amend the Public Health Service Act to direct the Secretary of Health and Human Services to make grants to covered health departments to increase the rate of recommended immunizations, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8487DA78E084453EB82780814B8A99D0"><section section-type="section-one" id="H4EC540733DBC4A7AB3373AD0ADE8C405"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community Immunity During COVID–19 Act of 2021</short-title></quote>.</text></section><section id="H02D979A122C34ADF87422569B908B48C"><enum>2.</enum><header>Grants to increase the rate of immunizations</header><text display-inline="no-display-inline">Section 317 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b">42 U.S.C. 247b</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H253F19EB37B54A5E8B1F50D3610570AB"><subsection id="HB60DF67652B947F9A873A58BBC7D8538"><enum>(n)</enum><header>Grants To increase the rate of immunizations</header><paragraph id="HDC25F664B9AA46BB803C173C1C844889"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall make grants to covered health departments to increase the rate of recommended immunizations during the COVID–19 public health emergency.</text></paragraph><paragraph id="HDAE4399BB78E4C08B15D1A6ECA8AAABB"><enum>(2)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A covered health department receiving a grant under this section may use funds received through the grant for the following:</text><subparagraph id="H6ECD5F6CC3284DF29372492C4DDA7453"><enum>(A)</enum><text display-inline="yes-display-inline">Providing funds to programs that increase the rate of recommended immunizations during the COVID–19 public health emergency, including supporting evidence-based outreach and educational activities in communities served by the covered health department involved.</text></subparagraph><subparagraph id="H8DACFF5A5A0E44879A391EF997BFEA4F"><enum>(B)</enum><text display-inline="yes-display-inline"> Supporting efforts by health care providers to communicate the importance of maintaining immunization schedules and visiting a primary care provider during the COVID–19 public health emergency.</text></subparagraph><subparagraph id="H486349E858454C93BAE3E514823BC928"><enum>(C)</enum><text>Increasing awareness with respect to health insurance options and programs that reduce the cost of vaccines, including the Vaccines for Children program (or similar program) carried out by the Centers for Disease Control and Prevention.</text></subparagraph><subparagraph id="HC6F82F0341374F2AAA1ABF35A11EF877"><enum>(D)</enum><text display-inline="yes-display-inline">Evaluating efforts to increase the rate of recommended immunizations in communities described in subparagraph (A) during the COVID–19 public health emergency.</text></subparagraph><subparagraph id="H9C0D59EF863546BCA551CA5BDD951009"><enum>(E)</enum><text display-inline="yes-display-inline">Developing and distributing culturally and linguistically appropriate messages about the importance of recommended immunizations during the COVID–19 public health emergency, including vaccines licensed under section 351 of this Act to prevent the virus that causes COVID–19.</text></subparagraph><subparagraph id="HF1EBA4BE738E44DFAF018AD3778AD3DA"><enum>(F)</enum><text display-inline="yes-display-inline">Combating misinformation and disinformation with respect to vaccines and the safety of vaccines, including a vaccine that will be licensed under section 351 of this Act or authorized for emergency use under section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/300bbb-3">21 U.S.C. 300bbb–3</external-xref>) to prevent the virus that causes COVID–19.</text></subparagraph></paragraph><paragraph id="H1C6EE05A13244DAFA5FCEE99212180D6"><enum>(3)</enum><header>Partnerships</header><text display-inline="yes-display-inline">A covered health department that receives a grant under this section may develop a partnership with entities and individuals in the communities served by the State, local, or Tribal government involved to carry out the activities under paragraph (3), including—</text><subparagraph id="HF02CC55DE9834FB4BBE9F03F6866C193"><enum>(A)</enum><text display-inline="yes-display-inline">a health care provider;</text></subparagraph><subparagraph id="H2E3663F7356A44D29EA1EF51325A24C4"><enum>(B)</enum><text>a local educational agency, including school nurses employed by such agencies;</text></subparagraph><subparagraph id="HE5FFF58B4C294C55B0572ADCF235B86E"><enum>(C)</enum><text display-inline="yes-display-inline">an organization that primarily provides health care or social services