 STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend section 21 of the Small Business Act to require cyber certification for small business development center counselors, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="H5FE29AEF211A4BC3892D67C447E1C8D6" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Cyber Training Act of 2022</short-title></quote>.</text></section><section id="HC63909B16E674A22BE14D54F1A4D6BE8" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Duties of small business development center counselors</header><subsection id="HE519DC14A59143F8B41649B8F9FF2334" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Cyber training</header><text display-inline="yes-display-inline">Section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H9F55A86A459245E680592E6568A80F3E" style="OLC" display-inline="no-display-inline"><subsection id="H886D60475C2946B2AC0DC6B5B735D7F9" commented="no" display-inline="no-display-inline"><enum>(o)</enum><header display-inline="yes-display-inline">Cyber strategy training for small business development centers</header><paragraph id="H411B639F079C4BD882A5A54AE789BF96" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection—</text><subparagraph id="H32FD32761BA84FBAA1380347B7A52A85" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the term <quote>cyber strategy</quote> means resources and tactics to assist in planning for cybersecurity and defending against cyber risks and attacks; and</text></subparagraph><subparagraph id="H32F7A0ED9EF04422AEDFC0F413D3562F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the term <quote>lead small business development center</quote> means a small business development center that receives reimbursement from the Administrator under paragraph (5).</text></subparagraph></paragraph><paragraph id="H8886E290D526474696AACE40A3CA3146" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Certification program</header><text display-inline="yes-display-inline">The Administrator shall establish a cyber counseling certification program, or designate 1 or more substantially similar governmental or private cybersecurity certification programs, to certify the employees of lead small business development centers in providing cyber planning assistance to small business concerns.</text></paragraph><paragraph id="H9748FEE9349D428286EBB8E33E578890" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Number of certified employees</header><text display-inline="yes-display-inline">The Administrator shall ensure that the number of employees of each lead small business development center who are certified in providing cyber planning assistance is not less than the lesser of—</text><subparagraph id="HB87DB3D51F2E415DBD0166514C4C6194" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">5; or</text></subparagraph><subparagraph id="H553CD41D00A641ABA55138D3BE4669CF" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">10 percent of the total number of employees of the lead small business development center.</text></subparagraph></paragraph><paragraph id="H3730E143CFA24F03BBD26ED7179656C2" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Cyber strategy</header><text display-inline="yes-display-inline">In carrying out paragraph (2), the Administrator, to the extent practicable, shall consider any cyber strategy methods included in the Small Business Development Center Cyber Strategy developed under section 1841(a)(3)(B) of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; 130 Stat. 2662).</text></paragraph><paragraph id="HF46496B067EE433F8A06074009D9EFE9" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Reimbursement for certification</header><subparagraph id="HA27FB9B3DC8A41E0B78D53795C09894F" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Administrator may reimburse each lead small business development center for costs relating to the certification of 1 or more employees of the lead small business center in providing cyber planning assistance under a program established or designated under paragraph (2).</text></subparagraph><subparagraph id="H33AC6491EB3F47E283B468677266017C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The total amount reimbursed by the Administrator under subparagraph (A) may not exceed $350,000 in any fiscal year.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection id="H72190C1ADC93405E8A87805B8C74825E" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall implement paragraphs (2), (3), and (4) of section 21(o) of the Small Business Act, as added by subsection (a).</text></subsection></section></legis-body><attestation><attestation-group><attestor display="no"></attestor><role>Speaker of the House of Representatives</role></attestation-group><attestation-group><attestor display="no"></attestor><role>Vice President of the United States and President of the Senate</role></attestation-group></attestation></bill>
