which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Wilderness Act to allow local Federal officials to determine the manner in which nonmotorized uses may be permitted in wilderness areas, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Human-Powered Travel in Wilderness Areas Act</short-title></quote>.</text></section><section id="idd2a3eb501e3949009718672b6921b6bb"><enum>2.</enum><header>Returning human-powered travel to wilderness areas</header><text display-inline="no-display-inline">Section 4(c) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(c)</external-xref>) is amended—</text><paragraph id="id53C496E9A8AF4AB597AF6FE6839CA3F3"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the subsection designation and heading and all that follows through <quote>Except as</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5C3B7B32CE9E4DDBAA9DFC73038AC420"><subsection id="idFEB240DD1EA54934B33F9E2C4E908176"><enum>(c)</enum><header>Prohibition of certain uses</header><paragraph id="id613DF21AE1A14D8E9473AE5B12EEA9D8"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id4D7593A6148540A9A73BB56160CF6085"><enum>(A)</enum><header>Local official</header><text>The term <term>local official</term> means the officer or employee who is the head of a unit or jurisdiction of, as applicable—</text><clause id="id8F346D7D8988428084715D0D8588799C"><enum>(i)</enum><text>the Bureau of Land Management;</text></clause><clause id="id2946F4322524475EB138D4E8B874B429"><enum>(ii)</enum><text>the National Park Service;</text></clause><clause id="idA87E8DB0B6784515A397555837F8C80E"><enum>(iii)</enum><text>the Forest Service; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id20F043641E6D421289276BA84EC66AB1"><enum>(iv)</enum><text>the United States Fish and Wildlife Service.</text></clause></subparagraph><subparagraph id="idE53090E961444507BAAC6B70EBD95C38"><enum>(B)</enum><header>Nonmotorized travel</header><text>The term <term>nonmotorized travel</term> means a method of human travel that does not use a propulsive internal or external motor with a nonliving power source.</text></subparagraph><subparagraph id="idB9E569C6C58D4B3CAB65880EE5A5769A"><enum>(C)</enum><header>Permitted route</header><text>The term <term>permitted route</term> means any new or existing path, trail, paved or unpaved road, or way over snow or ice, located within a wilderness area designated by this Act on which one or more forms of nonmotorized recreational use is permitted under applicable law (including regulations) on the date on which a local official makes a determination under paragraph (3) or the date that is 2 years after the date of enactment of the <short-title>Human-Powered Travel in Wilderness Areas Act</short-title>, as applicable in accordance with paragraph (3).</text></subparagraph></paragraph><paragraph id="idA3B9A2A680864B89AD9F951E9F67EFB4"><enum>(2)</enum><header>Prohibitions</header><subparagraph id="id8B01C61777A34545A0056D5FEFCA0076"><enum>(A)</enum><header>Commercial enterprises; permanent roads</header><text>Except as</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idCB1F8C569EDF4DAA9A2066E7CCF4F4E9"><enum>(2)</enum><text>in paragraph (2) (as so designated)—</text><subparagraph id="id874B65B474ED47299C2A09C7D47CF038"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>this Act and, except as</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id44CD1621428A4A2DB290DA0E53BEC101"><text>this Act.</text><subparagraph id="id10F1A0D53BA549E782E9414F05F65BEF"><enum>(B)</enum><header>Temporary roads; motor vehicles, motorized equipment, and other forms of travel</header><text>Except as</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="id108EE18659574DBEB63D9BD05F560410"><enum>(B)</enum><text>in subparagraph (B) (as so designated), by inserting <quote>(but not including any form of nonmotorized travel, regardless of whether the nonmotorized travel is mechanically assisted, in which the sole propulsive power source is one or more persons)</quote> after <quote>mechanical transport</quote>; and</text></subparagraph></paragraph><paragraph id="id3DF1B95DFE1147FC81C125ECEEA5C794"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9638ADC35192445A967C855B2BFAF94F"><paragraph id="id644540095EBB4AFBB8F231B1539CF72F"><enum>(3)</enum><header>Permissible forms of recreational use on permitted routes</header><subparagraph id="idD4C56A694EEF414C9B8BA41D28118C63"><enum>(A)</enum><header>Determinations by local officials</header><clause id="id9A872E58506B43D5926312072606A675"><enum>(i)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Secretary of Agriculture and the Secretary of the Interior shall authorize relevant local officials to determine, by not later than 2 years after the date of enactment of the <short-title>Human-Powered Travel in Wilderness Areas Act</short-title>, all permissible forms of nonmotorized travel over any permitted route within the jurisdiction of the local official.