<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1707</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210519">May 19, 2021</action-date><action-desc><sponsor name-id="S313">Mr. Sanders</sponsor> (for himself, <cosponsor name-id="S153">Mr. Grassley</cosponsor>, <cosponsor name-id="S247">Mr. Wyden</cosponsor>, and <cosponsor name-id="S346">Mr. Lee</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To ensure that the Department of Defense achieves a clean audit opinion on its financial statements. </official-title></form><legis-body><section id="idD59F36E463E54BC49FDD1A8AADD8680E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Audit the Pentagon Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="idFF2275846B064394997F9E2186C5D4B4"><enum>2.</enum><header>Department of Defense spending reductions in the absence of an unqualified audit opinion</header><text display-inline="no-display-inline">If during any fiscal year after fiscal year 2022, the Secretary of Defense determines that a department, agency, or other element of the Department of Defense has not achieved an unqualified opinion on its full financial statements for the calendar year ending during such fiscal year—</text><paragraph id="id3a696e5bf0e442ddbdb0ec43b70629b4"><enum>(1)</enum><text>the amount available to such department, agency, or element for the fiscal year in which such determination is made shall be equal to the amount otherwise authorized to be appropriated minus 1.0 percent;</text></paragraph><paragraph id="idE37CDFA30059470E88E627B3D6CEAA28"><enum>(2)</enum><text>the amount unavailable to such department, agency, or element for that fiscal year pursuant to paragraph (1) shall be applied on a pro rata basis against each program, project, and activity of such department, agency, or element in that fiscal year; and</text></paragraph><paragraph id="idcec417901a70439e92fafc660e1de3da"><enum>(3)</enum><text>the Secretary shall deposit in the general fund of the Treasury for purposes of deficit reduction all amounts unavailable to departments, agencies, and elements of the Department in the fiscal year pursuant to determinations made under paragraph (1).</text></paragraph></section></legis-body></bill>