for—</text><clause id="HE4827662C2594E3ABDF02D7638EC9BB1"><enum>(i)</enum><text>groups that have a low rate of immunizations;</text></clause><clause id="H049CFB39CBAF4315B7494ABB7A5CF5B3"><enum>(ii)</enum><text display-inline="yes-display-inline">individuals with a chronic health condition or underlying medical condition associated with increased risk for severe illness from COVID–19; </text></clause><clause id="idE360B112F75B4C8A9F6B6AE0BE6B3876"><enum>(iii)</enum><text display-inline="yes-display-inline">racial and ethnic minority, rural, and other vulnerable populations; or</text></clause><clause id="H94D956DB50C84F43953DF67631EFC727"><enum>(iv)</enum><text>individuals with a limited proficiency in the English language;</text></clause></subparagraph><subparagraph id="HCA8186CD4AD84278B714C6D877B45C5E"><enum>(D)</enum><text>a faith-based organization;</text></subparagraph><subparagraph id="H0B0B8CA9215945FDAE1D3D9658FBF12C"><enum>(E)</enum><text display-inline="yes-display-inline">a long-term care facility, senior center, or other facility in which recommended immunizations for older adults may be provided or promoted by the staff of such facility or center;</text></subparagraph><subparagraph id="H654B019207D74FA786D0ADF963390CC6"><enum>(F)</enum><text display-inline="yes-display-inline">a vaccine coalition;</text></subparagraph><subparagraph id="H0CA4372E6F1A4CA48D46FC06E109D325"><enum>(G)</enum><text display-inline="yes-display-inline">a pediatric hospital;</text></subparagraph><subparagraph id="HE26839D1C8BB45D79636A562D49CC01C"><enum>(H)</enum><text display-inline="yes-display-inline">a pharmacy;</text></subparagraph><subparagraph id="id4E52FACA2AED4E8EA1012433267BEC9C"><enum>(I)</enum><text>an early childhood education program or child care provider;</text></subparagraph><subparagraph id="H829D6634BC5B42AEA368CDC7C03D32E9"><enum>(J)</enum><text display-inline="yes-display-inline">a public elementary, or secondary school; or</text></subparagraph><subparagraph id="H291E33F226454F6EAE61C01642E5FD89"><enum>(K)</enum><text>an institution of higher education.</text></subparagraph></paragraph><paragraph id="H8EC1368847884C0E878B07C1EB311713"><enum>(4)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than 18 months after the date on which a covered health department receives a grant under this subsection, the covered health department shall submit to the Secretary an evaluation on the effectiveness of the activities carried out using such funds to increase the rate of recommended immunizations.</text></paragraph><paragraph id="H1F9CD5BEAD4A46DCA84FCD2B2D0D6484"><enum>(5)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this subsection, the Secretary shall submit to Congress a report that includes—</text><subparagraph id="HF910FCDB5AF04072BCD34FD923C06F7E"><enum>(A)</enum><text display-inline="yes-display-inline">an evaluation of the effectiveness of the activities under paragraph (3) to increase the rate of recommended immunizations, based on the evaluations submitted pursuant to paragraph (6); and</text></subparagraph><subparagraph id="HEFE90DE459E24B09857BD350D29DA9AD"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations to increase the rate of recommended immunizations, including recommendations with respect to any public health emergency that occurs in the future.</text></subparagraph></paragraph><paragraph id="H9CFB0BCEBE2B450988A4F9EDB1C9827F"><enum>(6)</enum><header>Definitions</header><subparagraph id="idD9061DFF47F94F50B538EE8A92EC72F2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In this subsection:</text><clause id="H68BEE997FF864E4588AC586C2AD10263"><enum>(i)</enum><header>Covered health department</header><text display-inline="yes-display-inline">The term <term>covered health department</term> means the public health department of a State, local, or Tribal government.</text></clause><clause id="HFE737392AE0D47148076090BD0415BE4"><enum>(ii)</enum><header>COVID–19 public health emergency</header><text display-inline="yes-display-inline">The term <term>COVID–19 public health emergency</term> means the public health emergency declared by the Secretary of Health and Human Services under section 319 of this Act on January 31, 2020, with respect to COVID–19.</text></clause><clause id="ide1997c72850b47658f59e2b5611cf029"><enum>(iii)</enum><header>Early childhood education program</header><text>The term <term>early childhood education program</term> has the meaning given such term in section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>).