</enum><text>Nevada;</text></subparagraph><subparagraph id="id16D23D26B44347A29D1A7D17EBAD834D"><enum>(E)</enum><text>New Mexico;</text></subparagraph><subparagraph id="id019CA80F0D344CC1B03024C6EB51D8D1"><enum>(F)</enum><text>Oregon; and</text></subparagraph><subparagraph id="id6B1A01D51CA24225873AB28223CFE34E"><enum>(G)</enum><text>Utah.</text></subparagraph></paragraph></section><section id="H89B950029A9A403A931CB2FC0FF8B11A"><enum>404.</enum><header>Southwest desert fish conservation assistance</header><subsection id="HFA08CD445DB042599020C194CAD4348C"><enum>(a)</enum><header>Assistance</header><paragraph id="H139F5278079940FA9A629179943D6DBA"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds, and in consultation with other Federal officials, the Secretary shall provide competitive financial assistance, including multiyear grants, for projects for the conservation of desert fish species in the Southwest and for which a project proposal is approved by the Secretary under subsection (c).</text></paragraph><paragraph id="HFA27955FB0C34DBBA32AC7CAF564FFBF"><enum>(2)</enum><header>Use of existing authorities</header><text display-inline="yes-display-inline">Assistance provided under this section shall be carried out in a manner consistent with authorities available to the Secretary under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></paragraph></subsection><subsection id="H7D46D2264B6B4D128B52B6A975890947"><enum>(b)</enum><header>Project proposals</header><paragraph id="HD67A70AD3D2648328DA42B18073F4324"><enum>(1)</enum><header>Eligible applicants</header><text>A project proposal may be submitted to the Secretary under this section by—</text><subparagraph id="H271C217403E24AC2B3EEFA57EB1E9754"><enum>(A)</enum><text>a relevant State or Tribal agency, research institution, or nonprofit organization with expertise required for the conservation of desert fish species in the Southwest; and</text></subparagraph><subparagraph id="H13111956D3C1413EA54FACEE7E8B435A"><enum>(B)</enum><text>any other individual or entity, as determined appropriate by the Secretary, with the expertise required for the conservation of desert fish species in the Southwest.</text></subparagraph></paragraph><paragraph id="idA9737C2237A249F0BA1DE49BB756DDC3"><enum>(2)</enum><header>Federal partnership opportunities</header><subparagraph id="id04083BC9E78949C08DF989F858040526"><enum>(A)</enum><header>In general</header><text>A Federal agency may be included as a partner or a collaborator on a project that receives funding under this section.</text></subparagraph><subparagraph id="id2B04C721F06445A794FE2FF868012EE8"><enum>(B)</enum><header>Prohibition</header><text>A Federal agency may not—</text><clause id="idF9D012DAAFBC4D07809FA7CB910DA2A3"><enum>(i)</enum><text>be a lead entity on a project that receives funding under this section; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5DE03E292679458B909EAE893960FAF5"><enum>(ii)</enum><text>receive funding for a project under this section.</text></clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HF971CA2553674D4E89F425B11E465753"><enum>(3)</enum><header>Required elements</header><text>A project proposal shall include—</text><subparagraph id="HD8106A54872B4A9F9EEACA1679C65F7A"><enum>(A)</enum><text>a statement of the purposes of the project;</text></subparagraph><subparagraph id="H2E9A482DE4F5499CA83532249E66EBF4"><enum>(B)</enum><text>the name of the entity or individual with overall responsibility for the project;</text></subparagraph><subparagraph id="H55DFF2F33E4949058E0985FFD771C74F"><enum>(C)</enum><text>a description of—</text><clause id="HA905281373BA4DECA7BD1D46A832576C"><enum>(i)</enum><text>the qualifications of the entity or individuals that will carry out the project;</text></clause><clause id="H56D1F4838CB24252868C368E10A47F14"><enum>(ii)</enum><text>methods for project implementation and outcome assessment;</text></clause><clause id="H8388AC09DB474ADE8CFA416852D7C99D"><enum>(iii)</enum><text>staffing and stakeholder engagement for the project;</text></clause><clause id="H61238E3CE4584289930BFBD3310B0150"><enum>(iv)</enum><text>the logistics of the project, including cost estimates and timelines;</text></clause><clause id="HC61DE8F1ED7C42BC800689D06A3D8F11"><enum>(v)</enum><text>anticipated outcomes of the project;</text></clause><clause id="H43321CB44CC1484A8857983189DA3263"><enum>(vi)</enum><text>mechanisms to ensure adequate local public