<section id="idec855fe815fb40eb85d9474c3e42caa8" section-type="section-one"><enum>1.</enum><header>Community-driven decision-making pilot program</header>
<subsection id="id5c2538cd2e2f4e8b8107c16b32a3f5a5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id64d2c5d0d5a84ffba8c53bcca094eeec" commented="no"><enum>(1)</enum><header>Community-based organization</header><text>The term <term>community-based organization</term> means a private, locally initiated, community-based organization that—</text>
<subparagraph id="idD9EB3DF0D4B44D569DCB63F8A013BB90"><enum>(A)</enum><text>is a nonprofit organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code; and</text></subparagraph> <subparagraph id="id829073460B194F2B81D807BEB5C96235"><enum>(B)</enum><text>has a Board of Directors that represent a majority of residents of the area served by the organization. </text></subparagraph></paragraph>
<paragraph commented="no" id="idD39810E9552F49F2BC51224AD718A0A9"><enum>(2)</enum><header>Eligible partnership</header><text>The term <term>eligible partnership</term> means a partnership between—</text> <subparagraph id="ide7d8127240e94468948d561639514100" commented="no"><enum>(A)</enum><text>1 or more local transportation planning agencies, including at least 1 of—</text>
<clause id="ideaf3367bdc95452f828e01979de51e0e" commented="no"><enum>(i)</enum><text>a metropolitan planning organization (as defined in section 134(b) of title 23, United States Code);</text></clause> <clause id="id2ee52b3b228f4afd896547f78a00dae8" commented="no"><enum>(ii)</enum><text>a regional transportation planning organization designated under section 135(m) of title 23, United States Code;</text></clause>
<clause id="id524c7eb0f0654999a9e4afef515dad88" commented="no"><enum>(iii)</enum><text>a municipal corporation;</text></clause> <clause id="id02a067b8526d4184882fccd7068e791b" commented="no"><enum>(iv)</enum><text>a county; or</text></clause>
<clause id="id439d271f9887447c9ca600bac49c77d0" commented="no"><enum>(v)</enum><text>any other unit of local government; and</text></clause></subparagraph> <subparagraph id="id2e82edb25d1a417fbe5fac5f0d71e94f" commented="no"><enum>(B)</enum><text>a community-based organization.</text></subparagraph></paragraph>
<paragraph id="id8B0D2A41E05041A8B2629893894F6521"><enum>(3)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the community-driven decision-making pilot program established under subsection (b)(1).</text></paragraph> <paragraph id="id66A9C8FEDE2448F092F2E83EDF10A962"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation. </text></paragraph></subsection>
<subsection id="id5614bb0789774305a547e76535ac4354"><enum>(b)</enum><header>Establishment</header>
<paragraph id="idfc57854bed0f4e46812438323dea1f30"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a community-driven decision-making pilot program to provide grants to eligible partnerships.</text></paragraph> <paragraph id="id2bd16927e15d431cb0ea8de20b106a47"><enum>(2)</enum><header>Purpose</header><text>The purpose of the pilot program shall be to demonstrate enhanced community-based decision making in the transportation planning process by supporting partnerships between local transportation planning agencies and community-based organizations which will serve as models for other communities to deepen and strengthen community engagement in transportation planning processes.</text></paragraph></subsection>
<subsection id="id7D1F95BB94104BA1A027C761A54F8B7A"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under the pilot program, an eligible partnership shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> <subsection id="id18ADAC75B9344E8F98295B338416A03A"><enum>(d)</enum><header>Eligible costs</header> <paragraph id="id8C6EF0CAFE0C46D090D1896506EA697C"><enum>(1)</enum><header>In general</header><text>An eligible partnership that receives a grant under the pilot program may use the grant funds for—</text>
<subparagraph id="id927CBD9427BF48538AE6F0D8BFC804F4"><enum>(A)</enum><text>personnel costs, including costs—</text> <clause id="idFB00CCA67A5D4CF0BF61AE45AE7D6851"><enum>(i)</enum><text>to support employees of the community-based organization to enable the organization to engage with the community during the transportation planning process; and</text></clause>