</text></clause><clause id="idda34e089caa4464bbb2a96f33bb6bff9"><enum>(iv)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></clause><clause id="H31F086E60B684AC3A740DA1AEAF922D1"><enum>(v)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given that term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></clause><clause id="HF667E00B936F4195B9D29A7B15C051F6"><enum>(vi)</enum><header>Recommended immunizations</header><text>The term <term>recommended immunizations</term> means immunizations recommended by the Advisory Committee on Immunization Practices of the Centers for Disease Control and Prevention.</text></clause><clause id="idfc3b55d7d0bd49538d4287c1134143dd"><enum>(vii)</enum><header>Tribal organization</header><text>The term <term>tribal organization</term> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></clause></subparagraph><subparagraph id="id257AEFC140D94B768CF122CD6070AF92"><enum>(B)</enum><header>Other terms</header><text>In this subsection, the terms <term>elementary school</term>, <term>secondary school</term>, and <term>local educational agency</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></subparagraph></paragraph><paragraph id="HF1383291CA98454AB0FB6A4C1E92EEA8"><enum>(7)</enum><header>Authorization of appropriations</header><subparagraph id="H161F19B5CE38474AB2AAEA3A0A5F06A3"><enum>(A)</enum><header>In general</header><text>To carry out this subsection, there is authorized to be appropriated, $560,000,000 to remain available until expended.</text></subparagraph><subparagraph id="H729652BF674249B5B647C7977968E293"><enum>(B)</enum><header>Apportionment</header><text display-inline="yes-display-inline">In awarding grant funds under this subsection, the Secretary shall apportion the amounts appropriated to carry out this subsection as follows:</text><clause id="H0BF9F23B2DEF4380BBF3CFA7A262359D"><enum>(i)</enum><text>Not less than 50 percent of such funds to State and Tribal public health departments.</text></clause><clause id="HE5D870B985CB45CD9D16F3FD69429F9F"><enum>(ii)</enum><text>Not less than 50 percent of such funds to local health departments.</text></clause><clause id="HBCD21A8FAE63466C97B87A9D3A037680"><enum>(iii)</enum><text>Based on the population of the State, local, or Tribal government involved.</text></clause></subparagraph><subparagraph id="id5e0c8fc4998642ceb05ff4a73262c6c5"><enum>(C)</enum><header>Tribal funds</header><text>Of total amount appropriated under subparagraph (A), not less than 3 percent and not more than 5 percent of such amount shall be reserved for non-competitive and formula-based awards to Indian Tribes and Tribal organizations.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H058C3E373FAA4FFEA114308DA5AD6173"><enum>3.</enum><header>COVID–19 vaccine guidance</header><subsection display-inline="no-display-inline" id="H02B55C82F5FC4EC586E4A2859ABC4D7B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 months after the date of enactment of this section, the Director of the Centers for Disease Control and Prevention (in this section referred to as the <quote>Director</quote>), in consultation with the Advisory Committee on Immunization Practices and Centers for Medicare &amp; Medicaid Services, shall develop and distribute to health care providers and State education agencies guidance to provide health counseling services with respect to a vaccine licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>) or authorized for emergency use under section 564 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/300bbb-3">21 U.S.C. 300bbb–3</external-xref>) for the prevention, mitigation, or treatment of COVID–19.</text></subsection><subsection display-inline="no-display-inline" id="H9B88D7C9591C47E3AEF59D0CDE7F2C44"><enum>(b)</enum><header>Content</header><text>The guidance developed pursuant to subsection (a) shall—</text><paragraph id="H0DE8325A89BE4CE297255A4F80B125D7"><enum>(1)</enum><text>be aligned with evidence-based practices; and</text></paragraph><paragraph id="H36CBF94464CC48598A404715BCD7C10C"><enum>(2)</enum><text display-inline="yes-display-inline">include information that is culturally appropriate.</text></paragraph></subsection><subsection id="H47EE2BB4791D40F78A7E6972D51E9A18"><enum>(c)</enum><header>Update</header><text display-inline="yes-display-inline">The Director shall periodically update and distribute, as appropriate, the guidance developed pursuant to subsection (a).</text></subsection><subsection commented="no" id="HF193BB88AF184A75BB3C6C3746AC2B41"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section, $2,500,000 to remain available until expended.</text></subsection></section></legis-body></bill>
