which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to ensure that Federal-aid highways, bridges, and tunnels are more resilient, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Resilient Highways Act of 2021</short-title></quote>.</text></section><section id="idB94EBCBEB4074BF3863A5B70B3E796BE"><enum>2.</enum><header>National highway performance program</header><text display-inline="no-display-inline">Section 119 of title 23, United States Code, is amended—</text><paragraph commented="no" id="id7a231215254d4d418c55de1ffbc6727b"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph commented="no" id="id6044000af3394e00ac2cef8f665371ff"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" id="idb5dfdea58beb4099816a63cea3a1c273"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" id="id5cbe59567df3494bbe28a5539539a9d5"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id57a02fcd62ba4e6f9ab632fce194e698"><paragraph commented="no" id="iddbb3651204bb40ee9290b46cfd3c18c4"><enum>(4)</enum><text>to provide support for measures to increase the resiliency of Federal-aid highways, bridges, and tunnels on and off the National Highway System to mitigate the impacts of sea level rise and extreme weather events.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="id5ea679cc26214cecaa83980e39cf6d7e"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id273f32b6def34bf2bd1403b0fc3221d4"><subsection commented="no" id="id2f6cdab7289b4899b4ca4f9be2850c36"><enum>(k)</enum><header>Protective features</header><paragraph commented="no" id="idECB455B5DE29453D93A2A2BAB83771E9"><enum>(1)</enum><header>In general</header><text>A State may use not more than 15 percent of the funds apportioned to the State under section 104(b)(1) for each fiscal year for a protective feature on a Federal-aid highway, bridge, or tunnel, if the protective feature is an economically justified improvement designed to mitigate the risk of recurring damage or the cost of future repairs from extreme weather, flooding, and other natural disasters.</text></paragraph><paragraph commented="no" id="id8016D22D3BF0496CB71C1323F3F71D74"><enum>(2)</enum><header>Protective features described</header><text>A protective feature referred to in paragraph (1) may include—</text><subparagraph commented="no" id="id944C0D85FDA2448D90F3DE5FC96CF7C1"><enum>(A)</enum><text>raising roadway grades;</text></subparagraph><subparagraph commented="no" id="idcf4aa4e19cd04b57a055fb710c3ab640"><enum>(B)</enum><text>relocating roadways in a floodplain to higher ground above projected flood elevation levels or away from slide prone areas;</text></subparagraph><subparagraph commented="no" id="id1e7731615bff435ca512994224122961"><enum>(C)</enum><text>stabilizing slide areas;</text></subparagraph><subparagraph commented="no" id="id420840e515a3419d97d07c7e470559b7"><enum>(D)</enum><text>stabilizing slopes;</text></subparagraph><subparagraph commented="no" id="id1114d6ef684548cc9a4fa6673653bccf"><enum>(E)</enum><text>installing riprap;</text></subparagraph><subparagraph commented="no" id="id5ced3e8ef05c454d87e4db9d1e780f34"><enum>(F)</enum><text>lengthening or raising bridges to increase waterway openings;</text></subparagraph><subparagraph commented="no" id="id4a61ccf3d20d43f697309c243eff8e1e"><enum>(G)</enum><text>deepening channels to prevent flooding;</text></subparagraph><subparagraph commented="no" id="id084332f8f4b7443ba1e99879a82f4525"><enum>(H)</enum><text>increasing the size or number of drainage structures;</text></subparagraph><subparagraph commented="no" id="idBEC627440A0D43F8A29FAAE9CDDBFB2E"><enum>(I)</enum><text>replacing culverts with bridges or upsizing culverts;</text></subparagraph><subparagraph commented="no" id="idB98F61F6E66E4DD0AD67B0618476BA2C"><enum>(J)</enum><text>repairing or maintaining tide gates;</text></subparagraph><subparagraph commented="no" id="ide2be0504c3fe4810abca3ffb976e439e"><enum>(K)</enum><text>installing seismic retrofits on bridges;</text></subparagraph><subparagraph commented="no" id="id9b0147786e95428397288c33c532d0e9"><enum>(L)</enum><text>adding scour protection at bridges;</text></subparagraph><subparagraph commented="no" id="idbd2c9ca4ec3f4460a498f8727c227ecc"><enum>(M)</enum><text>adding spur dikes;</text></subparagraph><subparagraph commented="no" id="idEC5FCE2690BB476E8E47FA459692FD79"><enum>(N)</enum><text>the use of natural infrastructure to mitigate the risk of recurring damage or the cost of future repair from extreme weather, flooding, and other natural disasters; and</text></subparagraph><subparagraph commented="no" id="id8a21ceba85604d0ead61f9f1da15d0b9"><enum>(O)</enum><text>any other features that mitigate the risk of recurring damage or the cost of future repair as a result of extreme weather, flooding, and other natural disasters, as determined by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" id="idDED1D36FDE6D4C74980169D973FB9915"><enum>(3)</enum><header>Savings provision</header><text>Nothing in this subsection limits the ability of a State to carry out a project otherwise eligible under subsection (d) using funds apportioned under section 104(b)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="idED7144DADBC443D0A580EBF0534BE020"><enum>3.