participation in project development and implementation; and</text></clause><clause id="H16E52AD51EB3428997198D4BD8B1EFB8"><enum>(vii)</enum><text>how the project will promote sustainable, effective, long-term programs to conserve desert fish populations in the Southwest;</text></clause></subparagraph><subparagraph id="H7AEC56AFF5DD4386B134E1EC23FE31DE"><enum>(D)</enum><text>demonstrated sensitivity to—</text><clause id="idEBA8A8C3D3774B768F6D685AEF4C2323"><enum>(i)</enum><text>local historic and cultural resources; and</text></clause><clause id="id542069CFDB9A49FC9533D07EC9A5F512"><enum>(ii)</enum><text>compliance with applicable laws;</text></clause></subparagraph><subparagraph id="HCC594C35AF6D4F418A329ADF6D331EF0"><enum>(E)</enum><text>assurances that the project will be implemented in consultation with relevant wildlife management authorities, Indian Tribes, and other appropriate government officials;</text></subparagraph><subparagraph id="H71763580FF4446E4AF6F4922D9E4ACD8"><enum>(F)</enum><text display-inline="yes-display-inline">information that demonstrates the clear potential of the project to contribute to the conservation of desert fish populations in the Southwest;</text></subparagraph><subparagraph id="H58433A085C9F4CB0B203F2E2119B42AE"><enum>(G)</enum><text>information regarding the source and amount of any matching funding available for the project; and</text></subparagraph><subparagraph id="HE5ABF77C32A94404922F7F2059A159DE"><enum>(H)</enum><text>such other information as the Secretary may require.</text></subparagraph></paragraph></subsection><subsection id="H013B5264B0794C1EA15E08D16CDAA880"><enum>(c)</enum><header>Project review and approval</header><paragraph id="H152DF9C699BC4AA9923BD8300FD452B9"><enum>(1)</enum><header>In general</header><text>The Secretary shall annually—</text><subparagraph id="H1741F8B963B5406BB6783639CA97EA91"><enum>(A)</enum><text>solicit project proposals for grants under this section;</text></subparagraph><subparagraph id="H59D8EFB75F2E4A11A5ABDA593DA59AB7"><enum>(B)</enum><text>provide to other Federal officials, as appropriate, copies of each proposal submitted in response to the solicitation; and</text></subparagraph><subparagraph id="H82089E961317434AA5413E434851B121"><enum>(C)</enum><text>review, on a timeline that recognizes the urgency of the declining number of desert fish species in the Southwest, each project proposal submitted in response to the solicitation to determine whether the proposal meets the criteria specified in paragraph (3).</text></subparagraph></paragraph><paragraph id="H231F87CDFA104E2CA303066684B0E8DB"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Subject to the availability of funds, for each project proposal submitted under this section, the Secretary, after consulting with other Federal officials, as appropriate, shall—</text><subparagraph id="H2E7DD4DA9C484A5280DFE5BD35A7D6B3"><enum>(A)</enum><text>consult with the government of each State in which the project is to be carried out regarding the proposal; and</text></subparagraph><subparagraph id="HFD9A3C7BD85745E283D103113DCB14E6"><enum>(B)</enum><text>provide written notification of the approval or disapproval of the project proposal to—</text><clause id="id7CF0B27A576345DDA87C7CFCEEAAE03C"><enum>(i)</enum><text>the individual or entity that submitted the project proposal;</text></clause><clause id="id6537F523BFC4476F926A2920DB1EE682"><enum>(ii)</enum><text>other appropriate Federal officials; and</text></clause><clause id="idCEA714CF80834CADA06B5AC29B246F65"><enum>(iii)</enum><text>each State described in subparagraph (A).</text></clause></subparagraph></paragraph><paragraph commented="no" id="H7C544DF2A30B47D2B99B6A70A9B5FD9E"><enum>(3)</enum><header>Criteria for approval</header><subparagraph commented="no" id="id36E718ABDC474F0DAE7702B07512D2EB"><enum>(A)</enum><header>In general</header><text>The Secretary may approve a project proposal under this section if the project shows promise for contributing to recovering and sustaining wild desert fish populations in the Southwest.</text></subparagraph><subparagraph commented="no" id="HD50E1225EE2A4C6AA323EDE5D4BDAC20"><enum>(B)</enum><header>Priority</header><text>In determining whether to approve a project proposal under this section, the Secretary shall give the highest priority to projects that conserve species listed as threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.).