<clause id="id0F22692E7A9E4B6295D1874AB99D0D86"><enum>(ii)</enum><text>to support employees of the local transportation planning agency in conducting more robust public engagement;</text></clause></subparagraph> <subparagraph id="idE6F16E10B9DD47DFA4C2C16D976C0B97"><enum>(B)</enum><text>materials and technology to support community engagement, including physical and digital presentation of data and polling;</text></subparagraph>
<subparagraph id="idBC76708197E64B8FB9725DB45EC65417"><enum>(C)</enum><text>training for personnel to improve the ability of the personnel to pursue and incorporate public input in the transportation planning process;</text></subparagraph> <subparagraph id="id0C791953C68342C9B82A94E57A3266DF"><enum>(D)</enum><text>training for the community-based organization and residents of the community in the basics of transportation planning;</text></subparagraph>
<subparagraph id="id1904E25E604B4F458824D14D3BC7A0AD"><enum>(E)</enum><text>facilitation of public meetings, including publicity, food, and provision of childcare;</text></subparagraph> <subparagraph id="idA3F3EC3013584FFE8100881E30F09259"><enum>(F)</enum><text>stipends for community participants for expenses relating to engagement in the transportation planning process; and</text></subparagraph>
<subparagraph id="id0292432D8722491A8F2E0A280E7501C6"><enum>(G)</enum><text>hiring and training of street teams to engage in public outreach relating to the transportation planning process, including the use of questionnaires and the solicitation of ongoing feedback.</text></subparagraph></paragraph> <paragraph id="idEBEDDA7DBCD141CD8BF1F1FE56E8F924"><enum>(2)</enum><header>Administrative costs</header><text>An eligible partnership may use not more than 5 percent of the funds from a grant under the pilot program for administrative costs.</text></paragraph>
<paragraph id="id3C977EFD62954544891921BC8C7240EA"><enum>(3)</enum><header>Limitation</header><text>A community-based organization that is part of an eligible partnership that receives a grant under the pilot program shall only carry out activities under the pilot program relating to community engagement and outreach.</text></paragraph></subsection> <subsection id="id1EA1F688B6CE46548768972F00661218"><enum>(e)</enum><header>Requirements</header><text>An eligible partnership that receives a grant under the pilot program shall—</text>
<paragraph id="id66cd6437016a4c54b6f50bc132ed4160"><enum>(1)</enum><text>submit to the Secretary a public engagement plan that—</text> <subparagraph id="id9F7216AC4F454B8A9800345D0AD5B7A5"><enum>(A)</enum><text>provides a direct role for community members in determining the priorities for and outcomes of a transportation planning process that will impact the community; and </text></subparagraph>
<subparagraph id="id7908FDD0E2CD450C865CE09063B3FC2F"><enum>(B)</enum><text>includes—</text> <clause id="id93a20b4e8653478aa14dbff9036db9fd"><enum>(i)</enum><text>a description of how the eligible partnership will provide an increase in capacity for the community-based organization for 1 or more employees to engage directly in the transportation planning process;</text></clause>
<clause id="id4dccc15ffae24c3c8639107cd5ff8df1"><enum>(ii)</enum><text>a description of how the eligible partnership will provide dedicated personnel within the local transportation planning agency for engagement with the community-based organization partner and for solicitation and incorporation of community input; and</text></clause> <clause id="id917727995ab144e6b152b90b68fb446c"><enum>(iii)</enum><text>specific and detailed strategies to ensure broad and equitable community input from traditionally underrepresented members of the community, especially low-income residents and people of color;</text></clause></subparagraph></paragraph>
<paragraph id="id24f7b5f6c47c4dabb89b37d01fb56a0f"><enum>(2)</enum><text>ensure that—</text> <subparagraph id="idC9BEF90BB8FE4393AD3E838D5AD7E7A0"><enum>(A)</enum><text>substantial weight is given to community input throughout the planning process, including in establishing goals and determining priority projects; and </text></subparagraph>
