<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1712</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210519">May 19, 2021</action-date><action-desc><sponsor name-id="S397">Mr. Braun</sponsor> (for himself, <cosponsor name-id="S384">Mr. Tillis</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend subtitle A of title II of division A of the CARES Act to require confirmation of employment status for long-term unemployed individuals, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0A7A8EF9B23644DDB107E68A8EB32CA4"><section section-type="section-one" id="H8C01B69B31A24B23BDED86F2F03C5501"><enum>1.</enum><header>Confirmation requirement</header><text display-inline="no-display-inline">Subtitle A of title II of division A of the CARES Act is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H515AD603206A4CF392BB767560F0FE41"><section id="H13C288EED3544369B3CEC68EB96581AA"><enum>2119.</enum><header>Confirmation of employment status for long-term unemployed individuals</header><subsection id="H7BCF3AE2DD2A435F82C784F284FF3D9C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">As a condition of each of the agreements described in sections 2104 and 2107, a State shall—</text><paragraph id="HC3F144E7EED44E788277F13B1BC9F5FB"><enum>(1)</enum><text>notify each long-term unemployed individual in the State that the State unemployment agency will seek confirmation of the individual’s current employment status from the individual’s most recent employer (except in cases in which such employer no longer exists);</text></paragraph><paragraph id="H238989B9C0D34E8B9A37CB44695ABD43"><enum>(2)</enum><text display-inline="yes-display-inline">request each employer described in paragraph (1) to submit information to the State unemployment agency with respect to each such individual describing whether—</text><subparagraph id="H29C3CE60D930478B948820069D95477A"><enum>(A)</enum><text>the individual’s position is not available at the time of the request; or</text></subparagraph><subparagraph id="H0C0A5567A8E6469195E9FC7EB99CED44"><enum>(B)</enum><text>the individual’s position is available but the individual has refused to return to work;</text></subparagraph></paragraph><paragraph id="H0710148EFC26443EA1BA4848675A2805"><enum>(3)</enum><text display-inline="yes-display-inline">in any case in which an employer submits information to the State unemployment agency with respect to an individual that describes a position that remains unavailable as described in paragraph (1), notify such individual, not later than the standard processing time for applications for regular unemployment compensation in the State after receipt of such information, that the individual’s unemployed status has been confirmed; and</text></paragraph><paragraph id="H590C85634AB74641BFEC5BE3780C54E4"><enum>(4)</enum><text display-inline="yes-display-inline">in any case in which an employer submits information to the State unemployment agency with respect to an individual that describes a refusal to return to work as described in paragraph (2)(B), or in any case in which an employer fails to submit information described in paragraph (2) not later than the standard processing time for applications for regular unemployment compensation in the State after the date of the request, terminate the individual’s Federal Pandemic Unemployment Compensation under section 2104 or Pandemic Emergency Unemployment Compensation under section 2107, as applicable.</text></paragraph></subsection><subsection id="H31BFBCFF8D0E4A85A823E76141F0459C"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>long-term unemployed individual</quote> means an individual who has received Federal Pandemic Unemployment Compensation under section 2104 or Pandemic Emergency Unemployment Compensation under section 2107 for more than 30 weeks of unemployment. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