</text></subparagraph><subparagraph id="id4B3CFCF5AFB44B799436E11AB4EF934B"><enum>(C)</enum><header>Preferences</header><text>In determining whether to approve a project proposal under this section, the Secretary, to the maximum extent practicable, shall give preference to—</text><clause id="idF8D79A3157694187B3F2AF0EBCFB9ED5"><enum>(i)</enum><text>conservation projects that are designed to ensure effective, long-term conservation of desert fish and desert fish habitats; and</text></clause><clause id="id91E763706AF14B3B9F72099C73DFCBE4"><enum>(ii)</enum><text>projects for which matching funds are available.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6E70B1E69E4E4F599D7D62EC2B64ABA3"><enum>(D)</enum><header>Waiver</header><text>The Secretary may waive the application of subparagraphs (B) and (C) if the Secretary determines that the waiver is necessary to support a conservation project that the Secretary has identified as being of high priority.</text></subparagraph></paragraph></subsection><subsection id="HAD0B931B723C4A7F91B70B2861C56266"><enum>(d)</enum><header>Project reporting</header><paragraph id="H3473B16366C146A4A5D46FEB20EC0BCD"><enum>(1)</enum><header>In general</header><text>Each individual or entity that receives assistance for a project under this section shall submit to the Secretary, at such intervals as the Secretary may require, periodic reports that include all information that the Secretary, after consultation with other government officials, determines is necessary to evaluate the progress and success of the project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph><paragraph id="H00B191EE61D34273B8BAAC8BA104B486"><enum>(2)</enum><header>Availability to the public</header><text>Each report under paragraph (1) and any other document relating to a project for which financial assistance is provided under this title shall be made available to the public in a timely manner.</text></paragraph></subsection></section><section id="HC04EEC5B53E14A10B8F958F24DE84D2E"><enum>405.</enum><header>Southwest Desert Fish Conservation Fund</header><subsection id="HE3E4374660514352B209D250D196AC6B"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a separate account, to be known as the <quote>Southwest Desert Fish Conservation Fund</quote>, consisting of—</text><paragraph id="H0035E7B048F6403BB1BC8B590D7EFBF7"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph><paragraph id="HC78760541570406ABD56583BECD6E7E0"><enum>(2)</enum><text>amounts appropriated to the Fund under section 407; and</text></paragraph><paragraph id="H35B85AA0AEB74DD492A69EE7F955F2A8"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection><subsection id="H090022861CA241DC8F1F1FCEEF951645"><enum>(b)</enum><header>Expenditures from fund</header><paragraph id="HC1EE0E9B7F18433CB5441F8758754FFC"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), at the request of the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 404.</text></paragraph><paragraph id="id42CE772EAB6A466782E80CB5BD8F31B2"><enum>(2)</enum><header>Administrative expenses</header><text>To pay the administrative expenses necessary to carry out this title in a fiscal year, the Secretary may expend from the Fund not more than the greater of—</text><subparagraph id="id25D2B3BE560B462E821BAE873BA5F53F"><enum>(A)</enum><text>3 percent of the amounts in the Fund that are available for the fiscal year; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD900BBA14AF54BDBB4449EC480156706"><enum>(B)</enum><text>$80,000.</text></subparagraph></paragraph></subsection><subsection id="HB19AB9DEDC13422B97EB6ADB7C566587"><enum>(c)</enum><header>Investment of amounts</header><paragraph id="H920E4044053949FA95FCB3FECDF51E59"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest the portion of the Fund that is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals.</text></paragraph><paragraph id="id024F2355C76E4C99A6989C8C7E48633C"><enum>(2)</enum><header>Requirement</header><text>Investments under paragraph (1) may be made only in interest-bearing obligations of the United States.</text></paragraph><paragraph id="HF2B012B263744DC58F4366E998805534"><enum>(3)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations of the United States may be acquired—</text><subparagraph id="HCDA9A84801DE4FF2A88FDB1559545D1B"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph><subparagraph id="HA0044E599F764416AF5D70A5B95610F9"><enum>(B)</enum><text>by purchase of outstanding obligations at market price.