</enum><header>Federal share payable</header><text display-inline="no-display-inline">Section 120(c) of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8E7005A93E1A4536AF2F37D74C53AF18"><paragraph commented="no" id="id3DF9D762362C4F27A195F03D89F861D3"><enum>(4)</enum><header>Protective features</header><subparagraph commented="no" id="id2663182E96E34B8EA1E4F5F650E4A963"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Federal share payable for the cost of a protective feature on a Federal-aid highway, bridge, or tunnel project under this title may be up to 100 percent, at the discretion of the State, if the protective feature is an economically justified improvement to mitigate the risk of recurring damage or the cost of future repair from extreme weather, flooding, and other natural disasters.</text></subparagraph><subparagraph commented="no" id="idD1420B7BE69A475DA189143A036F3E16"><enum>(B)</enum><header>Protective features described</header><text>A protective feature referred to in subparagraph (A) may include—</text><clause commented="no" id="idA3CBDFFBDB014F29B7BCBCCAF05D39BC"><enum>(i)</enum><text>raising roadway grades;</text></clause><clause commented="no" id="id954F54BB23DD479FB2D8E4B730DF094B"><enum>(ii)</enum><text>relocating roadways in a floodplain to higher ground above projected flood elevation levels or away from slide prone areas;</text></clause><clause commented="no" id="id80E760538A294AA7A120FF034B5DD92C"><enum>(iii)</enum><text>stabilizing slide areas;</text></clause><clause commented="no" id="idB33BA1527B5C49E993E9D0692DC1033C"><enum>(iv)</enum><text>stabilizing slopes;</text></clause><clause commented="no" id="id21DC411524044130957C749487A684E0"><enum>(v)</enum><text>installing riprap;</text></clause><clause commented="no" id="id78A2043A5C6E4839805BD01E5E5897E2"><enum>(vi)</enum><text>lengthening or raising bridges to increase waterway openings;</text></clause><clause commented="no" id="id736B0A98023A47D98CE3E9EF722E26AD"><enum>(vii)</enum><text>deepening channels to prevent flooding;</text></clause><clause commented="no" id="idED336B90F3A147E7A90BB78805C94913"><enum>(viii)</enum><text>increasing the size or number of drainage structures;</text></clause><clause commented="no" id="id6194B9FAC7CB4A2E893D23C2A5DBAA01"><enum>(ix)</enum><text>replacing culverts with bridges or upsizing culverts;</text></clause><clause commented="no" id="idE0C4117C8A5D4D01B7E7F179F173CCA0"><enum>(x)</enum><text>repairing or maintaining tide gates;</text></clause><clause commented="no" id="id7C15E9632D894776AF36B65485CF15ED"><enum>(xi)</enum><text>installing seismic retrofits on bridges;</text></clause><clause commented="no" id="idE7826A7BDAD5410D8529916C0EFE00AE"><enum>(xii)</enum><text>adding scour protection at bridges;</text></clause><clause commented="no" id="id40CB9785F07842B2AAA9143DDCF6F6BB"><enum>(xiii)</enum><text>adding spur dikes;</text></clause><clause commented="no" id="id985D3B3BBA204AABB945C21E5DC55C88"><enum>(xiv)</enum><text>the use of natural infrastructure to mitigate the risk of recurring damage or the cost of future repair from extreme weather, flooding, and other natural disasters; and</text></clause><clause commented="no" id="idEAB64E384BA64E6C9C8CF0D309CD81C9"><enum>(xv)</enum><text>any other features that mitigate the risk of recurring damage or the cost of future repair as a result of extreme weather, flooding, and other natural disasters, as determined by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" section-type="subsequent-section" id="idE9F3592D51DF4BE38E86BCE09753B13F"><enum>4.</enum><header>Emergency relief</header><text display-inline="no-display-inline">Section 125 of title 23, United States Code, is amended—</text><paragraph commented="no" id="idb161a1bc32c14f928cffefd057fd7f67"><enum>(1)</enum><text>in subsection (a)(1), by inserting <quote>wildfire, sea level rise,</quote> after <quote>severe storm</quote>;</text></paragraph><paragraph commented="no" id="idd8a379e8ae32401692142d459b17c9c0"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idea8ddec95e8b408cb59fb30466768acd"><subsection commented="no" id="id6c37c0b174244bea9fa5b45ed8296549"><enum>(b)</enum><header>Restriction on eligibility</header><text>Funds under this section shall not be used for the repair or reconstruction of a bridge that has been permanently closed to all vehicular traffic by the State or responsible local official because of imminent danger of collapse due to a structural deficiency or physical deterioration.