<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1721</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210519">May 19, 2021</action-date><action-desc><sponsor name-id="S351">Mr. Toomey</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to require the impaneling of a new jury if a jury fails to recommend by unanimous vote a sentence for conviction of a crime punishable by death.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2F9C4A7C3C9B4EBA995E5125D83F9DB1"><section section-type="section-one" id="H862D678017D240EE8364508C6762DC00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Eric’s Law</short-title></quote>.</text></section><section id="HFBCDE8F202D841BDB12B2A0CA250BBAC"><enum>2.</enum><header>Requirement to impanel a new jury in certain cases</header><subsection id="H49857DFE47E242ADBAE4F5FD8A0C1566"><enum>(a)</enum><header>Additional ground for impaneling jury</header><text display-inline="yes-display-inline">Section 3593(b)(2) of title 18, United States Code, is amended—</text><paragraph id="H369A125EE64E4D6B9F3AA386F107688A"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>or</quote> at the end; and</text></paragraph><paragraph id="H06B09A858F6A48EEB294772A4D822663"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H209043F0D0514D3CBB6F61F617D3771D"><subparagraph id="H70EF1F516C424F3FB2C438DB429CC499"><enum>(E)</enum><text display-inline="yes-display-inline">a new special hearing is required pursuant to subsection (g); or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H498F185E86924D2FBFC54F69918DBF9E"><enum>(b)</enum><header>Impaneling of new jury when jury does not reach a unanimous recommendation</header><text display-inline="yes-display-inline">Section 3593 of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HFDD7B7E4BC4145ECBA7725A3E136D816"><subsection id="H6558C6431F4A4D708D9FE6200A76BB55"><enum>(g)</enum><header>Special rule when jury does not return a unanimous recommendation</header><paragraph id="H052B3EF2EBE240EB845F706DBB55A749"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a jury described in subsection (b)(1) or subparagraphs (A) through (D) of subsection (b)(2) does not, by unanimous vote, make a recommendation whether the defendant should be sentenced to death, to life imprisonment without possibility of release, or some other lesser sentence pursuant to subsection (e), the court, upon motion of the attorney for the government, shall order a new special hearing and impanel a new jury pursuant to subsection (b).</text></paragraph><paragraph id="H441269116DE64517B94CE7353AD9948F"><enum>(2)</enum><header>Imposition of sentence</header><text display-inline="yes-display-inline">If the jury impaneled pursuant to paragraph (1) does not reach a unanimous recommendation as to sentence, the court shall impose a sentence other than death authorized by law.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