</text></clause><clause id="idfde41d7b550f4c85a4e001f2ce34d274"><enum>(ii)</enum><header>Failure to determine</header><subclause id="idF8C5F18F4EE74FBFAE94658BEB18FE3A"><enum>(I)</enum><header>In general</header><text>If a local official fails to make the determination described in clause (i) with respect to a permitted route within the jurisdiction of the local official by the date that is 2 years after the date of enactment of the <short-title>Human-Powered Travel in Wilderness Areas Act</short-title>, any form of nonmotorized travel shall be allowable on the permitted route.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1F4DB7BA70D84F21B469337879A59C12"><enum>(II)</enum><header>Effect of clause</header><text>Nothing in this clause limits the authority of a local official to make a determination described in clause (i) relating to a permitted route described in subclause (I) after the date that is 2 years after the date of enactment of the <short-title>Human-Powered Travel in Wilderness Areas Act</short-title>, in accordance with this subparagraph.</text></subclause></clause><clause id="idaa04f308444a4d1aada8497258249518"><enum>(iii)</enum><header>Requirement</header><text>In making a determination pursuant to this subparagraph, a local official shall seek to accommodate all forms of nonmotorized travel, to the maximum extent practicable.</text></clause></subparagraph><subparagraph id="id1f0480426a624ba2b1f4a944e43274ad"><enum>(B)</enum><header>Authority</header><text>In making a determination pursuant to subparagraph (A), a local official may carry out such activities and promulgate such regulations as the local official determines to be appropriate to reduce, eliminate, or prevent environmental impacts or undue conflicts among members of nonmotorized travel user groups, including—</text><clause id="id4e3397d30222415fb2603721310d49a7"><enum>(i)</enum><text>restricting, by permit or other means, the number of individuals allowed on a permitted route or in a wilderness area;</text></clause><clause id="idF9A45E9452D042D0A1B6398B819ACDC6"><enum>(ii)</enum><text>instructing users to stay on permitted routes;</text></clause><clause id="idCFACD4BF17594B019E691E6A6A232F2B"><enum>(iii)</enum><text>limiting party size;</text></clause><clause id="idAF5AD6F18FF7469398F03208C9CE19C1"><enum>(iv)</enum><text>educating users regarding best practices;</text></clause><clause id="idB22DCCF7CC07498D80C39D3D9B6C7C86"><enum>(v)</enum><text>using volunteer or paid patrollers;</text></clause><clause id="idE6E4B0B585F143908AE74DD77A059499"><enum>(vi)</enum><text>establishing speed limits;</text></clause><clause id="id3B6849789FFB4AB48EA5239FBB717789"><enum>(vii)</enum><text>adding natural features to discourage improper uses of permitted routes;</text></clause><clause id="id7F60D82F4D724C06A97443A52DB0B5C4"><enum>(viii)</enum><text>designating the direction of travel on a permitted route; and</text></clause><clause id="idC44CE79BECD84FCEA65FA61229D0B6FC"><enum>(ix)</enum><text>separating uses of permitted routes—</text><subclause id="id0BD38F9E280A40948B32B05C0EF6118E"><enum>(I)</enum><text>by day or time of day; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5061A53DB7274920A55776DCF8EF05B5"><enum>(II)</enum><text>seasonally.</text></subclause></clause></subparagraph></paragraph><paragraph id="id61b3601a703949f8b7cacfabc7d14f5b"><enum>(4)</enum><header>Effect of subsection</header><subparagraph id="id41FFAAD3B14F4052B0C4728225BC80B0"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), nothing in this subsection requires the Secretary of Agriculture, the Secretary of the Interior, or any local official—</text><clause id="id7083E22E9E8C486FAAC550BACF3DB200"><enum>(i)</enum><text>to alter any wilderness area;</text></clause><clause id="id9F4EB247425E4601A9C0E1A267C414A6"><enum>(ii)</enum><text>to allow in a wilderness area any use that is likely to change the wilderness character of the area;</text></clause><clause id="idE2D11F981F324C5390D3F7CD6AB9D8B2"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id2167F71D6A034DEDA1A9E949E8446E52"><enum>(I)</enum><text>to open a permitted route or wilderness area to a public recreational use; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id58CB29BDEED7452A9AA8F32FBD0EAD25" indent="up1"><enum>(II)</enum><text>to maintain a permitted route or wilderness area for such a use; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id74842e7b6efb43eea73d6ae2763f5099"><enum>(iv)</enum><text>to allow any nonmotorized travel on any portion of the Appalachian National Scenic Trail that is administered entirely as a footpath pursuant to section 5(a)(1) of the National Trails System Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1244">16 U.S.C. 1244(a)(1)</external-xref>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CE78C0439A0452391241EF63C7FD4B4"><enum>(B)</enum><header>Presumption</header><text>A form of nonmotorized travel, regardless of whether the nonmotorized travel is mechanically assisted, in which the sole propulsive power source is one or more persons shall be rebuttably presumed to be in accordance with the preservation and maintenance of the wilderness character of a wilderness area.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
