Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to increase retirement savings, to improve retirement plan administration, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="HA151F4DDB75447F0B6F38D27AEFC1192"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to Retirement Savings Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H56CB94F6A05B43DBA12B51D4565F5751"><enum>2.</enum><header>Multiple employer 403<enum-in-header>(b) </enum-in-header>plans</header><subsection id="HEAA95544CC81476D9E900B5F8D456F93"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/403">Section 403(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD818AFC212B64262AF07258B6EB8460A"><paragraph id="H070D81F3FBC34D54BDAC61596324D943"><enum>(15)</enum><header>Multiple employer plans</header><subparagraph id="H709BFBE1198E418483FB40B12E98F384"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except in the case of a church plan, this subsection shall not be treated as failing to apply to an annuity contract solely by reason of such contract being purchased under a plan maintained by more than 1 employer.</text></subparagraph><subparagraph id="HDB562212FD894DB08C8A21DABADCDE58"><enum>(B)</enum><header>Treatment of employers failing to meet requirements of plan</header><clause id="H2DFE126B96DD470C9127F801F1E11AF8"><enum>(i)</enum><header>In general</header><text>In the case of a plan maintained by more than 1 employer, this subsection shall not be treated as failing to apply to an annuity contract held under such plan merely because of 1 or more employers failing to meet the requirements of this subsection, if such plan satisfies rules similar to the rules of section 413(e)(2) with respect to any such employer failure.</text></clause><clause id="HFCE49E29A4EB4AD8BE4702C1C287D70E"><enum>(ii)</enum><header>Additional requirements in case of non-governmental plans</header><text display-inline="yes-display-inline">A plan shall not be treated as meeting the requirements of this subsection unless the plan meets the requirements of subparagraph (A) or (B) of section 413(e)(1), except in the case of a multiple employer plan maintained solely by a State, a political subdivision of a State, or an agency or instrumentality thereof.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF457E798585E48ED8B0343080C460824"><enum>(b)</enum><header>Annual registration for 403<enum-in-header>(b)</enum-in-header> multiple employer plan</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6057">Section 6057</external-xref> of the Internal Revenue Code of 1986 is amended by redesignating subsection (g) as subsection (h) and by inserting after subsection (f) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF95A775C30324B7DBC64488AC35034BC"><subsection id="H67D7DD3EECA7462EAA952D1D5DC3525D"><enum>(g)</enum><header>403<enum-in-header>(b)</enum-in-header> multiple employer plans treated as 1 plan</header><text display-inline="yes-display-inline">In the case of annuity contracts to which this section applies and to which section 403(b) applies by reason of the plan under which such contracts are purchased meeting the requirements of paragraph (15) thereof, such plan shall be treated as a single plan for purposes of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD3A5ED35861A46958E235587409847E6"><enum>(c)</enum><header>Annual information returns for 403<enum-in-header>(b)</enum-in-header> multiple employer plan</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6058">Section 6058</external-xref> of the Internal Revenue Code of 1986 is amended by redesignating subsection (f) as subsection (g) and by inserting after subsection (e) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H13402EF0633D4B5FAA0F0062304B5182"><subsection id="H1B72FEF34552437CB417355AAB47B05A"><enum>(f)</enum><header>403<enum-in-header>(b)</enum-in-header> multiple employer plans treated as 1 plan</header><text display-inline="yes-display-inline">In the case of annuity contracts to which this section applies and to which section 403(b) applies by reason of the plan under which such contracts are purchased meeting the requirements of paragraph (15) thereof, such plan shall be treated as a single plan for purposes of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8B7667A0D4A1431C9319C31B0EDD7C8C"><enum>(d)</enum><header>Amendments to Employee Retirement Income Security Act of 1974</header><paragraph id="H1880D195D6AF4DEDB123ED026ECB3ED4"><enum>(1)</enum><header>Treated as pooled employer plan</header><subparagraph id="H3B9F34571C9A483BBE81E6B4F2E00894"><enum>(A)</enum><header>In general</header><text>Section 3(43)(A) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(43)(A)</external-xref>) is amended—</text><clause id="H7AEAA43F8EA346FDB95ABA3E26DC551A"><enum>(i)</enum><text>in clause (ii), by striking <quote>section 501(a) of such Code or</quote> and inserting <quote>501(a) of such Code, a plan that consists of contracts described in section 403(b) of such Code, or</quote>; and</text></clause><clause id="HBED08CDEAE054EF8B9BE789A888BED44"><enum>(ii)</enum><text>in the flush text at the end, by striking <quote>the plan.</quote> and inserting <quote>the plan, but such term shall include any program (other than a governmental plan) maintained for the benefit of the employees of more than 1 employer that consists of contracts described in section 403(b) of such Code and that meets the requirements of subparagraph (A) or (B) of section 413(e)(1) of such Code.</quote>. </text></clause></subparagraph><subparagraph id="HEBE69B48C7914817A1FA98767A5AE9AC"><enum>(B)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Paragraphs (43)(B)(v)(II) and (44)(A)(i)(I) of section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002</external-xref>) are each amended by striking <quote>section 401(a) of such Code or</quote> and inserting <quote>401(a) of such Code, a plan that consists of contracts described in section 403(b) of such Code, or</quote>.