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="id994432237e034515b33ee1c7916e8082"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph commented="no" id="idC5FFCDD16661446A8423C8B7AC9B89BB"><enum>(A)</enum><text>in paragraph (2)(A)—</text><clause commented="no" id="id31D7090D2FF14901B078E9FB7FB673BE"><enum>(i)</enum><text>by striking the period at the end and inserting <quote>; and</quote></text></clause><clause commented="no" id="idACF8077E44964B8BAB87C6EBAE12FA9F"><enum>(ii)</enum><text>by striking <quote>a facility that meets the current</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" act-name="" id="idA8A5C60D9E6B4B08A968950A11A4BC0D"><text>a facility that—</text><clause id="id32AE7023F79B45B4A7424A1A936F1749"><enum>(i)</enum><text>meets the current</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" id="id67861673A04A4FD8827BC7C715F2B841"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" act-name="" id="id65FACBBEE74B4D4CB40C8F277E151CBC"><clause commented="no" id="id38049CEB306844D0AB334F47F02D97B0"><enum>(ii)</enum><text>incorporates economically justifiable improvements designed to mitigate the risk of recurring damage from extreme weather, flooding, and other natural disasters.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="idBE7C0BDFCCE84AD3B705EE31F4AB3405"><enum>(B)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph commented="no" id="id54A9A85E67A54E7F9E26ADEDED380DF2"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf552ca2d7aa6474f90210d932901ae09"><paragraph commented="no" id="id33649ea438c042f48e04f12899196e9e"><enum>(3)</enum><header>Protective features</header><subparagraph commented="no" id="id5FFF977D74254EA7B7B0DC80F29A25D0"><enum>(A)</enum><header>In general</header><text>The cost of an improvement that is part of a project under this section shall be an eligible expense under this section if the improvement is a protective feature that is economically justified to mitigate the risk of recurring damage or the cost of future repair from extreme weather, flooding, and other natural disasters.</text></subparagraph><subparagraph commented="no" id="id0DCCA4662F0C4940B85E66E74299D0A7"><enum>(B)</enum><header>Protective features described</header><text>A protective feature referred to in subparagraph (A) may include—</text><clause commented="no" id="id06F72436E40942389DFFBAF5A2684F38"><enum>(i)</enum><text>raising roadway grades;</text></clause><clause commented="no" id="id0E6B8E4A43574A5A9F308D189C215481"><enum>(ii)</enum><text>relocating roadways in a floodplain to higher ground above projected flood elevation levels or away from slide prone areas;</text></clause><clause commented="no" id="id3707184EEBAC405FB30D627C84347D11"><enum>(iii)</enum><text>stabilizing slide areas;</text></clause><clause commented="no" id="id6C537640060B4BA29E48774304A4C911"><enum>(iv)</enum><text>stabilizing slopes;</text></clause><clause commented="no" id="id5DFD977D67684D87A62FBDACA4E1D3A9"><enum>(v)</enum><text>installing riprap;</text></clause><clause commented="no" id="id7A577112742B4D69996039782C6936CD"><enum>(vi)</enum><text>lengthening or raising bridges to increase waterway openings;</text></clause><clause commented="no" id="id92245BA3875A416B880C7E18692721A9"><enum>(vii)</enum><text>deepening channels to prevent flooding;</text></clause><clause commented="no" id="id949850B92298490A8A8BFC8DA24F75AD"><enum>(viii)</enum><text>increasing the size or number of drainage structures;</text></clause><clause commented="no" id="id0D122E7C3E5447329C5BA4D4D9F8BBBD"><enum>(ix)</enum><text>replacing culverts with bridges or upsizing culverts;</text></clause><clause commented="no" id="idA7A55BDD01EA4C08BFBD11FD83406675"><enum>(x)</enum><text>repairing or maintaining tide gates;</text></clause><clause commented="no" id="idABE9BD4220A4468D9171BE47567D9ADF"><enum>(xi)</enum><text>installing seismic retrofits on bridges;</text></clause><clause commented="no" id="idD53BDADA1BE0498ABEF641C9F75C04B7"><enum>(xii)</enum><text>adding scour protection at bridges;</text></clause><clause commented="no" id="idF56E7B3E7A224CB1BD25FFB03D3F7940"><enum>(xiii)</enum><text>adding spur dikes;</text></clause><clause commented="no" id="id82502CEFAD604E55A009DA4342F68883"><enum>(xiv)</enum><text>the use of natural infrastructure to mitigate the risk of recurring damage or the cost of future repair from extreme weather, flooding, and other natural disasters; and</text></clause><clause commented="no" id="id600257843C04494085638730EF113227"><enum>(xv)</enum><text>any other features that mitigate the risk of recurring damage or the cost of future repair as a result of extreme weather, flooding, and other natural disasters, as determined by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
