which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 13, United States Code, to require the Secretary of Commerce to provide advance notice to Congress before changing any questions on the decennial census, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title; findings</header><subsection id="idC5C82722A17C49B8BCC94B5BF1D2CC46"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Census Improving Data and Enhanced Accuracy Act</short-title></quote> or the <quote><short-title>Census IDEA Act</short-title></quote>.</text></subsection><subsection id="id76908f5965ab487f9051b5d7935a0c97"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="id66b476b778d04751ab9018147fb9d2c9"><enum>(1)</enum><text>The decennial census was embedded in article I of the Constitution of the United States by the founders of the United States.</text></paragraph><paragraph id="id195FDC9F3CC44FC096149B0FE025295D"><enum>(2)</enum><text>The decennial census measures the progress of the country and helps chart our future.</text></paragraph><paragraph id="ide12a0a8f10e64d06bb7cdc3b4fc89fc9"><enum>(3)</enum><text>The decennial census, for the decade to follow, shapes the reapportionment of the House of Representatives and the drawing of hundreds of congressional political districts and thousands of State and local political districts.</text></paragraph><paragraph id="id5a336065060a46319ca81b9786a17aef"><enum>(4)</enum><text>More than $1,500,000,000,000 in Federal assistance to States and local communities every year is informed by the results of the decennial census.</text></paragraph><paragraph id="idDF3EBD69B520443D8D5E4545CA1B6089"><enum>(5)</enum><text>The decennial census is the largest peacetime mobilization undertaken by the Federal Government.</text></paragraph><paragraph id="idb555989fe6f14e7b9f01258e69d02ae2"><enum>(6)</enum><text>Congress must ensure that every decennial census is a complete, accurate, and fair decennial enumeration of all individuals in the United States.</text></paragraph><paragraph id="iddb48a9199d34494c8ac067512f53628f"><enum>(7)</enum><text>Any late, untested changes to the operational design of the decennial census will jeopardize public cooperation with the census and, therefore, the success and accuracy of the census.</text></paragraph></subsection></section><section id="idaf6c57facd1549a0bef7341ba25f4751"><enum>2.</enum><header>Limitations and requirements for the decennial census</header><text display-inline="no-display-inline">Section 141 of title 13, United States Code, is amended—</text><paragraph id="id36CA3C5F7AAD40BC891B7D5467BA7CC6"><enum>(1)</enum><text>in subsection (f)—</text><subparagraph id="id8EFB2297EA264B1DA3BB8C6FA7B6015B"><enum>(A)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id2766E0BC15C54AF38F9C3BB53AD447D7"><enum>(B)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a period; and</text></subparagraph><subparagraph id="idB9A950266650435D87DF4B15D4C5F423"><enum>(C)</enum><text>by striking paragraph (3);</text></subparagraph></paragraph><paragraph id="idd77d2da78e744705b88f92e58f5509c0"><enum>(2)</enum><text>by redesignating subsection (g) as subsection (h);</text></paragraph><paragraph id="idc259da7700a6434596aa113a743e2c0a"><enum>(3)</enum><text>by inserting after subsection (f) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6b7b0b36fea144c8af995371ba7b32d3"><subsection id="idcb23c48c88334164a74a1f624573f77d"><enum>(g)</enum><header>Limitations and requirements</header><paragraph id="idEC50D08E0FE14676AC1EFBF39989482A"><enum>(1)</enum><header>Notice to Congress of operational design, subjects, types of information, and questions</header><text>In the 2030 decennial census of population and each decennial census thereafter, the Secretary may not—</text><subparagraph id="id1214d6ad9fd342f4ace28c160a4691c0"><enum>(A)</enum><text>with respect to the census, implement any major operational design element that has not been researched, studied, and tested for a period of not less than 3 years before the decennial census date; or</text></subparagraph><subparagraph id="id8e2b340b9af54837bdf49d6bed98f644"><enum>(B)</enum><text>include on the questionnaire for the census any subject, type of information, or question that was not submitted to Congress in accordance with subsection (f).</text></subparagraph></paragraph><paragraph id="id6afecc9973c5484dbefbabdff2c3be7b"><enum>(2)</enum><header>Biannual reports</header><subparagraph id="id44107B5E07764C25A0ADD8BE70465D44"><enum>(A)</enum><header>Submission to Congress</header><clause id="id97CE6696C863475FA30194EB8CB4BB08"><enum>(i)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this subsection and biannually thereafter, the Secretary shall submit to each committee of Congress having legislative jurisdiction over the census, the Committee on Appropriations of the Senate, and the Committee on Appropriations of the House of Representatives a report that includes a detailed statement on the status, at the time of submission, of all research, testing, and operations that are or will be part of the Bureau's comprehensive plan for the next decennial census.</text></clause><clause id="id3E3B368316DB471FAC2E0C7CB6A75525"><enum>(ii)</enum><header>Operational plan components</header><text>Not later than 5 years before the decennial census date, the Secretary shall include in a report under clause (i) a description of each component of the operational plan for that decennial census.</text></clause></subparagraph><subparagraph id="id7aaf64af73ea4ad4bc7c98a7da631f6a"><enum>(B)</enum><header>Internet publication</header><text>On the date on which the Secretary submits a report under subparagraph (A), the Secretary shall publish the report on the public Internet website of the Bureau.</text></subparagraph></paragraph><paragraph id="id9fd1fc8b3cab4486a81dda7a07355f39"><enum>(3)</enum><header>GAO analysis</header><text>Before the decennial census date, the Comptroller General of the United States shall determine and report to Congress on whether the subjects, types of information, and questions to be included in that decennial census have been adequately researched, studied, and tested to the same degree as in previous decennial censuses.</text></paragraph><paragraph id="id52909EC551C94F4AA49C0E425353A25E"><enum>(4)</enum><header>Applicability</header><text>Nothing in this subsection shall be construed to affect—</text><subparagraph id="id8AAFDDBB229248AA8D4F0AF8F089C727"><enum>(A)</enum><text>the mid-decade census conducted under subsection (d); or</text></subparagraph><subparagraph id="id584E76490EAC4E03B16F110EA57936AD"><enum>(B)</enum><text>the survey conducted by the Secretary that is commonly referred to as the <quote>American Community Survey</quote>.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id98078ADD4D5544C89C208695B287E32B"><enum>(4)</enum><text>in subsection (h), as so redesignated, by inserting <quote><header-in-text level="subsection" style="USC">Definition</header-in-text>.—</quote> before <quote>As used in</quote>.</text></paragraph></section></legis-body></bill>
