which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To statutorily establish Operation Stonegarden, through which eligible law enforcement agencies shall be awarded grants for border security enhancement.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assisting Narcotics and Trafficking officers in Interdicting Drugs Act</short-title></quote> or the <quote><short-title>ANTI-Drugs Act</short-title></quote>.</text></section><section id="HA75FCD5C2D084507B3E359BD55811D85"><enum>2.</enum><header>Operation Stonegarden</header><subsection id="HF731B883535642D38F656EE61FDFA4F1"><enum>(a)</enum><header>In general</header><text>Subtitle A of title XX of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/601">6 U.S.C. 601</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4C0681D748E24E79A6FA8E597746B67E"><section id="H4A92A867BF704937A23516E9E31E7BCC"><enum>2010.</enum><header>Operation Stonegarden</header><subsection id="H3595AB11D75547A0A6627C171D3213DB"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department a program, which shall be known as <quote>Operation Stonegarden</quote>, under which the Secretary, acting through the Administrator, shall award grants to eligible law enforcement agencies, through the State administrative agency, to enhance border security in accordance with this section.</text></subsection><subsection id="H79A69232E7D044A8835A342D58C5EED9"><enum>(b)</enum><header>Eligible recipients</header><text>A law enforcement agency is eligible to receive a grant under this section if the agency—</text><paragraph id="HE40C0BE9B81141A3853A712882EDF5A4"><enum>(1)</enum><text>is located in—</text><subparagraph id="H4DBA745FC99B45DF9B46FA089F85755B"><enum>(A)</enum><text>a State bordering Canada or Mexico; or</text></subparagraph><subparagraph id="HA47C00B524F64F45BF5CCE03433B41A2"><enum>(B)</enum><text>a State or territory with a maritime border; and</text></subparagraph></paragraph><paragraph id="HFD9D0C2459F04486A95D47C5779A6E45"><enum>(2)</enum><text>is involved in an active, ongoing, U.S. Customs and Border Protection operation coordinated through a U.S. Border Patrol sector office.</text></paragraph></subsection><subsection id="H7EFBC75E2588440784535CAF81DC41C9"><enum>(c)</enum><header>Permitted uses</header><text>Grant funds received under this section may be used for—</text><paragraph id="HB18C97D0CB5841A88DFF56139A257B55"><enum>(1)</enum><text>equipment, including maintenance and sustainment costs;</text></paragraph><paragraph id="HFA3F14D96E974A1CAA49E99CB7906F26"><enum>(2)</enum><text>personnel, including overtime and backfill, in support of enhanced border law enforcement activities;</text></paragraph><paragraph id="HDD932A88547E44448307E752563C7278"><enum>(3)</enum><text>any activity permitted for Operation Stonegarden under the Department of Homeland Security’s most recent Homeland Security Grant Program Notice of Funding Opportunity; and</text></paragraph><paragraph id="H727E9D63748B42BDA7DDAC3331D1027D"><enum>(4)</enum><text>any other appropriate activity, as determined by the Administrator, in consultation with the Commissioner of U.S. Customs and Border Protection.</text></paragraph></subsection><subsection id="H7E936EA8463F4A3FB60900831B546969"><enum>(d)</enum><header>Period of performance</header><text>The Secretary shall award grants under this section to grant recipients for a period of not less than 3 years.</text></subsection><subsection id="H382BBA0ACF834EC28C9B154DCCDE7B34"><enum>(e)</enum><header>Report</header><text>For each of the fiscal years 2022 through 2026, the Administrator shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name> and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> containing information on the expenditure of grants made under this section by each grant recipient.</text></subsection><subsection id="H57E97EB226FC43B38B321BFA49CA40E2"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $110,000,000 for each of the fiscal years 2022 through 2026 for grants under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCC9A20519E5946838EAE35B6219325FA"><enum>(b)</enum><header>Conforming amendment</header><text>Section 2002(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/603">6 U.S.C. 603(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1F1ED580ECD141D3AF816F5413ACB0C7"><subsection id="H5E1421CF88314D6582837F0C9F28CD8A"><enum>(a)</enum><header>Grants authorized</header><text>The Secretary, through the Administrator, may award grants under sections 2003, 2004, 2009, and 2010 to State, local, and tribal governments, as appropriate.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H493E074EC6C84B35A008DBDF472E032C"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 2009 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H60D2B8603FD0494D8DC5FE239D6DE01E"><toc><toc-entry idref="H4A92A867BF704937A23516E9E31E7BCC" level="section">Sec. 2010. Operation Stonegarden.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idE1505088CB9841AE8B4A575D9D38123A"><enum>3.</enum><header>Reauthorization of the High Intensity Drug Trafficking Areas Program</header><text display-inline="no-display-inline">Section 707(p) of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1706">21 U.S.C. 1706(p)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id36764624E1A04A0AA825BC62B3D2EE6C"><subsection id="idD5B9BDE5E793408DBC036AB0EB50A2A2"><enum>(p)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Office of National Drug Control Policy $300,000,000 for each of the fiscal years 2022 through 2026 to carry out this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idaa0bc57e819842518f56ae61f0429000"><enum>4.</enum><header>COPS Grant Program</header><text display-inline="no-display-inline">Section 1701 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10381">34 U.S.C. 10381</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7281CE7964D64F4289CE1D4B655A06BD"><subsection id="idC07085F5858546B19BD796B875B9B1F1"><enum>(n)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Office of Community Oriented Policing Services to carry out this part $400,000,000 for each of the fiscal years 2022 through 2026.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