<subparagraph id="idDBC881A7DEF044F9B78628D476C0747A"><enum>(B)</enum><text>there is documentation of the extent to which community input is incorporated or the reasons for not incorporating community input;</text></subparagraph></paragraph> <paragraph id="ida70c9f1b047b49c7b41441c52fd47916"><enum>(3)</enum><text>ensure that all strategies described in paragraph (1)(B)(iii) are broadly accessible to people with disabilities in accordance with the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12101">42 U.S.C. 12101</external-xref> et seq.); and</text></paragraph>
<paragraph id="id7ea467e856c74ec3ad0425e09393b36a"><enum>(4)</enum><text>provide, in accessible formats that are easily understandable to the public, access to information including, at a minimum—</text> <subparagraph id="idb86e7239c27f4800b2cf6c04d3c2d0b1"><enum>(A)</enum><text>data about travel patterns and demand, including data relating to induced demand and multimodal accessibility;</text></subparagraph>
<subparagraph id="idff29dd3ea8ff49deb5e0583f9c0975f4"><enum>(B)</enum><text>any performance targets established pursuant to section 150 of title 23, United States Code, the achievement of which might be impacted by any projects or priorities under consideration; and</text></subparagraph> <subparagraph id="id82360b9a6cae47008224c49c9e4ce448"><enum>(C)</enum><text>the impacts of transportation priorities set and projects under consideration on specific neighborhoods and communities, including disparate impacts on traditionally disadvantaged communities.</text></subparagraph></paragraph></subsection>
<subsection id="idC77802E6C4444234AF5D22C13876EA43"><enum>(f)</enum><header>Reports</header>
<paragraph id="id23E3B63C3D8F4C5AB6FBA2491427E23B"><enum>(1)</enum><header>Report to Secretary</header><text>After carrying out all activities with a grant under the pilot program, each eligible partnership shall submit to the Secretary a report that describes—</text> <subparagraph id="id6802E57F8D884F78A41FAADFDB371C9E"><enum>(A)</enum><text>the activities that were carried out with the grant funds;</text></subparagraph>
<subparagraph id="idD5ADE8E78C2D498CA5E9BF474E49BA00"><enum>(B)</enum><text>the effect on community engagement on the activities carried out with the grant funds; and</text></subparagraph> <subparagraph id="id7DF3AB456D584554A9EECB07403275D5"><enum>(C)</enum><text>the extent of cooperation between the community-based organization and the 1 or more local transportation planning agencies in the eligible partnership. </text></subparagraph></paragraph>
<paragraph id="id8986F12C4E6B47A885F6DABDAA2C812B"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary shall submit to Congress a report on the effectiveness of the pilot program, including—</text> <subparagraph id="id4034440DACCA486EB241FB7E5CA70790"><enum>(A)</enum><text>lessons learned with respect to community engagement in transportation planning; and</text></subparagraph>
<subparagraph id="id6873FC473F254226AB4757574814B9CA"><enum>(B)</enum><text>recommendations for future Federal support of community engagement efforts in transportation planning. </text></subparagraph></paragraph></subsection> <subsection id="idC9BB657AB0374C03B52F1D70B1802FB5"><enum>(g)</enum><header>Publication</header><text>The Secretary shall make publicly available on the website of the Department of Transportation—</text>
<paragraph id="id8232B3A2D3A2421C86EFF771069C0693"><enum>(1)</enum><text>public engagement reports submitted by eligible partnerships under subsection (e)(1); </text></paragraph> <paragraph id="idB2B3813D8AFD42A2AE4BD71B2221030F"><enum>(2)</enum><text>reports submitted to the Secretary under subsection (f)(1); and</text></paragraph>
<paragraph id="id52A2C389157D4146AB7B8CBA8AB2576E"><enum>(3)</enum><text>the report submitted to Congress under subsection (f)(2). </text></paragraph></subsection> <subsection id="idd18612cc54324268821477c8db8530cd"><enum>(h)</enum><header>Maximum amount</header><text>A grant under the pilot program shall be not more than $400,000.</text></subsection>
<subsection id="id2afa0f613ada479bba035c771545df34"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) to carry out the pilot program $4,200,000 for fiscal year 2022, to remain available until expended.</text></subsection></section> </legis-body> </bill>