</text></subparagraph></paragraph><paragraph id="HBC0F7E3ABD1C48889682BFA006920759"><enum>(2)</enum><header>Fiduciaries</header><text>Section 3(43)(B)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/1002">29 U.S.C. 1002(43)(B)(ii)</external-xref>) is amended—</text><subparagraph id="H2CC9795471424327B4C99BFB0C0B7CC0"><enum>(A)</enum><text>by striking <quote>trustees meeting the requirements of <external-xref legal-doc="usc" parsable-cite="usc/26/408">section 408(a)(2)</external-xref> of the Internal Revenue Code of 1986</quote> and inserting <quote>trustees (or other fiduciaries in the case of a plan that consists of contracts described in <external-xref legal-doc="usc" parsable-cite="usc/26/403">section 403(b)</external-xref> of the Internal Revenue Code of 1986) meeting the requirements of section 408(a)(2) of such Code</quote>; and</text></subparagraph><subparagraph id="H456F21E1FDF5486F99489A871D976BE2"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>holding</quote> and inserting <quote>holding (or causing to be held under the terms of a plan consisting of such contracts)</quote>.</text></subparagraph></paragraph></subsection><subsection id="H04745A705E6B430595A013837EF90A0A"><enum>(e)</enum><header>Regulations</header><paragraph id="id03A198224E654647BBCBB6CB9F961E18"><enum>(1)</enum><header>Plan termination</header><text>The Secretary of the Treasury (or the Secretary’s designee) shall prescribe such regulations as may be necessary to clarify the treatment of a plan termination by an employer in the case of plans to which <external-xref legal-doc="usc" parsable-cite="usc/26/403">section 403(b)(15)</external-xref> of the Internal Revenue Code of 1986 applies.</text></paragraph><paragraph id="id374ddae7ea7d42329e19a2106e0cba6c"><enum>(2)</enum><header>Educational outreach to employers exempt from tax</header><text>The Secretary of the Treasury (or the Secretary's designee), in consultation with the Secretary of Labor, shall provide education and outreach to increase awareness among employers which are exempt from tax under section 501(a) of such Code that—</text><subparagraph id="id0499DA5A46E24120A4449CA1174D1082"><enum>(A)</enum><text>multiple employer plans are subject to the Employee Retirement Income Security Act of 1974, and</text></subparagraph><subparagraph id="idD442A7DAEDA74686870C8F65C6ABF5E5"><enum>(B)</enum><text>each employer is a plan sponsor with respect to its employees participating in the multiple employer plan and, as such, has certain fiduciary duties with respect to the plan and to its employees.</text></subparagraph></paragraph></subsection><subsection id="H51273A70DDA1469484DFCCEF6A823802"><enum>(f)</enum><header>Modification of model plan language</header><paragraph id="H2D15C715CE7F4A6FBFBFB35B0CF20883"><enum>(1)</enum><header>Plan notifications</header><text>The Secretary of the Treasury (or the Secretary’s designee) shall modify the model plan language published under <external-xref legal-doc="usc" parsable-cite="usc/26/413">section 413(e)(5)</external-xref> of the Internal Revenue Code of 1986 to include language which notifies participating employers which are exempt from tax under section 501(a) of such Code that the plan is subject to the Employee Retirement Income Security Act of 1974 and that such employer is a plan sponsor with respect to its employees participating in the multiple employer plan and, as such, has certain fiduciary duties with respect to the plan and to its employees.</text></paragraph><paragraph id="H8AA97C9222B044B4AC7D94842587E161"><enum>(2)</enum><header>Model plans for multiple employer <enum-in-header>403(b)</enum-in-header> non-governmental plans</header><text display-inline="yes-display-inline">For plans to which <external-xref legal-doc="usc" parsable-cite="usc/26/403">section 403(b)(15)(A)</external-xref> of the Internal Revenue Code of 1986 applies (other than a plan maintained for its employees by a State, a political subdivision of a State, or an agency or instrumentality thereof) the Secretary shall publish model plan language similar to model plan language published under section 413(e)(5) of such Code.</text></paragraph></subsection><subsection id="H560D1C20999C467997448F44AF2F80C3"><enum>(g)</enum><header>No inference with respect to church plans</header><text display-inline="yes-display-inline">Regarding any application of <external-xref legal-doc="usc" parsable-cite="usc/26/403">section 403(b)</external-xref> of the Internal Revenue Code of 1986 to an annuity contract purchased under a church plan (as defined in section 414(e) of such Code) maintained by more than 1 employer, or to any application of rules similar to section 413(e) of such Code to such a plan, no inference shall be drawn solely because section 403(b)(15)(A) of such Code (as added by this Act) does not apply to such plans.</text></subsection><subsection id="H29E8C0CA5D56424080E794C8B7423F79"><enum>(h)</enum><header>Effective date</header><paragraph id="HAD78A06D5D4146139F2ED802CED1B617"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to plan years beginning after December 31, 2022.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22130B1447FE4BAE9EC347AD37562F3D"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in the amendments made by subsection (a) shall be construed as limiting the authority of the Secretary of the Treasury or the Secretary’s delegate (determined without regard to such amendment) to provide for the proper treatment of a failure to meet any requirement applicable under the Internal Revenue Code of 1986 with respect to one employer (and its employees) in the case of a plan to which section 403(b)(15) applies. </text></paragraph></subsection></section><section id="H3C95DEC89C0342738EA138038DB3F0A1"><enum>3.