which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act to authorize the use of the Strategic National Stockpile to enhance domestic medical supply chain elasticity and establish and maintain domestic reserves of critical medical supplies, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE70357E355554AC284F0A17419EE2969"><section section-type="section-one" id="HDFA2495ED4524D7498F6FE06CD06622F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Supplies for Pandemics Act of 2021</short-title></quote>. </text></section><section id="HBBD6E84346CC4E7DBD6761811ECF8E4A"><enum>2.</enum><header>Supply chain flexibility manufacturing pilot</header><subsection id="HFE67E7849DF14FBA834617C3737E3387"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 319F–2(a)(3) of the Public Health Service Act (42 U.S.C. 247d–6b(a)(3)) is amended—</text><paragraph id="H5234A196788E4C0DB7513EF824BD048C"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HAF69F724A3724B86932DCAC139DAAF40"><enum>(2)</enum><text>in subparagraph (J), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HF2A52DC19EA34D06979705EDC4BE1932"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF9733A92228F476F8E55F83ABD60018D"><subparagraph id="H041A16D8C20B4E07AFB904B36BA66BD1"><enum>(K)</enum><text display-inline="yes-display-inline">enhance domestic medical supply chain elasticity and establish and maintain domestic reserves of critical medical supplies (including personal protective equipment, ancillary medical supplies, testing supplies, and other applicable supplies required for the administration of drugs, vaccines and other biological products, medical devices, and diagnostic tests) by—</text><clause id="H942BB143902740238B8BF795161E4F5C"><enum>(i)</enum><text>creating incentives for the domestic manufacturing of medical supplies— </text><subclause id="H31C4A5114734440F98DB3C4B222164DB"><enum>(I)</enum><text>to increase emergency stock of critical medical supplies; and</text></subclause><subclause id="H42430DDBF8C44159BFE832A2A3DD8A10"><enum>(II)</enum><text>to geographically diversify production of such supplies;</text></subclause></clause><clause id="HCE67AB69CD6C4C84A478AEE5068699AE"><enum>(ii)</enum><text>purchasing, leasing, or entering into joint industrial-based expansion ventures with respect to, facilities and equipment for the production of medical supplies; and</text></clause><clause id="H59F6BD17F9B7487AB7BE7664DBBE8DB7"><enum>(iii)</enum><text>working with distributors of medical supplies to manage the domestic reserves established under this subparagraph by refreshing and replenishing stock of critical medical supplies.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF9F7C40227AA4B13B6B92C8C3666A0B2"><enum>(b)</enum><header>Reporting; sunset</header><text display-inline="yes-display-inline">Section 319F–2(a) of the Public Health Service Act (42 U.S.C. 247d–6b(a)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD855A8A1E3834BF0B436B32D464ACBF0"><paragraph id="H78FF4BC886554D31AD95740F31D59C2C"><enum>(6)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than September 30, 2022, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report on the details of each purchase, lease, or joint industrial-based expansion venture entered into under paragraph (3)(K), including the amount expended by the Secretary on each such purchase, lease, or joint venture.</text></paragraph><paragraph id="HC218CAC05E5844519775BE24DC60D420"><enum>(7)</enum><header>Sunset</header><text display-inline="yes-display-inline">The authority to make purchases, leases, or joint ventures pursuant to paragraph (3)(K) shall cease to be effective on September 30, 2024.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H26BB66C5C38A4F319E44AFDB5A61E9C4"><enum>(c)</enum><header>Funding</header><text>Section 319F–2(f) of the Public Health Service Act (42 U.S.C. 247d–6b(f)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H073585DD30AD4775A3CDEC77361FD9E5"><paragraph id="H9CD4DE1952A34CA2BF6A72DEF54F6380"><enum>(3)</enum><header>Supply chain elasticity</header><subparagraph id="H7149F6C2DFC94F6485C67DCF504350AD"><enum>(A)</enum><header>In general</header><text>For the purpose of carrying out subsection (a)(3)(K), there is authorized to be appropriated $500,000,000 for each of fiscal years 2021 through 2024, to remain available until expended.</text></subparagraph><subparagraph commented="no" id="H1EE19FAFA5AD4DC3B59B6EAA87F8BB4D"><enum>(B)</enum><header>Relation to other amounts</header><text display-inline="yes-display-inline">The amount authorized to be appropriated by subparagraph (A) for the purpose of carrying out subsection (a)(3)(K) is in addition to any other amounts available for such purpose.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