</text></subparagraph></paragraph><paragraph id="H75AE957086AA41D8986ED1EFE637F2C8"><enum>(4)</enum><header>Sale of obligations</header><text>Any obligation of the United States acquired by the Fund may be sold by the Secretary of the Treasury at market price.</text></paragraph><paragraph id="H2A51C5CE1F994862B8DE681340261F3E"><enum>(5)</enum><header>Credits to fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection><subsection id="HA965104777FA40489D4A85D4F1439D9A"><enum>(d)</enum><header>Transfers of Amounts</header><paragraph id="H4176F983897D42E484EB06D439525298"><enum>(1)</enum><header>In general</header><text>Not less frequently than monthly, the Secretary of the Treasury shall transfer from the general fund of the Treasury to the Fund the amounts required to be transferred to the Fund under this section on the basis of estimates made by the Secretary of the Treasury.</text></paragraph><paragraph id="H8633CA27ECE74F8CBC1913DE1DFEA6DD"><enum>(2)</enum><header>Adjustments</header><text>In carrying out paragraph (1), the Secretary of the Treasury shall make proper adjustments in amounts transferred to the Fund to the extent that prior estimates were in excess of or less than the amounts required to be transferred under this section.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="HFEC5E5F567B84EFCA49AF7B83CCA32A5"><enum>(e)</enum><header>Acceptance and use of donations</header><paragraph id="H9B9E8D6BC1AE469CAFA45447B24739BB"><enum>(1)</enum><header>In general</header><text>The Secretary may accept for the Government, and shall transfer to the Secretary of the Treasury for deposit into the Fund, a gift to provide assistance under section 404 of—</text><subparagraph id="H5C772726ED334A229DE104E7FBC10681"><enum>(A)</enum><text display-inline="yes-display-inline">money;</text></subparagraph><subparagraph id="H48F47F02678D4343BD94B48CC5FAD749"><enum>(B)</enum><text>an obligation of the Government included in the public debt made only on the condition that the obligation be canceled and retired and not reissued; or</text></subparagraph><subparagraph id="H6ABEC1EDC6BE46DF8475499D0E487E82"><enum>(C)</enum><text>any other intangible personal property made only on the condition that the property is sold on the best terms available and the proceeds are deposited in the Fund.</text></subparagraph></paragraph><paragraph id="H56806471412B45D784EEBD129A62B8C2"><enum>(2)</enum><header>Discretion to reject a gift</header><text>The Secretary may reject a gift under this subsection when the rejection is in the interest of the Government, as determined by the Secretary.</text></paragraph><paragraph commented="no" id="H2910E305C41A4AFB90DA538459EA9C38"><enum>(3)</enum><header>Taxes</header><text>If a gift received under this subsection is subject to a gift or inheritance tax, the Secretary may pay the tax out of the proceeds of the gift or the proceeds of the redemption or sale of the gift.</text></paragraph></subsection></section><section id="HB3B98D2CBA0546B79C16E25AB0034F09"><enum>406.</enum><header>Report to Congress</header><subsection id="idFD2CB7047A5C49228A35B259BB670D00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 31 of each year, the Secretary shall submit to Congress a report regarding the Fund and the status of desert fish in the Southwest.</text></subsection><subsection id="idB2D9F4BC35A74D22BC02EFAA0E404978"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include, for the year covered by the report, a description of—</text><paragraph id="H1525DC953C724A208988B7AD3C8F0B5E"><enum>(1)</enum><text>the total amounts deposited into and expended from the Fund;</text></paragraph><paragraph id="H08478C74756F464FA949B120537E31B7"><enum>(2)</enum><text>the costs associated with the administration of the Fund;</text></paragraph><paragraph id="H17B39AF1E30D4D45880C5F433EA910B5"><enum>(3)</enum><text>a summary of the projects for which the Secretary has provided assistance under section 404 and an evaluation of those projects; and</text></paragraph><paragraph id="H20073BA4FDCD440BAC512FE8F03434AC"><enum>(4)</enum><text>an evaluation of the status of threatened and endangered desert fish populations in the Southwest.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H194297BA8FF84E9B94D1CCFDDC5E172B"><enum>407.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Fund $5,000,000 for each of fiscal years 2021 through 2026.</text></section></title></legis-body></bill>