</enum><header>Safe harbor for corrections of employee elective deferral failures</header><subsection id="H70FE1DB1A23542638F330BA168D085C1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/414">Section 414</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBD9232BB77664C45A248C39984AE83CC"><subsection id="HDD2E03A1815D4915B251F6E57EDA6F06"><enum>(aa)</enum><header>Correcting automatic contribution errors</header><paragraph id="HFDECABA758EB43AB9F07EFBD97DF5C3E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any plan or arrangement shall not fail to be treated as a plan described in section 401(a), 403(b), 408, or 457(b), as applicable, solely by reason of a corrected error.</text></paragraph><paragraph id="H62265989CF2646628E05B47550AF61A9"><enum>(2)</enum><header>Corrected error</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>corrected error</term> means a reasonable administrative error in implementing an automatic enrollment or automatic escalation feature in accordance with the terms of an eligible automatic contribution arrangement (as defined under subsection (w)(3)), provided that such implementation error—</text><subparagraph id="H678767218F12494BB2DA642C5B481D2A"><enum>(A)</enum><text>is corrected by the date which is 9½ months after the end of the plan year during which the failure occurred,</text></subparagraph><subparagraph id="H6CD740645946496A94763AA914867711"><enum>(B)</enum><text>is corrected in a manner which is favorable to the participant, and</text></subparagraph><subparagraph id="HF6805DD1EE1C43D7B38FD2224E991470"><enum>(C)</enum><text>is of a type which is so corrected for all similarly situated participants in a nondiscriminatory manner.</text></subparagraph><continuation-text continuation-text-level="paragraph">Such correction may occur before or after the participant has terminated employment and may occur without regard to whether the error is identified by the Secretary. </continuation-text></paragraph><paragraph id="HBA50995B0BB14A61AE7CE9BE4DC08903"><enum>(3)</enum><header>Regulations and guidance for favorable correction methods</header><text display-inline="yes-display-inline">The Secretary shall, by regulations or other guidance of general applicability, specify the correction methods which are in a manner favorable to the participant for purposes of paragraph (2)(B).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H70D156956D6F4012B014322267D3024A"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this section shall apply to the correction of any error with respect to which the date described in <external-xref legal-doc="usc" parsable-cite="usc/26/414">section 414(aa)(2)(A)</external-xref> of the Internal Revenue Code of 1986 (as added by this section) is after the date of enactment of this Act.</text></subsection></section><section id="H3308731C966C46A087F849020543BB5F"><enum>4.</enum><header>Application of credit for small employer pension plan startup costs to employers which join an existing plan</header><subsection id="H96AD8D7337554AD5AA820EBCE90E07C6"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/45E">Section 45E(d)(3)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>effective</quote> and inserting <quote>effective with respect to the eligible employer</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H33A7B35041CB4DF88C895B167DBA6128"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to eligible employer plans which become effective with respect to the eligible employer after the date of the enactment of this Act. </text></subsection></section><section id="H73231EA3BFC843C7AE57120E1238D7E3"><enum>5.</enum><header>Amendments to increase benefit accruals under plan for previous plan year allowed until employer tax return due date</header><subsection id="H5F9DEF77D690466797389C14F21DE797"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/401">Section 401(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H8FB3476C4EE34B92B554151AA0A6F3B3" display-inline="no-display-inline"><paragraph id="H5E90C8C8886D43D3BC4263F220C6277F"><enum>(3)</enum><header>Retroactive plan amendments that increase benefit accruals</header><text display-inline="yes-display-inline">If—</text><subparagraph id="HF3868F3395104E1E95B9F6E33203BB81"><enum>(A)</enum><text>an employer amends a stock bonus, pension, profit-sharing, or annuity plan to increase benefits accrued under the plan effective for the preceding plan year (other than increasing the amount of matching contributions (as defined in subsection (m)(4)(A))),</text></subparagraph><subparagraph id="H58B57E42F939460D8F3015E6707A6A17"><enum>(B)</enum><text>such amendment would not otherwise cause the plan to fail to meet any of the requirements of this subchapter, and</text></subparagraph><subparagraph id="HE17763A3FC3C4150AFC6C421A017A201"><enum>(C)</enum><text>such amendment is adopted before the time prescribed by law for filing the return of the employer for a taxable year (including extensions thereof) during which such amendment is effective, </text></subparagraph><continuation-text continuation-text-level="paragraph">the employer may elect to treat such amendment as having been adopted as of the last day of the plan year in which the amendment is effective.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H99F40F28210844CA91E12191322C5EDB" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to plan years beginning after December 31, 2022. </text></subsection></section></legis-body></bill>
